HAWAI`I SENATE VOTES TO DUMP PLDC

Honolulu Star-Advertiser - February 19, 2013

The Hawai`i state Senate has voted unanimously to get rid of the heavily criticized Public Land Development Corp.

The move comes after the state House passed a separate proposal last week abolishing the agency, which has been denounced for its broad power to develop public lands.

Despite the similar outcomes, Hawai`i senators avoided the fanfare that accompanied the House vote, when a number of representatives stood up to say the agency was a mistake. Rather, the Senate repeal sailed through without comment.

The bill creating the land agency originated in the Senate two years ago.

Although both chambers have affirmed proposals to get rid of the organization, the bills still have a long way to go before they can become law.

Both chambers must consider each other’s bills in committees and work toward a draft they both can agree upon. The Senate version of the repeal is similar to the House bill adopted last week, but the two aren’t exactly the same.

Unlike the House bill, the senators propose to keep some of the land agency’s personnel, including the executive director, by transferring them to the state Department of Land and Natural Resources.

Since its creation, the agency has been a constant source of contention between the state and county leaders, who have condemned the agency for its ability to develop public lands without regard to local zoning or permitting laws.

The bill approved by the Senate originally started as a proposal to curtail urban sprawl, but it morphed into a repeal of the public land agency after being heard by the Senate committees on economic development and land.

Sen. David Ige, chairman of the Senate Ways and Means Committee, cited the agency’s excessive power in his report to the Senate president recommending that the agency be killed.

He said that repealing the law creating the agency is in the public’s best interest.

TOMORROW - SUPPORT HR23 RECOGNIZING THAT HAWAIIAN NATIONALS STILL EXIST

State Representative Faye Hanohano introduced House Resolution 23 (HR23) in the State Legislature, “Recognizing Hawaiian Nationals as a population residing lawfully in the Hawaiian Islands.”

It needs your SUPPORT to pass.

The first hearing of HR23 is scheduled for -
Tomorrow, Wednesday, February 13, 2013 -10:50AM
State Capitol conference room 325

Before the House OMH Committee (Ocean Marine Resources & Hawaiian Affairs) chaired by Rep. Hanohano

The text of HR23 is attached, or can be found HERE

The hearing notice, along with links to submit testimony, is HERE

This is a simple, common sense resolution that should be supported not only by Hawaiian Nationals, but by anyone who cares about stopping oppression and discrimination on the basis of nationality.

Think about HR23 as a way to add our voice Ku’e to the petitions of our kupuna.

If HR23 passes, it will effectively protect Hawaiian Nationals from the current nationality-based discrimination and mistreatment by government and other interests operating in Hawaii. In essence it says, Hawaiian Nationals belong here - there is nothing wrong with being a Hawaiian National, so stop treating Hawaiian Nationals as if we are illegal aliens.

GET READY!
Prepare a short and sweet testimony about why you SUPPORT the State of Hawaii recognition of Hawaiian Nationals “as a population residing lawfully in the Hawaiian Islands” and submit your written testimony 24 hours before the Wednesday hearing.

ALSO, please make an effort to attend the hearing on Wednesday so you can give your testimony in person. Often they will allow on-the-spot oral testimonies even if you haven’t made a prior submission in writing.

PLDC CREATION A SLAP IN THE FACE

By Gary Hooser

The Public Land Development Corp. (PLDC) was created by the Legislature in a manner that at best was unprincipled and at worst corrupt and illegal.

Those responsible owe the people of our state first an apology and then a complete repeal.

Senate Bill 1555, which became Act 55 and created the PLDC, was introduced in the Senate on Jan. 26, 2011. Initially, while establishing a quasi-independent development corporation intended to maximize the development and revenue generation of public lands, SB1555 did not contain broad exemptions from land-use laws. Also, when first introduced, the original PLDC board included full neighbor-island representation.

As if by design, on March 18, 2011, after sailing through the Senate with only minor amendments and no controversy, the House Water, Land and Ocean Resources Committee (http://tinyurl.com/ dyg32jn) inserted the exemption provisions and stripped away neighbor- island representation on the PLDC board.

The only opportunity for public input in response to these critical amendments was on April 7, 2011, in the House Finance Committee (http://tinyurl.com/d4ujr97). It was here that Finance Chairman Marcus Oshiro, with the approval of Speaker of the House Calvin Say, waived the normal 48-hour public notice rule and gave Hawaii residents only 115 minutes public notice to offer their mana‘o on a measure that could dramatically accelerate the development of public lands statewide.

These two maneuvers, executed quite deftly by the House, enabled the measure to reach the all-important joint conference committee without incurring any serious public scrutiny.

Once in "conference" where public testimony is not allowed, the final work on the establishment of the PLDC was a fait accompli.

The Legislature passed out SB1555, HD2, CD1 on May 5, 2011, which created the PLDC, took away "home rule" from the counties and granted the PLDC and its private partners extraordinary powers over the development of public lands.

They made the development of public lands exempt from all county zoning, planning and land use laws, gave all of the power to control this development to three appointees of the governor and took away all neighbor-island representation on the PLDC board.

Along the way, the House Finance Committee said effectively: "Oh, by the way, if you don't like it you have 115 minutes to get down to the Capitol and provide testimony — and if you live in Puna, Hana or Kekaha … too bad...."

The House Finance Committee essentially thumbed its nose at the Constitution and at the general public — claiming it held a public meeting yet making it impossible for the majority of the public to attend, or in fact to even know that the meeting was being held.

The legislative history of the PLDC represents a shameful and incredibly arrogant attitude of entitlement by many at the Legislature. The public is seen as a bothersome impediment and rules are seen as obstacles to be circumvented whenever possible....

It is no wonder people are outraged and demanding a repeal.

ALERT! - FAKE STATE AKAKA BILL FINAL VOTE TODAY

The one remaining Akaka-scheme enabling bill (SB1520 SD2 HD3) is scheduled for “third reading” (final floor vote) during the House session today.

Please email and call TODAY to all the members of the House of Representatives to URGE THEM NOT TO VOTE FOR SB1520. Send one generic email to all 51 reps at one time at - reps@capitol.hawaii.gov

HEREʻS WHAT TO SAY -
This would be bad for Hawai`i. The majority of the people of Hawai`i, native and non-native, oppose this measure. They have not even had the opportunity to vet this idea at public hearings...

SB1520 is unconstitutional. It sets into motion the Akaka bill scheme of “federal recognition” and “creating a Native Hawaiian government,” actions which the state has no constitutional authority to perform.

Passage of SB1520 would literally commit the state to hundreds of millions of dollars in increased expenditures and diminished revenues.

SB1520 would be a redundancy as the state already has the Aha Na ‘Oiwi, Native Hawaiian Convention program in process, but which is uncompleted and stalled for lack of funding.

TELL THEM -
Do not pass SB1520.

Put off SB1520 until next year after sufficient public hearings are held throughout the state.

Set SB1520 aside and provide funds to complete the Aha Na ‘Oiwi, Native Hawaiian Convention process as called for in HR56 and HCR63.

LAWMAKERS PUSH AKAKA BILL AT STATE LEVEL

Civil Beat - March 28, 2011

In a departure from form, some hearing notices for the Hawaiian affairs committees in the Hawai`i Legislature this session have included the following quote -

"He lā hou, e ho’oulu"

A new day, building a nation

For example, the quote can be seen near the top of a hearing notice for a resolution to be heard Monday in House Hawaiian Affairs. The resolution asks the Office of Hawaiian Affairs to consider the idea of "kanaka villages" for homeless Native Hawaiians.

Most notably, the nation-building quote has graced several hearing notices for bills that actually have something to do with building a Hawaiian nation.

Two of those bills — Senate Bill 1520 and Senate Bill 1 — recognize Hawaiians as "the only indigenous, aboriginal, maoli people of Hawai`i," and establish a commission to "prepare and maintain a roll of qualified Native Hawaiians" for the purpose of organizing a convention of qualified Native Hawaiians, respectively.

Both measures have already comfortably passed the state Senate. Last week, both cleared House Judiciary and were sent to House Finance, the final hurdle before making it to the full House for a floor vote.

Both measures have been amended, and final language will have to be agreed upon in conference committee and floor votes before heading to the governor's desk.

But, if they do survive and become law, they would accomplish some of the same goals as the Native Hawaiian Government Reorganization Act, more commonly known as the Akaka bill.

OUTRAGE OVER HAWAI`I FAKE STATE AKAKA BILLS

An Open Letter To Hawai`iʻs Politicians

This is to remind you that you took an oath to represent the people of Hawa`'i. After witnessing the charade and political back-scratching in the Senate Chamber, I was outraged by the conduct of the senators who was apparent that they did their arguments behind closed doors rather than take this controversial issue into the senate chamber.

There was no debate but a railroading of this bill which we the people deserved much more than a flippant rush through of a bill we find repugnant. This was a blatant miscarriage of justice and democracy and sickening to observe the rubber-stamping of its passage through political complacency for pecuniary reasons.

We have asked for public hearings on all islands so we can speak out on the issues of this bill which is now on the floor in the House as HB 1627 and hope that you will consider opposing this nefarious and seditious bill.

We are cognizant that it is in violation of the US constitutional laws and international laws whereby you do not have the jurisdiction to create a puppet Native Hawaiian governing entity to usurp the still existing Kingdom of Hawai`i.

We will not tolerate this faux native Hawaiian governing entity as it is NOT representative of we, the citizens of the lawful Kingdom of Hawai`i, which is still under the US belligerent occupation and subject to the law of occupation.

We will continue to fight this travesty of justice and not recognize the copy of the Akaka Bill as a representation of us and our rights. This objection to the bills SB1; SB 1520; and HB 1627; as well as the duplicate version known as the Akaka Bill in US Congress is well-documented and recorded in the countless testimonies.

We are quite aware of the ulterior motives which we find despicable. We will remember those who disregarded our opposition at election time and who ram-rodded this bill by forcing it on us. We will constantly fight against the entity if you decide to create this faux entity to steal our status, rights and resources.
