SUPERFERRY FAILS TO ADDRESS PUBLIC CONCERNS

After publicly announcing efforts to “reach out” to Kaua`i, Hawai`i Superferry officials have yet to point at specific plans, prompting concern among legislators who say they expect more than empty promises.
Though Hawai`i Superferry President John Garibaldi has had meetings with Kaua`i government leaders such as Rep. Hermina Morita and Sen. Gary Hooser — he met with both of them at the Capitol last week — Hooser said more focus should be placed on reaching out to residents. Garibaldi also has an upcoming meeting with County Councilwoman JoAnn Yukimura.
“(Garibaldi) needs to meet with community leaders, not government leaders,” Hooser said. “The perception out there is that the government messed this up.”
Hooser said during his approximate half-hour meeting with Garibaldi, Garibaldi didn’t offer any specifics of how he would execute Hawai`i Superferry’s plan to meet with any constituents bearing Superferry-related concerns.
Hooser added that since the meeting, he hasn’t had follow up from any Superferry officials.
“I’m having doubts about the effort,” Hooser said. “I haven’t heard or seen anything....”

POLICE STATE COMES TO MAUI FOR SUPERFERRY SECURITY ZONE
WAILUKU » Vessels and surfboards could be confiscated and forfeited and violators could face up to 10 years in prison if a security zone around the Hawai`i Superferry is breached during its transit into Kahului Harbor, the Coast Guard warns.
A felony conviction could also result in a criminal fine of up to $10,000 and civil penalties of up to $32,500 for each violation, the Coast Guard noted yesterday as it issued its security guidelines for the ferry's return to Maui.
The Coast Guard, along with state, federal and county agencies, plans to enforce a security zone around the Superferry at Kahului Harbor beginning with its startup on Dec. 6.
A protest rally has been planned for Dec. 8 by some groups, including Maui Tomorrow, the Sierra Club and the Pacific Whale Foundation.
Maui Tomorrow Executive Director Irene Bowie said the rally will be peaceful and was scheduled for a Saturday to make attendance easier for those working during the week.
Bowie said the security zone is broader than she expected and appears to include the small boat launch, surfing areas and places where people go diving for octopus.
"This looks pretty heavy-handed coming to an island with no civil disobedience," Bowie said. "I'm stunned by the heavy-handedness of this. I think with this there's going to be a lot more people alienated."

The independent Nation of Hawai`i was a multi-ethnic country before being illegally overthrown and occupied by the US.
The illegal US occupation continues to this day.

WEDNESDAY IS KA LA KU`OKO`A -
HAWAIIAN INDEPENDENCE DAY
In the Kingdom of Hawai`i, November 28 was an official holiday called Ka La Ku`oko`a, or Independence Day. This was the day in 1843 when England and France formally recognized Hawai`i's independence.
His Hawaiian Majesty King Kamehameha III deemed it prudent and necessary to dispatch a Hawaiian delegation to the United States and then to Europe with the power to negotiate treaties and to ultimately secure the recognition of Hawaiian independence by the major powers of the world.
The Hawaiian delegation, while in the United States of America, secured the assurance of U.S. President Tyler on December 19, 1842 of its recognition of Hawai`i, and then proceeded to meet Sir George Simpson in Europe and secure formal recognition by both Great Britain and France.
As a result, the Hawaiian Kingdom entered into treaties with the major nations of the world and had established over ninety legations and consulates in multiple seaports and cities.
But in 1893, an illegal intervention into Hawai`i's affairs by the U.S. resulted in a "fake revolution" against the legitimate Hawaiian government, and a puppet oligarchy set itself up with its main purpose being Hawai`i's annexation to the United States.
Hawaiians protested and celebrated Ka La Ku`oko`a anyway, telling the story of the national heroes who had travelled to Europe to secure Hawai`i's recognition.

PEOPLE POWER & THE SUPERFERRY ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE
This coming Saturday the Superferry resumes service to Maui.
Ignoring everything but the smell of money, the Linda Lingle administration has forced the Superferry fiasco on Hawai`i, its people and environment.
But who will have the last word?
With winter swells, the design of Kahului harbor and the arrival of between 7,000 to 9,000 humpback whales into waters off Maui, things could play out far differently than Superferry backers expect.
The Superferry has already broken free of some of its mooring several times just while tied up in Honolulu harbor.
Then there’s the residents of Kaua`i.
Officials have not dared announce resumption of Superferry service to Nawiliwili harbor and for good reason.
No one knows what will happen when the ship attempts to return there.
One thing we do know – the people who love their land have stood up and delivered a clear message - they do not want this ship coming back.
We can expect that will continue to be the case not only on Kaua`i and Maui, but also Hawai`i island as Superferry officials attempt to establish service there soon.

One day at the Royal Hawaiian Shopping Center where he worked, Uncle Helemano noticed an old kahili, the feathered standards of old Hawai`i, in need of repair.
He decided he would take it upon himself to learn the skills in order to repair it.
And that’s how Uncle became one of Hawai`i’s best-known contemporary kahili makers.
Naturally when we sat down with him to talk story, he told us some amazing things including who the very first kahili really were.
He also told us kahili marked parameters in the old days when ali`i were present, since ancient Hawai`i had no flags.
We saw right away there’s a lot more to it, since for Uncle creating kahili is not just about passing the culture down through the generations, “it’s also about a positive message to our people.”

KAUA`I GROUP APPEALS SUPERFERRY RULING
Environmental attorneys for 1,000 Friends of Kaua`i may have stumbled upon a statute to make the Hawai`i judiciary rethink its barring of certain arguments against the Superferry.
That’s at least the hope, according to documents drafted by attorneys Greg Meyers and Dan Hempey, who filed a motion Nov. 13 appealing a September ruling by Circuit Judge Randal Valenciano.
Valenciano said in his ruling that 1,000 Friends couldn’t rely on the argument that the Hawai`i Superferry needed an environmental assessment, stating the statute of limitations had expired.
As a result of that ruling, 1,000 Friends of Kaua`i could have relied on two other arguments - one, whether the Superferry posed a nuisance; and two, whether the Superferry’s proceeding with service was constitutional....
They then asked the County Council to consider adopting an ordinance calling the arriving cars a nuisance, as, according to HRS 46-17, the county could trump the state in such an instance....
Under that law, the council of any county can adopt and provide for the enforcement of ordinances regulating or prohibiting noise, smoke, dust, vibration, or odors which constitute a public nuisance, it continues that in any case of conflict between a statute or rule and an ordinance, the law affording the most protection to the public shall prevail....

ILLEGAL US OCCUPATION OF THE HAWAIIAN KINGDOM
An independent neutral nation, the Hawaiian Kingdom, was invaded and overthrown by the US, a foreign state.
Since then the US has unlawfully occupied Hawai`i for over 114 years.
In January 1893, John L. Stevens, the US ambassador to Hawai`i conspired with 13 civilian businessmen to seize control of the Hawaiian Islands.
He proceeded to have 164 marines, armed with rifles and canon, disembark from the USS Boston. They camped and set up their canon to direct fire against Queen Lili`uokalani’s Palace.
The US declared Hawaiian nationals US citizens.
Yet, Hawaiian nationals never consented to their nation being ceded to the US, the loss of their Hawaiian nationality, nor to becoming US citizens.
In fact, all treaties between the Nation of Hawai`i and the United States of America including the treaty of Friendship, Commerce, Navigation and Extradition of 1850 have never been lawfully terminated.
The US established the “Committee of Safety,” later the “Provisional Government,” and finally the “Republic of Hawai`i.”
They remained in power only by the presence and threat of the US military.

FORMER OFFICE OF HAWAIIAN AFFAIRS TRUSTEE SPEAKS OUT AGAINST SUPERFERRY
There seems to be no limit to what they'll do to make corporate profiteers comfortable!
Is it not a crime to override two court decisions, both the State Supreme and lower court, and call a special session of the State Legislature to cater to arrogant Superferry Corporation owners?
The uncaring Hawai`i State Government has refused to protect our 'aina (land) and ocean, and has circumvented the requirement that the law be followed with an EIS (Environmental Impact Statement)....
Yet Kaua`i people who felt "backed against the wall" by the cavalier attitude of Superferry and the State going against the Supreme Court ruling are being chastised and accused of lacking the Aloha Spirit for their practice of Aloha `Aina (love of land) and for protecting their `aina and homes on Kaua`i....
The Governor's proposed "Unified Command" threatens protesters with a Coast Guard flotilla - this smacks of police state tactics.
Those citizens who question and protest these proceedings are further intimidated with the threat of child endangerment charges should their surfer teenager end up as part of the protest.
This Superferry gang and Governor Lingle will apparently go to any legal and extra legal lengths to undermine Judge Cardoza and the State Supreme Court's prudent rulings....
We don't want the urbanization, concrete jungle and freeway traffic jams of `Oahu....
The Superferry President and CEO, John Garibaldi, had already stated that they will not go slower than 37 knots (over 42 mph or about 60 ft per second.)
This is twice as fast as any current large ocean going vessel within these Islands.
The Superferry's route is within Maui's whale calving waters and is sure to slash and kill any whale on impact with the Catamaran's knife like hulls, according to expert testimony in Judge Cardoza's court.
It is not that we are against the Superferry and having alternative transportation between our Islands - we are positively against Superferry and the State Administration not protecting us - the People - and our natural resources.

Is it not a crime to override two court decisions, both the State Supreme and lower court, and call a special session of the State Legislature to cater to arrogant Superferry Corporation owners?
The uncaring Hawai`i State Government has refused to protect our 'aina (land) and ocean, and has circumvented the requirement that the law be followed with an EIS (Environmental Impact Statement)....
Yet Kaua`i people who felt "backed against the wall" by the cavalier attitude of Superferry and the State going against the Supreme Court ruling are being chastised and accused of lacking the Aloha Spirit for their practice of Aloha `Aina (love of land) and for protecting their `aina and homes on Kaua`i....
The Governor's proposed "Unified Command" threatens protesters with a Coast Guard flotilla - this smacks of police state tactics.
Those citizens who question and protest these proceedings are further intimidated with the threat of child endangerment charges should their surfer teenager end up as part of the protest.
This Superferry gang and Governor Lingle will apparently go to any legal and extra legal lengths to undermine Judge Cardoza and the State Supreme Court's prudent rulings....
We don't want the urbanization, concrete jungle and freeway traffic jams of `Oahu....
The Superferry President and CEO, John Garibaldi, had already stated that they will not go slower than 37 knots (over 42 mph or about 60 ft per second.)
This is twice as fast as any current large ocean going vessel within these Islands.
The Superferry's route is within Maui's whale calving waters and is sure to slash and kill any whale on impact with the Catamaran's knife like hulls, according to expert testimony in Judge Cardoza's court.

LINGLE ADMINISTRATION IGNORES FACTS ON SUPERFERRY

Kahului Harbor is renowned for being a place where you can surf inside the breakwater.
Berth 2C sits right in the path of wave-making swells churning through the entrance channel.
That’s where the Superferry barge was moored last week until it broke a chain and cable mooring and began slamming against the pier.
The state brought in the barge to allow vehicles to drive from the Superferry’s vehicle deck down to the pier. From the beginning, it was thought the barge would have to be moved during storms.
Last week’s event indicates it will have to be moved more than occasionally.
The situation is just one more example of how the state failed to think through its support for the ferry.
Due to the state administration ignoring environmental law, the $300 million operation has been sailing against a wind that has included a lawsuit, appeal to the Hawai`i Supreme Court, special session of the Legislature, weeks in Maui’s 2nd Circuit Court and months of emotional debate.
There’s one more piece of legal business to wind up.
Judge Joel August has ordered the ferry cannot put more than two vehicles a minute on Puunene Avenue to limit traffic congestion....

While Linda Lingle and her cohorts may have temporarily succeeded in circumventing US law, she has certainly not defeated the people who live here and love their land.
Ironically, the more chicanery they attempt, the more people they turn off.
The Hawai`i State Auditor has now gotten into the act wanting to know how the entire Superferry fiasco was pulled off.
Naturally the Lingle administration is being less than forthcoming with answers.

EXPECT WORST FROM SUPERFERRY'S SPEED

A month of testimony by experts in Judge Joseph Cardoza's court produced evidence that whales would be in great danger if the Superferry was allowed to go any faster than 12-13 knots when traveling in waters less than 100 fathoms.
The governor has issued a "condition" that allows the ferry to go 25 knots, double the safe speed, inside the whale sanctuary.
That's like allowing a huge truck to go 60 miles per hour in a residential zone where the speed limit is 30.
Any doubts about what will happen?

NEW SUPERFERRY LAW SETS NEW PRECEDENT

Do precedent-setting decisions mean anything?
In law, it's a "judicial decision that may be used as a standard in subsequent similar cases - (as in) a landmark decision that set a legal precedent."
It seems as though a large number of people on Kaua`i and Maui were concerned about circumvention of Hawai`i's environmental laws, while Gov. Linda Lingle, who championed Hawai`i's sustainability a few short months ago, assisted the Superferry in going around those same laws.
And that sets a precedent.
If you don't like Hawai`i's laws just convince the governor, or whoever is in charge, to see things your way and compliance isn't necessary.
As Jeff Mikulina said in his press release on Oct. 31, "If a three-decade old environmental law is scrapped for a single company, how are we to expect lasting policy decisions that sustain Hawai`i's future?"

I can't help but notice the similarities between what is happening with the Superferry and the situation simmering in Kailua, O`ahu.
With the exception of the environmental overtones, it's really about the same thing.
The ferry had to deal with protesters in the water, and the Windward residents had to deal with gates, rocks, bushes and trash bins, but the intent and message is the same "Keep them out!"
All globe manufacturers should modify their newest model globes by stamping in big, bold, red letters onto the Hawaiian Island chain the words "SOLD OUT."

The committee will consider and deliberate on the information it gathered during briefings and open session meetings convened in August and September 2007, addressing the "The Native Hawaiian Government Reorganization Act of 2007,'' also known as the Akaka bill.
It's very important for everyone who can to attend to show their opposition to this legislation.
Members of the public are entitled to submit written comments.
However comments must be received in the Western Regional Office by November 25, 2007 and mailed to 300 North Los Angeles Street, Suite 2010, Los Angeles, CA 90012.

I have no sympathy for the position that Hawai`i Superferry is being destroyed by overregulation and an unfriendly business environment in Hawai`i.
The Superferry is in an uncomfortable financial position now because it tried to circumvent the EIS -- had it complied, it would now be operating with no problems.
Why rewrite laws to allow the Superferry to operate before the completion of the EIS?
It shouldn't be rewarded for trying to break the rules in the first place.

SHOW YOUR SUPERFERRY & AKAKA BILL OUTRAGE ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE
Well there’s plenty happening this week on several fronts.
First, Maui Judge Joseph Cardoza will hear arguments this Wednesday from environmentalists on why the injunction he placed on the Superferry should not be lifted before an environmental impact statement is completed.
Naturally Superferry officials and the Linda Lingle administration are working overtime trying to get it lifted as quickly as they can regardless of the impact to the `aina (land,) the people of Hawai`i or marine life.
The only impact they’re considering is their pocketbooks.
Watch for a special announcement on Free Hawai`i TV late Tuesday on how you can watch the court proceedings live no matter where on earth you live.
Then on Thursday, the US Civil Rights Commission comes back into town to hold another hearing on the Akaka bill.
While the public will not be able to offer verbal testimony, it’s vitally important for everyone to attend to show your opposition to this bill – and remember to bring your anti-Akaka bill signs to hold up.

Mo’s been involved with Nu`alolo Kai archaeological work and Na Pali Coast `Ohana since 1996, and is primary author of both the archaeological inventory report and preservation plan for this amazing site.
Even when family obligations required Mo’s return to the family homestead in Virginia, he continued volunteering with Na Pali Coast `Ohana - collaborating by internet on short and long-term strategies, plans and reports.

SUPERFERRY TO CREATE SUPER TRAFFIC JAMS
WAILUKU, Maui — Even if a Maui court injunction is lifted next week, allowing the Hawai`i Superferry to resume sailing to Kahului Harbor, there remains a separate court order on traffic control that would present "a very big, big problem" for the ferry, said a state attorney.
The order by Maui Circuit Judge Joel August required that only two vehicles per minute to exit from the ferry site on the north end of Pu'unene Avenue, about 20 yards from one of the island's busiest intersections.
When the company's 350-foot catamaran, Alakai, came to Maui on Aug. 27 — the last time it sailed to Kahului — it took 55 minutes to get the nearly 90 disembarking vehicles onto public roads instead of the 20 minutes predicted by ferry officials.

SUPER FORCE TO GUARD SUPERFERRY
The Coast Guard believes it has the vessels and crews it needs to secure Kahului and Nawiliwili harbors if protesters again turn out when Hawai`i Superferry resumes service.
People who were present for the Kaua`i protests in August are predicting many demonstrators.
While the Coast Guard will not discuss specific steps it plans to take when service resumes, Coast Guard Lt. John Titchen said the plan may involve support from Coast Guard units on the Mainland....
Rich Hoeppner, chairman of People for the Preservation of Kaua`i, said he "definitely" believes protests are more likely on Maui and Kaua`i in the wake of last week's special session.
The fact that lawmakers essentially reversed a court ruling that an environmental assessment had to be completed before the Superferry can operate has fueled some of the anger....

Who are the backers rich enough to disrespect judicial ruling?
Bush cronies, military interest, and local corporate deities like Steve Case, ML&P's man behind David Cole.
This issue represents the door for corporate power, allowing big money to control our state in a most fascist way.
What is blind justice weighing on her scales? Is it truly the balance of power? Is it the system of checks and balances?
No, it is the Superferry on one plate and the money of invasive corporate checks on the other.
If locals don't welcome corporate interest with smiling brown faces of aloha, I believe the powers that want to be, will initiate a crisis of some sort to force the use of this super troop transport.
Federal powers can create any kind of situation to as a means to acquire its goal of control. Our governor seems all about national aspirations and could possibly create any threat necessary to ascertain her goals.
With the violent capabilities of Bush's administration, can terroristic, biological, or insurgent suppression be quickly dismissed? Carrying soccer teams and tomatoes inter-island is a pink cloud in front of a dark diesel smokescreen....

CROWDS TURN OUT FOR SUPERFERRY PROTEST

For the 250 demonstrators at Nawiliwili Park yesterday, it wasn’t just about the Superferry coming back to Kaua`i, it was how the Superferry bill came to be.
“The most upsetting thing to me is the process,” said demonstrator Andrea Brower of Aliomanu. “It was so undemocratic, so illegal and is undermining the most important environmental law....”
The judge’s decision was based on environmental laws that we have. Every time the Legislature doesn’t like the judge’s decision, it will be challenged as unconstitutional....
...Tim Swanson of Kapa`a feels people, including the local government, haven’t been taking care of what we have and aren’t ready for more people to come to the party.
“Our highways, our beaches and our roads, they’re not taking care of it, not putting money into it,” Swanson said. “The people of Kaua`i haven’t been taking care of Kaua`i like they should be. We don’t need people here until we can take care of Kaua`i....”
...Before supporters could take to the sea to participate in a water protest, demonstrator Auntie Louise gathered the crowd closer so she could give pule.
“We’re here to stand against the injustice of the legal process that has happened,” Auntie Louise said. “We’re here to protect the `aina (land.”)
Demonstrators then navigated their surfboards, canoes and kayaks down the jetty rocks to the water to gather in the middle of Nawiliwili Harbor in solidarity with demonstrations happening at the same time on Maui, O`ahu and the Big Island.

IT'S NOT JUST ABOUT THE SUPERFERRY ANYMORE

...Both sides of the Hawaii Superferry issue surprisingly agree on some important points.
Most important is that the conflict and dissent stem from larger issues than the ferry venture itself. It has become a touchstone, or more aptly the last straw, bringing out central issues regarding who we are as an island society.
Some of these issues, such as neighbor island attitudes towards O`ahu, have not been aired in such a public way in modern times, if at all.
The coming of the ferry struck a chord that has resonated so loudly it has brought together many disparate groups in protest and has left everyone else thunderstruck.
...In this way the ferry has made more relevant to the general population the same central issues as Native Hawaiian aspirations for sovereignty.
It has always been a tenet that there is a place for non-Hawaiians in sovereignty models for the future. But that place has always been vague.
The dramatic narrative of the ferry has shown that many of the most valid cultural claims of native Hawaiians are very similar to those that non-native groups are embracing in defense of their communities from the ferry.
As one Hawaiian activist commented to the press, "The protesters at Nawiliwili were there to protect the concerns of the kanaka. It wasn't just brown skin anymore...."

GEARING UP TO STOP THE SUPERFERRY ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE
A fight is rounds, and what we’ve seen so far with the Superferry is just the first two or three.

HAWAI`I'S POLITICIANS - BEST SUPERFERRY SUPPORT $$$ CAN BUY!

Hawai`i Superferry officials spent more than $175,000 over three years on lobbying and campaign contributions, including dozens of donations to Gov. Linda Lingle, U.S. Sen. Daniel Akaka, U.S. Rep. Neil Abercrombie and other key state legislators.
An Advertiser computer-assisted study of state and federal campaign records shows that the Superferry, its executives and several of its board members contributed more than $39,000 since 2004 to local lawmakers and members of Hawai`i's Congressional delegation.
A review of state and federal ethics filings also found that the Superferry spent more than $136,000 since 2004 to lobby state officials and the federal government.
"You're talking about an extremely large sum of money even by national standards," said Craig Holman, a campaign finance expert with Public Citizen, a Washington, D.C.-based consumer advocacy group.
"At the very least, they are trying to buy access, and at the worst they are trying to buy influence."
