Hawai`i Senate About To Vote On Fake State Akaka Bills.

Now is the time for a display of strong resistance and outrage that your voice is being ignored.

WHAT YOU CAN DO -

* Call all Senators and tell them to vote no on SB1 and SB1520, the “First Nation,” tribal government schemes. If they pass out of the Senate, call each House member a tell them to vote NO. Find Their Phone Numbers HERE.
* Get your testimonies ready. Be ready to send your testimony in at a moment’s notice and then be there at the hearings to present them in person.
* Keep your testimony simple and to the point (see sample ‘talking points’ below). Now is not the time to preach or ‘educate.’ They are not listening. The legislators need only know that there is fierce opposition to these bills.


Below are the four strongest talking points for your testimony. Pick one or two or use all four. “I am opposed to SB1 and SB1520 because...”

1. The State of Hawai`i has no constitutional power to form a new “indigenous” “First Nation” government. Nothing in the State or Federal constitutions give the State of Hawa`ii the authority to form a new “nation” within the “state.” Thus, if passed, these new fake “nation” entities will be ruled unconstitutional by the courts.

2. This will plunge the state of Hawaii into chaos. It will be divisive and extremely disruptive pitting Hawaiians against each other; Hawaiians against non-Hawaiians; families against families. It would create conflicting jurisdictions between the “Native Hawaiian” tribal government, the State government and the US government.

3. The State of Hawai`i is in a terrible financial crisis. Making the people of Hawai`i pay an unspecified hundreds of millions of tax dollars to implement a rogue tribal governing entity is irresponsible, immoral and illegal. It would be far better use tax dollars to fund the critical needs of current services and infrastructure in Hawai`i.

4. The legislature hasn’t spent the time to carefully consider the ramifications. Prematurely rushing through SB1 and SB1520 with so many more pressing, critical matters, would be a serious waste of time. It would also violate the people’s right to participate in the democratic, decision-making process. Before passing something that would so drastically alter the State’s governing structure, the legislature needs to defer action; take at least a year to hear what the people in our communities have to say, carefully study all the factors and ramifications, then make a decision.

AKAKA BILL PASSAGE QUESTIONED AS OPPOSITION MOUNTS

WASHINGTON – The headline of a recent story on a Hawaiian news site proclaimed “Native Hawaiians Move Toward Sovereign Tribal Status: ‘Akaka Bill’ passed in House could be voted in Senate this month.”

But would it pass?...

In the latest action, Hawaii Gov. Linda Lingle, an ardent Akaka Bill supporter, wrote to all 100 senators March 23, reaffirming her opposition to amendments introduced last December as House and Senate versions of the bill were prepared for committee action....

And it’s passionately opposed by some Kanaka Maoli – indigenous Hawaiians – who dream of restoring their country’s independence and self-determination.

“The Akaka Bill is a trap door that if accepted will slam shut and forever shut us off from ever reaching our goal for international self-determination and the protection of our future generations,” said Puanani Rogers, a member of Hui Pu, a coalition of Hawaiian nationalists.

“I am a proud grandmother of 15 grandchildren and I fear for their future if the Akaka Bill ever passes. If the AB should pass, I will never acknowledge it as law. It will take all of us to overthrow this grave crime of genocide this bill will inflict upon us.

"My message to others is that we raise our voices in unity and with a spiritual force that is undefeatable. We know who we are, we know where we come from and we know whose lands we live on.

"I will fight for our lands, fight for our people, fight for our freedom. America can try, but they will never take the truth away from us....”

AKAKA BILL HEARINGS IN HAWAI`I CALLED FOR

Gov. Linda Lingle's reversal of her long-standing support for the Akaka Bill indicates how fundamentally the Hawaiian sovereignty measure has changed over the course of this Congressional session.

Any future attempts to pass the measure -- assuming the current bill dies in the Senate, as is now predicted even by many supporters -- should include full public hearings in Hawaii to explain why the 2010 version is so different from the versions that have preceded it since 2000.

The measure, which would grant federal recognition to native Hawaiians, has been approved three times by the House since then, but never by the Senate....

"...This structure will, in my opinion, promote divisiveness and litigation, rather than negotiation and resolution," the governor said. "I do not believe such a structure, of two completely different sets of rules -- one for 'governmental' activities of the native Hawaiian governing entity and its officers and employees, and one for everyone else -- makes sense for Hawaii."

Hawaiian nationalists also oppose the bill, albeit for different reasons. They say native Hawaiians who support it are being duped into relinquishing their inherent sovereignty as descendants of the independent Hawaiian kingdom overthrown by U.S. interests. To them, federal recognition is a land grab disguised as recompense.

That the opposition includes such diverse points of view is further evidence that the Akaka Bill needs a full airing before rising again.

AKAKA BILL HAWAI`I HEARINGS CALLED FOR

Although its author expresses optimism that the Akaka Bill will pass this year, the loss of the Democrats' supermajority in the Senate and last-minute changes to the bill that fueled objections in Hawaii may pose significant hurdles during this ninth try.

The measure that would grant native Hawaiians federal recognition like that of American Indian tribes was in some trouble even before Republican Scott Brown's upset victory in Massachusetts ended the Democrats' filibuster-proof majority in the Senate....

...The Obama administration worried that special status bestowed on native Hawaiians may be overturned as illegal racial discrimination, given the 2000 U.S. Supreme Court ruling in Rice v. Cayetano. But redefining native Hawaiians under existing federal law governing Indian tribes raised a host of issues barely aired in Hawaii under the bill's many previous incarnations....

...It's hard to imagine that the Native Hawaiian Government Reorganization Act will be a high priority outside the Hawaii delegation in such a topsy-turvy political environment, and the lack of transparency surrounding the late changes in the Senate version may come to haunt its author.

AKAKA BILL - INOUYE'S FAILED BACKROOM PLOY
Senator Inouye blustered, “I have never suggested that the Akaka Native Hawaiian Recognition Bill be passed and adopted as part of the defense appropriations process. I don’t know where this nonsensical suggestion originated.”

This “nonsensical suggestion” actually springs from the reputation, track record and modus operandi of Senator Inouye. He is famous for (and even proud of) his uncanny skill to work the system, tacking on various and sundry earmarks to unrelated appropriations bills.

That’s how he brings home the pork (and lots of it) year after year. Inouye’s instant and strong denial was like that of someone caught with his hand in the cookie jar. Why such a vehement denial? I think we hit a nerve. As Shakespeare put it: ’Methinks thou doth protest too much.’

Surprise, surprise! The very next day, we learn the governor is miffed about being excluded from back-room secret talks on amendments to the Akaka bill.

Welcome to the club governor. Now you know how the people of Hawaii have felt for the past 10 years, being left out of the process in this classic example of back-room politics. The Akaka bill epitomizes Inouye’s crafty, “nonsensical” style.
