"BARBARIAN" PRINCESS MOVIE
Denigrating Slur Used

Marc Forby, the writer and director of the "Barbarian Princess" movie, claims that he is using the term "barbarian" in the title only to attract more viewers and that he doesn't mean to offend anyone. This is a specious excuse.

In the 19th century, the term "barbarian" was intentionally used to denigrate, demean, mock and injure its intended target, in this case, Princess Ka`iulani.

It was a racial/ethnic slur in the same way the N-word is used by Americans today.A slur is a slur. It is particularly offensive when it is being used to promote box-office receipts.

Shame on Marc Forby and shame on the people who accept his smooth-talking jive.

If Forby cannot grasp that the very title of his movie is a direct affront to Ka`iulani (and all Hawaiians) then and now, how can we think that his movie won't likewise smear the truth?

BACK DOOR LAND GRAB HURTS HAWAIIANS WHILE DEVELOPERS PROFIT

The Lingle administration campaigned on a pledge to cut the waiting list for leases at the Department of Hawaiian Home Lands.


But the plan has turned out to be a back-door land grab by commercial and development interests.

Governor Lingle has proceeded by cutting funding for the agency and forcing DHHL to rely on income from commercial leases, most of those to non-Hawaiians.

THE EFFECTS OF OVER A CENTURY OF U.S. OCCUPATION OF HAWAI`I

Hawaiians suffered since the first Western contact in 1778.

Western diseases, to which Hawaiians had no immunity, decimated their numbers.

At the time of western contact, some 800,000 people inhabited the Hawaiian Islands. By 1805 that number had been halved.

By 1853 there were only 71,000 Hawaiian or part-Hawaiian people in the islands. Within 100 years of western contact, Hawaiians had been reduced by nearly 90 percent.

Today the numbers of people who claim some native Hawaiian ancestry have increased to over 400,000.

But only 239,000 live in Hawai`i. They are the poorest segment in the state.

They make up 37 percent of the state's homeless population, according to a 2003 survey.

US HAS NO LEGAL STANDING IN HAWAI`I

According to a story in the Maui News Feb. 10, "State Lawmakers are considering passage of legislation that would require people seeking driver's licenses to prove that they're legally in the United States."


If passed, the state of Hawai`i could never issue another driver's license. From a standpoint of law absolutely nobody in Hawai`i - resident aliens, US citizens, even the state itself - "can prove they're legally in the United States."


The California Assembly could pass the same legislation and not run into these problems. This is because the the Guadalupe Hidalgo treaty of 1848 transferred Mexico's title to the United States, thereby making California legally part of the US
.

The United States Congress twice rejected treaties proposing the annexation of Hawai`i. They opted to "annex" Hawai`i by joint resolution. Being a domestic law, no resolution other than one ratifying a treaty has any effect on an international level. For instance, Congress cannot annex Russia without Russia's consent.


U.S. Public Law 103-150 admitted that "the indigenous Hawaiian people never directly relinquished their claims to their inherent sovereignty as a people or over their national lands to the United States, either through their monarchy or through plebiscite or referendum."


Since the sovereignty of Hawai`i was never relinquished, Hawai`i is not legally part of or "in the United States."

AKAKA BILL REINTRODUCED INTO US CONGRESS

US Senate and House sponsors introduced the Akaka bill today which would create a process to legitimize the illegal overthrow of the Hawaiian Kingdom.


The legislation, if passed, would perfect all land title in Hawai`i, seal the theft of lands seized during the overthrow, and legally cover over all illegal acts by the US both during the overthrow and during the fake statehood vote in 1959.


There would be no legal recourse for recovery.


The Akaka bill would also designate native Hawaiians as "indians" or wards of the US federal government and place them on reservations.


Felons currently incarcerated in US federal prisons also enjoy the status of wards.


Typically native peoples who enter into such an agreement with the US federal government end up with less than two percent of their lands, little money and no legal recourse for recovery.

And they make up 37 percent of the state's homeless population, according to a 2003 survey.
