KOANI FOUNDATION CEDED LANDS PROTEST STATEMENT
The so-called ceded lands are really only one thing - stolen lands of the Hawaiian Kingdom which was illegally overthrown over one hundred years ago and is still occupied by the U.S. to this very day.
We stand solidly opposed to any action by the so-called state of Hawai`i or the Office Of Hawaiian Affairs which would attempt to take, trade, dispose or sell these lands since they are not theirs to begin with.
The ceded lands belong to Hawai`i Nationals - descendants of citizens of the Hawaiian Kingdom and their loyalists.
There is no deal or negotiation which would be legitimate other than the return of our nation which includes all the `aina (land) not just some of it.
The plea by the fake state of Hawai`i to the U.S. Supreme Court to declare the ceded lands theirs is both illegitimate and an outrage.
We call upon Governor Linda Lingle and Attorney General Mark Bennett to immediately and permanently withdraw this case.
Their desire that the U.S. Supreme Court declare the ceded lands theirs based on the Newlands Resolution is simply an attempt to legitimize a theft.
The U.S. Department of Justice itself declared the Newlands Resolution as less than legitimate during the Reagan administration in 1988, when they stated, “It is therefore unclear which constitutional power congress exercised when it acquired Hawai`i by joint resolution. Accordingly, it is doubtful that the acquisition of Hawai`i can serve as an appropriate assertion of authority.”
Likewise the Koani Foundation opposes the Akaka bill or federal recognition in any form since Hawai`i has never been a part of the U.S. to begin with, nor have Hawaiians ever relinquished their rights according to both international and U.S. public law 103-150, otherwise known as the Apology bill.

HAWAI`I NATIONAL PATRIOTS SAY "NO!" TO SALE OF STOLEN LANDS

About 100 people from various Native Hawaiian groups rallied in front of the state Capitol yesterday to demonstrate their objection to Gov. Linda Lingle's position on ceded lands, those lands that belonged to the Hawaiian government and were taken over at the 1898 overthrow.

SUPERFERRY MODEL RUNS AGROUND
If a single situation could be held up as a model to discourage enterprise and investment in the state, it is that of the Hawai`i Superferry.
The Lingle administration and an equally culpable state Legislature did no one -- not taxpayers, the visitor industry, businesses or public or environmental interests -- any favors in their bungling of the ferry issue.
Had officials simply adhered to legal requirements from the get-go, the harm imposed and that could yet be brought to the ferry company and others, and the community divisiveness their mistakes have generated would not have occurred.
A report by the state auditor criticizing special legislation tailored to benefit the ferry company served as a prelude this week to arguments before the Supreme Court on constitutional challenges of the law.
The audit concluded that the legislation -- known as Act 2, passed after the court ruled that the state should not have exempted the ferry from environmental reviews -- "compromised" the law and "set a precedent for future government intervention that puts the interests of a single business before the state's environmental, fiduciary and public safety responsibilities."

WILL HAWAI`I HIGH COURT GROUND THE SUPERFERRY?
Illegal Operation Without Environmental Impact Statement Is Focus
An attorney for three Maui groups told the Hawai`i Supreme Court Thursday that a law permitting the Hawai`i Superferry to operate while an environmental impact study is conducted is unconstitutional.
Isaac Hall’s arguments came as the high court heard a legal challenge to special legislation passed by the Hawai`i Legislature in October 2007.
Hall, representing the Sierra Club, Maui Tomorrow and the Kahului Harbor Coalition, said the legislation, called Act 2, benefited only a single entity.
“Act 2 was conceived, cut and tailored for Hawai`i Superferry alone,” he said. “That’s what this [case] is about.”

The Hawai`i State Auditor today released a report finding the Hawai`i Superferry legislation compromised the state's environmental laws and set a worrisome precedent that put the interests of a single company ahead of state responsibilities.
The auditor also found that $40 million in state harbor improvements for the Superferry project could be in question if Superferry configures both of its high-speed catamarans with on-board ramps that could used as alternatives to the state's ramps and barges.
The Hawai`i Supreme Court will hear arguments on the Superferry case this morning. At issue is whether the Superferry can continue to operate without an environmental impact statement being completed first, as well as the validity of legislation written to benefit a single company.

SUPERFERRY SERVICE TO END SOON?
Hawai`i Supreme Court To Decide New Case
The Hawai`i Supreme Court, whose ruling last year led to a three-month shutdown of the Superferry, will decide whether the interisland service can continue in a new case to be heard next week.
The court will decide whether Gov. Linda Lingle and the Legislature violated the state Constitution last year with a new law that allowed Superferry to resume operation while an environmental review of the project is completed.
A ruling could have an immediate impact on whether Superferry can operate between O`ahu and Maui.

IS IT ANY WONDER MORE & MORE PEOPLE WANT THE ILLEGAL U.S. OCCUPATION OF HAWAI`I TO END?
Life Harder under U.S. Occupation
Native Hawaiians constitute roughly 20 per cent of the state population, but they represent 54 per cent of the prison population.
Not coincidentally, they also have the lowest per capita income, the highest poverty rate and the shortest lifespan of any ethnic group in Hawai`i.
Hawai`i public school students receive a very poor education by any standard of measurement. They consistently rank among the lowest of any state in test scores.
In the 1980s, Hawai`i gained the enviable reputation of providing medical insurance to the highest percentage of residents of any state.
A decade after the state ended dental cover, toothless smiles are commonplace among the poor. Tens of thousands of residents have no medical insurance at all.
Despite higher profits for many businesses, jobs are scarce and most of the available work pays minimum wage or close to it... In some cases, the lives of the working poor are worse than the unemployed.
Among other things, they don't qualify for state financial assistance or full food stamp benefits.
Today most of the Island of Hawai`i (Big Island) as well as the islands of Moloka`i, Lana`i and Kaua`i are economic wastelands with little opportunity to make a decent living.
On Kaua`i workers often share apartments or small houses with several other workers because rents are too expensive for one or two individuals to afford.
On every island married couples with children often work two jobs each to make ends meet - if they are fortunate enough to find that many jobs, even at minimum wage.
Hawai'i imports two-thirds of its food from the mainland and locally-grown food is expensive due to high land prices.
As one long-time resident commented: "Hawai`i is turning into one of those Caribbean tourist islands where you have fancy hotels and a tiny rich neighborhood and the rest of the island is a shantytown of poverty and crime."

HOW SMART ARE THE PEOPLE WHO RUN THE US OCCUPATION OF HAWAI`I?
Gov. Lingle Skips Meeting With Barack Obama

You have to wonder after her baffling decision to skip the governors meeting with President-elect Barack Obama. Where are the sharp instincts that got her elected Hawai'i's first Republican governor in 40 years?
The snub looks disrespectful at best, and at worst petulant for the governor of Obama's birth state, who spent weeks on the Mainland campaigning for the Republican ticket of Sen. John McCain and Alaska Gov. Sarah Palin....
The new president will be asked to support many Hawai'i projects and it's time to mend fences, not burn more bridges. Even Palin was among the 41 governors attending the Philadelphia meeting called by Obama to discuss the national economic crisis and the challenges facing the states.
Lingle said she didn't go because the one-day meeting required three travel days and she was needed at home to deal with the state's growing budget deficit.
Such concerns didn't stop her from making three Mainland trips for McCain and Palin while state departments were struggling to make budget cuts of up to 20 percent she ordered. She also made an 11-day trip to Asia to promote tourism....
Failing to demonstrate cooperation with the new president pointlessly opened Lingle to criticism from Democrats and was the latest in a series of dumb political moves you wouldn't expect expect from a Republican prodigy who got herself elected governor twice in a strongly Democratic state....

HAWAI`I NATIONAL PATRIOT SAYS - "YOU CAN'T HAVE IT BOTH WAYS!"
US Claims Newlands Resolution Has Force Of Law, Yet Apology Resolution Does Not
"The Newlands Resolution (how the US acquired Hawai`i) and the Apology Resolution (US Public Law 103-150) are the same type of instrument.
If they recognized the Newlands resolution, then they have to recognize the Apology Resolution, in which the US acknowledges its guilt. One undoes the other - which means the US is belligerently occupying the Hawaiian Kingdom.
The State of Hawai`i is null and void and an illegal entity.
As a few US senators stated concerns, the only logical consequence of the apology bill is total independence. They are very correct in their summation of the bill.
How it is resolved is a matter of interpretation on whether the thief wants to keep its stolen property criminally gotten and not return it to the rightful owners.

US Claims Newlands Resolution Has Force Of Law, Yet Apology Resolution Does Not
"The Newlands Resolution (how the US acquired Hawai`i) and the Apology Resolution (US Public Law 103-150) are the same type of instrument.
If they recognized the Newlands resolution, then they have to recognize the Apology Resolution, in which the US acknowledges its guilt. One undoes the other - which means the US is belligerently occupying the Hawaiian Kingdom.
The State of Hawai`i is null and void and an illegal entity.
As a few US senators stated concerns, the only logical consequence of the apology bill is total independence. They are very correct in their summation of the bill.
How it is resolved is a matter of interpretation on whether the thief wants to keep its stolen property criminally gotten and not return it to the rightful owners.
