Your voices were heard loud and clear.

While they did not vote to support this bill, enough of them chose to not vote at all.

They fell short of the four votes needed to have OHA officially oppose HR. 3744.

HR 3744 - The Tribal Recognition Act -


If passed in the US Congress, HR 3744 would remove both the Executive Branch and by extension the US Department of Interiorʻs authority to recognize and therefore create a Native Hawaiian Tribe.


HR 3744, if passed, would require AN ACT OF THE ENTIRE US CONGRESS for any acknowledgement of a tribe should Robin Danner of the SCHHA and Michelle Kauhane of the CNHA attempt a government-to-government relationship with the US.


The administration of the Office of Hawaiian Affairs is recommending to the OHA trustees they vote to officially OPPOSE HR 3744.


HR 3744 will be on the agenda as "115th Congress Legislative Positioning Matrix 1" at tomorrowʻs OHA BAE Committee meeting at 1 PM at OHA headquarters.


If approved a vote of ratification will occur Thursday, January 11th at the regular 10 AM BOT meeting at OHA headquarters.

HAWAI`I CON-CON - A FIELD DAY FOR SPECIAL INTERESTS LIKE HAWAIIAN TRIBE PROPONENT ROBIN DANNER  & THE CNHA


State Sen. Les Ihara, a Democratic state senator, was a delegate to the 1978 Constitutional Convention.

The ’78 Con Con, as it’s called, is perhaps best known for establishing the Office of Hawaiian Affairs.

But it also set term limits for governor and lieutenant governor, required an annual balanced budget, recognized Hawaiian as an official state language, formally adopted the state motto, incorporated a right to privacy in the state bill of rights, included the waters surrounding the Hawaii islands as part of the state’s boundaries and established the Judicial Selection Commission, Council on Revenues and Tax Review Commission....

According to a new Civil Beat poll, two-thirds of Hawaii voters (67 percent) surveyed think it’s time for a new constitutional convention. Only 14 percent of those surveyed opposed having a con con.

On Nov. 6, Hawaii voters will have the chance to call for a con con, which would allow citizens to amend the state Constitution without going through the Legislature.
Many Hawaii voters are likely not aware of the constitutional convention question, which goes on the ballot every 10 years. But holding a con con can be consequential....

But as Anne Feder Lee, whose 1993 reference guide “The Hawaii State Constitution” explains in its section on the 1978 Con Con, the convention was wide-ranging in its agenda proposals.

Lee cited sources that argued public interest groups supported a convention because it was “a healthy and democratic device to review basic government organization and procedures.”

But Lee also noted that special interest groups supported a con con in order to have “yet another opportunity to write their platforms into the Constitution.”

OBAMA SPITS IN THE FACE OF EVERY HAWAIIAN


Protest Na`i Aupuni Responds To DOI Ruling

2 years ago, the Office of Hawaiian Affairs CEO Kamana’opono Crabbe a letter dated May 5, 2014 to Secretary of State John Kerry—in it, he questioned the legitimacy of US jurisdiction in Hawai`i and requested proof of how the Hawaiian Kingdom was legally annexed to the United States.

Rather than answer the question and prove once and for all that the US legally annexed Hawai`i, President Obama hastily ordered that the DOI hold public hearings in Hawai`i to discuss federal recognition. Literally, within 2 months of Mr. Crabbe’s letter, hearings on 5 islands went on for 2 weeks. Thousands of Hawaiians came out, but only hundreds were able to testify. 95% of the Hawaiians who spoke out were opposed to any notion of federal recognition or state and federal interference in our right to self determination.

Since then, Obama and his DOI have been inventing processes and manipulating data to create the illusion that the Hawaiian people want to be a tribe. And OHA, a state agency that has spent tens of millions of dollars trying to force federal recognition down our throats, has spent even more money with their fake Kana`iolowalu list, their fake Na`i Aupuni elections, and their fake Na`i Aupuni ʻAha 2016 Constitution.

Today, President Obama and the democratic party’s Hawai`i delegation in DC announced that they now have a process. But all they are really doing is covering up the crime of the illegal, US overthrow of the Hawaiian Kingdom’s government in 1893—something they admitted to in 1993 federal legislation referred to as the Apology Resolution and Public Law 103-150.

Today, President Obama furthered the crime of the fake annexation and the crime of fake statehood.

Today, President Obama circumvented the legal processes that the US Congress is there for, so that he could personally sign an Executive Order and give fake recognition to federally chosen Hawaiians who do not represent the Hawaiian people.

Why? So that he, and whoever his successor is, can create a counterfeit settlement for the Crown and Government land of the Hawaiian Kingdom, the so-called ceded lands.

Today, President Obama spat in the face of every Hawaiian from Queen Liliuokalani down to us Hawaiians standing here right now.

The only Hawaiians this new federal lie will benefit are the ones who will make money off of it. There is nothing, and there never was anything in it for the Hawaiians who suffer from the poverty invented by the US occupation. Our people remain the most impoverished, with the highest rates of homelessness, incarceration, diabetes, cancer, suicide and on and on.

President Obama doesn’t give a damn about us and our homeland, which has been turned into the largest military command on earth, our `aina which has been turned into the largest concentration of open field GMO test sites on earth, our `aina which is constantly being desecrated and destroyed by US policies and corporations.

When we Hawaiians look at what is being done to us from the US government and corporations, all we see is total erasure and removal of us, total exploitation and theft of who we are and what belongs to us.

We are being devoured by resort lifestyles and the military takeover of our housing, so we can’t even afford to pay rent in our homeland. We are supposed to allow the ongoing desecration of what is the most sacred to us, places like Mauna Kea for the TMT project and places like Wai`aleale so that corporations can bottle our water and sell it. Rather than let us use our water to grow our food we are being forced to accept that 90% of everything we eat is shipped in from 2500 miles away.

This is unacceptable. We, as a people, cannot allow the United States and its greedy corporations and its bought off sellout Hawaiians to get away with this. If we allow this to go on our children and their children will pay the price.

9TH CIRCUIT COURT HEARS NA`I AUPUNI LAWSUIT IN HONOLULU

Grassroot Institute Warns Closer To Native Hawaiian Tribe Than Ever Before

The challenge to the state's Native Hawaiian race-based election scheme moved forward today as the U.S. Court of Appeals for the Ninth Circuit held a hearing in Honolulu to consider the case of Akina v. Hawaii.

The lawsuit, which was brought by four Native Hawaiians and two non-Hawaiian locals through the assistance of Judicial Watch, raises Constitutional issues regarding the use of race to qualify voters for elections and plebiscites related to the creation and approval of a Native Hawaiian tribal government. In addition, the Native Hawaiian plaintiffs have raised free speech questions related to the Roll's requirement that voters affirm the "unrelinquished sovereignty of the Native Hawaiian people."

"What many people do not realize is that we are closer today to the creation of a state-sponsored Native Hawaiian government than we were on the day that we instituted this suit," stated Keli'i Akina, Ph.D., President of the Grassroot Institute of Hawaii and a plaintiff in the lawsuit. "That is why this issue is very much alive despite the dissolution of Na'i Aupuni. Neither the state nor the Office of Hawaiian Affairs--which are also defendants in this case--have indicated any desire to abandon the nation-building process. Only a permanent injunction preventing a race-based election would put a true end to the matter."

Dr. Akina continued: "The majority of Native Hawaiians, along with general population of the state, do not support the use of public resources to form a race-based separatist nation. Our lawsuit is critical for preserving the Aloha Spirit in Hawaii."

"Finally, the Constitution and case law are clear in rejecting the race-based election and voter roll that are at the heart of the state's nation-building process. For this reason, we are confident that we will ultimately prevail," Dr. Akina concluded.

HOW TO TURN HAWAIIAN HOMELANDS INTO A FAKE US FEDERALLY RECOGNIZED TRIBE WITHOUT A VOTE OF CONGRESS

Its been nearly a year since thousands of native Hawaiians at dozens of public hearings angrily rejected what the Feds called "Procedures to Reestablish a Government-to-Government Relationship with the Native Hawaiian Community."

Now, a different set of rules proposed May 8, 2015 by the US Department of the Interior (DoI), at the urging of Robin Danner's Council for Native Hawaiian Advancement, would create a path to federal recognition in three steps:

1) The 1920 Hawaiian Homes Commission Act (HHCA) provides for "the rehabilitation of native Hawaiians." On page 2 of the proposed rules, the DoI informs readers that "The Department of the Interior interprets the term 'rehabilitation' to include political cultural and social reorganization that would facilitate the stated goals of rehabilitation.(1) By providing a clear process for the Department's review and approval of land exchanges and HHCA amendments, this regulation will further the goals of the HHCA, including rehabilitation." (emphasis added)

2) Page 25-26 of the proposed rules reads, "The Secretary will determine that Congressional approval is required if the proposed amendment ... Allows the use of proceeds and income from the Hawaiian home lands for purposes other than carrying out the provisions of the HHCA...."

3) The Hawaii State legislature then need only enact a bill amending the HHCA to authorize use of Department of Hawaiian Homelands (DHHL) funds for the "political reorganization" of native Hawaiians. Under the DoI interpretation outlined on page 2 the bill would be deemed to be in line with the intent of the HHCA. Based on this interpretation, the Secretary of Interior would determine that Congressional approval is unnecessary because the expenditure lies within the purposes of the HHCA. (The Legislature has at least twice approved bills including language authorizing the use of DHHL funds for "rehabilitation" through "political processes.")

The HHCA is written into the Hawaii Admission Act. The Admission Act of a State can only be amended by vote of both the state legislature and the US Congress. It is Congress which has consistently protected native Hawaiians from being turned into a fake Indian tribe by Hawaii's money grubbing politicians. The new DoI interpretation is an attempt to illegally sidestep Congress.

This explains why Robin Danner told the Star-Advertiser May 8, 2015: "We were high-fiving (upon learning the news.) It means the door is open and it can't be shut. This is just the beginning of what I anticipate will be five to six years of rule-making...."

HAWAIIANS DELIVER STRONG OPPOSITION TO U.S. PUSH TO CREATE HAWAI`I TRIBAL NATION

Week Of Washington, DC Meetings & Events Seen As Success

(WASHINGTON, DC) - Hawaiians from Hawai`i have spent this week meeting with U.S. federal officials to oppose a longstanding plan to put Hawaiians into tribal nation status, much like American Indians.

Opposition to stopping this effort came to a head recently when it was discovered that President Obama is considering issuing an executive directive before leaving office early next year ordering the US Department of Interior (DOI) to federally recognize Native Hawaiians as a tribal nation against their wishes.

Having failed for 12 years to get the U.S. Congress to fabricate a fake Hawaiian tribal nation through the Akaka Bill, the State of Hawai`i has now clumsily attempted to concoct one by handing over a ready-made one for the Department of the Interior to take into the fold of recognized American Indian tribes.

However, today most native Hawaiians are adamantly refusing to be stuck into a fake tribal nation.

The U.S. government wants to do it anyway, whether Hawaiians like it or not, and whether anyone else living in Hawai`i likes it or not.

“This is why weʻve spent this week in Washington, DC, stated Hawaiian Kingdom Foreign Minister Leon Siu.

“We wanted to deliver a resounding ʻNO!ʻ to the Obama administration regarding their federal recognition scheme and we have done just that.”

Since there never was a treaty of annexation, Hawai`i never legally became part of the U.S. according to U.S. laws and constitution.

To duck this problem, the Obama administration has had designs to put Hawaiians into a tribal nation like American Indians.

This way Hawaiiansʻ claims to their lands can be put into a kind of Native Hawaiian land pool under a tribal “governing entity” recognized and administered by the DOI, similar to lands of the American Indians and Native Alaskans.

What has emerged, however, is so sloppy, so distasteful, so repulsive to Hawaiians and Americans, it will be extremely difficult for the Obama administration and the DOI to succeed.

FALLOUT CONTINUES FROM DANNER EVICTION REVELATION

Hawaiian Homestead Communities Outraged By Actions Of Robin Danner

(HONOLULU, HAWAI`I) - Outrage, anger and disbelief are the main reactions of Hawaiians who live on homestead land to a bombshell report that began airing online yesterday on Free Hawai`i TV.

The report, aired on the Koani Foundationʻs Free Hawai`i Broadcasting Network at http://FreeHawaiiTV.com, revealed that Sovereign Councils Of Hawaiian Homelands Assembly (SCHHA) chairperson Robin Danner evicted her own sister, Jade Danner Jones and her family earlier this year from a Waimanalo, O`ahu Hawaiian homestead property for non payment of rent.

The home in question is leased by Robin Danner from the Department of Hawaiian Homelands (DHHL.)

“Response has been both immediate and intense,” reports Free Hawai`i TV host `Ehu Kekahu Cardwell. “People are outraged and want answers.”

“Isnʻt there a rule in place that a person can receive only one residential homestead?” is a question that many have asked.

“If Robin has a Waimanalo, O`ahu homestead in her name, and yet she lives on an Anahola, Kaua`i homestead, whose name is on the Anahola homestead lease? There is something highly wrong with this womanʻs apparent control of so much DHHL property,” is sentiment expressed by many.

“This is who is in Washington, DC this week claiming to speak for Hawaiians?” asked another homesteader.

“These kind of people would sell out our keikiʻs birthright and future for a few crumbs from the U.S. angrily stated a Hawaiian National.

Since being posted online this yesterday, the Free Hawai`i TV video report continues to evoke outrage and anger amongst many throughout social media sites online.

U.S. DEPT OF INTERIOR TRYING TO FORCE HAWAIIANS INTO INDIAN TRIBE

Dept. Of Interior Move Would Mask Prolonged Illegal Occupation

(WASHINGTON, DC) - Hawaiians from Hawai`i and elsewhere are converging on Washington, DC this week to strongly protest and meet with key U.S. officials and decision makers. Why?

Hawaiians are alarmed because there are a series of meetings taking place this week in Washington, DC that focus on the possibility the U.S. Department Of Interior (DOI) is trying to turn Hawaiians into a U.S. Indian tribe.

The U.S. has a big problem that it apparently thinks can be solved by putting Hawaiians into a concocted Indian tribe.

“This is a desperate attempt to tie up loose ends from the illegal takeover of Hawai`i 118 years ago,” remarked Hawaiian Kingdom Foreign Minister Leon Siu.

“The U.S. doesn’t actually have legal title to lands in Hawai`i, so the U.S. thinks it can solve this problem by tricking the Hawaiian people into signing over their claim by identifying themselves as indigenous to the United States.

“Before too many Hawaiians find out about it and claim lands that are rightfully theirs, the U.S. is trying to get Hawaiians to pool their land interests into a tribal nation that the U.S. can “recognize” as a nation within a nation - a subservient Hawaiian nation within a superior U.S. nation, and therefore regain control.

“And thatʻs why weʻre here in Washington, Dc this week to say ʻNo!ʻ to this slight of hand.”

The U.S. takeover of the Hawaiian Islands in 1898 was an unlawful act which the U.S. has since officially admitted and apologized for. (See U.S. law 103-150 signed by President Bill Clinton.)

Jurisdiction and title to lands of the Hawaiian Kingdom were never lawfully conveyed to the U.S.

The U.S. simply used its bully power at the close of the nineteenth century to assume “ownership” of Hawaiian lands, ignoring the rightful claims of the Hawaiian Kingdom and the Hawaiian people.

Despite a century of propaganda and indoctrination the people have awakened to the fact that the U.S. and its puppet government, the fake State of Hawai`i not only have no jurisdiction, they own no land.

Esther Kia`aina Heads Effort To Create Tribes 

On Tuesday, February 23, Assistant Secretary of the Interior for Insular Areas Esther Kia`aina will host a panel discussion in Washington, D.C. on Self Determination in the U.S. Virgin Islands, American Samoa, and Guam.

The scope of the panel discussion is to focus on those U.S. territories – U.S. Virgin Islands, American Samoa, and Guam – that are still listed on the United Nations List of Non-Self-Governing Territories.

Since the last self-determination conference for the US territories was held in 1993 in Washington, DC, Assistant Secretary Kia`aina stated, “I believe it is important to provide an updated context for federal policy-makers and a new generation to learn about the status of self-determination in the respective territories as well as to understand what their rights are to self-determination under federal and international law.”
