A BRAZEN ATTACK ON THINGS HAWAIIAN

Why is the attorney general of Hawai`i issuing a subpoena for documents belonging to a Hawaiian-Environmental Alliance?
KAHEA is a grassroots group opposing, in part through civil disobedience, the development of the proposed Thirty Meter Telescope on Maunakea, and it has been fighting subpoenas in court.
Advocates for Hawai`i nonprofit organizations say that the subpoena “seems to be a pretext to attack an organization that may not share the same point of view as the investigating agency.”
KAHEA has objected to the subpoenas, and the case ended up in the First Circuit Court this week, where the judge punted the case back to the opposing parties.
The attorney general claims KAHEA has violated laws regulating nonprofits by supporting alleged illegal protests.
Another charge, that the group has been late in filing its financial reports, was essentially dismissed out of hand by First Circuit Judge James Ashford, who remarked, “It’s a little hard for me to get excited about the Form 990 oversight.”
KAHEA’s attorney says the subpoenas are a politically motivated overreach that violates the free speech rights of the protestors.
It turns out that the attorney general has also issued subpoenas to the Office of Hawaiian Affairs, which helped fund the protests, and to Hawaiian Airlines to try to get names of people who donated frequent flyer miles to the protestors.
Leaders of the Hawai`i Association of Nonprofit Organizations (HANO) called “foul” in a recent op-ed for Hawai`i’s Civil Beat. They went on to note that this kind of move taints the cooperative relationship forged to date between nonprofits and state regulators:
Actually, it’s a surprise the judge did not quash the measure in its entirety.

For many years, the nonprofit community in Hawaii has worked alongside the AG to safeguard Hawai`i’s charitable assets to foster an environment under which both charities and their regulator maintain a healthy nonprofit ecosystem. This cooperative effort has helped Hawaii’s nonprofit community to be better stewards of their charitable assets.We’ve seen this type of unconstitutional overreach employed before when the rights of indigenous people come up against corporate interests.
Recent actions by the AG, however, threaten that ecosystem by introducing doubt regarding the motivations of regulatory actions.
While we support the protection of our state’s charitable resources, we disagree with the idea that a legitimate nonprofit organization’s participation in nonviolent protest, assisting those that are, or free expression, should be grounds for investigation. The targeting of organizations expressing opposition — and in particular, to government—is undemocratic and erodes our civil society. This is not what Hawai`i Alliance of Nonprofit Organizations and the nonprofit sector stand for.
Actually, it’s a surprise the judge did not quash the measure in its entirety.

JUDGE APPEARS WILLING TO OK HARASSMENT OF MAUNA KEA SUPPORTERS
A Circuit Court judge today said he was inclined to allow the state Attorney General’s office to subpoena financial records of a non-profit group devoted to Hawaiian issues, including raising funds to provide bail and other support for people opposed to the planned Thirty Meter Telescope atop Mauna Kea.
Judge James Ashford, however, had concerns about the scope of the Attorney General’s subpoena and gave attorneys on both sides until Feb. 7 to reach agreement about how much financial information should be disclosed about KAHEA: The Hawaiian-Environmental Alliance.
During today’s hearing to consider whether to quash the Attorney General’s subpoena of 18 different requests of KAHEA information held by First Hawaiian Bank, Ashford said he was inclined to allow the Attorney General’s office to obtain information regarding nine areas, such as monthly statements, cancelled checks and loan applications.
But Ashford had concerns about other First Hawaiian Bank information sought by the Attorney General’s subpoena, including surveillance photos taken from ATM machines.
While Ashford did not rule on KAHEA’s request to quash the subpoena, his comments represented a victory for the Attorney General’s office, which has faced off against KAHEA in two contested cases that went before the Hawaii Supreme Court over Mauna Kea.
The Attorney General’s office previously issued a subpoena to Hawaiian Airlines seeking the names of people who donated their frequent flyer miles so protesters could join the protest at Mauna Kea; and subpoenaed the Office of Hawaiian Affairs, which had provided portable toilets, rubbish collection and other amenities at the protest camp at the base of Mauna Kea Access Road, according to a memorandum filed by KAHEA attorney, Richard Naiwieha Wurdeman.
In nearly 45 minutes of arguments, Wurdeman told Judge Ashford that the subpoena is “unreasonable, oppressive and overly broad” and would have the “chilling effect” of stifling donations to support the TMT protest.
Wurdeman repeatedly called the Attorney General’s effort “a fishing expedition.”

June 21 is a day for Solstice Ceremonies and is very significant as we all know and recognize to many peoples around the world.
What an auspicious day to be assigned to come together for Mauna Kea and in that spirit we ask for prayers and support as we present the oral arguments addressing the decision of the Board of Land and Natural Resources to grant the construction permit to build the 18 story Thirty Meter Telescope on the Northern Plateau of the mountain following the second contested case hearing.

KAHEA CALLS FOR PLDC REPEAL

One of Hawaii’s environmental groups is calling for the repeal of the Public Land Development Corporation.
KAHEA: The Hawaiian-Environmental Alliance has issued a press release saying that the new development arm of the Hawaii Department of Land and Natural Resources, “should be repealed because it promotes the sale and improper use of public lands, including ceded lands.”
Issued by Jon Osorio, a KAHEA board member and well-known UH professor of Hawaiian Studies, the statement continues -
"It improperly exempts the state from many of the important laws that are meant to be a way for the state to carry out its public trust duty to protect our precious resources. We believe there are no rules that can “fix” the PLDC to restore protections to our public trust resources and ceded lands. The PLDC simply must be repealed."
