ALASKA & HAWAI`I DELIGHTED WITH
PAKISTAN’S REQUEST AT UNITED NATIONS
UNITED NATIONS, GENEVA - The Koani Foundation, as a member of the Alaska-Hawai`i Alliance for Self-Determination, is delighted by the request made by the Islamic Republic of Pakistan to the United States delegation at the Universal Periodic Review of the United States of America on Monday, 11 May 2015 at the UN headquarters in Geneva, Switzerland.
This simple intervention by Pakistan clearly indicates that the situations of Alaska and Hawai`i are matters of international law specifically pertaining to decolonization.
What Was The Question?
Pakistan simply asked the United States to: “Respond to the suggestion made by the Special Procedures in paragraph 69(n) of report A/68/284 regarding the cases of Alaska, Hawai`i and the Dakotas.“ This was in reference to the 2013 report to the UN General Assembly by Dr. Alfred deZayas the UN Independent Expert on the promotion of a democratic and equitable international order, where he recommended the Decolonization Committee be receptive to communications from indigenous and non-represented peoples.
What Does It Mean?
Pakistan’s intervention recognizes that the situations of Alaska and Hawai`i are within the context of international law as opposed to US domestic law. This recognition by a State makes it possible for Alaska and Hawai`i to access, at the international level, procedures and mechanisms like the Decolonization Committee, to exercise their right to self-determination.
Position Of Alaska & Hawai`i -
The peoples of both Alaska and Hawai`i maintain that their countries were never lawfully annexed or otherwise acquired by the United States of America and that the US concealed this fact to mislead the UN General Assembly and subvert its decolonization process. The US falsified referenda in Alaska (1958) and Hawai`i (1959) and, using this “manufactured consent,” misled the world into believing the people of Alaska and Hawai`i chose to become “federal states” under the domestic laws of the United States.
Ambassador Ronald Barnes Of Alaska Stated -
“We are very happy with this development at the Universal Periodic Review for the United States of America (US UPR). The official document of the Office of the High Commissioner on Human Rights (OHCHR) in paragraph 86 of the Summary issued for the USA UPR dialogue affirms that Alaska and Hawai`i continue to claim their rights as states of peoples — as recognized sovereign nations. The Shadow Reports submitted by Alaska and Hawai`i establish the historical standing of Alaska and Hawai`i as sovereign nations. We call on the international community to support Alaska and Hawai`i in our endeavour to access procedures under international law to peacefully pursue our right to self-determination in restoring our status as sovereign nations.”
Leon Siu From The Koani Foundation & Ke Aupuni O Hawai`i Added -
“At long last a UN member State is inquiring about what really happened in Alaska and Hawai`i. This is a significant step toward unmasking the circumstances behind the illegal US occupation of the Hawaiian Islands. We hope that Pakistan’s inquiry will lead to support from other States for an official examination into the matter and affirm our right to exercise self-determination. The first matter of course would be for the US to comply with the laws of occupation and implement the necessary steps to end its foreign occupation of Hawaii.”
Sarah James, Chairperson Of The Gwichʻin Steering Committee Added -
“Self-determination would mean that we, the people of the land, would be the decision-makers in issues like protecting our caribou birthing grounds from the ravages of oil and gas extractive industries. It would mean we can preserve our environment, our natural resources and our way of life. In no case may a peoples be deprived of their right to subsistence.”
What Now?
The Alaska-Hawai`i Alliance for Self-Determination will eagerly utilize the door opened by the intervention of Pakistan and invite the UN member States to respect Alaska and Hawai`i as sovereign nations claiming their rights to self-determination and self-governance. We call on member States to get involved in persuading the US to act in accordance to the rule of international law to end the unlawful occupations of Alaska and Hawai`i. We call on States to support Alaska and Hawai`i in requesting the UN Decolonization Committee examine the United States’ actions regarding the irregular plebiscites of 1958 in Alaska and 1959 in Hawai`i, and to take appropriate actions to address the violations. We call on UN member States to assist Alaska and Hawai`i in activating the proper UN mechanisms for decolonization, de-occupation or whatever is deemed appropriate for peaceful and just resolution to the offenses committed.
POST SCRIPT
What was the USA response?
The US UPR representative responded by ignoring the international context of Pakistan’s query—the fact that under international law, Alaskan native peoples and Hawaiian Kingdom subjects comprise the body politic of sovereign nations under occupation. The US response cited policies by their government to apply domestic “American Indian” policies to those the US government unilaterally identifies as “Native Hawaiian” or “Alaskan Native.” In essence, the US “answer” was entirely unacceptable and misleading. It deliberately avoided the international stature of Alaskans and Hawaiians and portrayed them as tribal wards of the state. Ironically, the US “answer” confirmed that their position on the matter of Alaska and Hawai`i is classic colonialism — an insult to the dignity of peoples and nations and an affront to the principles of self-determination.

BREAKTHROUGH AT THE UNITED NATIONS - US QUESTIONED ON HAWAI`I
On Monday, May 11, the Koani Foundation got the break we have been working for years to achieve! It has caused a big stir in Geneva and in the international community, but is being downplayed or ignored in the UN, which also means it is being downplayed in Hawai`i.
What Are We Doing At The UN? -
The Hawaiian Kingdom is not at the UN to get “recognition.” We are not there to try to “join" the UN. We are not there to ask to be “decolonized.” We are not there to invoke “indigenous” rights.
We are there to call on the member states of the UN to compel its fellow member, the United States of America, to comply with international law by ending its prolonged, illegal occupation of the Hawaiian Islands.
The US Lied To The UN -
In 1959, the United States misled the United Nations General Assembly into thinking that Alaska and Hawai`i had voted to become fully integrated into the United States as “federal domestic states." It was a false report, but the General Assembly accepted it and from that point on, considered Alaska and Hawai`i to be under the domestic laws of the United States, not as peoples and territories under the international law of nations.
This false depiction of our status has been so engrained globally that people find it hard to believe Hawai`i is not a part of the US. This has practically blocked our ability to engage other countries and international bodies like the UN, to support our efforts to free Hawai`i.
Our Task At The UN -
If we want to engage the United Nations to help free Hawai`i, we have to change the engrained perception—getting the UN to see Hawai`i as a sovereign nation-state in captivity rather than a minority population of “federally recognized” “Native-Hawaiian-Americans” within the fake federal “State of Hawai`i” and all completely subjected under US laws.
The key to changing the perception is persistence and consistency. Being present and constantly using every opportunity to speak, file and refile petitions, complaints and interventions to make our point; tell our story to anyone who will listen and even those who may not want to listen…and being pleasant and diplomatic…eventually it gets through.
We have approached and engaged many different mechanisms at the UN that might be able to help. In particular, we have concentrated on several human rights bodies based in Geneva as well as a couple of General Assembly committees in New York.
The breakthrough we recently had was in the Human Rights Council.
The Universal Periodic Review -
Every few years, on a rotational basis, each member State (country) of the United Nations has its human rights “record” reviewed by the United Nations Human Rights Council based in Geneva. This process is called the Universal Periodic Review. Last week it was the United States' turn. The way it works, is that months before the review, the country submits its report of how they are doing internally on a wide range of human rights topics, self-analyzing their strengths and weaknesses. The other member states (countries) examine the report and formulate their questions and/or recommendations to make to the US.
On May 11, 2015 a formal meeting was convened in the main salon at the Palais des Nations, the UN headquarters in Geneva. There, the delegation from the US made its oral presentation for about an hour, then the member states that signed up to speak have an opportunity to give their observations, questions and recommendations through what is called “interventions.” Only member states can participate in making written and oral interventions at a UPR. There were over 120 States signed up to give oral interventions. They were only given 1 minute each, so it took well over two hours to get through all the speakers.
Most of the interventions have a few seconds of platitudes (congratulating the US, etc.) then they list a number of concerns. As you can guess, a lot of them have concerns.
At the Universal Periodic Review of the United States, only member countries of the UN (called "member States”) can make remarks or ask questions. Outsiders like us who are not member States, have to find a member State to ask a question for us. That’s how it works.
Representatives from the people of Alaska and Hawai`i teamed up about 10 years ago to assert our independence. One of the key elements of the partnership is to have the UN question the US claim that Alaska and Hawai`i are "federal states" of the US.
While there are many UN member States sympathetic to our pursuit, for ten years, none has been willing to stick its neck out to mention the irregularities regarding Alaska and Hawai`i. It was safer to not disturb the dragon.
But we persisted in attending dozens of meetings at the UN in Geneva and New York to press our case. Over the years, things have shifted in our favor.
On Monday, May 11, 2015, at the US UPR, Pakistan broke the ice by posing a request to the US pertaining to us. There! A member State of the UN actually said it indirectly but clearly, suggesting that Alaska and Hawai`i are situations that come under international law, not US domestic law…and more specifically, our cases require the attention of the UN Decolonization Committee.
In the subdued, understated, circumspect, innuendoed world of diplomacy, Pakistan’s query was like the fable where the boy blurts out, “But the emperor has no clothes!” Everyone could see it, but no one wanted to say it.

GROUP SEEKS END TO US OCCUPATION OF ALASKA & HAWAI`I
A human rights group speaking in the name of indigenous populations of Alaska and Hawai`i seek UN intervention to organize self-determination referenda in the US states, saying Washington has illegally occupied it since 1959.
The group is to raise the issue during next week’s Universal Periodic Review (UPR) of the UN Human Rights Council in Geneva, reports TASS.
Both territories were listed in 1946 as Non Self-Governing Territories under article 73 of the UN Charter.
The status theoretically subjected Alaska and Hawai`i to decolonization. In both, referenda were held over whether they would become fully-fledged states of the USA, which both did in 1959.
Critics of the transition, including the Alaska-Hawai`i Alliance for Self-Determination, accuse the US federal government of failing to hold the ballots properly, which they say should have involved offering and explaining to the people the option for becoming an independent state rather than part of the US.
The group wants the UN to pressure the US over what they call a violation of UN charter and international law. It accuses Washington of mistreating indigenous peoples of Alaska and Hawai`i living under what it calls American ‘occupation’.
“Our culture is being suppressed. But US actions target not only our culture, but also world peace, because it has a military base in Pearl Harbor,” said Leon Siu, a representative for Hawai`i in the alliance.
“They pollute our land and water during exercises. People get sick because of it. It’s an affront to our land and our people. We don’t want to be part of a war machine.”
“They take our land and mine mineral resources in large amounts damaging our
environment,” he said.
Barnes told TASS that the group would seek assistance from Russia for their cause.
“It will be 150 years since the sale of Alaska by Russia to the US in 2017. If we could work with the Russians to present the historical truth and reject the distorted concepts about Alaska and our peoples, I believe it could be a good way to amend the situation,” he said.
He said Alaska could become a neutral independent state between Russia and the West.
The group has been active since at least 2010, although its members have long records of fighting for the rights of native peoples of Alaska and Hawai`i. Activists from the two states banded together earlier under other names. For instance in 2006 they acted as Indigenous World Association, to get UN support for their cause.

NEW VERSION OF AKAKA BILL INTRODUCED IN US SENATE

US Senator Daniel Akaka has introduced a compromise version of a native Hawaiian federal recognition bill and is waiting to hear from Senate leaders whether legislation can move during a lame-duck session before the end of the year.
The version was negotiated between the state's congressional delegation and the Lingle administration and has the support of Governor Linda Lingle.
If Akaka is given time on the Senate floor this year, however, the version would likely be offered as an amendment to an older version of the bill that moved through the committee process.
"It was just to get it on the record and to show the world that we are going to honor the agreement with Lingle," explained Jesse Broder Van Dyke, an Akaka spokesman.
Akaka, D-Hawai`i, likely needs 60 votes to break Republican procedural opposition in the 100-member Senate. Akaka has been relying on one Republican, US Senator Lisa Murkowski, R-Alaska, to help him get to 60 votes. Murkowski lost in the GOP primary but has won in the general election as a write-in candidate.
If the bill were to clear the Senate, it would have to go back before the House for approval, since the House passed a different version of the bill earlier this year.
Clearing both chambers would be difficult given the short amount of time left this year. The bill may have an even more difficult road next year, when Republicans take over the House and increase their ranks in the Senate.

AKAKA BILL - WHY WOULD WE WANT IT?

“Why would any Hawai`i national want to give consent (e.g. Akaka Bill) to giving away what the so-called Native American and Alaska tribes never got for themselves?” asked Foster Ampong, a resident of the Island of Maui.
“The Akaka Bill is raced-based and the ethnic/non-ethnic Hawaiian proponents are in denial, ignorant and/or apathetic to this reality. The opposition by the neoconservative and colonial-thinking paradigm, I dare say oppose the Akaka Bill because of their Eurocentric racism. Period.”
Mikahala Roy, a Kahu or caretaker of Kamakahonu, the first capitol of the Hawaiian Kingdom, said U.S. politicians are trying to push the bill through without input from Kanaka Maoli.
“Kanaka Maoli are a people who carry forward their long ancestral history in oral traditions. Our sacred traditions from the beginning of time through our history as the Kingdom of Hawai`i continue today.
"The illegal American occupation of Hawaii of 117 years is now revealed for what it is – a race to acquire, finally and now lawfully, Hawai`i. Hearings in Hawai`i will bring up the truth of the occupation.”

HEARINGS ON AKAKA BILL SHOULD BE HELD IN HAWAI`I

There will always be those with differing opinions on the Akaka Bill, as the March 14 Viewpoint "Passing Akaka Bill will keep Hawai`i Hawai`i" illustrated. In its 10-year history of insurgency, misinformation is most definitely a problem.
The Viewpoint writer quotes opinions from individuals in Washington, D.C., and laws that were enacted by foreigners based on Hawaiian ethnicity. This does not mean the prejudices and racism committed against Hawaiians did not/does not occur. It means stop all this twisting and spinning of the facts.
Native Hawaiians via Hawaiian Homes Act is an American created word that, within its legal context, is based on ethnicity and omits Hawai`i's political history.
Thousands of miles of ocean separate us from the American continents. Free of the espoused notion, these Hawai`i Islands and their people were never indigenous to the United States.
In the 1840s, Kamehameha III secured international recognition as an independent state - equal and external to the United States of America - a fact and achievement no indigenous tribe of the Americas and Alaska has ever attained.
Proponents claim the Akaka Bill is not raced based. The Glenn Beck-Rush Limbaugh type-of-opponents don't want the bill because it takes from the haves and gives to the have-nots. I oppose the bill based on my national origin, where blood quantum and ethnicity are not an issue.
What do you want? Demand hearings are held in Hawai`i.
