INOUYE TRIES AKAKA BILL SNEAK ATTACK ONCE AGAIN

On page 129 of the US Senate Appropriations Committee FY13 Interior Subcommittee Bill Draft, between “Livestock Grazing Administration” and “Use of American Iron, Steel and Manufactured Goods”, US Senator Dan Inouye has slipped in his latest scheme to hide the US federal Akaka bill hoping no one will notice. 

The Subcommittee Bill Draft was released Wednesday, September 26, 2012. 

Senator John Kyl (R-AZ), a long time opponent of the Akaka bill, immediately announced a ‘hold’ on the Appropriations bill until the language is removed. 

Under Senate rules a ‘hold’ blocks further consideration of a bill.

Kyl, who is retiring this year, has prevented consideration of the Akaka Bill several times in years past.

The Akaka Bill died last Thursday evening in Washington, DC.

With the withdrawal in the US Senate of the Omnibus spending bill that day, Dan Inouye lost his last chance in this lame duck US Congress to keep it alive as an earmark “study” he had craftily snuck and buried deep in the Omnibus legislation.

Starting in January the republicans will control the US House of Representatives until at least 2013.

There will be no chance therefore that the US Congress will pass an Akaka bill.

Moreover, earmarks are now going the way of the dinosaur. Tricks that have allowed Dan Inouye to bend the rules in the US Congress for years are now considered political suicide and vanishing.

He knows this and is moving on, preparing other ways trying to achieve what the Akaka bill would have done, but with different methods.

Inouye Blasts Senators For Shelving Spending Bill

US Senator Daniel Inouye has chided his Senate colleagues for shelving an omnibus spending measure which contained an Akaka bill earmark hidden deep inside in favor of a short-term resolution keeping US federal expenditures at current levels.

In a US Senate floor speech yesterday, the Democratic chairman of the Appropriations Committee noted that Republicans who helped craft the 1,900-page bill ended up opposing it.

He said the measure was huge because it contains spending provisions that normally are in 12 separate bills.

He claimed US voters in November were not sending a message to eliminate earmarks.

Omnibus Spending Bill Pulled

The Omnibus Spending bill, which contained the Akaka bill earmark, is now dead.

The Akaka bill would have turned native Hawaiians into a US indian tribe, legitimized the illegal US takeover of the sovereign Hawaiian Kingdom over a century ago and sealed the theft by the US of Hawaiian lands.

US Senate majority leader Harry Reid pulled the bill completely from consideration last evening after thousands of people angrily called Capitol Hill from all across the US as well as Hawai`i and complained about the numerous earmarks in this fatally flawed bill.

The Inouye native Hawaiian Governing Entity earmark, as well as the Akaka bill itself is now dead and gone.

AKAKA BILL STUDY SNUCK INTO OMNIBUS SPENDING BILL

US Senator Daniel Inouye has snuck into the Omnibus spending bill an appropriation for study of native Hawaiian recognition.

The appropriation is related to his support for the Akaka bill, otherwise known as the Native Hawaiian Government Reorganization Act.

Opponents of the Akaka Bill and government transparency advocates are concerned that the study provides no vehicle for public involvement, testimony or legal analysis and instead appears to simply be a working group — conducted in secret, with no particular beginning or end.

One Congressional source remarked, “If Inouye wants it to be a meaningful study, then it needs to be structured in a way that truly grapples with the legal, policy, and cultural questions in an organized fashion.

"Perhaps he does not really want that and instead is just tossing this study into the bill as an admission of defeat. If he wants it to work, then this isn’t the best way of doing it.”

In the Senate, Appropriations Committee Chairman Daniel Inouye, D-Hawai`i, backed by Democratic leaders, has fashioned an omnibus spending measure — providing almost $20 billion more than the House bill — that he wants to substitute for the measure being passed across the Capitol.

Senate Minority Leader Mitch McConnell, R-Ky., opposes Inouye's move, but GOP members of the Appropriations Committee, such as Senators Thad Cochran of Mississippi and Lisa Murkowski of Alaska, are open to the idea.

US ELECTIONS OUTCOME BAD FOR AKAKA BILL

So many Republican victories in the off-term US elections could mean defeat for the Akaka Bill.

The lame duck session in US Congress will start November 15 and it's unrealistic to think the Native Hawaiian Government Reorganization Act will get to a vote on the senate floor before Christmas.

"I would say as a result of yesterday the odds are bad. I'm being very candid and upfront because I don't want people to have their hopes unjustifiably raised because at this stage I would say it's not one of the so called priority measures. There are certain appointments of judges that will go down the drain also," said Sen. Dan Inouye, (D) Hawai`i.

AKAKA BILL WILL DIVIDE HAWAIIANS

The amendments to the Akaka Bill are ludicrous. Under the amended version, Hawaiians have no control of their national lands or natural resources and they cannot challenge the United States for the illegal overthrow of the Kingdom of Hawai`i during 1893.

Hawaiians had better read the updated version of HR.2314 and object to U.S. Sens. Daniel Inouye and Daniel Akaka and the Office of Hawaiian Affairs making crucial decisions relative to their culture without their consent.

The bill will divide the Hawaiian community even more than it is now. It will make it more difficult to claim the crown lands, konohiki lands and the kuleana lands.

I urge Congress not to pass HR.2314 until a true vote is instigated by the Hawaiian community.

AKAKA BILL PUSH IS ON IN US SENATE

A vote in the US Senate on allowing Native Hawaiians to form their own government could come this month following a deal between Hawai`i's Democratic senators and Republican Governor Linda Lingle.

When changes were made, Lingle withdrew her support of the so-called Akaka Bill, named after Senator Daniel Akaka, who introduced the measure.

Senator Daniel Inouye said yesterday that Lingle will support the Native Hawaiian recognition measure after changes are made to the bill clarifying that a Hawaiian government would not have sovereign authority until after negotiations are completed.

"After a thorough review of the State’s most recent proposal, I determined that the changes will not diminish the bill’s intent to establish a federally recognized government-to-government relationship with the United States.

"I believe these changes will help secure additional votes in the Senate to overcome procedural hurdles and receive an up-or-down vote on the bill. We need to act quickly to ensure the bill passes the Senate and is signed into law this year.

"I remain optimistic that the United States will finally extend federal recognition to Native Hawaiians and end over a century of inequality in its treatment of its indigenous peoples," Akaka said.

TIME RUNNING OUT FOR AKAKA BILL?

After a 10-year slog, supporters of the Native Hawaiian federal recognition bill think they have their best chance yet to pass the legislation.

It also may be their last chance for many years.

Democrats are expected to lose seats in both the U.S. House and Senate this fall, making it even more difficult to scrape up the votes to pass the bill in the next Congress. Republican support is necessary, even now, to pass the bill.

The Native Hawaiian Government Reorganization Act — aka the Akaka bill — would establish a process for Native Hawaiians to gain U.S. recognition similar to Indian tribes.

The Democratic-controlled House passed the measure in February, and Hawaii's senior senators —Daniel Akaka, for whom the bill is named, and Daniel K. Inouye, both Democrats — have said this year that passage in the Democratic-controlled Senate is likely.

That can happen only if the Akaka bill gets a floor vote, though. As of mid-June, none had been scheduled.

And there's no promise from the Senate Majority Leader's Office that one will be. There's also a dwindling number of Senate session days remaining.

HAWAI`I HEARINGS FOR MAIL DELIVERY YET NONE FOR AKAKA BILL

What's Wrong With This Picture?

Hawai`i Senators Inouye and Akaka say hearings on a proposal to drop mail deliveries on Saturdays should be held in Hawai`i and Alaska, yet steadfastly refuse any hearings at home on the Akaka bill.

The island Democrats joined Alaska's senators, Republican Lisa Murkowski and Democrat Mark Begich, in asking the Postal Regulatory Commission to hold hearings in both states.

The commission has already announced hearings on the proposal will be held in seven other states.

AKAKA BILL FALTERS

The Akaka Bill is in big trouble. Earlier this week, Republican Senator Jim DeMint placed a ‘hold’ on the bill, which in essence freezes the bill from moving forward. This is the newest setback in a series of catastrophic hits over the past six weeks that took the bill from certainty of passage by Christmas, to certainty of passage by February, to being dead in the water.

How did this happen? Let’s go back about eight weeks…the Akaka Bill was literally days away, closer than it’s ever been, to passing…

AKAKA BILL - SNEAK ATTACK PROTEST
Monday, December 14, 2009, independence protesters assembled at the corner of Beretania and Punchbowl to protest an attempt by Hawaii’s US senators Daniel Akaka and Daniel Inouye to sneak the Akaka bill into one of the large US federal appropriations bills while congress and the nation were distracted by the epic battle over the huge healthcare reform bills.

INOUYE’S DENIAL
Senator Inouye in Washington, D.C. hurriedly issued a strong denial, but it was way over the top, like that of someone caught with his hand in the cookie jar. No one believed his denial as everyone knows sneaky back-door deals is his specialty, his modus operandi.

STATE WITHDRAWS SUPPORT
Our SNEAK ATTACK protest triggered inquiries by Governor Lingle, and uncovered a scheme (brokered by Robin Danner) between Akaka and the White House to amend the Akaka bill in two days. State Attorney General, Mark Bennett, sent a scathing letter to Akaka and the members of the house and senate committees, strongly objecting to the unexpected changes and withdrawing the state’s support of the bill. He also suggested that public hearings be held in Hawaii before Congress takes further action on the bill. This constituted a major blow to the Akaka bill, as the State of Hawaii is the most vital player in the scheme of things.

OBAMA ASKS QUESTIONS
The demand for ‘congressional-hearings-in-Hawaii’ grew to a clamor coming from many diverse quarters. Even President Obama caught the hint from protestors at the entrance to his vacation compound while in Hawaii over the holidays. Of course it was hard to miss the huge banners and signs for ‘congressional hearings in Hawaii.’ Sources tell us that upon returning to DC, the White House asked questions about why there had not been hearings in Hawaii.

OHA CAUGHT OFF GUARD
Apparently the Office of Hawaiian Affairs was also caught off guard by the amendments. OHA was strangely silent about the crisis for quite some time. Eventually OHA responded with yet another dog-and-pony TV forum. Their purpose? To squelch the growing demands for congressional hearings in Hawaii and assure everyone that everything was still on track. The OHA show was unbelievably shameful and pathetic.

Ironically, the day of OHA’s televised forum hyping the Akaka Bill, Senator Akaka was on Maui holding a “public hearing” for Maui veterans for a proposed vet complex (as they deservedly should get). This insult by Senator Akaka (the vets get a hearing, Hawaiians don’t) has not been lost on the people of Hawaii.

CONGRESSIONAL SUPORTERS CAUGHT OFF GUARD
Co-sponsors of the bill like Alaskan Senator Lisa Murkowski, were also kept in the dark about the amendments. Murkowski has hedged her support.

INOUYE’S DAMAGE CONTROL FALLS FLAT
Trying to regain composure, Inouye arrogantly tells the press that the governor’s balk was just a matter of miscommunication and that he would get it straightened out over the holidays, and the bill will pass by mid February.

OHA and STATE TEAM UP
On January 20, the State AG and OHA submitted a list of 30(!) changes they would like to see made to the Akaka Bill, in essence crippling any chances of it being passed any time soon, certainly not “by mid-February.”

SHIFTS IN SENATE KILLS BILL
The surprise upset by Scott Brown in Massachusetts left Democrats in the US Senate one short of the 60 needed for a super majority to dislodge a ‘hold’ or stop a ‘filibuster.’ Sure enough, Senator Jim DeMint placed a hold on the Akaka bill. For all intents and purposes, the bill is dead.

INOUYE/DANNER PLOT EXPOSED
One of the bonuses of the last six weeks is that the long, unholy alliance between Inouye and the Danner sisters has been exposed. The last-minute amendments (that caused the eventual collapse of the bill) would have contracted CNHA (the Danner’s non-profit corporation) to be the interim administrator of the Native Hawaiian tribe, until such time that negotiations were ever completed for the creation of a Native Hawaiian Governing Entity.

In a supreme display of poor judgment, Robin Danner has been sent out into the Hawaiian community to put out the wildfires of growing opposition to the Akaka bill. But Hawaiians are ma’a (familiar) to what’s going on and Robin’s presence is like pouring gasoline on the flames. The more she tries to extinguish the fires, the larger the conflagration gets.
