Hawai`i Senators Attempt To Jam It Down The Throats Of Hawai`i Residents Anyway

HONOLULU - Hawaii politicians are scrambling to gather enough votes in Congress to pass a bill that would grant Native Hawaiians a degree of self-government and possibly a share of the land ruled by their ancestors.
After seven years of debate, the proposal to recognize Native Hawaiians as indigenous inhabitants of the 50th state — a legal status similar to that of American Indians — has finally been promised a vote in the Senate. The vote could come as early as next week
Members of the Koani Foundation, a Hawaiian sovereignty advocacy group, fear federal recognition would forever put indigenous people under the authority of the Interior Department, said director Kai`opua Fyfe.
"More Hawaiians are coming to understand just how bad this federal recognition would be. It would be the final nail in the coffin for Hawaiian issues," Fyfe said.

Hearings never held on bill in Hawai`i

In the letters of proponents of the Akaka bill, I hear the common argument that because tribal groups on the Mainland are recognized by the federal government, so should Native Hawaiians.
The fact is, current Federal Indian Policy is under attack in the courts, and America's version of apartheid is only a Supreme Court decision away from being abolished....
The Akaka bill is an assault on the U.S. Constitution and on the unity of Hawai`i.
If all the citizens of Hawai`i were to have a chance to vote on it, I am sure it would be rejected.
I guess that is why the politicians who support it have never supported a public plebiscite on the merits of the bill.

At their conference in Honolulu last August, the Council For Native Hawaiian Advancement (CNHA) invited several representatives of federally recognized Native American tribes and Alaska Native Corporations to promote the economic benefits of federal recognition and oil drilling in the Artic National Wildlife Refuge.
When the Gwich'in, the native people who actually live on that land asked to participate in the discussions, the CNHA refused their request.
Not to be silenced, the Gwich'in did come to Honolulu and, with help from their many Hawai`i supporters, presented panel discussions and an Artic Film Festival at the State Capitol.
They also rented a conference room close to the CNHA convention to share the truth with all who would listen.
What they revealed was stunning.
A proud and self-sufficient people, the Gwich'in refuse to allow the violation of their natural environment.
They recount their life of poverty and deprivation under federal recognition and their constant battles with the US federal government and alien economic opportunists.
It has become clearly apparent that certain individuals within the CNHA have been secretly working with senators from both Alaska and Hawai`i to promote drilling in the ANWR, against the wishes of the Gwich'in, and also to force federal recognition here in Hawai`i - for personal gain.
In this emotionally charged segment, hear the truth for yourself - what the CNHA has tried to hide as Alaskan Natives describe how oil is destroying their physical and spiritual health and their traditional lives. Hear the disastrous effects of federal recognition on these special people.

HAWAI`I'S GOVERNOR INVOLVED IN AKAKA BILL SWINDLE

...Given the governor's sworn oath to protect all people in the state of Hawai'i without regard to race, how can the governor support the Akaka bill, which would seek to separate people rather than unify them?
In her zealous, unreasoned support of the Akaka bill, Gov. Lingle would give away the choice of 90 percent of those, including Native Hawaiians, who voted for Hawai'i to become a state in 1959.
Given the voters' mandate for Hawai'i, why, then, shouldn't voters be the final voice on the Akaka bill, which would eventually give away huge tracts of land and billions of state dollars to a new nation that even Native Hawaiians have not been allowed to vote on?...
Rather than stumping in Washington, D.C., to pass the Akaka bill, she needs to return to Hawai'i and allow Hawai'i's voters to determine our own destiny.

HERE'S HOW THE U.S. TREATS NATIVE AMERICANS UNDER FEDERAL RECOGNITION
Shades Of Things To Come For Hawaiians Under Akaka Bill
Indian Country Today - May 19, 2006
On May 15, America - via its Supreme Court - told the Indian people of New York state, principally the Haudenosaunee, that they don't count.
The high court shrugged off a petition to review the apparent destruction of the Cayuga land claim settlement by a New York court decision.
That Cayuga decision came on the heels of the now infamous City of Sherrill v. Oneida Indian Nation of New York case of 2005, when the Oneida attempt to buy and restore ancestral reservation land back into tribal jurisdiction was dashed against a wall of manipulated intolerance that reached the ears and eyes of the Supreme Court and allowed it to deny a true day of reckoning for the Indian peoples.
The Supreme Court had previously ruled the lands in question were, in fact, stolen.
The land cases themselves are foolproof. New York, like all states always intent on diminishing Indian holdings, coerced the lands from the Indian nations against federal law that prohibited such transactions.
These Indian lands were guaranteed, after major concessions and treaty agreements, and in the case of the Oneida Nation, after loyal and valiant service to the new Americans in their revolution against England.
What happened?
Why did a Supreme Court that only a generation ago fully affirmed the just cause claims of the New York nations now gut the right to remedy on such claims?
Why did the high court thwart the final possibility of justice from the most dispossessed people in the country?...
Without the American public or the citizens of states and regions on our side, American Indians and Natives, tribal sovereignties and jurisdictions, are imperiled in America.

THINK THE LIVES OF HAWAIIANS WOULD IMPROVE UNDER THE "SPECIAL TRUST RELATIONSHIP" FEDERAL RECOGNITION WOULD BRING ?
Just look at these comments from the Senate Indian Affairs Committee March 11, 2003 letter to the Budget Committee justifying their budget request for fiscal year 2004 -
"Native people in the U.S. continue to rank at or near the bottom of nearly every social, health, and economic indicator, as compared to all other citizens.
"Natives continue to suffer the highest rates of unemployment and poverty, live in substandard housing, have poor health, receive an inadequate education, and contend with disintegrating social systems, all of which erode both the quality and dignity of life in Native communities.
"The educational attainment for Native youth is deficient compared with other groups in the U.S.
"There is also unmet demand for electricity in Native communities: a recent Department of Energy report estimated that 14.2% of all Native homes on reservations have no access to electricity compared to just 1.4% of all U.S. households.
"With unemployment averaging 43% and poverty rampant, Native communities are particularly sensitive to high energy prices.
"Given the near-complete absence of a private sector in most Native communities, 31.2 % of Natives live in poverty.
"In the U.S. today, the unemployment rate is 5.8%, whereas the rate for Natives is near 50% --- twice that of the national unemployment rate in the Great Depression."

WHAT DO HAWAIIANS THINK ABOUT THE AKAKA BILL ?
The Akaka bill is legislation that would purportedly establish a process for the nation's 400,000 Native Hawaiians to be formally recognized by the United States as an indigenous people.
Under it, only Native Hawaiians could decide to pursue a sovereign government that could negotiate with the US over land use and other rights.
But this is in conflict with the bona fide descendants of Hawai`i Nationals of the Kingdom living today.
As descendants of the Kingdom's subjects, 15.6% were of foreign ethnicity who embraced the Hawaiian Kingdom and were loyal to it and the rest were Kanaka Maoli (Native Hawaiian.)
The Hawaiian Nation already had a Constitutional government that has jurisdiction to negotiate with the US and other nations with whom it has treaties throughout the world that are still in effect today.
So the Akaka bill, by including only Native Hawaiians, is racial legislation that's designed to serve the United States interest, not descendants of Kingdom subjects.
The Akaka bill is really only about forced assimilation, not reconciliation.
Instead of turning Native Hawaiians into indian tribes, the US needs to deoccupy Hawai`i.
The United States needs to Free Hawai`i now.

HAWAIIAN NATION - DEAD OR ALIVE? ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE

Each January descendants of the Kingdom, both Native and non-Native as well as their supporters come together at `Iolani Palace to mark the illegal overthrow and subsequent continuing occupation by the U.S. in what is still an independent Hawaiian Nation.

VOICES OF HAWAI`I & PACIFIC HEARD AT UNITED NATIONS
NEW YORK - Representatives of the Pacific Region including Hawai`i presented their views of the priorities for Indigenous Peoples in the Pacific Region, in a side event yesterday.
The panel discussion provided an opportunity for the voice of the peoples of the Pacific Islands to be heard.
Peter Emberson, of the Pacific Concerns Resource Centre based in Fiji stressed the importance of self-determination for the peoples in the region.
He reminded the audience of the commitments originally made for decolonization of the region, and the failure of the United Nations to live up to its original commitments.

THE NEXT TIME SOMEONE ASKS, "WHY IS INDEPENDENCE BETTER FOR HAWAI'I THAN FEDERAL RECOGNITION," HERE'S WHAT TO TELL THEM -
Federal recognition (Akaka bill) is yesterday's solution.
It's thesis is again going hat in hand to the US federal government for help and turning Hawaiians inward and against each other in their own land.
For more than 100 years, this has not worked.
Instead, we can seize the opportunity to create a dynamic new nation through which we can maintain our culture and values, have more control over our future and be a leader among the pacific nations.
Let This Be Our Legacy To Future Generations.

SECRETARY GENERAL SAYS UNITED NATIONS BACKS INDIGENOUS PEOPLES AGENDA
Hawai`i And Pacific Caucus Hear Statement
The Secretary General of the United Nations has given Indigenous Peoples hope of a positive start to the Second Decade of the World’s Indigenous Peoples.
In a video message to the opening of this year’s session of the UN Permanent Forum on Indigenous Issues, United Nations Secretary-
General Kofi Annan said that the Programme of Action should be observed by all governments.
“Today, I call on all States to work with Indigenous Peoples to translate the Programme into reality on the ground”, he said.
“Let us aim to make it mean something positive - a change for the better - in the life of every indigenous person, wherever he or she may live.”

LAWSUITS BARRED FOREVER IF AKAKA BILL PASSES
Hawaiians To Be Left Out In Cold Under New Inouye Amendment
Senator Dan Inouye made the following statement regarding the Akaka bill in the Hawai`i Reporter, Tuesday May 16th -
"I will offer a substitute amendment.
"The substitute amendment has been widely distributed since September 2005 and is the result of successful negotiations between the Executive Branch officials and our Congressional delegation and Governor. "
The Amendment Inouye speaks of contains the following, and other, devastating new language under the heading "Specific Purpose" -
"Nothing in this act is intended to create or allow to be maintained in any court, any potential breach of trust actions, land claims, resource protection or resource management claims, or similar types of claims brought by or on behalf of Native Hawaiians, or the Native Hawaiian governing entity for equitable, monetary, or Administrative Procedure Act based relief against the United States or the State of Hawai`i whether or not such claims specifically assert an alleged breach of trust, call for an accounting, seek declaratory relief,or seek recovery of compensation for lands once held by Native Hawaiians."

NATIVE HAWAIIANS SPEAK AT UNITED NATIONS
Pacific Region Influence Grows In High-Level Session At Fifth Permanent Forum On Indigenous Issues
UN Headquarters, NY - Native Hawaiians and Pacific Region representatives join Indigenous leaders, senior United Nations officials, academics and over 1200 indigenous community members for the next two weeks to discuss challenges and strategies for improving conditions of the world’s indigenous peoples at the fifth session of the Permanent Forum on Indigenous Issues.
The Koani Foundation, a Kaua`i based unity organization, is participating with other Native Hawaiian non-governmental organizations in articulating and addressing human rights, environmental, economic and social issues at the international forum.
“Hawaiians are treated like outcasts in their own homeland,” remarked Koani Foundation board member `Ehu Kekahu Cardwell. "The Hawaiian Nation survives today despite more than a century of belligerent occupation, forced assimilation, and cultural oppression.”
The Permanent Forum has designated health, education and inclusion in decision making for Indigenous Peoples as the focus for this year’s gathering.
The Koani Foundation is presenting recommendations on human rights and universal education for Pacific Region Indigenous Peoples.
“Hawaiian Nationals are proclaiming their identities; reclaiming their heritage, their land, resources and rights,” Cardwell stated. “They will never accept second class citizenship in their Hawai`i homeland.”
In addition to Polynesian Triangle members Hawai’i, Aotearoa (New Zealand) and Rapa Nui (Easter Island), other Pacific Region participants include representatives from Australia, Fiji, Papua, Melanesia and Micronesia
The forum, which starts today and runs for two weeks through May 26th, was established in 2000 at the recommendation of the UN Commission on Human Rights.

Hawai'i is in a four-way tie for first place after the fourth day of the Quiksilver ISA World Junior Surfing Championships.
Yesterday's competition was held in 4- to 5-foot waves at Maresias Beach, Sao Paulo, Brazil.
All 12 Hawai'i surfers remained in contention, including seven in the winner's bracket....
Hawai'i, which won the team title last year, is one of 27 countries/regions in the contest. Hawai'i is recognized as its own nation for the event.

WHY ARE HAWAIIANS OPPOSED TO THE AKAKA BILL ?
Hawaiian groups are opposed to the Akaka bill because they feel it does not go far enough in providing reparations.
The recommendation shows that Hawaiians should not be dealing the U.S. government in the first place.
The fact that the Civil Rights Commission voted the way it did on the Akaka bill is an indication that we need to move from talking about our civil rights, which is a very limited way of talking about the issue, to human rights.
We need human rights, not bogus U.S. "civil rights."
Hawaiian groups are opposed to the Akaka bill because they feel it does not go far enough in providing reparations.

The fact that the Civil Rights Commission voted the way it did on the Akaka bill is an indication that we need to move from talking about our civil rights, which is a very limited way of talking about the issue, to human rights.
We need human rights, not bogus U.S. "civil rights."

Four months ago the entire Hawaiian Archipelago was successfully registered for the Kanaka Maoli (Native Hawaiians) with the International Court of Justice in The Hague, Netherlands.
The documentation alone weighed 127 pounds, notifying the courts and the world that these lands are exclusively the property of its rightful owners, Kanaka Maoli o Hawai`i.
Americans cannot be blamed for being ignorant of these facts.
Essentially, they were not supposed to be privy to the injustices.
When the United States, by force, entered the Kingdom of Hawai`i, books were removed from shelves and records altered to keep people in ignorance.
Crown patent lands were handed down from the Hawaiian royalty to their subjects to be used exclusively to live and prosper. They were not
sold nor could they ever be bartered or traded.
They were left to the Kanaka Maoli Hawai`i in perpetuity and exclusively to be handed down from generation to generation.
Imagine therefore how disturbing for a foreigner to witness a rightful crown patent land heir armed with "perfect legal title" in hand, attempting to secure his land from unscrupulous developers and to note the Maui judge threatening the Kanaka Maoli with arrest and jail if he dare speak and then, without hesitation attempt to fraudulently give ownership of the land to a developer.
Thank God the eyes of the world are now firmly upon the illegalities being perpetrated by the USA against the Kanaka Maoli Hawai`i.

Anchorage, Alaska - If Alaska Natives are right, then Alaska really is Seward's folly.
The Alaska Inter-Tribal Council made a stunning announcement: it plans to take the United States before the United Nations this summer.
It's a case that could overturn the 1867 treaty by which the United States bought Alaska from Russia.
A document submitted to the United Nations’ Human Rights Commission last month contends that “the United States is not sovereign in Alaska or Hawai`i.”
It says that in 1959, at the time of statehood, the United States “misled the United Nations” about how it acquired Alaska and Hawai`i.
Resolution 2005-10, which claims that Alaska and Hawai`i are not states, will be formally argued before the Human Rights Commission in Geneva this July.

FIGHTERS FOR FREEDOM ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE
This last Thursday, three Native Hawaiian groups filed a Shadow Report detailing on-going human rights violations against native Hawaiians since the illegal overthrow of the Hawaiian Kingdom.

When the Gwich'in, the native people who actually live on that land asked to participate in the discussions, the CNHA refused their request.
Not to be silenced, the Gwich'in did come to Honolulu and, with help from their many Hawai`i supporters, presented panel discussions and an Artic Film Festival at the State Capitol.
They also rented a conference room close to the CNHA convention to share the truth with all who would listen. What they revealed was stunning.

Three Hawaiian sovereignty groups are calling for the United Nations to demand that the United States respond to allegations of human rights violations against Native Hawaiians that the groups have detailed in a report.
They also took the opportunity to slam the Akaka bill even as supporters of the measure, which seeks to create a federally recognized government
entity, rally for it to be heard in the U.S. Senate.
The report was submitted earlier this year to the U.N.'s Human Rights Committee by Mililani Trask, convenor of Na Koa Ikaika O Ka Lahui Hawai`i, Kai`opua Fyfe of the Koani Foundation and Kekuni Blaisdell, chairman of the Kanaka Maoli Tribunal Komike.
The groups are seeking the removal of the U.S. government from the Hawaiian Islands.
Trask, Fyfe and Blaisdell appeared at a news conference yesterday in front of `Iolani Palace, where Queen Liliu'okalani was overthrown in 1893 by businessmen with the backing of U.S. troops....
The goal of the report is "to shame the United States for its theft of our nation, theft of our government, the taking of our land," Blaisdell
said.
The report is one of thousands alleging human rights violations by the U.S. that will be taken up by the Human Rights Committee in Geneva in
July, Fyfe said.
Fyfe said the Akaka bill would not go far enough in addressing the concerns of Native Hawaiians....
"Because the Hawaiian peoples never directly relinquished their claims to their lands, the differences between the USA and Hawai'i can only be settled under international law," Fife said.
"The Akaka bill, a domestic law if enacted by the U.S., could not apply...."
Said Trask: "I think we all admit that this Akaka bill is nothing more than a failure. It's going nowhere, and frankly, it doesn't address any of
the issues in the apology. It doesn't address any of the needs here, whether housing, education or employment. The (Akaka) bill is simply too little, too late. We really need to look for redress somewhere else."

WHAT DO HAWAIIANS WANT ?
HERE IS WHAT THEY SAY ABOUT THEMSELVES, THEIR COUNTRYMEN AND THE UNITED STATES -
"The most common sense thing is for total independence.
We were a progressive modern nation of our time and recognized as a friendly, neutral nation within the Family of Nations, the predecessor of the League of Nations and the United Nations.
We had a democratic form of government, a constitutional monarchy with a bicameral legislative assembly.
The works and legacies of our monarchs are legendary and noteworthy.
Today under the American system, we are concerned about our lands, culture, people and lifestyle which has been under attack for over a hundred years.
This gets us angry and more Hawaiians are desiring total independence as a result.
The Kingdom of Hawai`i is not only Native Hawaiians but subjects of non-Hawaiian blood who were legitimate subjects of the Kingdom.
This racial argument is an American thing and not a Hawaiian thing.
So our concerns are well within our scope to protect all our subjects of the Kingdom.
We do expect reparations and restitution from the US for the injurious damages to our nation, land and people.
The US government is well aware of this and is trying to offer a piecemeal to settle this.
Other options are still on the table and we are beginning to take a stand on which option is the right thing to do.
If the tables were turned around; which would you do? I'm sure it wouldn't be a hard decision.
Remember, Hawaiians never hated Americans; but only those that did harm to us and the US government for its complicity and deceit.
We were never afraid that another country would take us over; we had over twenty-four treaties with various countries but the US is the only country that broke their treaties with us.

HAWAIIANS CHALLENGE U.S. VIOLATIONS
Self-Governance and Control of Resources Denied
Honolulu - Three Native Hawaiian groups have filed a Shadow Report detailing on-going human rights violations against native Hawaiians since the illegal overthrow of the Hawaiian Kingdom.
Na Koa Ikaika o Ka Lahui Hawai`i, The Koani Foundation and Kanaka Maoli Tribunal Komike filed their report with the UN Human Rights Committee challenging Bush Administration claims that the United States has complied with its obligations under the International Covenant on Civil and Political Rights (ICCPR), an international Human Rights Treaty, to which the U.S. is signatory.
The three Hawaiian groups also endorsed and supported, with the Alaska Inter-Tribal Council, a second report filed by the Indigenous Peoples and Nations Coalition which raises human rights violation by the U.S. as the administering agent of the Non-Self Governing Territories of Alaska and Hawai`i.
“The reports demonstrate the historic and continuing violation of our people’s right to self-governance and self-determination that predates the overthrow and continues to the present,” said Mililani Trask, Convener of Na Koa Ikaika o Ka Lahui Hawai`i.
“Self-determination is the right of the Kanaka Maoli (Hawaiians) to determine their political status and to freely pursue our economic, social and cultural development. Self-Governance and Control of Resources Denied
Honolulu - Three Native Hawaiian groups have filed a Shadow Report detailing on-going human rights violations against native Hawaiians since the illegal overthrow of the Hawaiian Kingdom.
Na Koa Ikaika o Ka Lahui Hawai`i, The Koani Foundation and Kanaka Maoli Tribunal Komike filed their report with the UN Human Rights Committee challenging Bush Administration claims that the United States has complied with its obligations under the International Covenant on Civil and Political Rights (ICCPR), an international Human Rights Treaty, to which the U.S. is signatory.
The three Hawaiian groups also endorsed and supported, with the Alaska Inter-Tribal Council, a second report filed by the Indigenous Peoples and Nations Coalition which raises human rights violation by the U.S. as the administering agent of the Non-Self Governing Territories of Alaska and Hawai`i.
“The reports demonstrate the historic and continuing violation of our people’s right to self-governance and self-determination that predates the overthrow and continues to the present,” said Mililani Trask, Convener of Na Koa Ikaika o Ka Lahui Hawai`i.
“Self-determination is the right of the Kanaka Maoli (Hawaiians) to determine their political status and to freely pursue our economic, social and cultural development. It also means we have the right to control our natural wealth, land and resources which have been withheld from our peoples since statehood was imposed in 1959” Trask said.

NATIVES VOICES SPEAK OUT - A VOICES OF TRUTH SPECIAL REPORT
