HAWAIIAN INDEPENDENCE DAY OBSERVED











A Hawaiian sovereignty organization held an event at `Iolani Palace today to commemorate the day 163 years ago when Great Britain and France formally recognized Hawai`i as an independent nation.


Lynette Cruz, a spokeswoman for the group The Living Nation, said that Nov. 28, 1843, was known as La Ku'oko'a, Hawaiian Independence Day, and recognized as a holiday by the Hawaiian monarchy.

But it was eliminated in favor of the American Thanksgiving by the Republic of Hawai'i in 1895, two years after the overthrow, she said.


The Living Nation gives much of the credit to Timoteo Ha`alilio, an ali`i and confidante to King Kamehameha III, who led a delegation through the U.S. and Europe in search of a treaty that would recognize Hawai'i as a sovereign nation, Cruz said.

"The idea was that in order for Hawai`i to become recognized as a member of the family of nations, (a treaty) had to be brought back," she said.


The U.S. did not sign the treaty but issued the 1842 Tyler Doctrine, a unilateral American policy that recognized Hawai`i as an independent nation.

The Office of Hawaiian Affairs claims if the Native Hawaiian Government Reorganization Act, (Akaka Bill) isn’t passed, alleged subsequent loss of federal funding could have a dramatic effect upon not only Native Hawaiians, but also Hawai`i's economy.

Let's take a look at actual annual federal appropriations over the last few years to cover all 250,000 people who call themselves Native Hawaiian -

Education - $30.5 million / 250,000 Hawaiians = $122.00 per Hawaiian.

How much education can you buy this year with $122.00? If teachers are making say $30,000 a year you could hire 1,016 teachers. That means there would only have to be 246 Hawaiians per classroom.

Affordable Housing - $9.6 million/250,000 Hawaiians = $38.40 per Hawaiian.

How much of your yearly rental costs does $38.40 cover?

Health Care - $7 million /250,000 Hawaiians = $28.00 per Hawaiian.

How much dental and medical insurance can you buy with $28.00? Maybe get only half your teeth cleaned this year and hope you don’t get sick?

Strengthening Community Colleges - $3.25 million /250,000 Hawaiians = $13.00 per Hawaiian.

How many units of academic instruction does $13.00 cover at a community college these days?

Vocational Education - $2.9 million/250,000 Hawaiians = $11.60 per Hawaiian.

What can you learn how to do for $11.60?

Community Development - $2 million/250,000 Hawaiians = $8.00 per Hawaiian.

How much Community infrastructure does $8.00 buy?

Strengthening Community Colleges (Agriculture) - $1.5 million /250,000 Hawaiians = $6.00 per Hawaiian.

What does $6.00 buy in the way of agricultural education at community college these days?

KA LA KU`OKO`A - HAWAIIAN INDEPENDENCE DAY OBSERVED TOMORROW

Ceremonies Tomorrow At `Iolani Palace, Honolulu, 3 PM - 7 PM

In the Kingdom of Hawai`i, November 28 was an official holiday called Ka La Ku`oko`a, or Independence Day. This was the day in 1843 when England and France formally recognized Hawai`i's independence.


His Hawaiian Majesty King Kamehameha III deemed it prudent and necessary to dispatch a Hawaiian delegation to the United States and then to Europe with the power to negotiate treaties and to ultimately secure the recognition of Hawaiian Independence by the major powers of the world.

The Hawaiian delegation, while in the United States of America, secured the assurance of U.S. President Tyler on December 19, 1842 of its recognition of Hawaiian independence, and then proceeded to meet Sir George Simpson in Europe and secure formal recognition by Great Britain and France.

As a result of this recognition, the Hawaiian Kingdom entered into treaties with the major nations of the world and had established over ninety legations and consulates in multiple seaports and cities.

November 28 was thereafter established as an official national holiday to celebrate the recognition of Hawai`i's independence.

But in 1893, an illegal intervention into Hawai`i's affairs by the U.S. resulted in a "fake revolution" against the legitimate Hawaiian government, and a puppet oligarchy set itself up with its main purpose being Hawai`i's annexation to the United States.

Hawaiians protested and celebrated Ka La Ku`oko`a anyway, telling the story of the national heroes who had travelled to Europe to secure Hawaii's recognition.

We celebrate Ka La Ku`oko`a - Hawaiian Independence Day, to remember that Hawai`i was a fully recognized member of the world family of nations, and its independence is still intact under prolonged illegal occupation.

You offer me food and rest. I decide to stay.

Then, I order you and your family around, use your things and rearrange the rooms.

I take down your photos and religious symbols, replace them with my own and make you speak my language.

One day, I dig up your garden and replace it with crops that I can sell.

You and your family must now buy all of your food from me.

Later, I invite my father and his buddies over.

They bring guns. We take your keys.

I forge a deed and declare my father to be the owner of your house.

I bring more people. Some work for me. Some pay me to stay in your house.

I seize your savings and spend it on my friends.

You and your family now sleep on the porch.

Finally you protest.

Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave.

I tell you, "Sorry, I was wrong for taking the house."

But when you demand your house back, I tell you to be realistic."You are part of this family now, whether you like it or not," I say. "Besides, this is for your own good.

For all that I have done for you, why aren't you grateful?"

Misconception #2 Only Native Hawaiians Were Wronged.

In the late 19th Century, the Hawaiian Kingdom was a progressive, literate, flourishing, peaceful independent country and an active, full-fledged participant in the Family of Nations.

Hawai`i conducted trade and enjoyed diplomatic relations with all the leading nations of the world — including the United States.


Domestically, Hawai`i had a constitution, a bi-cameral legislative body, a judicial system, session laws, penal codes, a police force, immigration laws, an excellent public education system and all the departments necessary to govern and provide services for the people of this country.

The forceful overthrow of the Hawaiian Kingdom in 1893, displaced a country's government and its lands, not the members of an ethnic group. It was the Hawaiian Kingdom — a nation — that was overthrown, not the aboriginal people — the kanaka maoli (what the U.S. and "state of Hawai`i" insist on calling, "Native Hawaiians.")

Yes, kanaka maoli were harmed by the loss of their nation, but so were many non-aboriginal subject/citizens of the Hawaiian Kingdom: Asians, Caucasian, Polynesians and so forth.

This is a crucial point. When a nation is stolen, all the citizens of that nation are deprived of their country, not just the aboriginal people.


At the time of the overthrow, there were many people from different origins and ethnic groups who called Hawai`i home.

Many of them were naturalized citizens and enjoyed the benefits and responsibilities as citizens/subjects of the Hawaiian Kingdom.

Those who were citizens of Hawai`i in 1893 were also injured when their nation was summarily taken and occupied by a foreign government, without their consent and, in fact, over their vociferous protests.


Their descendants, should they choose to assert their lawful birthrights, have legitimate claim to the return of their country and Hawaiian Kingdom citizenship and a stake in matters of reconciliation, redress and restitution involving the Hawaiian Kingdom.

If justice is to be served, the United States must withdraw and return the Hawaiian Kingdom to all the people of the Hawaiian Kingdom, not the people of an ethnic group deviously identified by the U.S. as "native Hawaiians."

Misconception #1 Hawai`i Is A Part Of The United States.

The truth is: the current government, the "state of Hawai`i," (allegedly a part of the United States) resulted from a series of unlawful acts stemming from the 1893 unlawful overthrow of the recognized, peaceful, civil government of the Hawaiian Kingdom.

The United States government has twice officially acknowledged (in 1893 and again in 1993) that its participation in the unlawful overthrow of a friendly, neutral nation was an unprovoked unlawful act of aggression.

It violated international laws as well as U.S. laws, and of course, Hawaiian Kingdom laws.


Knowing of this problem of the United States' unlawful occupation of Hawai`i, two options are presently being pursued:


Option One:
In the name of justice, restore the sovereign nation, the Hawaiian Kingdom; it's people, its lands, its lawful government and international standing. The various Hawaiian independence groups are pursuing this option.


Option Two:
Ignore the facts and allow the United States to continue its fraudulent, unlawful occupation of Hawai`i. The supporters of the "Akaka Bill" are pursuing this option.

HAWAIIAN SACRED PLACES - PRESERVED OR DESTROYED ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE

Mahalo to everyone who contacted us this last week about our new “Sacred Caretaker” segment.

Many of you spoke about those scared places in Hawai`i that move you deeply. It’s obvious this issue is one where so many have such strong feelings and lines are drawn.

Mighty struggles are occurring in Hawai`i currently at two such places – La`au on Moloka`i and Punalu`u at Ka`u on Hawai`i Island.

A $200 million dollar luxury home development at La`au threatens literally every single resident on Moloka`i, and will destroy the culture and lifestyle on that island forever.

Water consumption demand on Moloka`i will double due to, you guessed it, golf courses and luxury mansions for rich foreigners. And Hawaiian homesteaders will have their water diverted to meet those obscene demands.

Punalu`u faces a similar threat – a beautiful black sands beach, the only public access beach left in Ka`u, being turned into yet another luxury resort.

Worse, it would mean the demise of nesting sites for the endangered Hawksbill Sea Turtle, a habitat for the rare and endangered Hawaiian Monk Seal, the Hawaiian Hoary Bat and others.

Punalu`u is also home to some of the largest Hawaiian sacred sites and burial complexes in all of Hawai`i.

So we are bowing to your requests to air our “Sacred Caretaker” segment again this week along with one closely connected - on the defeat of the Akaka bill earlier this year.

It’s critical for everyone to make the connection that should the Akaka bill ever become US law, it will open the floodgates to many more developments in Hawai`i for wealthy foreigners and the destruction of not only a way of life, but those places that gave rise to that lifestyle.

A U.S. Census Bureau survey unprecedented in its specificity has confirmed what previously had been deduced - Hawaiians are at the bottom of the state's economic ladder as they struggle in court and Congress to maintain government-funded programs aimed at lifting them from intolerable conditions....

The Hawaiians' per capita income is $16,932, far less than the statewide average of $25,326.

While the poverty rate for all families in the islands is less than 8 percent, the rate for Hawaiians is nearly 15 percent, according to the survey. All other ethnic groups' poverty rates are in single digits.


"While there certainly are success stories, the vast majority of native Hawaiians still find challenges on a daily basis, some even in putting food on the table," Shawn Kana`iaupuni, director of strategic planning and implementation at Kamehameha Schools, told the Star- Bulletin's Christine Donnelly.

WHO WINS IN A FREE AND INDEPENDENT HAWAI`I ? EVERYONE !

One of the biggest lies perpetuated today is that when Hawai`i achieves nationhood once again it will be at the expense of everyone else.

But no one will be kicked out; their businesses seized or their homes and property confiscated.

Instead, everyone, Hawaiians and all others, will be citizens of the sovereign and independent Nation of Hawai`i.

The Hawaiian Nation included people of many ethnic backgrounds that were loyal citizens before the illegal overthrow and it will be so again.

The truth is a sovereign Hawaiian nation will need the contributions and talents of all of its citizens to remain viable in the world.

Hawaiians would be no better than the very supremacists that overthrew and occupied them were they to divide people by race.

Hawaiians have always been inclusive, not exclusive.

How would this be accomplished politically given a civil war resulted the last time a state tried to leave the US?

Unlike the southern US states, the Kingdom of Hawai`i and its citizens never agreed to become part of the United States in the first place.

Therefore a move for Hawai`i to secede from the US would be both unnecessary and inappropriate.

Much like removing the top coat of paint to reveal the one underneath, the US Congress, after consultation between Hawaiians and the US at the level of state to state, could simply enact a US federal law that dissolves the entity known as the "state government" in Hawai`i.

What would be left in its place is what has existed all along anyway without interruption – the Nation of Hawai`i.

Only at that point, would it be appropriate for the citizens of Hawai`i to decide their future as it relates to a relationship with the United States.

Those possibilities would include

Full Independence - Joining once again the family of nations in the world.

Free Association Much like Palau and the Federated States of Micronesia.

Integration with the US Becoming a state again or a tribe of the US under federal recognition.

Did you know ? -

When Ronald Reagan was president, one of the most conservative US presidents in recent times, his administration actually granted the Marshall Islands independence in 1986, which then lead to a free association relationship with the US.

Precedent for Hawaiian independence exists right now within US law as outlined above.

There are no laws that exist today within the US to prevent the US federal government from dissolving a state government.

It is only fear and ignorance that holds the status quo in place.

WHAT DO HAWAIIAN NATIONALS WANT ?

HERE IS WHAT THEY SAY ABOUT THEMSELVES, THEIR COUNTRYMEN AND THE UNITED STATES -

"The most common sense thing is for total independence.

We were a progressive modern nation of our time and recognized as a friendly, neutral nation within the Family of Nations, the predecessor of the League of Nations and the United Nations.

We had a democratic form of government, a constitutional monarchy with a bicameral legislative assembly.

The works and legacies of our monarchs are legendary and noteworthy.

Today under the American system, we are concerned about our lands, culture, people and lifestyle which has been under attack for over a hundred years.

This gets us angry as more Hawaiians desire total independence as a result.

The Kingdom of Hawai`i is not only Native Hawaiians but subjects of non-Hawaiian blood who were legitimate subjects of the Kingdom.

This racial argument is an American thing and not a Hawaiian thing.

So our concerns are well within our scope to protect all our subjects of the Kingdom.

We do expect reparations and restitution from the US for the injurious damages to our nation, land and people.

The US government is well aware of this and is attempting a piecemeal settlement.

If the tables were turned around; which would you do? I'm sure it wouldn't be a hard decision.


Remember, Hawaiians never hated Americans; but only those that did harm to us and the US government for its complicity and deceit.

We were never afraid that another country would take us over; we had over twenty-four treaties with various countries but the US is the only country that broke their treaties with us."

That should tell you something.

Free Hawai`i means returning the Hawaiian Islands back to an independent nation status, as it was before it was illegally overthrown by US marines and rich sugar barons in 1893.

In 1993, President Clinton formally apologized for that act and publicly acknowledged the illegality of the overthrow.

98% of all Hawaiians living at the time opposed the illegal overthrow!

Today, less than 20% of all land in Hawai`i is in Hawaiian hands. Over 60% today is in non-Hawaiian hands!

A few individuals, who are non-Hawaiian, lease an amount of land in Hawai`i that is greater than all land leased to all Native Hawaiians!

Currently, only 72 landowners control 95% of all land in Hawai`i.

Native Hawaiians make up the largest percentage of homeless in Hawai`i today.

Native Hawaiians have the worst social, educational and economic indicators compared to any ethnic group in the US.

Native Hawaiians currently have the worst health profile compared to any ethnic group in the US.

Descendants of the Hawaiian Nation want their country and land back so they can grow their own foods, become healthy once again, and control their own destiny.

NATIVE HAWAIIAN HUMAN RIGHTS VIOLATIONS DOCUMENTED

Report To United Nations Available For All To See


A two day conference,
"The Rights Of Native Hawaiians As Indigenous Peoples To Self-Determination Under International Human Rights Law And U.S. Domestic Law," concludes today at University of Hawai`i Manoa.

Earlier this year a Shadow Report detailing on-going human rights violations against Native Hawaiians since the illegal overthrow of the Hawaiian Kingdom was filed with the Human Rights Committee at the United Nations.


So that everyone can understand the background to this groundbreaking work, we have posted several of the documents, along with the final Shadow Report itself here

Bush Seeks Dramatic Changes To Escape Liability Of Wrongdoing

The Bush administration is proposing sweeping changes to the Cobell settlement bill that would phase out the federal government's trust management responsibilities and force consolidation of Indian lands.

Within 10 years, the Interior Department would no longer manage the 54
million acres held in trust for individual Indians and tribes.

The goal is to turn
the system into a "beneficiary- managed" trust for which the United States cannot be held liable for any damage claims.

To facilitate the major shift, the administration wants to consolidate the
Indian land base through voluntary and involuntary mechanisms.

Highly
fractionated parcels would be whittled down to just 10 owners in the next 10 years.

And the administration is asking Congress to resolve all tribal trust claims
in addition to the Cobell suit over the Individual Indian Money trust....

Jim Cason, the associate deputy secretary at Interior, has advocated for the
resolution of all tribal and individual Indian trust claims.

David
Bernhardt, the recently-confirmed solicitor, has lobbied Congress to limit the liability of the United States....

More than two dozen tribes subsequently filed lawsuits for accounting,
mismanagement and related claims. But some cases -- notably the Navajo Nation's $1.8 billion claim -- have been pending in court for years longer than Cobell
or the more recent tribal suits.

HOW HAWAI`I TREATS HAWAIIANS - THE CONCLUSION

Stanlyn Placencia said government officials should be talking less about creating "affordable housing," and speaking more about creating "affordable rentals."

"Everything is snapping," she said. "Our services are stretched thin. We have good, decent people who can't get a good, decent place to live."

Jordan believes the coast's homeless predicament could be substantially eased if the state would open a temporary homeless transitional shelter in Wai`anae similar to "Next Step," recently opened in Kaka`ako.

"It could be a mini-shelter, smaller in scale," Jordan said. "Instead of 200 people, the facility could maybe accommodate, say, 75 to 90 people."

Jordan acknowledged that there's no facility available in the area, such as the warehouse that was converted into the Kaka`ako shelter. But she said a large, stabilized tent structure could work.

Reminded that the concept resembles the "Camp Hope" model residents three years ago screamed would become a "dumping ground" that would transform Wai`anae into the "homeless capital of Hawai`i," Jordan said, "Look at what they've got now.

"I think our community is ready for something like that. I think the people would be responsive...."


"We could see how this is working at Next Step and how it would work best in other parts of the island," he said.

Placencia said: "I believe our community is ready for anything right now."
