IN MEMORIAM -
KOANI FOUNDATION DIRECTOR KAI`OPUA FYFE DIES

































Kai`opua Fyfe served continuously until his death as a director of the Kaua`i based Koani Foundation since being appointed by Founder John ‘Butch” Kekahu III prior to Butchʻs own passing in late 2001.

As a descendant of Hawaiian ancestors who signed the Ku`e petitions, he was a strong proponent of a Free Hawai`i and an end to the illegal occupation of Hawai`i by the US.

On behalf of the Koani Foundation, Kai`opua focused on the international arena promoting awareness, and building support for resolution of a broad range of Hawai`i issues: in Bonn, Germany, at the 9th Conference of the Parties to the Convention on Biological Diversity; in Geneva, Switzerland, before the Human Rights Council, the Committee on the Elimination of Racial Discrimination, the Human Rights Committee, the International Covenant on Civil and Political Rights, the Working Groups on Indigenous Populations and Expert Mechanism, the Human Rights Sub-Commission; and participated with the UN Institute for Training and Research on Conflict Prevention and Peace-Building.

Kai`opua was active for many years at the annual UN Permanent Forum on Indigenous Issues in New York City, and partnered these opportunities with informational expeditions to Capitol Hill.  In Brisbane, Australia, he served as the Human Rights Rapporteur for the UNPFII 2nd Pacific Consultation and, in Aotearoa, attended UN hearings on violations of Maori Foreshore and Seabed Rights.

He participated in Aloha Marches in California and Massachusetts, and was also co-host of Voices Of Truth, One-On-One With Hawai`i’s Future, the Koani Foundation’s award-winning weekly television show.

Kai’opua was a Charter Member of the Native Hawaiian Education Council, having served on the Executive Board, and as Chair of the Kaua`i / Ni`ihau Island Council.  In this capacity, he participated in World Indigenous Peoples Conferences on Education in Aotearoa-New Zealand; Calgary, Canada; and Hilo, Hawai`i; and at National Indian Education Association conferences in Indian Country.

Kai’opua was also a past President of his extended `Ohana and former Chair of its Kona Heritage Committee, dedicated to the protection and perpetuation of cultural sites and traditional protocol.  Both of his maternal great-grand mothers, and numerous other relatives of their era, signed the Ku`e Anti-annexation Petitions of 1897.  His grandfather and mother served in the territorial legislature.

In the Hawai’i State Legislature Kai`opua served as clerk of the Senate Hawaiian Affairs Committee.  He was the elected Lihu`e, Kaua`i Delegate to the `Aha Hawai`i `Oiwi, the Native Hawaiian Convention.  He was a student, trainer and facilitator of strategic planning and collaborative leadership for Native Hawaiian community-based development.

He returned full time to Hawai`i in 1986 and lived in Lihu`e.

He will be sorely missed.

GRASSROOT INSTITUTE SEEKS EVIDENCE OF WAIHE`E'S NATIVE HAWAIAN ROLL CLAIMS

The Grassroot Institute of Hawaii filed an Information Act request with the Native Hawaiian Roll Commission seeking substantiation of claims made by Roll Chairman John Waihe`e III that suggested near-unanimous consent by individuals whose names were transferred from other lists in the building of the Roll itself.

Waihe`e's comments were made during an interview with Hawai`i News Now on Feb. 23, 2015 that explored a recent lawsuit filed against the Roll Commission for its failure to comply with an information request for the Roll. 

In the report, Waihe`e says that the approximately 80,000 individuals added to the Native Hawaiian Roll via the Kau Inoa list were asked if they wanted their names removed and adds that, "Ninety-nine percent of the people said, 'No! Keep our registration.'"

Keli`i Akina, Ph.D., President of Grassroot Institute, states, "Our request for information is made on behalf of all Native Hawaiians and citizens of the State of Hawai`i to hold a government agency transparent and accountable. 

The Native Hawaiian Roll Chairman has made claims that must be documented in order for the public to know the truth about how their money is being spent and whether individuals whose names were automatically transferred to the Roll from other sources gave their consent. 

Furthermore, if the Roll contains names of individuals who have not truly registered, its claim to represent the will of the Hawaiian people becomes questionable."

The process by which the Native Hawaiian Roll has been assembled thus far has been a cause of controversy and confusion. 

In the effort to shed some light on the issue, the Grassroot Institute of Hawai`i has issued a request under the state's Uniform Information Practices Act seeking substantiation for Chairman Waihe`e's remarks. 

The request seeks records that support Waihe`e's statement that, "the Native Hawaiians added to the Native Hawaiian Roll via the Kau Inoa List were (1) asked if they wanted their names removed; and (2) that in Waihe`e’s words “99% of the people said, ‘No, keep our registration.'"

NATIVE HAWAIIAN ROLL SLAPPED WITH LAWSUIT FOR LACK OF TRANSPARENCY 
Roll Commissioners Refuse To Disclose Names On Roll

HONOLULU, HAWAII-- After repeated efforts by the Grassroot Institute of Hawaii and non-profit government watchdog group Judicial Watch to obtain a copy of the Native Hawaiian Roll (Kana'iolowalu), Judicial Watch and former Hawaii Attorney General Michael Lilly are filing suit to compel the Native Hawaiian Roll Commission to release the list to the public. The lack of cooperation and stall tactics employed in the effort to avoid compliance with state transparency laws raise serious concerns about the activities of the Commission as well as the Office of Hawaiian Affairs.

The Native Hawaiian Roll, established in 2011 by Legislative Act 195 and administered by OHA, aims to create a voter list for an "aha" (constitutional convention). Enrollment in the Native Hawaiian Roll is limited to individuals of Native Hawaiian blood who complete an affidavit affirming "the unrelinquished sovereignty of the Hawaiian people."

According to Keli'i Akina, Ph.D., president of the Grassroot Institute, “After more than two years of enrollment efforts by OHA and the Native Hawaiian Roll Commission, the vast majority of Native Hawaiian people have chosen not to participate and many have serious concerns over the way the Roll has been compiled. There are numerous questions concerning the tens of thousands of names that have been placed on the list without the express permission of individuals, particularly those who provided their names to lists such as Kau Inoa which does not affirm ‘unrelinquished sovereignty.’ Other questions concern the process by which substantial numbers of prisoners have allegedly been added to the list.”

Dr. Akina continues: "The integrity of the process demands transparency so that Hawaiian groups and the public can hold the state agency OHA and the Native Hawaiian Roll Commission accountable. In addition, we are seeking, through a separate request, a full and accurate accounting of the financial transactions of the Roll Commission. Hawaiian beneficiaries and the general public deserve not to have this information withheld from us."

Judicial Watch President Tom Fitton said, “Our litigation is important to uncovering potentially improper activities by a state agency that is classifying Hawaiians by race in a way that violates the U.S. Constitution. This issue is of national importance, as politicians in Hawaii and in Washington DC would put divisive racial politics before the rule of the law.”

Judicial Watch, in cooperation with the Grassroot Institute, first requested a copy of, “the complete enrollment list,” from the Roll Commission on August 8, 2014. On September 4, 2014, they received a response signed by Kanaiolowalu Executive Director Clyde Namuo, denying that request on the grounds that the work of the Commission was ongoing and there was no “complete enrollment list.” In an interesting coincidence, the Roll was also reopened at this time.

Although this was clearly an effort to dodge the request, Judicial Watch issued a revised request that took into account Mr. Namuo’s evasions. In a letter dated September 25, 2014, Namuo again denied the request, citing the ongoing work of the Roll as justification for his refusal to provide either the enrollment list or any documentation related to the decision to reopen it.

As it was clear that the Roll Commission had no intention of making its actions transparent, Judicial Watch appealed to Hawaii’s Office of Information Practices (OIP). The Office of Information Practices agreed that the grounds cited by the Roll for denying the request for the enrollment list was questionable. Believing that this information should be revealed to the public, Judicial Watch initiated Court proceedings to compel the disclosure of the requested information.
