Na`i Aupuni Involvement Could Trigger IRS Probe

Aloha Trustees,
We are forwarding you this letter of concern relating to public statements and blogs about the use of the Kamehameha Schools Ho`oulu Hawaiian Data Center for racial and blood quantum verification for the Na`i Aupuni (Native Hawaiian Nation Constitution) / Kana`iolowalu ‘ratification/ federal recognition’ effort.
Kanaiolowalu (Act 195) was created by State Legislation. Its Commissioners were political appointees of Neal Abercrombie, the State Governor. Oversight was under OHA a State Agency. Some of the Bills and Committee reports accompanying these bills specifically mention and refer to the Kamehameha Schools. These references were made because those supporting the Bills wanted access to the KS Ho`oulu Hawaiian Data Center for election and racial verification purposes. These bills involved heavy lobbying in Hawai`i and also Washington DC.
Recently, information was circulated on the Internet verifying that Brendon Kalei`aina Lee, who is currently the Po`o of the KS Alumni Association, made statements in Alaska indicating he was working with Kamehameha Trustees and the Pauahi Foundation to give "Workshops" about the Native Hawaiian Nation Constitution adopted by 88 members of the Na`i Aupuni Aha and the upcoming ratification process of it. He alluded to the use of the KS Ho`oulu Hawaiian Data Center for verification of the race/blood quantum of the people who enrolled on Kana`iolowalu. Upon returning to Hawai`i, it is understood that Brendon Lee sought and received permission to engage the Pauahi Foundation Board in "workshops". As we understand it, these “Workshops” are being explained as “educational efforts”.
We strongly object to the usage of the KS Ho`oulu Hawaiian Data Center for any and all political purposes. The Federal 9th Circuit is currently reviewing the process relating to the alleged election of delegates for the Na`i Aupuni ConCon and the continued usage of the Kana`iolowalu list. The fiscal allocations from OHA now exceed 6.7 million dollars, of which 4 plus million were spent for Kana`iolowalu purposes. No accounting has been made on these trust funds to date, however the Judicial Watch OIP request resulted in OHA being forced to publish all invoices paid, which totaled 2.9 million dollars leaving 1.1 million dollars as unaccounted for expenditures.
Use of any data from Kamehameha Schools risks embroiling our Kamehameha Trust in another IRS probe . It is our opinion that allowing use of the KS Ho`oulu Hawaiian Data Center can only be interpreted by the IRS as Kamehameha Schools involvement in political processes that have been heavily lobbied in Hawai`i and Washington DC.
The students and alumni of the Kamehameha Schools have not agreed to or have given their approval for the use the KS Ho`oulu Hawaiian Data Center for verifying the race of individuals registered to participate in these political processes.
We are requesting the Board respond to this inquiry directly. We are forwarding our letter to other KS alumni and the Hawaiian Community.

Na`i Aupuni Makes Up The Rules As They Go Along
Na‘i Aupuni, the Native Hawaiian organization determined to enslave Hawaiians in US federal recognition, announced it is extending the deadline to vote to December 21.
“Because voters may not have cast their ballots over concerns and questions on the recent U.S. Supreme Court's (SCOTUS) decision to temporarily stop the vote count, we are extending the voting deadline to December 21, midnight Hawai`i time," said Bill Meheula, legal counsel for Na`i Aupuni.
Observers have remarked the real reason the voting deadline is being extended is because Na`i Aupuni voting participation has been extremely low.
In order for the US Department Of Interior to offer federal recognition, a minimum of thirty thousand votes need to be cast.
Observers believe the actual number of votes cast so far to be significantly below that.
Opponents of Na`i Aupuni are urging all Hawaiians to protest by not voting in the election.

NA`I AUPUNI = SEIZURE OF GOVERNMENT

As you read this, Na`i Aupuni (Seizure of Government), the new non-profit agency created and funded by the State of Hawai`i, is launching a Native Hawaiian constitutional convention. In order to understand the process it has never been more timely to have a public discussion about the ethics and credibility of the creation of the Native Hawaiian Roll that will be used during upcoming elections. The goal of Na`i Aupuni is to elect 40 candidates to write a “Hawaiian” constitution in 40 days. Of the five commissioners on the Kana`iolowalu roll commission, three, Na`alehu Anthony, Mahealani Wendt and Lei Kihoi, along with the roll commission’s executive director, Clyde Namu`o, have chosen to run as candidates for the Na`i Aupuni convention.
But there’s more to the dialog than having people who certified and created the roll run for election themselves. Unfortunately, the Native Hawaiian roll does not reflect the will of the people, and because the State of Hawai`i has backed the institutions and provided the funding that manufactured this roll – the voice of unregistered Native Hawaiians, the majority, remains unheard and uncounted. We must examine how this roll was created, and question the culturally insensitive inclusion of deceased Native Hawaiians on the roll as well.
In 2012, the Hawai`i State Legislature formally approved a process to create a roll of “qualified” Native Hawaiians by forming Kana`iolowalu, the Native Hawaiian Roll Commission. Only Native Hawaiians certified by the roll commission would form the electorate to participate in the creation of a Native Hawaiian Governing Entity. Under Act 195, Hawai`i State Governor Neil Abercrombie appointed 5 commissioners who were charged with overseeing the creation of this Native Hawaiian roll. Their self-proclaimed objective was to wage “…a campaign to reunify Native Hawaiians in the self-recognition of our unrelinquished sovereignty…”
Enrollees would be qualified on the basis of three criteria: They must be 18 years of age or older; they must satisfy ancestry requirements; and they must consent to participating in the organization of the Native Hawaiian governing entity.
Funded with approximately $2.6 million, the commission began the process of building the Native Hawaiian roll on July 20, 2012 and ultimately collected somewhere between 9,300 and 40,000 names (depending upon the news source), which is between 2 and 8 percent of the roughly 500,000 Native Hawaiians currently living in Hawai`i and abroad. The outcome fell far short of Kana`iolowalu’s objective to enroll 200,000 Hawaiians.
The state’s next move was to pass Act 77 (2013) an amendment that allowed the commission to take names from three other State of Hawai`i-controlled lists of Native Hawaiians: Office of Hawaiian Affairs’ Operation ʻOhana (1990s), Office of Hawaiian Affairs’ Native Hawaiian registry (2002) and the Office of Hawaiian Affairs’ Kau Inoa list (2004). The inclusion of these additional lists increased the total number of names on the roll to over 100,000, though the roll commission has not disclosed how many names came from each list.
Of the three lists, only the most recent, Kau Inoa, launched 11 years ago, explicitly promoted itself as having political aims: It consists of Native Hawaiians who signed up to be part of a Native Hawaiian nation. The purpose of Operation ʻOhana, however was to identify Native Hawaiians worldwide, while the Office of Hawaiian Affairs’ (OHA) Native Hawaiian Registry was created to supply Native Hawaiians with an I.D. card that would, “allow the applicant to access Native Hawaiian programs without providing birth certificates and other paperwork to prove they are Hawaiian.”
There is no mention of nation-building in the purpose of either ʻOperation ʻOhana or the Native Hawaiian Registry lists. Regarding the people who signed on to the Native Hawaiian Registry in 2002, then OHA Administrator, Clyde Namu`o claimed "It is not the board's intent to use the list as a political tool. The law doesn't allow for it to be anything but confidential." The question arises, how can the passage of a recent State of Hawai`i legislative amendment manufacture consent to move names from other registries to the Native Hawaiian roll? How does expressing interest in registering as a “Hawaiian” automatically make you a supporter of the State of Hawai`i process to build a Native Hawaiian governing entity? (While there was an option to ‘opt out’ for Native Hawaiians who were added to the Native Hawaiian roll from these other lists, relatively few individuals did so, as an ‘opt out’ is a standard marketing ploy to suppress action.)
As troubling as this fabrication of consent may be for the living, the Kana`iolowalu Native Hawaiian roll includes the names of the dead. The commissioners failed to remove the names of deceased Native Hawaiians from the various lists that they incorporated into the new Native Hawaiian roll. As a result, there are deceased individuals on the list – at least 604 by our count. We expect this is probably an undercount of the true amount as we could only search back to 2010 because the online obituaries do not extend further back than that. While all voter rolls may contain at least some names of the deceased, the difference here is that those individuals gave their express consent to be included on those lists while alive. We found almost a hundred names of people who died prior to the start of the Kana`iolowalu legislation in 2012.
It is extremely distasteful, embarrassing and frustrating that a commission with millions of dollars of resources was unable to remove the names of deceased Native Hawaiians. It is not clear whether the commission was unable or uninterested in determining who was deceased. However, it was not an onerous task as we completed this analysis in a few days’ time. It is unconscionable that a commission of Native Hawaiians would include the names of deceased kūpuna (grandparents) and other deceased Native Hawaiians on a certified roll without the individuals’ consent or that of their families. It is an embarrassment to them and for the rest of us as well.
The process of organizing a government needs to come from the bottom up, not from the top down. This process should not manufacture consent for the living or the dead. Our process and path to nationhood, whether via Federal recognition or Independence, is ours alone. A critical mass of Native Hawaiians given the opportunity can come together and make a fully-informed decision about self-determination. We believe that free and informed governance is a human right.

NA`I AUPUNI SUED FOR UPCOMING PHONY NATIVE HAWAIIAN CONVENTION & ELECTIONS
A group of four Native Hawaiians and two non-Native Hawaiians have filed suit against the State of Hawai`i and subsidiary agencies to halt a racially exclusive election and constitutional convention designed to establish a sovereign Hawaiian nation.
Working closely with the Grassroot Institute of Hawai`i, the suit was filed by non-profit watchdog group Judicial Watch, represented by former Hawai`i Attorney General Michael Lilly. Plaintiffs to the suit include native Hawaiians Keli’i Akina, president of the Grassroot Institute, Melissa Moniz, Kealii Makekau, and Pedro Gapero, as well as non-Native Hawaiians Joseph Kent and Sean Mitsui.
The suit alleges that the election, sponsored by the Office of Hawaiian Affairs (through a contracted organization Na’i Aupuni), using the Native Hawaiian Roll (a voter list compiled and certified by the Native Hawaiian Roll Commission), violates the U.S. Constitution by pursuing a race-based and politically qualified election to establish a racially exclusive nation. The suit thus argues that the State and its agencies are in violation of the First Amendment, Fourteenth and Fifteenth Amendments, and the Voting Rights Act.
The plaintiffs represent three categories: 1) Native Hawaiians whose names were placed on the Native Hawaiian Roll without their consent; 2) Native Hawaiians who are excluded from the Roll because they cannot in good conscience affirm the political declaration required in order to enroll; and 3) Non-Native Hawaiians who were racially discriminated against when excluded from the Roll because of race.
A group of four Native Hawaiians and two non-Native Hawaiians have filed suit against the State of Hawai`i and subsidiary agencies to halt a racially exclusive election and constitutional convention designed to establish a sovereign Hawaiian nation.
Working closely with the Grassroot Institute of Hawai`i, the suit was filed by non-profit watchdog group Judicial Watch, represented by former Hawai`i Attorney General Michael Lilly. Plaintiffs to the suit include native Hawaiians Keli’i Akina, president of the Grassroot Institute, Melissa Moniz, Kealii Makekau, and Pedro Gapero, as well as non-Native Hawaiians Joseph Kent and Sean Mitsui.

NATIVE HAWAIIAN ROLL "SWEETHEART DEALS" INVESTIGATION REQUESTED
A request by the Grassroot Institute of Hawai`i for information about the expenditures of the Native Hawaiian Roll Commission has led to additional questions about the Commission's possible violation of the state procurement code.
Former Hawai`i Attorney General Michael Lilly has requested that the Directors of the Departments of Commerce and Consumer Affairs and Accounting and General Services review whether the expenditure of over $800,000 on two vendors by the Native Hawaiian Roll Commission without public bid violated the State’s procurement code. Such a violation of the code is subject to possible criminal and civil penalties.
The Grassroot Institute requested from the Office of Hawaiian Affairs the check register of the Native Hawaiian Roll Commission as part of their ongoing government transparency effort. With the Commission's response now made public, citizens and government observers have been stepping forward with more questions about the expenditures listed and the process behind them.
In his letters sent as a private citizen to the state department directors, Michael Lilly states:
Some $4 million was reportedly transferred by OHA to the NHRC. The attached ledger summarizes payments by the NHRC to various vendors including over $600,000 to Makauila, a multimedia company ... Another some $200,000 went to "1013" which is a branding company found on your web site here as "One Zero Ten Three" ... None of these payments to vendors apparently complied with the procurement code, Chapter 103D.
According to Keli'i Akina, Ph.D., President/CEO of Grassroot Institute, "Much of the money being spent by OHA and the Native Hawaiian Roll Commission could better be used to meet the real needs of Hawaiians for housing, job opportunities, education, and health-care. And, if any of this public money is being fraudulently used, OHA and the Roll Commission must be held accountable."
Mr. Lilly added in a statement to Grassroot Institute: "The procurement code was established to ensure transparency and openness in public bidding, to ensure everyone has an equal right to bid on public contracts and to protect public funds from being overspent on insider deals."
