THE REAL ISSUE IN THE CEDED (STOLEN) LANDS CASE

Hundreds Show Up To Protest - Only Hawaiian Kingdom Patriots Nail The Truth

About 300 people converged on the state Capitol yesterday and urged the Lingle administration to back off its legal claim that the state has the right to sell ceded lands.

In a case that supposedly places the state against the state Office of Hawaiian Affairs, Gov. Linda Lingle and her administration are appealing a unanimous ruling by the Hawai`i Supreme Court in January that the state cannot sell or otherwise transfer ceded lands until Native Hawaiian claims against the land holds were resolved.

Yet only a handful of protestors actually described the issue accurately.

"These are stolen lands, we're clear on that," Native Hawaiian practitioner Andre Perez said to the crowd. "I want my land back. I want my country back."

TODAY IS KA LA KU`OKO`A - HAWAIIAN INDEPENDENCE DAY

In the Kingdom of Hawai`i November 28 was an official holiday called Ka La Ku`oko`a, or Independence Day. This was the day in 1843 when England and France formally recognized Hawai`i's independence.


His Hawaiian Majesty King Kamehameha III deemed it prudent and necessary to dispatch a Hawaiian delegation to the United States and then to Europe with the power to negotiate treaties and to ultimately secure the recognition of Hawaiian Independence by the major powers of the world.

The Hawaiian delegation, while in the United States of America, secured the assurance of U.S. President Tyler on December 19, 1842 of its recognition of Hawaiian independence, and then proceeded to meet Sir George Simpson in Europe and secure formal recognition by Great Britain and France.

As a result of this recognition, the Hawaiian Kingdom entered into treaties with the major nations of the world and had established over ninety legations and consulates in multiple seaports and cities.

November 28 was thereafter established as an official national holiday to celebrate the recognition of Hawai`i's independence.


But in 1893, an illegal intervention into Hawai`i's affairs by the U.S. resulted in a "fake revolution" against the legitimate Hawaiian government, and a puppet oligarchy set itself up with its main purpose being Hawai`i's annexation to the United States.

Hawaiians protested and celebrated Ka La Ku`oko`a anyway, telling the story of the national heroes who had traveled to Europe to secure Hawai`i's recognition.

- Hawaiian Independence Day to remember that Hawai`i was a fully recognized member of the world family of nations, and its independence is still intact under prolonged illegal occupation.

Plunge Could Mean Cuts To Needy Hawaiians


The stock investment portfolio for the Office of Hawaiian Affairs shrank by 27.9 percent during the first 10 months of 2008, 12 percent during October alone.

The immediate impact is a hiring freeze, but the agency may be forced to cut money for programs in future budgets.

OHA is one of numerous multimillion-dollar agencies, organizations and businesses dealing with dramatic shifts in the stock market and the tough economic times that are forcing sweeping cutbacks.

In 1893 the Hawaiian Kingdom was at Peace, unlike United States going to wars with the indigenous people of the North American continent and other indigenous people all over the world.

WHO REALLY OWNS LAND TODAY IN HAWAI`I ?

Land Titles Issued Today Are Very Much In Doubt -


"Clear Title," regarding legitimate legal ownership of land in Hawai`i is a topic quickly becoming an issue in the political and commercial areas.

With more lands being "quiet titled" in the courts with the aid of foreign laws (USA and state of Hawai`i) illegally imposed against the rightful and legal owners of these lands with a judicial system aiding and abetting in these crimes, it's no wonder developers are eager to build hundreds of new luxury homes on La`au Point on Molokai and elsewhere.

To this day, land titles in Hawai`i continue to carry the original "royal patent" from the Mahele of 1848.

If The US Government or state of Hawai`i and their citizens rightfully have "clear title" to these lands, then why has the US patent not replaced the royal patents as was done in 49 other states?

Answer - Each royal patent has been "adjudicated," making them all a legal decree.When purchasing land, a "warranty deed" is issued instead, not clear title per se.

It's no different than if someone steals your car and attempts to sell it to someone else - they can't convey the "pink slip" to the new owner because they never had it in the first place - they're simply selling stolen property.

That's Why There Is No Clear Title To Land In Hawai`i

SUPERFERRY COSTS SINK STATE BUDGET

A request for $414,284 in repairs to the docking barge for the Hawai`i Superferry to land at Kahului Harbor will exhaust the state harbors appropriation for ferry-related improvements, Deputy Transportation Director Mike Formby said Friday.


Funds for additional projects required to modify state harbors to accommodate the Superferry "will come from somebody other than the state," said Formby, who heads the Harbors Division.

TROUBLES MOUNT FOR SUPERFERRY

The Hawai`i Superferry has dismissed Terry O’Halloran, its director of business development, and Duane Kim, manager of Maui operations.


Superferry spokeswoman Lori Abe said the company doesn’t “publicly discuss specific personnel actions” but added that it “made some realignments last week in the port, maintenance and engineering, and business development areas that affected a small number of people.”


Meanwhile an appeal by Maui opponents of the ferry is scheduled for a Dec. 18 hearing before the Hawai`i Supreme Court. The opponents are challenging the state Legislature’s Act 2, passed in October 2007, which allows Superferry to continue operations while an environmental impact statement is being conducted.

SUPERFERRY INVESTOR LEHMAN BESET BY FINANCIAL PROBLEMS

Superferry investor John Lehman’s wealth has probably been cut by a third to half by the recent stock market crash.

Money that he had last year to keep throwing at the Superferry, he may feel he doesn’t have to waste anymore.

Austal, the Superferrys’ manufacturer, has spoken recently about commercial ferry operators running into difficulties recently on financing.

Until recently, the Stewards of Waimea Valley had respected OHA as "a Hawaiian organization" but having also observed "OHA's culture of secrecy, OHA's political patronage system masquerading as an open and fair grant and procurement process, and OHA's manifest neglect of the needs of the Hawaiians they were created to serve", the Stewards now take the position that the Office of Hawaiian Affairs is a State Agency and that the trustees must begin to conduct its business as such.

SUPERFERRY CUTS SCHEDULE & RAISES FARES FOR REMAINING SHIP

Expansion Plans Turn Out To Be All Wet


The Hawai`i Superferry recently announced a delay in delivery of a second ship that was to have sailed between O`ahu and Hawai`i island.

Now the Maui News reports the Superferry is also trimming the schedule for its remaining vessel on the Oahu-Maui route and hiking some prices as it switches to a "fall schedule," according to a company spokeswoman.
