…The Biden administration is poised to settle this problem by federally recognizing a Native Hawaiian government in a similar process to that which it does American Indian tribes….

The situation in US Congress is not promising. The Democratic-controlled US Congress looks poised to complete the colonial settlement. Senator Brian Schatz from Hawai`i is now the chairman of the Senate’s Indian affairs committee, and in his first meeting hosted discussion about federal recognition. His position is one that the Native Hawaiian senator Daniel Akaka previously held while advocating for the Native Hawaiian Government Reorganization Act. The Akaka Bill, as it was called, suggested that it could reconcile US participation in illegally overthrowing the Hawaiian Kingdom’s government.

While Democrats largely support federal recognition – as reconciliation for past harms in Hawai`i – Republicans grumble that Native Hawaiians aren’t American Indians and aren’t, therefore, eligible for tribal governance. The question “Are Hawaiians Indians?” continues to be debated, exasperating conservatives and liberals alike, yet it exposes the manipulation of federal Indian law and policy in an ongoing process to settle US possession of Hawai`i.

The thief returns to the scene of the crime asking for forgiveness but refusing to return what they stole.

Recently elected Native Hawaiian US representative Kai Kahele, like Senator Schatz, supports federal recognition, despite his own community’s opposition. Congressman Kahele is being courted by Representative Deb Haaland – who affirmed a commitment to Native Hawaiian issues during her Senate confirmation hearing – to take over her seat as co-chair of the Congressional Native American Caucus. With the posturing of Schatz and Kahele, the political landscape is ripening for a new bill to come to fruition….

Kana'iolowalu Moves into "Nation-Building" -

Two weeks ago, the Office of Hawaiian Affairs (OHA) called a press conference and made a big public announcement that, following the “success” of Kana`iolowalu (the Native Hawaiian Roll consisting of Native Hawaiians who are US Citizens), OHA is funding/facilitating the next phase: to convene a constitutional convention this Fall to discuss the future form of a Native Hawaiian governing entity. Then, by the end of the year, they intend to have a vote (by those on the Kana`iolowalu list) to choose what form of governance to adopt for a US Citizen/Native Hawaiian nation.

Over the years OHA and the State of Hawai`i agreed to fund several “nation-building” initiatives. The most prominent was the "Akaka Bill" debacle; a 15-year campaign for the US Congress to grant "federal recognition" to Native Hawaiians as an American Indian tribe.

But, before the Akaka Bill, there was the Native Hawaiian Convention (Aha Hawai`i `Ōiwi), the product of years of preparation: electing delegates from each island, extensive community meetings, creating governance models to be considered at a Native Hawaiian constitutional convention, etc. 

But when the state realized that there was a strong possibility that Aha Hawai`i `Ōiwi would choose the independence model, the state suddenly yanked the funding, essentially freezing the process in place. Since then, every other OHA/State-funded governance initiative got its plug pulled whenever it arrived at favoring independence.

OHAʻs Neutral Stance on Governance?

OHA also announced at the recent press conference, that during this new nation-building initiative, it was going to be “neutral,” not advocating for any particular outcome like they did for 15 years where they spent around $20 million (in beneficiaries’ money) to push for the now-defunct Akaka Bill. 

OHA’s new position of neutrality should be treated with skepticism. As a state agency, OHA is hard-wired to an integration, nation-within-a-nation, American Indian tribe model (such as the Akaka Bill (and now, Kana`iolowalu).
    
OHA made their "neutrality" announcement two weeks ago. But a week later (last week), OHA chair, Colette Machado; trustee, John D. Waihe`e, IV and OHA attorney, the former Hawai`i State Supreme Court Justice Robert Klein made a secret trip to Washington, DC to talk to the US Department of Interior (DOI), the US Federal agency that oversees the affairs of American Indian Tribes. Also present were: John D. Waihe’e III (the former governor and current chair of the Native Hawaiian Roll Commission); OHA Washington lobbyist Dennis Dwyer and other prominent state players.

What were they doing at the DOI? Apparently, to make another attempt to strike a back-door deal for (US) "federal recognition" as an Indian tribe. 

Maybe they thought that by getting federal recognition right now, they could circumvent their own “Native Hawaiian Constitutional Convention” that they just announced the week before! 

A few days later, at a so-called “governance” conference in Honolulu, when confronted about the secret meeting with the DOI (even other OHA trustees did not know about it), chair Collette Machado admitted and repented that they had made the trip.

So much for OHA’s profession of "neutrality"! Old habits are hard to break.

Hawaiian Nationals Resolution -

Good News! On Wednesday, March 19 the Hawaiian Nationals Resolution (House Resoulution 178) passed the first committee hearing unanimously. Even though one word is a little awkward, itʻs something we can live with because the rest of the resolutionʻs text comprise a solid declaration of the sovereign status of nationals and that of the Hawaiian Kingdom.

HR 178 (and its companion HCR 226) now go to the House Finance Committee for another hearing. Perhaps there, we can amend the resolution to the exact wording that would suit us best. But either way, should the legislature pass this resolution, it will have a dramatic effect on protecting Hawaiian Nationals from discrimination and cause the state to respect our Hawaiian Kingdom nationality as legitimate.

Diplomatic Progress -

At the UN in Geneva, Switzerland -


Two weeks ago, I was a panelist on two side events ("Self-Determination and Decolonization" and "Human Rights and Impunity") at the 25th Session of the Human Rights Council. It went very well and stimulated follow-up meetings and discussions about partnering with several other unrepresented nations seeking liberation from occupation and colonization.

While there, I also participated in challenging the US Periodic Report to the 110th Session of the Human Rights Committee. We continued to press the US delegation to account for how the Hawaiian Islands came to be a domestic "state" of the U.S. in 1959. Thatʻs always a tough one. We also continue to request various UN human rights bodies to look in to the matter.

At the UN in New York -

In New York, we had a significant breakthrough for our newly formed advocacy/mutual support group, the Decolonization Alliance.  The main purpose of the alliance is to encourage the UN General Assembly to pick up the pace in helping to liberate captive nations by actively pursuing reform and re-activation of the UN decolonization process. Those involved are nations pursuing independence, such as Hawaii, West Papua, Rapa Nui, Alaska, and original nations of Turtle Island, South America, Australia and so forth (the list is growing).  

We are gearing up for a launch of the alliance at an event in conjunction with a major UN conference in May.

WHAT DOES HAWAI`IʻS FUTURE LOOK LIKE ?

Since Kana`iolowalu, the Native Hawaiian Roll is not the answer, what is?

Can the US really help create a bright future for the Hawaiian Nation? What solutions will benefit all residents of Hawai`i?

Hawaiians want and deserve freedom just as much as US citizens do.

Some say, “the illegal act of war that overthrew your Queen can’t be erased . . . like it or not, you’re all Americans now.”

But, every day we see people around the world fighting for, and winning back their native and national rights. Their quest, and ours are totally legitimate and very real.
Like everyone else, Hawai`i Nationals want four basic things –

FREEDOM The freedom to decide their own future for themselves. That “freedom” was taken away when the sovereign Nation of Hawai`i was overthrown in 1893. It was taken away again by illegal annexation to the United States in 1898. And, it was taken away a third time by the fake statehood vote in 1959.

According to international law, a new vote must to be taken that offers three options – 1) Independence, or 2) Free-Association or 3) Integration (nation within a nation.)

RIGHTS The rights of the independent Nation of Hawai`i were never relinquished. The destruction and denial of these rights must cease. Everyone who descends from citizens of the Hawaiian Nation prior to 1893, regardless of race, are entitled to these rights.

IDENTITY The political identity of Hawai`i Nationals must be acknowledged by the United States. They will decide their own future, without interference by the US. And, only those with any measure of indigenous blood may define who is native Hawaiian. A blood quantum imposed by the US is an unacceptable means to divide and conquer.

LAND BASE - Hawai`i Nationals love their country and lands just as much as US citizens love the US. Hawaiians want all their land back, not just some of it.

HAS SOMEONE STOLEN YOUR FAMILY'S CAR?

Your family car is like the sovereignty of the Hawaiian Kingdom.

Your car would make anyone wealthy who could occupy it.

The theft is clearly unlawful, even against the their own laws and constitution.

So after generations of denying and obfuscating the issue, the thieves finally admit they stole your car.

They concede that it's really not their car (Apology Bill, US law 103-150,) that they really don't have any title to it, but they declare how much they love the car, and how the grandchildren of the victims can't operate the car anymore anyway.

They also say since they have had the stolen car for so long, they now have a claim to it.

They have even repainted the car (Statehood) and done some maintenance.

And now they want to compromise.

They offer the grandchildren (you) the hubcaps, and when the you refuse, they try and offer you the wheels (Hawaiian Homelands.)

Then they tried to trick you by offering to let you drive the car on Sundays (Kanai`olowalu and the Native Hawaiian Roll.)

Whoever gets title to the car is vastly wealthy.

That's why they've tried to brainwash you, telling you there is no title to the car anymore.

Yet valid title does still exist and international law as well as Hawai`i and US laws say the car still belongs to you and your family.

What does it take to get it back?

Demand the entire car back. Then jump in the driver's seat and drive away.

WHAT WENT WRONG? - THE APOLOGY BILL 20 YEARS LATER

Statement Of The Committee of Hawaiian Nationals - `Iolani Palace November 23, 2013

Apologizing for an offense is only a meaningless gesture if it is not followed by sincere efforts to resolve the offense. 

So far, the United States has done nothing but use the Apology against the interests of the Hawaiian people, and in particular Hawaiian Nationals. This has to stop.

On the 20th anniversary of the Apology Law, the Committee of Hawaiian Nationals calls upon the President of the United States, the US Congressional Delegation from the US State of Hawai`i, the Governor of the US State of Hawai`i, the Legislature of the US State of Hawai`i, the Office of Hawaiian Affairs of the US State of Hawaii and all other officials of the US State of Hawai`i and the United States of America, to take substantive actions to remedy the 120-year offenses for which it apologized.

The only proper and just remedy would be for the US to end its unlawful occupation of the Hawaiian Kingdom.

Therefore, we call on the United States and the US State of Hawai`i to provide an honest, workable exit strategy, including a timetable, for a peaceful, graceful withdrawal from the entire Hawaiian Archipelago, which comprise the lawful territories of the Hawaiian Kingdom.

We call for the immediate adoption of Hawaiian Kingdom laws to be administered in the Hawaiian Islands during the period of transition and execution of the US exit plan.

We call for an end to the discrimination and persecution of Hawaiian Nationals living in the Hawaiian Kingdom.


Furthermore, we call upon the international community, particularly Hawaiian Kingdom treaty partners, to assist in assuring a peaceful and orderly transition into a Free Hawai`i.

Pilipo Souza of The Committee of Hawaiian Nationals states, “The US apology basically said, ‘sorry for stealing your nation,’ but the Apology purposely avoided providing any remedy, and the US for the past 20 years has refused to engage in any meaningful dialog for reconciliation.”

Committee member Leon Siu adds, “Instead of returning our country, the US is trying to further subdue the Hawaiian people by offering to turn “Native Hawaiians” into a ‘federally recognized’ Native American Indian tribe. This is not reconciliation, this is subjugation. This is not freedom, this is bondage.”

HOW THE US PLANS TO STEAL THE HAWAIIAN NATION THRU THE NATIVE HAWAIIAN ROLL

By their own laws the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent.


They and the fake state of Hawai`i have never had "Clear Title" since Jan 17, 1893.
They have all known this for a long time.

The only way the United States will ever be able to get clear title to the Hawaiian Islands is if Hawaiians give it to them.


This is why title to the Hawaiian Islands never transferred to the United States by the Newlands resolution.


The Newlands resolution relied on a treaty of Annexation from the republic of Hawai`i. But the republic never owned title because the Kingdom of Hawai`i never gave it to them.


But now they have a plan - they're going to get Hawaiians to give title to them.


How Will They Do That?


Theyʻve tried to convince a majority of Hawaiians to sign onto Kana`iolowalu.
That failed.


So now theyʻre trying to get US President Barack Obama to issue an executive order recognizing Kanaka Maoli, or ethnic Hawaiians as an American Indian Tribe.

"Leaders" (Robin Danner and other sell-outs) will head that Hawaiian tribe and create a "Native Hawaiian Governing Entity."

They will then attempt to get Hawaiians to elect officers to that government.


They are going to make sure those governing documents give the officers of the government the authority to give away title in negotiations.


They are going to get those that signed Kana`iolowalu to vote for the new governing documents to reorganize the Hawaiian "government."


That "government" although not authorized and approved by the majority of Hawaiians is going to sit down at the negotiating table with the United States and trade land title for cash and benefits.


Many people believe that only the Kingdom of Hawai`i is authorized to give a way title to the Hawaiian Islands,and they are correct, but only as long as the kingdom remains intact.


Kana`iolowalu is only the bait. The hook is the formation of a new government and the negotiations between the US and the new government.

As long as Hawaiians don't bite the bait, the hook is harmless.

Kana`iolowalu is not intended to settle any claims. It does not tell Hawaiians, but asks them to form a government that can and will extinguish Hawaiians claims.

WOULD A FREE HAWAI`I NEED A WHOLE NEW GOVERNMENT?

There's no need to create a new government when a perfectly good and lawful one — the Hawaiian Kingdom — continues to exist.

Although it has been greatly impaired by unlawful suppression and layers of fraud, the sovereignty of the Hawaiian Kingdom was never lawfully extinguished.

Therefore, there is no justification to contrive a new government to replace the Hawaiian Kingdom unless the people, the lawful subjects/citizens, called Hawaiian Nationals, decide they want to alter or change their government.

No one other than Hawaiian Nationals can make that determination — not the US government or foreign US citizens residing in Hawai`i, or the fake State of Hawai`i, the Office of Hawaiian Affairs, or the Akaka Bill’s proposed phony Native Hawaiian Governing Entity.

Because the Hawaiian Kingdom is in continuity, there is no lawful way to alter or replace that existing government except through the processes provided in the existing lawful constitution of the Hawaiian Kingdom.

Prior to the Hawaiian Kingdom being taken over by insurgents during the illegal US invasion in 1893, Hawai`i had already been functioning for decades as a nation-state under one of the best constitutions in the world.

The United States’ prolonged occupation does not change the fact that the constitutional government of the Hawaiian Kingdom, the one in place from 1840 to 1893, is still the one and only lawful and indisputable government for the Hawaiian Islands.

The United States is a usurper, and has no lawful jurisdiction in Hawai`i.


Since the Hawaiian Kingdom was never extinguished, its constitution, laws, statutes and policies are still intact.

HAS SOMEONE STOLEN YOUR FAMILY'S CAR?

Your family car is like the sovereignty of the Hawaiian Kingdom.

Your car would make anyone wealthy who could occupy it.

The theft is clearly unlawful, even against the their own laws and constitution.

So after generations of denying and obfuscating the issue, the thieves finally admit they stole your car.

They concede that it's really not their car (Apology Bill, US law 103-150,) that they really don't have any title to it, but they declare how much they love the car, and how the grandchildren of the victims can't operate the car anymore anyway.

They also say since they have had the stolen car for so long, they now have a claim to it.

They have even repainted the car (Statehood) and done some maintenance.

And now they want to compromise.

They offer the grandchildren (you) the hubcaps, and when the you refuse, they try and offer you the wheels (Hawaiian Homelands.)

Then they offer to let you drive the car on Sundays (Kanai`olowalu and the Native Hawaiian Roll.)

Whoever gets title to the car is vastly wealthy.

That's why they've tried to brainwash you, telling you there is no title to the car anymore.

Yet valid title does still exist and international law as well as Hawai`i and US laws say the car still belongs to you and your family.

What does it take to get it back?

Demand the entire car back. Then jump in the driver's seat and drive away.
