HONOLULU (AP) - The state Ethics Commission says Hawai`i Superferry will not be punished for grossly underreporting its lobbying expenses last year.
The company spent nearly 380-thousand dollars lobbying lawmakers in 2007, as it fought an environmental impact statement and then asked for legislation allowing it to resume interisland service.
But Superferry executives initially reported only 22-thousand dollars in expenses.
Executive Director of the state Ethics Commission Dan Mollway says the company cooperated in amending its reported expenses. He says the mistake did not appear intentional.
Ethics Commission records show Superferry spent more than twice as much on lobbying as any other organization in 2007. The second-highest lobbying expenditures were by a pharmaceutical group.

MORE SUPERFERRY SECRETS THEY DON'T WANT YOU TO KNOW
The Lingle administration has been resisting a legislative auditor's investigation into how the state exempted the Hawai`i Superferry from the need for an environmental impact statement.
The law that authorized the Superferry to sail also called for the auditor's investigation and for the Lingle administration to cooperate.
"We have encountered significant delays and a variety of roadblocks in conducting our audit task," legislative auditor Marion Higa said.
The attorney general's office had said that it would only turn over documents that were not protected under the attorney-client privilege laws and has been reviewing documents.
Lingle declined yesterday to talk about the letter, saying she did not know about it.

Charges against one of the last defendants to be arrested during the Aug. 26 and 27 protests of the Superferry at Nawiliwili Harbor has been dismissed, his attorney yesterday said.
Fourteen people were arrested on charges related to the protests, including four juveniles.
Fifth Circuit Court Judge Randal Valenciano dismissed the case against Randy Wolfshagen, 50, of Kekaha, with prejudice.
Wolfshagen, a surfer, had been charged with second-degree criminal trespassing and obstruction of government property.
Defense attorney Michael Soong said he and his client were prepared to go to trial March 25 but said the complaint was defective. Prosecutors agreed.
“From an investigation point of view it was the kind of a situation where nobody knew who did what,” Soong said.
“From my side, (prosecutors) did the right thing in not pushing the case further.”

WAILUKU, Maui — Three groups yesterday filed an appeal of a Nov. 14 court ruling upholding a new law that allowed Hawai`i Superferry to operate while an environmental review is undertaken....
The company's 350-foot, high-speed catamaran has been in drydock for maintenance and repairs since Feb. 13 and is expected to return to service March 25....
"We have been heartened and encouraged to go forward with this appeal by so many people throughout the state contacting us and offering both moral and financial support," said Irene Bowie, executive director of the Maui Tomorrow Foundation.
She said supporters include People for the Preservation of Kaua`i, 1000 Friends of Kaua`i, Surfrider Kaua`i and Sierra Club-Kaua`i Group.

Inter-Island Service Stopped Until March 3
The Hawai`i Superferry has canceled all voyages until March 3 to repair the Alakai's auxiliary rudders.
Company officials said Friday that they are moving up the ferry's annual drydock for maintenance and recertification by the U.S. Coast Guard to take advantage of the off-peak travel season.
The Alakai will be docked in Honolulu from now until March 3.

SUPERFERRY WON'T SAIL - COMPANY'S SURVIVAL IN QUESTION
The Hawai`i Superferry will stay in port tomorrow, despite earlier hopes.
Officials say there was an unexpected delay in finishing repairs to the vessal.
The Alakai has been docked since Sunday because of high seas between O`ahu and Maui.
The continued problems for the Superferry have some wondering if the company will survive.
"I mean it's understandable but still if someone needs to be on Maui at a certain time, certain day it creates difficulty." said Jim Tollefson, Chamber of Commerce President.
Superferry CEO John Garibaldi says despite protests, legal challenges and even mother nature, his company is committed to Hawai`i.

SUPERFERRY COSTS HAWAI`I $350,00 MORE
The state Department of Transportation said 10 weeks of daily tugboat service — at a cost of $350,000 — is needed at Kahului Harbor to support Hawai`i Superferry operations.
The tug service is necessary to keep a state-owned barge snug against the end of Pier 2C during ocean surges and to provide safe loading and unloading of passengers and vehicles, according to a request filed Friday to exempt the contract from state procurement rules.
Without the assistance, the state could be liable for damage claims by the Superferry of $18,000 a day if it cannot meet its obligation to provide barges with mooring systems to enable ferry operations, the request said.

SUPERFERRY PASSENGER NUMBERS STILL SUPER LOW
"Hawai`i Superferry is experiencing bookings at numbers that are much lower than expected.
Bookings are averaging approximately 150 passengers per voyage, while the planned passenger load is about 410 passengers per voyage.'' (Order 23953, page 5)

IT'S NOT JUST ABOUT THE SUPERFERRY ANYMORE

...Both sides of the Hawaii Superferry issue surprisingly agree on some important points.
Most important is that the conflict and dissent stem from larger issues than the ferry venture itself. It has become a touchstone, or more aptly the last straw, bringing out central issues regarding who we are as an island society.
Some of these issues, such as neighbor island attitudes towards O`ahu, have not been aired in such a public way in modern times, if at all.
The coming of the ferry struck a chord that has resonated so loudly it has brought together many disparate groups in protest and has left everyone else thunderstruck.
...In this way the ferry has made more relevant to the general population the same central issues as Native Hawaiian aspirations for sovereignty.
It has always been a tenet that there is a place for non-Hawaiians in sovereignty models for the future. But that place has always been vague.
The dramatic narrative of the ferry has shown that many of the most valid cultural claims of native Hawaiians are very similar to those that non-native groups are embracing in defense of their communities from the ferry.
As one Hawaiian activist commented to the press, "The protesters at Nawiliwili were there to protect the concerns of the kanaka. It wasn't just brown skin anymore...."
