LEADERS MUST CONSIDER EFFECT OF SUPERFERRY DECISIONS

As I monitor the Superferry situation from the Mainland, I have to perplexedly scratch my head in confusion at the lack of planning by those involved with this major undertaking.


My wife and I visit Hawai`i as often as we can. In these visits, we have taken a great interest and gathered a great love for the Aloha State. We were even married in Makena Cove six years ago.


But a visit last month to Kona made me a little sad.

Not only did we see the effects of last year's earthquake on North Kohala and the overdevelopment of the Big Island, we landed smack dab in the middle of the controversy surrounding this gaudy monstrosity known as the Superferry without so much as a comprehensive environmental impact report.


As a Californian who has mourned the ramming deaths of three 70-foot beautiful blue whales in the Santa Barbara Channel this past month, I can attest firsthand what damage "progress" has wrought.

May those making the decisions consider greatly the effect they have on your wonderful islands before it's too late.

SUPERFERRY - SINK OR SWIM? ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE

This will be the definitive week for the Superferry.


The state House passed the Superferry bill only after removing all amendments that would have created protection for Hawai`i’s marine life and environment.

So much for listening to the people.

The focus now moves to the Hawai`i state Senate.

They hold the key to whether the Superferry will sail before an environmental impact statement is completed.

By now two things are common knowledge – the primary reason for the Superferry is actually US military based and not civilian.

And political donations from Superferry investors to Linda Lingle and other elected officials are the real driving force behind what the legislature will decides.

In other words, business as usual.

The solution? A Free Hawai`i .

In a Free Hawai`i there would be no foreign occupier driving the agenda.

In a Free Hawai`i all it’s citizens would decide what’s best for them, their family and future.

And in a Free Hawai`i elected officials would actually serve the people who elected them, and not rich foreigners living thousands of miles away who have the power to corrupt and pervert our Island Nation.

Whatever the Legislature decides this coming week will only be the end of round one.


The people who love their land will continue to stand and fight for what’s right. In reality, it is they who will decide the outcome.

HUNDREDS OF PEOPLE PROTEST AT KAUA`I FERRY MEETING

I attended the Superferry informational meeting, where hundreds of people from Kaua`i came to voice their opinions.


Yet, The Advertiser says it was "dozens" of people.

I saw firsthand that 165 people signed up to testify, and certainly not everyone present testified.


So quit acting like it is a small number of people involved — it wasn't dozens, it was hundreds of people.


And in the four hours of testimony that I heard, only two people out of more than 100 supported the ferry's operation with no EIS before it sails.

SUPERFERRY TASK FORCE STACKED WITH FERRY SUPPORTERS

At Sunday's Superferry meeting on Kaua`i, Sen. Colleen Hanabusa represented herself as being evenhanded and undecided on the special legislation issue regarding the Superferry.


I was distressed to come home and read on The Advertiser Web site that she is recommending a bogus "watchdog commission" comprised of three of the governor's minions, the attorney general, Superferry CEO John Garibaldi and enough "business representatives," (read chamber of commerce) to provide a solid pro-Superferry majority on the 13-member commission.


If she truly meant it when she said, "I think we need to heal as best we can," then she needs an extreme makeover of her diagnosis of the condition.


This sort of duplicity will, in time, earn her the distrust of her colleagues and constituents, and she will marginalize her influence as Senate president.

OVERWHELMING SUPERFERRY OPPOSITION CONTINUES ON NEIGHBOR ISLANDS

KAILUA-KONA - State senators heard more of the same yesterday at their third neighbor island Hawai`i Superferry meeting in three days as they prepared for a special legislative session.

More than 400 people, including more than 180 who signed up to testify, overwhelmingly favored an environmental study be conducted before the ferry is allowed to sail between the islands.

Whether they wanted the ferry or were against it, not one Big Island resident said they wanted to see state lawmakers give special treatment to a privately owned business.

Some called the special session, which was set to start today in Honolulu, a waste of money, while others demanded that the Superferry follow the same state regulations as every other private enterprise.

Several people claimed Gov. Linda Lingle botched the issue and was leaning on lawmakers to fix her mistake.

While about 70 percent of those gathered seemed to oppose the Superferry on principle, almost all called for lawmakers to follow existing state law and to follow the prescribed process....

...Ron Self of Kau said the senators were faced with a "monumental decision."

"It's whether or not we want to create highways between our islands.

This is something we've never seen before," he said. "We don't have the infrastructure to support Superferry and won't have it by 2009.

Let's take our time. Don't make legislation to rush this through. You are wrong on that...."

HUNDREDS OPPOSE SUPERFERRY AT MAUI MEETING

WAILUKU, Maui - The head of the Maui County Council today told a panel of state senators that proposed legislation allowing the Hawai`i Superferry to operate while an environmental review is done would spark "a social and political revolution" unlike any seen since the 1950s movement that brought Democrats to power in Hawai'i.


Speaking at an informational briefing at the Baldwin High School auditorium, Council Chairman Riki Hokama said "state government is at risk of being seen as out of touch with the recent growth on the Neighbor Islands."


He said the proposed legislation is a "disingenuous" attempt to circumvent court
rulings requiring an environmental review of state-funded harbor improvements to accommodate the new interisland ferry.

A raucous crowd of at least 400 people were present when the informational meeting began shortly after 3 PM, with the audience expected to grow as the afternoon wears on.

The Superferry fiasco continues to grab the center of attention in Hawai`i and beyond for yet another week.

BULLETIN! - SUPERFERRY BRIEFINGS TO BE HELD ON KAUA`I, MAUI AND HAWAI`I ISLAND

Special Superferry Legislative Session Could Start Next Wednesday


The Hawai`i Senate will hold informational briefings regarding the Superferry draft legislation on Kaua`i, Maui and Hawai`i Island in advance of a possible special legislative session next week.

Several senators, and a few House lawmakers, plan to attend to hear public comment on the proposed draft.

A special Superferry session in the legislature could start as soon as this coming Wednesday.

Please bring friends and share your opinions on whether the Superferry should be allowed to operate before the completion of the court-ordered environmental review.

Wear red EIS for Superferry T-shirts if you have them, or red shirts in support if you can.

No red shirt, come anyway and be heard.

The first briefing will be tomorrow, Sunday, 2 PM at King Kaumuali`i Elementary School cafeteria in Lihu`e.

The Maui briefing will be 3 PM Monday at the Baldwin High School auditorium in Wailuku

NO RESPECT FOR SUPERFERRY SPECIAL TREATMENT

Dear Senators and State Representatives,


As a citizen of this great state of Hawai`i I am deeply disturbed by the events that are unfolding.

It is hard to imagine how the average citizen will have any respect for the law and our legal system if a special session is convened to overturn the courts ruling regarding the Superferry....


What is more important, the survival of a mismanaged business or the preservation of our unique environment?

I will submit that we cannot afford to jeopardize our environment at any cost....


It seems that a special session should only be available in times of crisis, national security, or in the case of a public works project.

To suggest that our legislature convene a special session to retrofit the law to accommodate a private company is irresponsible and bad public policy.

Doing so opens a door that all corporations will demand access to. What will keep other businesses from wanting the same treatment? ...


Please demonstrate to your constituency and the rest of this great state that you have the moral courage to place our environment, our communities, and the rule of law ahead of the need of a mismanaged business.

Vote against a special session for the Superferry and demand that the Superferry comply with the laws that have served this great state of Hawai`i for over 30 years.

This last Wednesday, we posted a special edition video on Free Hawai`i TV exposing Governor Linda Lingle’s plan to circumvent the courts and wishes of the people to get the Superferry operating again.

We asked all of you to call the Governor’s office as well as Senate President Colleen Hanabusa and House Speaker Calvin Say to let them know you expect them to obey Maui Judge Joseph Cardoza’s ruling that an environmental impact statement must be completed before the Superferry sails again.

And that you did - their phones were jammed with callers delivering this message.

Now, contrast your actions with what Superferry executives did.

A pro Superferry form letter was emailed so many times to Hawai`i politicians they were forced to shut down their computer systems.

As a result, legislative members are now publicly stating Superferry executives are “out of touch” with how to resolve this issue that’s clearly not going away.

So whose voice was genuinely heard – theirs, or yours?

Who responded with a love of land versus love of money?

And who comes with aloha – the people whose home it is, or foreign corporate interests thousands of miles away?

The bottom line is the legislature has heard you loud and clear.

But now is not the time to let up. Make sure everyone you know makes those three phone calls.

And you don’t even have to live in Hawai`i to get involved. You can make a difference in this critical issue no matter where on earth you live.

State Senate Democrats yesterday described the
Lingle administration's draft legislation to help Hawai`i Superferry as unacceptable, which will delay a decision on whether lawmakers come back into special session to save the project.

The draft, shared with Senate Democrats in
private caucus yesterday afternoon and also with House Democrats, would require the state to
perform a full environmental impact statement on $40 million in state harbor improvements for the ferry and the secondary effects of ferry service on the environment.

While the draft calls for an environmental impact
statement - rather than the narrower environmental assessment required by the state
Supreme Court - Senate and House Democrats said it fails to include any conditions on ferry service to prevent whale collisions, the spread of invasive species and increased traffic at harbors....

"I don't believe the bill in its present form is
something the caucus will go for," state Senate President Colleen Hanabusa said....

But, more ominously for Superferry, several
senators said Superferry executives have acted with arrogance and may not deserve any help.

Superferry executives, they said, have
communicated mostly through lobbyists and not done the kind of outreach that would help them
now that they are in crisis....

Thousands of people have sent e-mails to
lawmakers in the past few days asking for a special session, including many who were directed
by the Superferry's Web site....

Hanabusa said the e-mails generated through
Superferry have not been helpful.

She also said
Superferry executives should re-evaluate how they have been approaching lawmakers and a special session.

"I will tell you one of the criticisms that
people have about the Superferry, and this is something that they should take to heart, is that they have been extremely - to a certain extent - insensitive to the situation," Hanabusa said.

"They have not, as far as I know, other than
through their high-priced lobbyists, even approached many of the senators or representatives who really now hold the key to whether they are going to be able to operate.

"But that's not as important as the fact of just
coming to tell us what is it that they feel they need, or how do they want to assist us in the
process.

And for us, we want to know how they
want to start to help mend the divisions within our community.

So those are very critical issues,
and we haven't heard from them...."

"From the beginning, the Superferry has had the
wrong approach to this. They have always had a problem in being forthright and talking with us straight," said state Sen. J. Kalani English.

English said Superferry executives have not
approached the Senate with "aloha," humility or the spirit of cooperation.

"Every step of the way, the Senate has offered
compromise," he said. "And every step of the way, they have rejected it."

LIHU`E, HAWAI`I - The woman in the sun hat wants to crack someone in the jaw. It's been a bad day. Actually, for Ka`iulani Huff, it's been
a bad few decades.

She has watched as her home, the island of Kaua`i, changed from a wild
garden of secret places to -- in her eyes -- an overcrowded amusement park for rich people.

"Welcome to Disneyland," she says one day while driving around the

island. "See the natives. Watch us dance the hula. Clog up our roads.
Buy up all the good land. And please, help yourselves to our beaches!"

Development on Kaua`i has been so unrelenting that Huff's sentiment

has become widespread among longtime residents, although until
recently it was a quiet simmering.

HAWAI`I FAILS HOMELESS CHILDREN

The state has failed so badly at helping homeless children get to and from public schools that federal courts should intervene in the situation, according to a class-action lawsuit filed by the American Civil Liberties Union and two other parties....


...The suit, filed by the ACLU, the Lawyers for Equal Justice and the law firm Alston Hunt Floyd & Ing, alleges that the state has failed to carry out a section of federal law called the McKinney-Vento Act, which requires state and local school districts to help homeless children receive educational services....

But the program has been so badly managed that the overall effect "is that homeless children are turned away at the schoolhouse door, experience significant delays in enrolling in public school, are forced to unnecessarily change schools and/or are denied access to transportation or other services necessary to receive a public school education," the plaintiffs charged....

...One of the plaintiffs in the suit, Alice Greenwood, has been homeless since May 2006 when she and her 6-year-old son lost their Nanakuli rental residence.


They lived in a tent at Ma`ili Beach Park until March of this year, and Greenwood, who has physical disabilities, would struggle to take her son on the bus to Nanakuli Elementary School, where he was enrolled in the Hawaiian Language Immersion Program, according to the suit.


She encountered repeated difficulties in obtaining bus passes for herself and her son, and as a result, the boy missed 33 days of school last year, according to the suit.


At one point, school officials indicated that Greenwood might lose custody of her son if she could not arrange transportation for him, the suit alleged.

STEALING THE HAWAIIAN NATION - ONCE AND FOR ALL!

Here's How The US & Office Of Hawaiian Affairs Are Planning To Do It

By their own laws, the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent.

They and the State of Hawai`i have never had clear title to land in Hawai`i since Jan 17, 1893. They know this.

The only way the United States will ever be able to get clear title to Hawaiian Islands is if Hawaiians give it to them.

This is why title to the Hawaiian islands never transferred to the United States by the Newlands resolution.

The Newlands resolution relied on a treaty of Annexation from the republic of Hawai`i.


But the Republic never owned title because the Kingdom of Hawai`i never gave it to them.


But now they got a plan -they are going to get Hawaiians to give title to them.

How Will They Do That?

They are already trying to register a majority of Hawaiians on a "Kau Inoa" roll.


Then they're going to draft governing documents to "re-organize the Hawaiian government."


They 're going to get Hawaiians to elect officers to that government.


Next, they're going to make sure those governing documents give the officers of the government the authority to give away title in negotiations.


Then, they're going to try to get the majority of Hawaiians on the roll to vote for the new governing documents to reorganize the Hawaiian government.


Then that government authorized and approved by the majority of Hawaiians will sit down at the negotiating table with the US and trade land title for cash and benefits
.


Many people believe that only the Kingdom of Hawai`i is authorized to give a way title to the Hawaiian Islands - and they are correct, but only as long as the kingdom remains intact.

If the majority of its subjects revolt by forming a new government, the kingdom no longer exists.

Method Used In Alaska To Take Native Lands


In a move replicating the Alaskan Native Claims Settlement Act, the Office Of Hawaiian Affairs (OHA) has announced the formation of their own non-profit limited liability corporation (LLC,) Hi`ilei.

OHA claims as the purpose of the LLC the administration of Waimea Valley on O`ahu.

However, OHA Trustee Mona Bernardino and Administrator Clyde Namuo will be sole managers.

Moreover, $100,000 of Hawaiian beneficiary money has been transferred from OHA to Hi`ilei.

Many may not be aware this is the same model used in Alaska to negotiate away lands from Alaskan natives to the US government for pennies on the dollar.


Some Very Important Questions Must Be Asked -

How can the Administrator and Deputy of OHA, also be the managers of this non-profit LLC?

How can the OHA Board of Trustees in Executive Session vote to transfer public trust funds to the non-profit LLC?

How can OHA take public trust lands purchased with public trust money and transfer these lands to a non-profit LLC?

Is this model to be used to negotiate away Hawaiian lands should the Akaka bill pass?


Most importantly, why were the beneficiaries not consulted first?

FACT - By moving assets over to a non-profit LLC, beneficiaries loose their ability to hold OHA representatives accountable pertaining to these lands and funds.

CHILD ENDANGERMENT THREAT ENRAGES SUPERFERRY PROTESTORS

Children with boogie boards and surfboards who jumped into Nawiliwili Harbor on Kaua`i to confront the Hawai`i Superferry last month prompted warnings by the Lingle administration that parents could be subject to child welfare investigations if it happens again.

The administration said the warnings, along with a list of more than a dozen possible criminal charges for illegal protests, are to inform parents of the consequences of violating federal security zones when the Superferry returns....

But rather than diffuse tensions on Kaua`i, the warnings of potential child welfare investigations in particular have led to an emotional backlash....

"It's unprecedented that they've used child protective services as a political weapon, especially one to censor people, to censor their right to speak, to censor their right to protest," said Andrea Brower, an activist in Anahola who was among the protesters who went into the harbor to block the ferry.


"It's pretty telling how far the Lingle administration is willing to go to ensure that these private business owners get their way."


Keone Kealoha, director of Malama Kaua`i, said that warnings seem to be at the root of the administration's response to the protests.


"It just seems, again, that they are escalating the consequences instead of listening to the concerns," he said....


State Senate Majority Leader Gary Hooser, D-7th (Kaua`i, Ni`ihau), called the prospect of child welfare investigations "unnecessarily heavy-handed."


"To use the threat of such action to enforce a political decision is just wrong," Hooser said.
