ARREST WARRANT DROPPED FOR SPEAKING HAWAIIAN

Speaking Hawaiian inside a Maui courtroom could have landed a Kula man behind bars. Trial for a Haleakala telescope protester was scheduled to start at District Court in Wailuku Wednesday morning but it didn't get very far.

Fifty-one-year-old defendant Kaleikoa Kaeo identified he was present in court, speaking Hawaiian instead of English. 

When presiding Judge Blaine Kobayashi told Kaeo he couldn't understand him, Kaeo continued to speak in his native tongue. The judge refused to recognize Kaeo's presence in court and issued a bench warrant for his arrest.

Today the Hawaii State Judiciary dropped the arrest warrant.  Judge Kobayashi issued an order recalling the bench warrant.  

Also, a hearing has been scheduled regarding the use of a Hawaiian language interpreter.  The Judiciary will be reviewing its policies regarding the provision of Hawaiian language interpreters.

According to court records, Kaeo was granted a Hawaiian language translator more than a dozen times for past petty misdemeanor proceedings. Kaeo is able to speak English, and in this case, the judge ordered the trial to be held in English and did not provide a translator.

"It's really unfortunate. If I spoke Spanish, if I spoke Filipino or Japanese, they would provide an interpreter," Kaeo said.

When court was dismissed, Kaeo's supporters shouted and expressed disapproval with the ruling inside the packed courtroom.  

"It's a tragedy. But it's also important, it wakes people up that really think Hawai`i has a sense of equality. You would think Native Hawaiians would have some sense of humanity in this place, knowing the history. Knowing the struggles," Kaeo exclaimed.

Protestors in favor of Kaeo filled the court's hallways and exterior with signs and songs. Keiki who attend Hawaiian language immersion program Punana Leo lined the hallways, as well. Some of the children's parents who were there were in shock. Among them, Kumu Hula Napua Greig who tearfully expressed her frustration during a Facebook live stream.

"I can't even believe that this is happening today. I can't even believe it. Why do we educate our kids in our native language if they won't even be allowed to defend themselves," said Greig.

Along with English, Hawaiian, is an official language of the State of Hawai`i.

If federal recognition, the Akaka bill, is not the answer, what is?

Can the US really help create a bright future for the Hawaiian Nation? What solutions will benefit all residents of Hawai`i?

Hawaiians want and deserve freedom just as much as US citizens do.

Some say, “the illegal act of war that overthrew your Queen can’t be erased . . . like it or not, you’re all Americans now.”

But, every day we see people around the world fighting for, and winning back their native and national rights. Their quest, and ours are totally legitimate and very real.

Like everyone else, Hawai`i Nationals want four basic things –

FREEDOM – The freedom to decide their own future for themselves. That “freedom” was taken away when the sovereign Nation of Hawai`i was overthrown in 1893. It was taken away again by illegal annexation to the United States in 1898. And, it was taken away a third time by the fake statehood vote in 1959.

According to international law, a new vote must to be taken that offers three options – 1) Independence, or 2) Free-Association or 3) Integration (nation within a nation.)

RIGHTS – The rights of the independent Nation of Hawai`i were never relinquished. The destruction and denial of these rights must cease. Everyone who descends from citizens of the Hawaiian Nation prior to 1893, regardless of race, are entitled to these rights.

IDENTITY – The political identity of Hawai`i Nationals must be acknowledged by the United States. They will decide their own future, without interference by the US. And, only those with any measure of indigenous blood may define who is native Hawaiian. A blood quantum imposed by the US is an unacceptable means to divide and conquer.

LAND BASE - Hawai`i Nationals love their country and lands just as much as US citizens love the US. Hawaiians want all their land back, not just some of it.

HAWAIIAN EDUCATOR WINS PRESTIGIOUS AWARD

Doctorate Dissertation Recounts First Encounters Between Nawaiians & Missionaries

For the third time in the past decade, a Brandeis doctoral dissertation has been judged the best in the nation by The Society of American Historians.

Noelani Arista, an Irving and Rose Crown Fellow who will be awarded her PhD at the university’s commencement in May, has won the 50th annual Allan Nevins Prize for her interdisciplinary thesis, "Histories of Unequal Measure: Euro-American Encounters with Hawaiian Governance and Law, 1793-1827," which she defended in December.

Arista joins an illustrious cast of past winners, including such luminaries as William Freehling and Mary Beth Norton. She also joins two other Brandeis Crown Fellow winners: Jeff Wiltse, PhD'02, won in 2003, and Jessica Lepler, PhD'07, in 2008.

“I feel very honored to win this distinguished prize, especially because my goal was to be able to write a dissertation about Hawai`i and early encounters between Hawai`i and the US in a way that brought Hawaiian history to the attention of the main stream of American history,” Arista said. “That a dissertation that emphasizes Native (Hawaiian) history was awarded this prize I believe is significant.”

Arista, who currently teaches in the History Department at the University of Hawai`i at Manoa, says it was her academic background in Hawaiian culture and language that made her feel at home at Brandeis. “I felt that Brandeis with its own cultural and historical traditions would be a good fit for me in this stage of my development, and I have found it to be a culturally diverse and rich place of seeking after knowledge, a Hawaiian cultural value known as `Imi Loa," Arista said.

Arista was interested in illuminating this unequal history because she felt that American approaches to the study of Hawaiian history have always been written in English language sources and methodological assumptions. It was her goal to draw upon both English and Hawaiian sources to tell a different story about the transformation of Hawaiian government during this period.

“I argue that Hawaiians have their own conceptualization and reality when it comes to history and the interpretation of events, and also make the point that not only linguistic, but cultural literacy is central to telling this history well,” Arista said.
