OFFICE OF HAWAIIAN AFFAIRS AUDIT ADVANCES

A key Senate committee yesterday advanced a resolution urging state Auditor Marion Higa to conduct a financial and management audit of the Office of Hawaiian Affairs, following more than three hours of testimony for and against the action....


Senators said the suggestion for an audit came from growing calls from constituents who question OHA's expenditures and want more accountability from an agency established to benefit Native Hawaiians.


"This was brought to us by the beneficiaries," said Sen. Jill Tokuda, D-24th (Kane`ohe, Kailua), who chairs the Agriculture and Hawaiian Affairs Committee that voted 4-0 in favor of the resolution.

Looking at trustees sitting in the audience, she said: "Step back for a moment and think about who called for this...."

Legislators Hold Hearing For Start Of Special Audit

The state Legislature is considering a special audit of the Office of Hawaiian Affairs because of questions about whether the agency "is adequately managing its affairs and financial resources...."


Both Republicans and Democrats said OHA is facing more questions because of its aggressive advertising campaign for Kau Inoa, the native Hawaiian registration program, and forming limited-liability companies for projects.


"I have asked questions for years about their expenses for lobbying and Kau Inoa and have always been stonewalled," complained Sen. Sam Slom (R, Diamond Head-Hawai`i Kai).


"You have former and present trustees who can't find out where the information is and where the money is going.


"Too many people think they are feathering their own nest and doing well by doing good for themselves.

"Let's find out," Slom said.

"ONE SIZE DOES NOT FIT ALL," SAY SUPERFERRY OPPONENTS

LIHU`E — About 120 Kaua`i residents met with state Department of Transportation officials yesterday and most opposed the return of the Hawai`i Superferry to the Garden Isle.


The Superferry began service between O`ahu and Kaua`i in August but was soon turned back by protesters on surfboards and in kayaks who blocked the entrance to Nawiliwili Harbor.


More than six months later, opposition remains strong here, at least from those who attended two meetings yesterday at Kaua`i Community College.


The speakers were concerned about the safety of whales and other marine life, the transport of invasive species from island to island, traffic and crime....


The two meetings yesterday were intended to give Kaua`i residents an opportunity to ask questions about the environmental assessment the state is conducting with the help of consultant Belt Collins.


At one meeting, Sandra Herndon said she was among Kaua`i residents who petitioned Gov. Linda Lingle for an environmental study regarding the Superferry two years ago.


"What I'd like to ask now, if it is possible for Belt Collins to deliver an independent study," Herndon said, adding that the company seemed to be "intertwined with the Superferry corporation."


The economic model that assumes Hawai`i will need more large harbor space "to continue to import all its food and goods" will crumble under the rising price of oil, said architect and planner Juan Wilson, representing the organization Island Breath.


The state needs improvements in small harbors for fishermen and small boats, "not a 40,000-horsepower, 40 mph football field," Wilson said....

UPDATE! - CEDED LANDS BILL HEARING

The Ceded Lands Settlement hearing will in fact not take place tomorrow, Monday, March 24th at the Hawai`i state capitol building.


We are now told a committee meeting will quietly take place sometime next week after the language in the House and Senate bills are rectified.


Rep. Kirk Caldwell will reportedly chair this meeting they hope to keep out of the public’s eye.


We wish to draw your attention to an important nine page agreement, signed on January 17th of this year by the Office Of Hawaiian Affairs, Governor Linda Lingle, Attorney General Mark Bennett and former Hawai`i Supreme Court Justice Robert Klein.


This agreement will have the force of contract between OHA and the state should the Ceded Lands Settlement bill pass.


It contains the language where OHA waives all future claims on behalf of beneficiaries.

Despite overwhelming opposition from practically the entire Hawaiian community, the Office of Hawaiian Affairs is still trying to get the Hawai`i legislature to resurrect the Ceded Lands Settlement bill.


Why would OHA go against the wishes of everyone? We’ll get to that in a minute.

First we need to ask all of you to turn out tomorrow, Monday, March 24th at the Hawai`i capitol building to once again voice your opposition to this swindle.

The hearing will be in room 414 at 2:45 PM. Please plan to be there.

SUPERFERRY NOT WELCOME ON KAUA`I - PERIOD!

Kaua`i opponents will not be welcoming the Hawai`i Superferry any time soon.


Yesterday about 150 people came to Kaua`i Community College for two public meetings held as part of the environmental impact study being done by contractor Belt Collins. Every speaker said the Superferry's ship, Alakai, should not return until the study is finished.

And a vast number of speakers, both in the afternoon and evening sessions, said that no matter what Belt Collins issues as part of its report, the company and the state's credibility will always be questioned, and the ship will not be welcome.

"This is a sham," said Rich Hoeppner. "I guarantee you if the ferry comes to Kaua`i, that ferry will never get back to its dock at Nawiliwili."

Hoeppner, part of the Thousand Friends of Kaua`i group that sued the Superferry and the state over the environmental study process, said that hundreds have told him they will swim out to block the ship's return, despite repeated threats from the U.S. Coast Guard and the state.

"That's not a threat," he said between the meetings. "That's a guarantee."

OFFICE OF HAWAIIAN AFFAIRS NOT GIVING UP ON CEDED LANDS BILL

Less than 24 hours after a stunning defeat for the state Office of Hawaiian Affairs before the Legislature, supporters of the proposed $200 million ceded lands settlement, including OHA officials themselves, held out hope that the agreement could be salvaged during the remaining month-and-a-half of the legislative session.


Meanwhile, opponents of the proposal said yesterday that OHA officials need to spend more time talking to the agency's beneficiaries after the legislative session to get the agency's priorities right.


After five hours of testimony, three major committees of the state Senate voted Monday night to shelve the plan, which would have had the state transfer three parcels valued at $187 million, $13 million in cash and at least $15 million annually, to OHA as its share of revenues derived from ceded lands.


In exchange, OHA and other Hawaiians would no longer be able to make further claims to those revenues.


Those opposed to House
Bill 266 said Monday that the measure was giving up too much for too little and that it would have additional ramifications....

But OHA Administrator Clyde Namu`o said agency officials want to talk to Senate President Colleen Hanabusa and House Speaker Calvin Say to see if there's still any chance of the settlement passing this session.

HERE'S HOW HAWAIIANS FEEL ABOUT THE SALE OF THEIR STOLEN LANDS

I'm writing in regards to (Bill 2733) OHA's dirty hands in land transfer (in the form of a Ceded Lands Settlement)which does much more then dispossesses all Hawaiians from our (kanaka maoli) Ceded Land Trust assets.

It hinders our right as a Nation that of which has been illegally occupied by America and currently undergoing political land trade-offs of coersion and theft...

Neither the State of Hawai`i, the U.S, nor OHA have the right to decide to resolve Native claims to the Ceded Lands Trust and all of its assets. It is not resolved until it is back in the hands of our nation (the Hawaiian Kingdom...)

Until the sovereignty of our nation is established, those lands should not be up for grabs by any State or US entity.

Those lands, assets there upon and it's resources and biodiversity which belongs to the Hawaiian people and we are not represented by OHA and it's lack of integrity...

OHA Trustees are not the leaders of our Independent Nation and do not have the permission of "all" Hawaiians to sign off claims to Native Hawaiians Land, Resources and Assets...

The nation doesn't deserve 20% of revenues of Ceded Lands Trust.

We own it and would like the State of Hawai`i to pay 100% of the revenues it has earned in the past back to the kanaka maoli so we can get our people off the beaches and all Hawaiians will never have to struggle again...

8 REASONS WHY YOU SHOULD OPPOSE THE OFFICE OF HAWAIIAN AFFAIRS CEDED LANDS SETTLEMENT

The proposed Ceded Lands Settlement Hearings will be this coming Monday, March 17th at 2:45 pm in Hawai`i state capitol - Room 414.

It's very important to attend and demand that the bill be killed.

OHA's strategy is to forego sovereignty completely, and enrich itself on the backs of future generations and our grassroots struggle.

Please plan to attend and speak out.

5. For several weeks Hawaiians have requested that OHA provide the valuation reports and other documents (Phase 1 & 2 Real Estate reports) on the status of the lands, and valuation figures and formulas used in the settlement. This data has not been provided to the legislature or native beneficiaries.

6. There is evidence the Kalaeloa land is contaminated and toxic. The settlement demonstrates the parties know of this problem but OHA has agreed to accept the land, pay trust assets to conduct an environmental due diligence effort and then return the land or get a 25% credit once the toxicity is proven. Why is OHA taking toxic land?

7. Under this measure Hawaiians will not be able to sue OHA for accountability. OHA has waived our right to sue the state and all of its agencies including themselves. The Legislature should take note the Hawaiian peoples have been excluded from the legislative and legal discussions relating to this measure. Legislative hearings will be over before the "informational sessions" which the Senate forced on OHA are completed.

Negotiations took place in secret, and the valuations reports and data regarding the figures have been withheld. OHA is soliciting letters of support from its grantees, not its beneficiaries.

Finally, the OHA video pushing the settlement features Aunty Gladys Brandt calling for unity and justice. This manipulation is intended to dupe Hawaiians into believing that Aunty Gladys supported this travesty. In reality, she died years before this shameful settlement was conceived by the current OHA trustees (Rowena Akana excluded).


8. The settlement is fatally flawed -

A. The waiver language and the provisions relating to res judicata should be deleted from the measure;


B. A reservation clause should be added that states that all claims of Native Hawaiians against the state relating to the Ceded lands trust are reserved and that the scope of the settlement is only for claims relating to revenues owed to OHA from 1978 - 2008.

Hawaiians do not need to reserve claims against the US as the settlement does not involve the US or federal claims. Hawaiians know who owns the Ceded Lands - it belongs to the public and the Native Hawaiians under the Admissions Act.

C. All references to a prospective figure for OHA revenue share (15 million) should also be deleted until OHA and the Governor can justify the figure. We are entitled to 20% of the 5(f) revenues;


D. Any prospective agreement should be subject to reopening and recalculation every 5 years in order to ensure that Hawaiians benefit from the increase in value, revenue and proceeds of the public land trust.

1. The Settlement dispossesses Hawaiians of our Ceded Lands trust assets. OHA has negotiated a small package of land and revenue for itself and has agreed to relinquish all claims of our peoples to 1.8 million acres of land, the submerged lands, energy resources, biodiversity and surface and subsurface natural resources.

2. The settlement is supposed to resolve claims to "the portion of income and proceeds from the lands of the public trust for use by OHA" Settlement Agreement (SA), pg. 1 of 9 from 1978 - 2008. In return for the settlement, OHA waives or gives up, not only claims to the income from 1978 -2008, but "...any other tangible right, item or benefit from the public land trust." (SA, pg. 2 of 9). OHA is giving up these rights not only for OHA, but for "any other person or entity."


3. OHA's waiver of claims is res judicata for all Hawaiians, their organizations and nation - this means that we will never be able to sue the state or OHA for our trust lands, revenues or other rights including an accounting and inventory of our trust assets. This language is so broad and sweeping that Hawaiians will lose rights not related to the OHA 20% pro rata debate. Other rights that Hawaiians claim to the public trust include HRS 7-1 rights (access and gathering), rights to worship at heiau on 5(f) lands, genetic resources, etc. These rights will now be ignored by the State.


4. Under Hawaiian law OHA is entitled to 20% of the Ceded Land revenues. There is no relation between the 20% figure and the 15 million dollar figure. The figure appears to be an arbitrary amount. In addition, the legislative bill deletes all statutory language relating to the Hawaiians share (20%) of revenues. This theft of revenue from Hawaiians is based on the claim of OHA that the courts overruling of Act 304 also overruled the OHA 20% share of proceeds. This is false - in January, 2008, the Hawaiian Supreme Court ruled in OHA vs. HCDH that the State cannot dispose of Ceded Lands trust assets without resolving native claims - the court cited the Apology Bill, the DOI (Department of Interior) Mauka to Makai report and OHA's claims for 20% (see pg. 6 of the Opinion).

MORE SUPERFERRY SECRETS THEY DON'T WANT YOU TO KNOW

The Lingle administration has been resisting a legislative auditor's investigation into how the state exempted the Hawai`i Superferry from the need for an environmental impact statement.

The law that authorized the Superferry to sail also called for the auditor's investigation and for the Lingle administration to cooperate.

"We have encountered significant delays and a variety of roadblocks in conducting our audit task," legislative auditor Marion Higa said.

The attorney general's office had said that it would only turn over documents that were not protected under the attorney-client privilege laws and has been reviewing documents.

Lingle declined yesterday to talk about the letter, saying she did not know about it.

“Hale Halfway – Monument To Activists – A Visit With Soli Papakihei Niheu”

People were concerned about longtime Hawaiian political activist Soli Papakihei Niheu.

In poor health and living in an old one-room structure in Waimea, his friends knew he needed something better.

So they decided to act. They collected contributions, both money and materials, and soon had enough resources to build him a new house.

That’s when Soli stepped forward to let them know he didn’t want a house.

Instead he wanted the one thing missing in Hawai`i that’s common throughout most other islands in the Pacific - a hale halawai.

Similar to the Maori marae in Aotearoa, (New Zealand,) hale halawai is a formal meeting place to receive and host visitors from far and wide, through Hawaiian protocol and hospitality.

Soli saw his hale halawai as a place to host sovereignty movement activists from all over Te Moana Nui – The Polynesian Triangle.

Because Soli had dedicated his life to serving others, they knew they now had to do the same thing for him.

So they built it for him.

SUPERFERRY PROTEST CASES DISMISSED

Government Threats Turn Out To Be Paper Tiger


The Garden Island - March 7, 2008


Charges against one of the last defendants to be arrested during the Aug. 26 and 27 protests of the Superferry at Nawiliwili Harbor has been dismissed, his attorney yesterday said.


Fourteen people were arrested on charges related to the protests, including four juveniles.


Fifth Circuit Court Judge Randal Valenciano dismissed the case against Randy Wolfshagen, 50, of Kekaha, with prejudice.


Wolfshagen, a surfer, had been charged with second-degree criminal trespassing and obstruction of government property.


Defense attorney Michael Soong said he and his client were prepared to go to trial March 25 but said the complaint was defective. Prosecutors agreed.


“From an investigation point of view it was the kind of a situation where nobody knew who did what,” Soong said.


“From my side, (prosecutors) did the right thing in not pushing the case further.”

GROUPS APPEAL TO GROUND SUPERFERRY

Honolulu Advertiser - March 1, 2008

WAILUKU, Maui — Three groups yesterday filed an appeal of a Nov. 14 court ruling upholding a new law that allowed Hawai`i Superferry to operate while an environmental review is undertaken....

The company's 350-foot, high-speed catamaran has been in drydock for maintenance and repairs since Feb. 13 and is expected to return to service March 25....


"We have been heartened and encouraged to go forward with this appeal by so many people throughout the state contacting us and offering both moral and financial support," said Irene Bowie, executive director of the Maui Tomorrow Foundation.


She said supporters include People for the Preservation of Kaua`i, 1000 Friends of Kaua`i, Surfrider Kaua`i and Sierra Club-Kaua`i Group.

CEDED LANDS ARE STOLEN LANDS ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE

The ceded lands bill controversy continued for another week with the Office of Hawaiian Affairs trying their best to convince Hawaiians it’s a good deal.

But people are not that easily fooled.

It’s never a good deal when you’re talking about stolen property to begin with.

As one testifier stated, “The proposed changes to the law and transfer of certain land and money assets keeps the status quo of State control of the “ceded lands” (through the state agency, OHA), while pretending to have made compensation for the stolen lands.

The State’s solution for stealing a Kingdom is to generously give it to itself!”

MAUI TRIES TO STOP SUPERFERRY RETURN

WAILUKU -- Hawai`i Superferry opponents filed an appeal today of a court decision that has allowed the 350-foot ferry to operate while the state prepares an environmental assessment of ferry-related Kahului Harbor improvements.


The Maui Tomorrow Foundation, Sierra Club and the Kahului Harbor Coalition have successfully argued in court that an environmental assessment is required for the ferry.

Now the ferry opponents contend that Act 2 unconstitutionally circumvents Hawai`i's environmental law and is aimed at helping a single business.


"It was special legislation, and we felt it was not a correct interpretation of Hawai`i's environmental law," said Irene Bowie, executive director of Maui Tomorrow.


Because of damage to an auxiliary rudder, the Superferry's Alakai has been in drydock for weeks and is not expected to return to service until March 25.


"Once Hawai`i Superferry is out of drydock and begins to operate, the threat of actual irreparable harm to multiple endangered and protected resources returns," said plaintiff attorney Isaac Hall.
