FBI INVESTIGATING OHA TRUSTEE DAN AHUNA SAYS ATTORNEY

The state Attorney General’s office and the FBI are conducting a wide-ranging investigation into allegations of “public corruption and misappropriation” of taxpayer and state funds at the Office of Hawaiian Affairs, Hawai`i News Now has learned.
Earlier this month, HNN reported that the FBI had joined the state investigators, who have broadened their probe into the embattled state agency.
HNN now has learned that the AG’s office has sent OHA a letter on Feb. 26, asking for thousands of pages of documents, including records of contracts issued by OHA and its for-profit subsidiaries dating back to 2012.
They’re also asking for nearly six years of OHA bank statements, records of credit card and check transactions, wire transfers and all information relating to OHA’s outside investments.
Only a small portion of the records involve actions taken by individual trustees. Most of the documents relate to actions taken by or approved by CEO Kamana`o Crabbe and OHA’s top management, adding fuel to efforts to oust OHA's top executive.
"I think it's very clear that the focus of this investigation is the OHA CEO and the administration,” said Hawaiian activist and attorney Mililani Trask.
"I think the time has come to dismiss Kamanao Crabbe."
OHA's board will take up matter of Crabbe's contract during a meeting on Thursday. The agency declined comment.
Legal experts say they don’t expect OHA to immediately turn over the records or will ask investigators to narrow their request.
“This is a classic definition of what a fishing expedition looks like,” said Ken Lawson, co-director of the Hawai`i Innocence Project at the University of Hawaii’s William S. Richardson School of Law.
“This is chess. So basically, the next move is on OHA to say we're not responding to your request. If you want it, either get a subpoena or get a search warrant."
But while the investigation focus appears to be on OHA's management, Federal Public Defender Peter Wolff said he believes that even trustees are being targeted -
"Mr. Ahuna is being investigated by the FBI," Wolff wrote in a March 14 letter to a federal judge.

CLEAN HOUSE AT OHA

It’s about time that the Office of Hawaiian Affairs is being scrutinized for inappropriate spending of millions of dollars over a two-year period (“Millions improperly spent, OHA audit shows,” Star-Advertiser, Feb. 14).
Moreover, some expenditures were approved without the Board of Trustees’ vote or even knowledge, according to the audit, to the tune of $14 million while actual “budgeted, vetted and monitored grants” were half that amount — $7.7 million.
This travesty is just another example of spending about which we Hawaiians have no clue. Remember OHA’s suing the University of Hawai`i for “mismanagement” of the Mauna Kea summit? It used funds we Hawaiians might not have wanted to be used in this manner.
OHA’s own mismanagement is epic. Get rid of OHA’s chief executive officer, Kamana‘opono Crabbe, who ignored “do not fund” recommendations.
Also, Chairwoman Colette Machado, who, too late, is proposing new spending controls. It’s like closing the barn door after the horse has left. Because of poor leadership, she has to leave, too.

FLASH! - FBI JOINS CRIMINAL INVESTIGATION OF OHA

The FBI has joined the state's criminal investigation into the Office of Hawaiian Affairs, Hawai`i News Now has learned.
Multiple sources say the state and federal authorities have broadened their probe, requesting copies of OHA contracts, trustee emails and financial records of OHA’s nonprofit subsidiaries.
OHA declined comment during a board meeting Thursday, and its attorney declined to provide details of the investigation to a beneficiary.
"I think there's something they're trying to hide,” said Healani Sonoda-Pale, chair of Ka Lahui Hawai`i’s political action committee, who asked the board to disclose details of the investigation.
"There needs to be more transparency in this whole agency, because it is for the benefit of kanaka maoli."
Sources said that the state Attorney General’s office recently sent OHA a letter, disclosing the FBI’s role in the investigation.
During a meeting behind closed doors, multiple sources said that OHA’s attorney Robert Klein advised board members to hire their own attorneys.
The federal involvement comes as several state agencies, including the state Ethics Commission and the legislative auditor have issued critical reports on the way OHA spends its money.
