OVER 100 RELIGIOUS LEADERS STAND FOR MAUNA KEA

WE who live in the Hawaiian Islands and call them home are challenged today and in the future to care for them so that those of Hawaiian ancestry as well as those of us who have affection for this special place continue to serve and care for the land and her people with authenticity and integrity.

The current test that we face for both the preservation and future use of Mauna Kea is but the latest of many that force us to take sides. To many, the choices seem insurmountable which is why we who lead and stand with our communities of faith must stand tall (Ku Kanaka) and provide the light of insight that will bring about peace and resolution to the stalemate of interests that present themselves on today on the Sacred Mountain.

Mauna Kea is a sacred space. It is wao akua—place of the gods, it is the mountain of God. It is understood asthe genesis point of the Hawaiian people, where sky father Wakea met with earth mother Papahanaumoku.

The controversy surrounding the TMT telescope continues to highlight the struggle of native peoples to protect and preserve their sacred sites from desecration.
We the undersigned have a responsibility not to stay silent in the face of injustice. We are not against science or scientific research. But it should be done in an appropriate location.

Building one more gigantic telescope on our sacred mountain might harm the natural environment, and the spiritual integrity. In light of recent arrest of kupuna, in the act of peaceful civil disobedience, the questionable telescope project is certainly harming the deep peace of our Hawaiian community!

Some may disagree, but we believe the mountain belongs to the Kanaka maoli. It is part of their homeland.

And they must have a say about what to do and what not to do on their sacred land! We offer our prayers in solidarity with all our kanaka maoli sisters and brothers who feel oppressed, bullied, and not listened to.

We pray for a deeper understanding of this very important issue. We pray for the people who insist to build in the midst of the loud outcry & the deep pain of our Kanaka maoli community. We pray for ourselves and all religious people and organizations to take action and join with others to right the wrongs.

We the undersigned religious leaders express ourselves in these words, speaking truth to power during these difficult days!

"WE ARE NOT FOOLED"

OPEN LETTER TO HAWAI`I GOV. DAVID IGE
READ AT THE HAWAI`I STATE CAPITOL

On behalf of `Īlioʻulaokalani, we, the undersigned kumu hula and practitioners of hula and other forms of Hawaiian knowledge and culture, descendants of Wākea and the lands that comprise the pae `āina of Hawai`i, we do vehemently assert our ancestral rights to these lands, as well as our continued opposition to the construction of the TMT.

We also protest and disavow your “legal” unleashing of violence against Kānaka Maoli through your declaration of a State of Emergency.

As you are (hopefully) aware, but perhaps haven’t fully realized the irony as yet, the people who overthrew the Hawaiian Kingdom back in 1893 did the exact same thing—they deployed military troops and power in the name of “maintaining peace.”

In reality, they did it, as do you, in order to maintain power so that you can continue to subjugate and oppress our people and our `āina, all the while speaking of the greater good—of capitalism, of Christianity, of codified law, of land as private property, of your so-called civilization, assimilation,... and now, astronomy.

We want you to know that we are not fooled by your statements, now or previously, about the “legality”of the TMT.

When you create the system that creates the laws and also interprets and adjudicates them, then your version of “legal” sometimes has nothing to do with any version of “pono.”

The TMT decision is a prime example of that and rests on a very tenuous legal interpretation (as acknowledged by Hawai`i Supreme Court and many others) and yet you persist because it is “legal.”

To this we cannot, and we will not ever, agree.

We want you to know that we are not fooled by your statements about the need to declare a “State of Emergency.” We clearly recognize and will educate others to recognize this as an excuse for you to unleash sanctioned, legal violence against peaceful citizens of Hawai`i—both young and old, Hawaiian and non-Hawaiian—who feel so strongly that we risk our physical, emotional, and spiritual—and economic—health and well-being of ourselves and future generations in order to stop this.

Know that we are not fooled by your statements of concern for the safety and well-being of we, the protectors. We know and will educate others to know that you are the one putting our lives at risk solely in order to protect the economic and political interests of the state, the university, private corporations, and no doubt, yourself.

As some of our kia`i leave the mauna, others will go to it. As some step aside, we will fill in... and so on... and so on... and on... a mau loa aku.

We are Hawai`i. We are Maunakea. We are `Īlioʻulaokalani.

From Todayʻs Honolulu Star-Advertiser -

Law enforcement sources told the Honolulu Star-Advertiser in recent days that police officers from Oahu and Maui would assist state law enforcement officers and Hawaii County police and that riot training had been conducted on Hawaii island in recent weeks.

They said helmets and long batons had been issued to officers expected to be deployed to the protests and that Hawaii County police had gone so far as to mount tear gas “cannons” on heavy vehicles used by its special response team.

PROTECTING THE SACRED - NEW MAUNA KEA LAWSUIT FILED

Honolulu Star-Advertiser - July 9, 2019

Foes of the Thirty Meter Telescope filed a lawsuit Monday saying the state failed to make the developer of the $1.4 billion project post a security bond as required by the state’s 1977 plan for Mauna Kea.

Mauna Kea Hui leader Kealoha Pisciotta said the suit filed in Third Circuit Court on Hawaii island is the first of at least three planned legal challenges aimed at stopping the TMT from being built on Hawaii’s tallest mountain.

Filed by Big Island attorney Gary Zamber, the suit claims that the Mauna Kea Plan of 1977 requires that every project have a posted security bond in the amount of the full cost of the project.

“The rules clearly state that a bond is required,” Pisciotta said this afternoon.

The claim names as defendants Gov. David Ige, state Attorney General Clare Connors, state Land Board chairperson Suzanne Case and other members of the state Board of Land and Natural Resources, plus Hawaii County Mayor Harry Kim, University of Hawaii President David Lassner and the Thirty Meter Telescope International Observatory.

The governor’s office declined to comment about the lawsuit.

“By failing to post the bond they have laid all financial liability on the People of Hawai‘i, in the event (that)TMT doesn’t get full funding and this is especially important because they don’t have full funding now,” Pisciotta said in an email.

Pisciotta said a bond helps to ensure that the developer would be able to return the land back to its original state — a requirement of the TMT’s conservation district use permit — even if the project went bankrupt in the middle of construction.

“That is the purpose of requiring a bond in the first place —so the people don’t get stuck with the bill,” she said.

The plaintiffs include Pisciotta and other Native Hawaiian religious and cultural practitioners who here petitioners in the recent TMT contested case and court case.
