STOLEN LANDS DEAL NOW MOVES TO HAWAI`I SENATE

Lawmakers Attempt To Legitimize Lands Stolen From Hawaiian Nation

The fate of the $200 million so-called ceded lands settlement package will be in the hands of the 25 members of the state Senate.

A key senator was noncommittal on the new proposal's chances in that body.


Meanwhile Rep. Sylvia Luke, who voted against the bill,
said homesteaders in her district, specifically those living in Papakolea, had expressed strong concerns about the proposal.

"If there's any group of people who should benefit, it's the Native Hawaiians," Luke said.

Many were upset that the Office Of Hawaiian Affairs did not first approach them for their thoughts on the plan, she said.

WHAT'S THE DIFFERENCE BETWEEN FEDERAL RECOGNITION AND A FREE HAWAI`I ?

A Free Hawai`i is a sovereign state with dominion, the right to join the UN, and fly it's own flag.

More important, independent states have a well-defined set of rights under international law, such as the right not to be invaded and belligerently occupied.

On the other hand, under federal recognition and the Akaka bill, Hawai`i would technically become a "captured nation," meaning that international law could not prohibit the US commencing aggression and total extermination of its indigenous Hawaiian population.

Even worse, Native recognition would be conditional only after extinguishment of Hawaiian Kingdom Citizenship political status (your right to exist.)

US law would not grant full autonomous self-rule and would in fact destroy territorial integrity which continues to exist right now, even as you read these words.

Why reject "native recognition" for a Free Hawai`i ?

Independence is a formal recognition of Hawai`i's territory and laws. It's subjects are not under US jurisdiction.

The Hawaiian Kingdom still has its own bill of rights, constitution and comprehensive complied laws.

Only by the assertion of our Dominion and Hawai`i Territorial Authority can we protect our beloved homeland with international support.

But, every day we see people around the world fighting for, and winning back their native and national rights. Their quest, and ours are totally legitimate and very real.

Like everyone else, Hawaiians want four basic things –

FREEDOM The freedom to decide their own future for themselves. That “freedom” was taken away when the sovereign Nation of Hawai`i was overthrown in 1893. It was taken away again by illegal annexation to the United States in 1898. And, it was taken away a third time by the so-called statehood vote in 1959.

According to international law, a new vote must to be taken that offers three options – 1) Independence, or 2) Free-Association or 3) Integration (nation within a nation.)

RIGHTS The rights of the independent Nation of Hawai`i were never relinquished. The destruction and denial of these rights must cease. Everyone who descends from citizens of the Hawaiian Nation prior to 1893, Native Hawaiians and all others, are entitled to these rights.

IDENTITY The political identity of Hawaiians must be acknowledged by the United States. Hawaiians will decide their own future, without interference by the US. Also, only those with any measure of indigenous blood may define Native Hawaiians. A blood quantum imposed by others is an unacceptable means to divide and conquer.

LAND BASE - Hawaiians love their country and lands just as much as US citizens love the US. Hawaiians want ALL their land back, not just some of it.

OFFICE OF HAWAIIAN AFFAIRS HYPOCRISY

OHA seems willing to compromise its integrity, morality and lack of
historical memory, by complicitly joining the Republic of Hawai`i in continuing dealings involving the illegal conversion of stolen Hawaiian Kingdom National lands (the so-called "ceded" lands) in settlement of a dispute with the State over moneys owed.

While, on its face, the settlement appears to return "Hawaiian" lands to
"Hawaiians," the political reality (by international law) is that it doesn't.

It all reduces to the illegal "taking" (acquired without consent or
compensation) of the lands of National Hawaiians (descendants and heirs of subjects of the Hawaiian Kingdom, the holder of absolute title) by the Republic of Hawai`i (with no title) in the illegal overthrow of 1893 which were allegedly "ceded" to the United States by the so-called Annexation that never took place (resolutions cannot annex foreign lands) and using them to pay the financial debts of the State of Hawai`i to American-Hawaiians.

OHA's willingness to accept the "stolen" lands in settlement is about as far from being PONO (righteous) as possible.

In poor health and living in an old one-room structure in Waimea, his friends knew he needed something better.

Similar to the Maori marae in Aotearoa, (New Zealand,) hale halawai is a formal meeting place to receive and host visitors from far and wide, through Hawaiian protocol and hospitality.

Soli saw his hale halawai as a place to host sovereignty movement activists from all over Te Moana Nui – The Polynesian Triangle.

Because Soli had dedicated his life to serving others, they knew they now had to do the same thing for him.

So they built it for him.

One day at the Royal Hawaiian Shopping Center where he worked, Uncle Helemano noticed an old kahili, the feathered standards of old Hawai`i, in need of repair.

And that’s how Uncle became one of Hawai`i’s best-known contemporary kahili makers.

Naturally when we sat down with him to talk story, he told us some amazing things including who the very first kahili really were.

He also told us kahili marked parameters in the old days when ali`i were present, since ancient Hawai`i had no flags.

We saw right away there’s a lot more to it, since for Uncle creating kahili is not just about passing the culture down through the generations, “it’s also about a positive message to our people.”

Here's the #1 reason to oppose the ceded lands (read Stolen Lands) settlement being pushed by the Office Of Hawaiian Affairs.

OHA Staffer Jonathan Scheur was asked recently in a public meeting if some of the money awarded in the settlement would be used to support Kau Inoa, the registry of Native Hawaiians that many see as being directly connected to the Akaka Bill, which would effectively end all hopes of independence.

SUPERFERRY BEACHED UNTIL END OF MARCH

The Hawai`i Superferry will be out of commission for repairs three weeks longer than originally expected.


The interisland ferry Alakai was taken out of service Feb. 13 and was to be put back into service on March 3. On Wednesday, Superferry officials said the ship would go back into service on March 25.


The company said the work was extended announced "due to damage to Alakai's hull that occurred during the drydocking process and additional maintenance that was identified while the vessel has been in drydock."

IT'S SINK OR SWIM TIME FOR THE SUPERFERRY

Inter-Island Service Stopped Until March 3


The Hawai`i Superferry has canceled all voyages until March 3 to repair the Alakai's auxiliary rudders.

Company officials said Friday that they are moving up the ferry's annual drydock for maintenance and recertification by the U.S. Coast Guard to take advantage of the off-peak travel season.


The Alakai will be docked in Honolulu from now until March 3.

A big mahalo to everyone who submitted testimony or turned out yesterday at the Hawai`i legislature to protest the attempted give away of valuable ceded lands to the “state” government by the Office of Hawaiian Affairs.

This travesty is outrageous for two reasons.

First, the lands they would give up are worth millions, and they never consulted the Hawaiian community before secretly negotiating the deal behind closed doors.

Second, it’s not their land to give away.

How can one bunch of US bureaucrats give something to another bunch of US bureaucrats if it’s stolen property to begin with?

A former construction worker building houses and highways, Ke`eaumoku’s first awakening came during the 1993 Onipa`a March in Honolulu.

The second occurred when he found himself actually making concrete parts for the H-3 freeway, which eventually caused the desecration of ancient sites in Halawa Valley on O`ahu.

Needing to earn money to feed his family, he kept asking himself, “Is what I’m doing pono, is it just? Is the knowledge I’m acquiring through the corporate system legitimate, based on my life as an island person and Kanaka Maoli?”

Soon thereafter he walked in, quit his job and dedicated the rest of his life to answering the question, “Is there a way to create just with the unjust?”

Today he and his wife run no less than five associations dedicated to serving those threatened with losing their family land to corporate development.

“Hale Halawai – Monument To Activists – A Visit With Soli Papakihei Niheu”


People were concerned about longtime Hawaiian political activist Soli Papakihei Niheu.


In poor health and living in an old one-room structure in Waimea, his friends knew he needed something better.

So they decided to act. They collected contributions, both money and materials, and soon had enough resources to build him a new house.

That’s when Soli stepped forward to let them know he didn’t want a house.

Instead he wanted the one thing missing in Hawai`i that’s common throughout most other islands in the Pacific - a hale halawai.

Similar to the Maori marae in Aotearoa, (New Zealand,) hale halawai is a formal meeting place to receive and host visitors from far and wide, through Hawaiian protocol and hospitality.

Soli saw his hale halawai as a place to host sovereignty movement activists from all over Te Moana Nui – The Polynesian Triangle.

Because Soli had dedicated his life to serving others, they knew they now had to do the same thing for him.

So they built it for him.

In our moving and highly inspirational visit with Soli, you’ll hear him tell his story and see the pictures for yourself of how his hale halawai became reality. Surviving two earthquakes and many other challenges, Soli persevered in his vision of having both a monument to his heroes, the early pioneers of the sovereignty movement, as well as a place for today to teach the young.

AKAKA BILL NOT THE ANSWER TO LAND CLAIMS

Hawaiian Kingdom Was Illegally Overthown, Not Conquered

Sunday's editorial about the Supreme Court's decision to bar the sale of the ceded lands - the crown and government lands of the Hawaiian kingdom - pointed only to the process of reconciliation and the difficulties of negotiating that reconciliation with the United States and the state of Hawai`i.


From this the writer leaps to the conclusion that only the passage of the Akaka bill can provide a native agency that can negotiate a claim with the state and lead to a settlement that will close "the book on Hawai`i's turbulent past."


I can understand why Hawai`i residents would want this resolved as expeditiously as possible, but as one of the original plaintiffs in this case, I think there are other concerns about the state's control of these lands that are just as important, especially since Hawaiians are not responsible for the theft of their lands nor of the continued denial either of the right to self-determination or the restoration of their national government.


Theft is the most accurate description of the taking of the crown and government lands by the republic in 1894 and the cession of those lands to the United States.

The United States did not conquer Hawai`i, but it prevented the kingdom from extinguishing the insurrection in 1893, disregarded its own constitution by assuming an annexation even when it could not secure enough votes for a legal annexation and took possession of lands that the kingdom's legislatures and chiefs had reserved for its monarchs and national well-being before 1850.


Neither the state nor the United States has legal title or moral claim to the ceded lands.


I, too, would like to see a reconciliation, but our people did not create this pilikia (trouble) and we should not be admonished to hurry through the "settlement" just because it is inconvenient to the state.

SAY "NO" TO STEALING HAWAI`I NATIONAL LANDS!

The Hawai`i state government's proposed allocation of lands belonging to the Hawaiian Nation must be rejected.

The state of Hawai`i, as part of the U.S. federal system, has no authority to allocate any land of the sovereign Hawaiian Nation to any
party other than the rightful owners.

US Public Law 103-150 (Apology Resolution) of 1993 clarified that the kanaka maoli (native Hawaiians) never relinquished their claims over their national lands to the United States.

Even though the Hawaiian Nation was invaded by the United States in 1893 and its government was removed, the Hawaiian Nation, under international
law, continues to exist.

Only the kanaka maoli and fellow loyal non-kanaka citizens, as
continuing members of the Hawaiian Nation, have legal authority to decide on the lands of the Hawaiian Nation.

Until the US government ends its illegal occupation of Hawai`i, it is obliged to keep intact all the lands it occupies.


The state Office of Hawaiian Affairs cannot be viewed as a legal representative of the Hawaiian Nation, since it was created in 1980 by the illegal state government and the federal government....


...OHA and the state's proposed land and money awards to OHA bring to center stage the reality that the United States remains an occupier and that as such, it is trustee of the Hawaiian national lands until the Hawaiian Nation government is reconstituted and recognized.

The news keeps going from bad to worse for the Superferry.

On top of inclement weather, cracks were discovered in the Superferry’s auxiliary rudder this past week, causing a further delay in service and of course stranded passengers and vehicles.

Mainstream media now wonder aloud how soon the Superferry will be bankrupt.

Ironically it turns out the Superferry never really had a chance to impact the environment like many feared – rather it’s the environment which has doomed the Superferry.

Not to be outdone, the Lingle administration is now planning to spend one third of a billion dollars building a pier in Lahaina harbor for cruise ships and the Superferry which will destroy a surf spot and canoe course and raise freight costs for everyone.

Naturally the people of Maui who love their land have plenty to say about that because they know it’s the freighters, which bring supplies to Maui that should have top priority.

Also this week the Office of Hawaiian Affairs announced a ceded land deal with the state government.

How can one arm of the illegal US occupying force trade what is rightfully Hawai`i National property to another arm of the illegal US occupying force and have it be anything other than a farce which is null and void?

SUPERFERRY WON'T SAIL - COMPANY'S SURVIVAL IN QUESTION

The Hawai`i Superferry will stay in port tomorrow, despite earlier hopes.

Officials say there was an unexpected delay in finishing repairs to the vessal.

The Alakai has been docked since Sunday because of high seas between O`ahu and Maui.

The continued problems for the Superferry have some wondering if the company will survive.

"I mean it's understandable but still if someone needs to be on Maui at a certain time, certain day it creates difficulty." said Jim Tollefson, Chamber of Commerce President.

Superferry CEO John Garibaldi says despite protests, legal challenges and even mother nature, his company is committed to Hawai`i.

The Hawai`i Superferry has been out of service since Sunday because of bad weather, but the company confirmed on Wednesday the ship needs repairs.

Hawai`i Superferry officials confirm there are "surface cracks" involving two "auxiliary rudders" on the back end of the ship.

The Superferry canceled all voyages to Maui Sunday because of bad weather and it has not sailed since.

Now, the Superferry confirmed inspections performed while the ship was dockside uncovered the surface cracks.

The investigator determined that the vessel wasn't in compliance due to these cracks.

The cracks need to be repaired before the vessel can sail safely.
