US SUPREME COURT DECIDES STOLEN LANDS CASE
What Does It Mean?
The US Supreme Court simply remanded the case back to the Hawai`i Supreme Court because the justices unanimously decided this should be decided according to state law, not US federal law.
From the Opinion -
“When a state supreme court incorrectly bases a decision on federal law, the court’s decision improperly prevents the citizens of the State from addressing the issue in question through the processes provided by the State’s constitution.
Here, the State Supreme Court incorrectly held that Congress, by adopting the Apology Resolution, took away from the citizens of Hawaii the authority to resolve an issue that is of great importance to the people of the State.
Respondents defend that decision by arguing that they have both state-law property rights in the land in question and “broader moral and political claims for compensation for the wrongs of the past.” Brief for Respondents 18.
But we have no authority to decide questions of Hawaiian law or to provide redress for past wrongs except as provided for by federal law.
The judgment of the Supreme Court of Hawaii is reversed, and the case is remanded for further proceedings not inconsistent with this opinion.”
If you recall in their questioning during oral arguments, the justices kept asking both AG Mark Bennett and OHA “Why are you here? This matter should be decided by you all back in Hawai`i, not at the federal level.”
Their decision issued today reflects that line of thinking completely.

"...As for OHA, this government controlled organization with no transparency restrictions accountable to any one is a disgrace and should be investigated and restructured," said Princess Abagail Kawananakoa. "Have they helped one needy Hawaiian family? I think you know the answer."

THE NATION EXPOSES HAWAI`I SUPERFERRY

In the latest turn of events in Hawai`i's impressive grassroots uprising against a huge corporate-military boondoggle, the state's Supreme Court has ruled unanimously (5-0) that the Hawai`i Superferry has no legal authority to continue its operations in the state, at least for the time being....
And yet, after last week's court ruling, the Superferry company showed surprisingly little desire to fight, quickly announced it would suspend all Hawai`i service within three days and did.
This struck some observers as out of character for such an aggressive, self-important outfit, and raised new questions about the company's and Lehman's intentions: What's up now? Could it be the company actually wanted to get out?
Does this confirm that the Hawai`i adventure was really only a demo for bigger military options, as many suggest?...

HAWAI`I STATEHOOD VOTE - REAL OR FAKE?
I can honestly say I was disappointed and even upset that the Statehood Bill was passed.
I knew my country existed and I was a Hawai`i national.
The smug US Americans celebrated in triumph and were callous of the rights of the Hawai`i nationals.
There were no choices of independence or commonwealth but to remain a territory or become a state.
Many Hawaiians didn't vote or were barred from voting. Only US Americans could vote; including the military and their families that qualified their residency within our Kingdom.
Today we find that there was no treaty of annexation and the the statehood voting processes were unlawful. I look forward to the day the US de-occupies our nation-state of Hawai`i.
Our citizens spoke through the Ku`e Petitions against annexation as the Turpie Resolution indicated that we had a right to do.
The fake annexation and fake Statehood speaks for itself. Conditions haven't improved for us since the US invasion and its belligerent occupation.
God Bless the Kingdom of Hawai`i forever and down with the US.

50 YEARS OF A FAKE STATE
WHAT REALLY HAPPENED?

What was intended to be the big 50th anniversary celebration at the State Capitol on March 18 sent the exact opposite message than the State of Hawai`i intended.
The fifty or so demonstrators who went to the capitol with messages of “FAKE STATE,” “A HISTORY OF THEFT,” “HAWAIIAN INDEPENDENCE,” in orderly, peaceful protest completely stole the show.
When they got there, the demonstrators found that the state’s only planned public celebration of the 50th anniversary of statehood had retreated into the house chamber, leaving the capitol, the rotunda, the steps, the entire exterior, open to the voices of opposition.
Thus, to the public — the tourists visiting the capitol grounds, the people in passing cars, the legislative staff peering over the railings, the deputy sheriffs, the local and international press looking for pictures and sound bites — the only visible message delivered in the clear light of day was: “the State of Hawai`i is a Fake State.”
It was all over the internet, MSNBC, even in far off India; “Hawai`i is a Fake State.”
Leon Siu is the Minister of Foreign Affairs for Ke Aupuni O Hawai`i, the Hawaiian Kingdom, and has served in that capacity since 2000.

AKAKA BILL - BOTH CRIME & CRIMINAL

The Akaka Bill, the Office of Hawaiian Affairs and the Department of Hawaiian Home Lands are all a compromise of true reconciliation, a total distraction to overt giving back what was stolen.
They form a strategy conjured up by the Tavistock Institute think tank in order to keep the masses occupied, pitted against each other and creating a distraction while picking the pockets of nations in broad daylight - Hawai`i included!
The issues of ceded lands and who actually has legal title to it is a pile of kukae!
What ceded lands are we talking about? The land was seized, not ceded!
Thanks to years of propaganda production, ceded lands has become a household word confusing even our own.
We all better wake from the hypnotic state induced on us all, whether by choice or by deception, whichever way you look at it.
We better all wake up before we self-destruct in the hands of those seeking to rule this world under a one world government, a new world order.

SUPERFERRY WINS IN COURT LOSS
Superferry Chronicle Authors Paik & Mander Explain Why
...the cushy federal loan guarantee for $140 million issued by the U.S. Maritime Administration, leaves the departing company in much better financial shape than if they were to continue in Hawai`i, running at a loss.
But the biggest coup of all for the Superferry corporation is that it got what it needed out of the deal: to prove the boat’s seaworthiness as a demo model in competition to build the Navy’s Joint High-Speed Vessel (JHSV).
Austal USA, an investor in Superferry as well as its builder, won the contract worth $1.6 billion last September to build ten JHSVs.
That’s why conducting an EIS has been anathema to Superferry from the very start.
Doing so would have kept the boat out of the water, and unable to prove itself against Austal USA’s competitors for the lucrative Navy contract....

INDIA COVERS HAWAI`I FAKE STATE PROTEST

Hundreds of the state's former governors, legislators, congressmen, judges, entertainers and their families packed the Capitol for the event. During the song "This is aloha," singer Danny Couch persuaded them and the audience to hold hands and sway to the music.
The Native Hawaiians outside weren't so cheerful. Longtime protester Richard Pomai Kinney carried his Hawai`i state flag upside-down as a sign of distress.
"Statehood is a fraud," said Kinney, who was 19 years old at the time. "My parents said Hawai`i would become a place only for the wealthy. Look at it today. There's nothing to celebrate."

The Hawai`i Superferry said it will cease operations on Thursday following a ruling today by the Hawai`i Supreme Court that went against the inter-island ferry service.

I was one of the few people who got a seat to hear oral arguments in the Supreme Court. The question before the court was whether or not the Apology clouded the title the State held on the “Ceded lands.” The argument between OHA and the State of Hawai`i were essentially the same.

WHAT DO HAWAI`I NATIONALS WANT ?
Here Is What They Say About Themselves, Their Countrymen And The US -
"The most common sense thing is for total independence.
We were a progressive modern nation of our time and recognized as a friendly, neutral nation within the Family of Nations, the predecessor of the League of Nations and the United Nations.
We had a democratic form of government, a constitutional monarchy with a bicameral legislative assembly.
The works and legacies of our monarchs are legendary and noteworthy.
Today under the American system, we are concerned about our lands, culture, people and lifestyle which has been under attack for over a hundred years.
This gets us angry as more Hawaiians desire total independence as a result.
The Kingdom of Hawai`i is not only Native Hawaiians but subjects of non-Hawaiian blood who were legitimate subjects of the Kingdom.
This racial argument is an American thing and not a Hawaiian thing.
So our concerns are well within our scope to protect all our subjects of the Kingdom.
We do expect reparations and restitution from the US for the injurious damages to our nation, land and people.
The US government is well aware of this and is attempting a piecemeal settlement.
If the tables were turned around; which would you do? I'm sure it wouldn't be a hard decision.
Remember, Hawaiians never hated Americans; but only those that did harm to us and the US government for its complicity and deceit.
We were never afraid that another country would take us over; we had over twenty-four treaties with various countries but the US is the only country that broke their treaties with us."

After more than a full year of operation, it’s time to give the albatross of inter-island travel known as the Hawai`i Superferry a progress report.
Has the high-speed ferry service given indications it can be profitable in the long term?
Has there been justification for Gov. Linda Lingle leading the charge, with state legislators close behind, to rewrite the state’s environmental laws to allow Superferry to operate?

WASHINGTON - Lawyers typically warn clients never to apologize for anything, since a plaintiff could seize upon the remorse as an admission of liability. But what happens when governments apologize?
A century after a cabal of American sugar planters, financiers and missionaries overthrew the Kingdom of Hawai`i, Congress said it was sorry. The U.S. Supreme Court soon will decide whether that apology meant anything - from a legal standpoint, at least.
The Hawai`i Supreme Court thought it did. Last year, that court cited the 1993 Apology Resolution to block the state from transferring any of the 1.2 million acres of land - some 29% of Hawai`i's total - received from the federal government upon statehood in 1959. Those lands once belonged to the Hawaiian crown or its subjects, and were confiscated by the Americans without compensation....
...The Americans eventually forced Queen Liliuokalani to abdicate and declared themselves rulers of a new Republic of Hawai`i.
The indigenous population soon was swamped by settlers from the mainland....

What Really Happened At The US Supreme Court

Reading the newspaper accounts of the State of Hawaii v. the Office of Hawaiian Affairs oral arguments at the Supreme Court I asked myself, were they in the same courtroom that I was?
Hawai`i newspapers put a phony, positive spin on what actually went down.
The state's whole case is built upon the premise that the State of Hawai`i has "indisputable perfect title” to the “ceded lands.”
Well guess what? If their title was “indisputable” and “perfect” why are they in court?
And why have they been in court over this issue for 14 years? Because there is a dispute! There is a question of title!
OHA never challenged the state’s “perfect title” claim and argued instead that according to state laws, the state had a “fiduciary duty,” sort of a moral obligation, to take care of the Native Hawaiians.
That led Justice Ginsburg to ask, “The Native Hawaiians -- they do get 20 percent of the proceeds, correct?”
And the OHA attorney to answer, “That's correct…as a matter of State law they get 20 percent of the revenue from the ceded-lands trust…” (we all looked incredulously at each other…since when?)
Then he clarified, “…though the amount of that revenue has itself been the subject of protracted and unresolved litigation.” Oh, so we get 20%, but not yet! The check’s in the mail… Yeah, right.
Later, Justice Kennedy stated to the OHA attorney: “Your whole case rests on a cloud on the title in favor of your clients. But you - you ignore the cloud on the title that has been entered against the State.”

SUPERFERRY'S HIDDEN DECLINING RIDERSHIP
In a recent report, for the 5 months of September '08 through January '09 the Superferry transported about 75,000 passengers, or an average of about 15,000 passengers per month.

US HAS NO LEGAL STANDING IN HAWAI`I

According to a story in the Maui News Feb. 10, "State Lawmakers are considering passage of legislation that would require people seeking driver's licenses to prove that they're legally in the United States."
If passed, the state of Hawai`i could never issue another driver's license. From a standpoint of law absolutely nobody in Hawai`i - resident aliens, US citizens, even the state itself - "can prove they're legally in the United States."
The California Assembly could pass the same legislation and not run into these problems. This is because the the Guadalupe Hidalgo treaty of 1848 transferred Mexico's title to the United States, thereby making California legally part of the US.
The United States Congress twice rejected treaties proposing the annexation of Hawai`i. They opted to "annex" Hawai`i by joint resolution. Being a domestic law, no resolution other than one ratifying a treaty has any effect on an international level. For instance, Congress cannot annex Russia without Russia's consent.
U.S. Public Law 103-150 admitted that "the indigenous Hawaiian people never directly relinquished their claims to their inherent sovereignty as a people or over their national lands to the United States, either through their monarchy or through plebiscite or referendum."
Since the sovereignty of Hawai`i was never relinquished, Hawai`i is not legally part of or "in the United States."

HAWAIIANS DENOUNCE OFFICE OF HAWAIIAN AFFAIRS & STOLEN LANDS SETTLEMENT

In spite of short notice, sixty angry Hawaiians gathered at Hilo’s Keaukaha Elementary School Wednesday night to tell OHA trustees and members of the House Committee on Hawaiian Affairs what they think of OHA’s proposed ceded lands revenue settlement....
Just as with the 2008 settlement proposal, testimony in Hilo was 100% opposed to OHA receiving any ceded lands revenue.
Speakers were angry and emotional....
Most of those who spoke felt that OHA was taking from Hawaiians rather than giving to them. Said one: “After you guys take your cut, how does that affect the rest of us Hawaiians? We cannot make any more claims after that....”
That was one point those testifying at the hearing agreed on. As one explained: “You guys (OHA trustees) got the monetary value, we got the shaft. You stealing ‘em. You guys only topping off for yourselves.”
A Panaewa Hawaiian Homelands resident pointed out: “The ceded lands belong to God, not OHA.”
Another Hawaiian Homelands resident pointed out: “(When OHA was established in the 1978 ConCon) you changed to 49.9% and less (blood quantum) and my 25% children not going to get s*** from you guys.”
Keaukaha resident Albert Kalihi said, “Why not resolve it for the Hawaiian people (instead of for OHA)? I’m tired of being ignored. You wasting all of our time. I wish somebody would do something.”
Kilauea Marciel, a registered nurse said: “I don’t understand why the OHA is in charge of us and our complaints and our needs. Who do we go to that not on the State payroll? I go around begging for medicine to help homeless Hawaiians. OHA doesn’t help.”
Mililani Trask explained “OHA is a state agency guilty of breach of trust and mismanagement.” She argued that OHA’s policy of creating non-profit corporations to manage its growing property empire was a scheme to personally enrich individual trustees and create a power base for them at the expense of OHA’s Hawaiian beneficiaries....
Roy Takalao asked: “Why you going to steal for? Stealing is wrong.”

MAUI CELEBRATES TORCH MARCH
LAHAINA - A sea of people of all ages embraced and honi'd, or touched noses, Friday at Lahaina while celebrating the end of a weeklong, 193-mile torch march around Maui to raise attention for Native Hawaiian issues.
Elders of Na Kupuna O Maui had joined the marchers at Puamana, walking the last 1.2 miles of the journey called E Ka`apuni A Ho`a Kukui Na Moku`aina.
An estimated 400 people ended the march about 4:15 p.m. on a hot, dusty patch of Moku`ula, or Malu`uluo Lele Park, with traditional haule-lani rites honoring deceased members of the Native Hawaiian community.
Coordinator Ke`eaumoku Kapu said the marchers fulfilled their goal, to ignite "a spark of light that spread across all of Maui." The "light," represented by the trek's continually lit torches, signified unity and enlightenment about Native Hawaiian issues, he said.
Those issues included the ceded-lands lawsuit now before the US Supreme Court; threats to Native Hawaiian trusts, exemplified by lawsuits related to Kamehameha Schools admissions; and Native Hawaiian health, education and well-being, he said.
