AKAKA BILL = FRAUD

...a Kahului resident, whose great-great-grandfather helped draft 1839 documents of the Hawaiian kingdom, said he opposes the Akaka Bill "mind, body and soul."
"The Akaka Bill is a race-based bill," said Foster Ampong, an advocate for Hawaiian independence. "Because you're talking about Native Hawaiians, as defined by law - 50 percent or greater Hawaiian blood."
Ampong said the Akaka Bill does not address the most critical legal issue for Hawaiians - nationhood.
"The Akaka Bill is another attempt at creating a fraud or appearance that the Hawaiian Islands and people were acquired by the US lawfully - and in essence and in fact it wasn't," he said.
"For me, it's my passion. It's what I really, sincerely believe - We are Hawaiian nationals, not just Native Hawaiians by blood or ethnicity. . . . We have our very own bill of rights that formed our lahui, our nation," Ampong said.
Likewise, another Akaka Bill opponent points out that the kingdom of Hawai`i had a relationship as a co-equal with "England, France, Russia, Belgium, Netherlands, all the powers of the world."
Kaleikoa Ka`eo, Hawaiian studies instructor at Maui Community College, said of the Akaka Bill - "I am actively involved to organize against its passage" because the bill would diminish Hawai`i's international standing, making it "go to the back of the line" and give up a status it already had.
"It's like saying you attained citizenship - and now you give yourselves the right to attain a green card as an alien," he said.
For Ka`eo, a major issue "is that the so-called Akaka Bill provides no land, not one acre of land, and no access to water - that's not really self-determination," he said....

"On Monday, May 11, the U.S. Circuit Court for the District of Columbia will hold an important hearing on our case.
We will be challenging the Aug. 7 ruling of U.S. District Court Judge James Robertson.
He has held that the Indian Trust beneficiaries are not entitled to any interest on the $455 million that he believes the government failed to place in our individual trust accounts.
We will argue that we are entitled to interest on that money and say that his method of calculating how much money was not properly credited was inaccurate.
The government has indicated it will argue that you, the trust account holders, are not entitled to any money at all...."

SUPERFERRY JUMPS SHIP ON RENT

Waterfront Partners sued Hawai`i Superferry in Circuit Court yesterday, alleging the Superferry has failed to pay $51,310 in rent on its leased headquarters at One Waterfront Plaza.
The landlord alleges the Superferry stopped making lease payments on March 20, the day after Superferry ceased operations in Hawai`i because of a state Supreme Court ruling.

"I won't be celebrating the 50th anniversary of statehood. I want to get our country back," says Henry Noa, who taught school in Honolulu until a few years ago, when he was elected prime minister of the Reinstated Hawaiian Government....
Asked whether his plans for independence are practical, Noa gets emphatic.
"Was it practical for the Jewish people to reclaim Israel?" he asks. "It took them 1,800 years. So what's 50 years to us?..."

The Lingle administration campaigned on a pledge to cut the waiting list for leases at the Department of Hawaiian Home Lands.
But the plan has turned out to be a back-door land grab by commercial and development interests.
Governor Lingle has proceeded by cutting funding for the agency and forcing DHHL to rely on income from commercial leases, most of those to non-Hawaiians.

"...Our primary purpose for contacting you, Mr. President, is to solemnly inform you of our categorical opposition to the proposed legislation now before the U.S. Senate and House that is entitled The Native Hawaiian Government Reorganization Act, which is commonly referred to as the 'Akaka Bill.'
We reject this Akaka Bill for weighty reasons. To begin with, the historical harm the United States first committed in Hawai`i in 1893 brought down, not a “Native Hawaiian Government”, but the independent Hawaiian Kingdom composed of Kanaka Maoli as well as non-Kanaka Maoli subjects....
...Consequently, the Kanaka Maoli people and other Hawaiian Kingdom heirs have, since that time, accumulated fundamental political and other claims against the United States under international law that the United States must recognize rather than hope to dispel via the enactment of this Bill.
Indeed, in our view, the passage of this Bill would constitute nothing less than a second illegal denial of our Kanaka Maoli people’s right to self-determination and the Kingdom heirs’ right to sovereignty...."

WHY IS INDEPENDENCE BETTER FOR HAWAI`I THAN FEDERAL RECOGNITION?

Federal recognition (Akaka bill) is yesterday's solution.
It's thesis is again going hat in hand to the US federal government for help and turning Hawaiians inward and against each other in their own land.
For more than 100 years, this has not worked.
Instead, we can seize the opportunity to create a dynamic new nation through which we can maintain our culture and values, have more control over our future and be a leader among the Pacific nations.
Let This Be Our Legacy To Future Generations

Native Hawaiians constitute roughly 22 per cent of the state population, but they represent 54 per cent of the prison population.
They also have the lowest per capita income, the highest poverty rate and the shortest lifespan of any ethnic group in Hawai`i.
Hawai`i public school students receive very poor education by any standard of measurement. They consistently rank among the lowest of any state in test scores.
Most of the bright students who manage to learn something in spite of the handicapped school system leave Hawai`i for foreign colleges and careers.
Tens of thousands of residents have no medical insurance at all.
In some cases, the lives of the working poor are worse than the unemployed.

WHAT DOES A FREE HAWAI`I LOOK LIKE ?
Hawai`i Nationals want and deserve freedom just as much as US citizens do.
Some say, “the illegal act of war that overthrew your Queen can’t be erased . . . like it or not, you’re all Americans now.”
Yet every day we see people around the world fighting for and winning back their national rights. Their quest like ours is totally legitimate and very real.
Like everyone else Hawai`i Nationals want four basic things –
FREEDOM – The freedom to decide their own future for themselves. That “freedom” was taken away when the sovereign Nation of Hawai`i was overthrown in 1893. It was taken away again by illegal annexation to the United States in 1898. And, it was taken away a third time by the fake statehood vote in 1959.
According to international law, a new vote must to be taken that offers three options – 1) Independence, or 2) Free-Association or 3) Integration (nation within a nation.)
RIGHTS – The rights of the independent Nation of Hawai`i were never relinquished. The destruction and denial of these rights must cease.
Everyone who descends from citizens of the Hawaiian Nation prior to 1893, Native Hawaiians and all others, are entitled to these rights.
IDENTITY – The political identity of Hawaiians must be acknowledged by the United States. Hawaiians will decide their own future, without interference by the US.
Only those with any measure of indigenous blood may define who is Native Hawaiian. A blood quantum imposed by others is an unacceptable means to divide and conquer.
LAND BASE - Hawaiians love their country and lands just as much as US citizens love the US. Hawaiians want ALL their land back, not just some of it.

THE EFFECTS OF OVER A CENTURY OF U.S. OCCUPATION OF HAWAI`I
Hawaiians suffered since the first Western contact in 1778.
Western diseases, to which Hawaiians had no immunity, decimated their numbers.
At the time of western contact, some 800,000 people inhabited the Hawaiian Islands. By 1805 that number had been halved.
By 1853 there were only 71,000 Hawaiian or part-Hawaiian people in the islands. Within 100 years of western contact, Hawaiians had been reduced by nearly 90 percent.
Today the numbers of people who claim some native Hawaiian ancestry have increased to over 400,000.
But only 239,000 live in Hawai`i. They are the poorest segment in the state.
They make up 37 percent of the state's homeless population, according to a 2003 survey.

AKAKA BILL - IF IT'S SO GOOD, WHY ARE THEY AFRAID TO TELL YOU MORE?
I still don’t support the Akaka Bill because of the shadiness that is surrounding it.
Why aren’t there meetings and Q&A sessions hosted on every Island where the people can come to ask questions and get answers regarding this bill?
And if there were, why aren’t there any more?
It’s about education- it would be irresponsible of OHA to support this bill without educating the prime group that this bill would affect the most.
And if it happened already, it should be happening more....

HOUSE GUESTS FROM HELL -
HOW HAWAI`I NATIONALS FEEL ABOUT THE US OCCUPATION
Let's pretend I visit your house. You offer me food and rest. I decide to stay.
Then, I order you and your family around, use your things and rearrange the rooms. I take down your photos and religious symbols, replace them with my own and make you speak my language.
One day, I dig up your garden and replace it with crops that I can sell. You and your family must now buy all of your food from me.
Later, I invite my father and his buddies over. They bring guns. We take your keys. I forge a deed and declare my father to be the owner of your house. I bring more people. Some work for me. Some pay me to stay in your house. I seize your savings and spend it on my friends. You and your family now sleep on the porch.
Finally you protest. Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave. I tell you, "Sorry, I was wrong for taking the house." But when you demand your house back, I tell you to be realistic.
"You are part of this family now, whether you like it or not," I say. "Besides, this is for your own good. For all that I have done for you, why aren't you grateful?"

We’re going to have to go out and find other employment for Alakai,” said the president of Hawai`i Superferry, Thomas B. Fargo, a retired Navy admiral who once commanded American forces in the Pacific. “Certainly the military may very well want to lease this particular ship....”
A shipbuilding analyst in Florida, Tim Colton, said the company’s owner and chairman, John F. Lehman, a former Navy secretary, was well positioned to lease the Alakai and a just-finished sister ship to the Navy....
State Representative Hermina M. Morita, a Democrat and chairwoman of the Committee on Energy and Environmental Protection, said she never thought either ferry would be profitable.
“You look at the players involved,” Ms. Morita said. “You have to question their motives....”
