FEDERAL RECOGNITION SHOULD OUTRAGE HAWAIIANS

After being amended for the 10th time, the Akaka Bill is thinner than nonfat milk.

Hawaiians, why are you not upset about this? Why do you let people like the governor, the Office of Hawaiian Affairs and two senators compromise you right out of your independence, freedom and your future native rights?

Remember, these people who are supposed to represent you consider themselves Americans.

Recognition is a joke. Do you need someone to tell you that you are Hawaiian?

Do you like them telling you if you're not 50 percent Hawaiian, you're not a Hawaiian so you don't qualify for affordable homes while the rich haole who has no Hawaiian blood buys up land by the acres and lives here three months out of the year?

You need to be concerned about our natural resources, our ceded lands, geographical location, our independence. These are the things that will afford education, health care and a future for our people.

We need to break free from the occupying oppressor. We are 400,000 Hawaiians strong.

HOW WOULD YOU LIKE IT IF THIS HAPPENED TO YOU ?

Let's pretend I visit your house.

You offer me food and rest. I decide to stay.

Then, I order you and your family around, use your things and rearrange the rooms. I take down your photos and religious symbols, replace them with my own and make you speak my language.

One day, I dig up your garden and replace it with crops that I can sell. You and your family must now buy all of your food from me.

Later, I invite my father and his buddies over. They bring guns. We take your keys. I forge a deed and declare my father to be the owner of your house.

I bring more people. Some work for me. Some pay me to stay in your house.

I seize your savings and spend it on my friends. You and your family now sleep on the porch.

Finally you protest. Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave.

I tell you, "Sorry, I was wrong for taking the house." But when you demand your house back, I tell you to be realistic. "You are part of this family now, whether you like it or not," I say. "Besides, this is for your own good. For all that I have done for you, why aren't you grateful?"

FEDERAL RECOGNITION VIOLATES INTERNATIONAL LAW

We ku'e (reject) the Akaka bill pending in the U.S. Senate....

Whereas, we, descendants of the nationals of the Hawaiian Kingdom
independent state founded in 1810, who thrived in Ka Pae 'aina prior to the unlawful United States military invasion of 1893, and U.S. military occupation and purported annexation in 1898, in violation of treaties and international law, have not been afforded the opportunity, unlike the peoples of other territories named on the said U.N. List, to exercise our full right of self-determination under international law, including the option of full independence;


Whereas, the United States itself formally recognized, in U.S. Congress Joint Apology Resolution (PL 103-150) signed by U.S. President William J. Clinton on Nov. 23, 1993, that we kanaka maoli people, who constituted the overwhelming majority of the nationals of the Hawaiian Kingdom in 1893-1898, have never directly relinquished our inherent sovereignty nor our national lands to the United States;...

We, the kanaka maoli people of Hawai'i [Native Hawaiians], are learning freedom and what caused us to nearly lose our identity.

Now that we are getting more akamai [smart] or educated with law and the processes of law, the de facto government in Hawai'i is moving fast to claim all.

We see what is happening on Moloka'i and that won't stop, we know that. So what do we do?

We can't wait around until something else is taken away then come together and make noise.

Gotta start now, people! Let's move now. The Akaka Bill is not for me, yet they say it is for all kanaka [people.]

ALOHA MAI AND WELCOME ! - IF YOU'RE VISITING FREEHAWAII.INFO FOR THE FIRST TIME.

Free Hawai'i means returning the Hawaiian Islands to an independent, sovereign nation status, like it was before it was illegally overthrown by US marines and rich sugar barons in 1893.

In 1993, President Clinton formally apologized for that act and publicly acknowledged the illegality of the overthrow.

WHY DO HAWAIIANS WANT THEIR NATION AND LAND BACK ?
  • Because today Native Hawaiians are at a criical juncture to survive as a people.
  • Because for foreign business interests it's a matter of profit and loss. For Native Hawaiians it's a matter of life and death.
  • Because we seek to protect our natural resources.
  • Because while Native Hawaiian families are struggling to survive, their water is being shipped to the other side of the island so that housing and resorts can be built by rich foreigners.
  • Because it is our national inheritance - never given away by either native treaty or by native vote.

ANNEXATION OF HAWAI'I NOT DONE LEGALLY

Amy Stringer, in her March 3 letter, asks why we haven't let the "annexation" of Hawai'i go and states that the "issue of our annexation should not be debated."

Ms. Stringer, we would have no problem if the annexation had been done legally. The annexation of Hawai'i was done by a joint resolution of Congress, not by treaties, as was required.

A joint resolution has no legal standing in a foreign country, which is what Hawai'i remained, even under the provisional government. This means that the status of the Hawaiian people as a distinct and sovereign nation is beyond debate.

If America were the champion of justice as it portrays itself to be, then it would have no problem addressing the injustices it committed with more than an "I'm sorry."

If you're sincerely sorry for taking part in a theft, restitution by means of a complete return of items stolen is in order.

America may be beneficial to Hawai'i, but the fact remains that it is still the master in someone else's home.

FEDERAL RECOGNITION CREATES PHONY NATION

...We would be forced to live with endless repetitions of a fake Hawaiian culture pushed in our faces if the Akaka bill becomes the law of the land: the phony, nauseatingly stupid, missionary hula; the castrati-falsetto hymn praising colonialist princes and princesses; senseless rewrites in Christian versions of Hawaiian myths as fairytales.

It's a kind of modern-day racist minstrel show with Hawai'i's numerous ethnic minorities costumed as Native Hawaiians and putting on demeaning skits...

A lie repeated often enough ends up becoming a kind of hyper-reality. Existing law long ignored versus the lie made into new law by politicians serving the same special interests that have for too long held Hawai'i's economy in a monopoly death grip...

Like one of those charity schemes wherein they pretend to raise money for a good cause but give only a couple of pennies on the dollar to them, the Akaka bill is one of the most outrageous political con games ever - with newly minted fake Native Hawaiians serving as dumb shills to leverage increased government funds for yet more deadhead bureaucrats...

HAWAIIAN KINGDOM HAD CITIZENS FROM MANY COUNTRIES

The March 3 editorial in support of the Akaka Bill quoted Gov. Linda Lingle's testimony saying that annexation "effectively subordinated the Native Hawaiian government to the federal government.
Hence the United States' relationship to the people governed by the Native Hawaiian government was political, not racial, in nature."

One problem with this statement (aside from the fact that the government wasn't actually "subordinated" but simply made ineffective while its territory was occupied) is that it was not a Native Hawaiian government, anymore than the state government today is a Native Hawaiian government or the government of the United States is a European-American government.

A review of the naturalization registry of the Hawaiian kingdom reveals naturalized Hawaiian citizens from China, Great Britain, Germany, Portugal, Italy, Spain, France, Switzerland, Norway, Sweden, Denmark, Holland, Austria, Hungary, Prussia, Mexico, Chile, Ecuador, Australia, New Zealand, Tahiti, Samoa, Africa, Jamaica, Canada, India, the United States, etc.

Children born in Hawai'i were automatically citizens regardless of their race or their parents' place of origin. Citizens of all races voted for [and served in] the government. So it is just plain wrong to say Hawai'i had a "Native Hawaiian government" under the Hawaiian kingdom.

I am arguing against the Akaka Bill, but I'm not arguing against sovereignty.

True sovereignty is the restoration of Hawaii's independence where once again people of all races who so choose can be naturalized and enjoy rights and protections in the multiracial independent country of Hawai'i, consistent with Hawai'i's history.

Linda Lingle: As I previously testified before your committee in 2003, this bill is vital to the survival of the Native Hawaiian people, it is vital to providing parity in federal policy for all native peoples in America, and it is vital to the continued character of the State of Hawai'i.

David Ingham: This bill is vital to nothing but the interests of a precious few people with alot to lose or alot to gain personally at the expense of Hawaiians.

This bill enriches a few at the expense of Hawaiians.

You have shown that you are unwilling to exercize your authority as governor to lift Hawaiians, and you have shown you either know nothing, or know damn well what you are supporting in asking that Hawaiians be subjected to federal indian policy.

LL: Let me conclude by telling you that this bill will be a unifying force for our state.

DI: Unification of the State will kill and sicken Hawaiians. Assimilation has a nasty habit of doing that. How bout you learn to live in Hawaiian's world rather than asking them to live in yours? After all, they are the Hawaiian Islands or you don't see it that way?

LL: It is supported by every elected official of both major political parties, it is supported overwhelmingly by people of all ethnic backgrounds, and it is supported by a majority of the state's business community, including the two largest banks.

DI: Interesting you don't mention Hawaiian support for the bill.... the support isn't there. A rare glimmer of truth, albeit by omission, in this otherwise uninformed and misleading testimony.

LL: Your passage of SB147 will allow a process to begin that will lead to the kind of self-government enjoyed by the nation's other indigenous people and it will reaffirm our nation's commitment of equal treatment for all its citizens.

DI: The process is well under way without the bill. As Dan Inouye and the founding fathers of the United States agree: "Native Hawaiians can go ahead and start reorganizing their government regardless of what happens with the legislation."

I think you really need to go visit a reservation governor Lingle, go see just how much Indians are "enjoying" what you are proposing for Hawaiians.

If it doesn't make tears roll down your face , I'll understand why you support this legislation.

Linda Lingle: Besides granting long-delayed justice to the Native Hawaiian people, SB147 achieves four important results for everyone in the State of Hawai'i.

David Ingham: Do tell

LL: 1. Enhances the ability of individual Native Hawaiians to become more self-sufficient, which reduces their reliance on state and federally funded services.

DI: All you have to do to "enhance the ability of Hawaiians to become more self-sufficient" is get them access to thier land, and resources and lift restrictions on their rights .

You, governor Lingle, as the governor of the State of Hawai'i have this ability right now. Why aren't you doing it?

LL: A Native Hawaiian government using existing appropriated funds will be in a position to engage in meaningful economic development that not only will generate revenue for social services and other programs, but most importantly will create new employment opportunities for individual Native Hawaiians.

DI: As I said, Hawaiians don't need the bill to Unify the Hawaiian governments. They need you governor Lingle to lift restrictions on access to their land and resources. If the funds you speak of are "existing appropriated funds" they don't need the bill to get them either.

LL: 2. Provides greater accountability for and makes more efficient and effective use of state and federal programs.

DI: Once again, Hawaiians don't need the bill to unify thier governments. to provide the greater accountability you speak of. If you are interested in consolidating Hawaiian government, why don't you facilitate the unification? You yourself said above that an effective Hawaiian government would benefit all of the people in Hawai'i.

LL: 3. Creates the best opportunity to preserve the Native Hawaiian culture.

DI: Yes it does.... So why aren't you applying the authority you have right now ,as governor, to get Hawaiians access to thier land rights and resources so that thier government can be effective? You got a better use for all that vacant land other than putting Hawaiians on it?

LL: The unique nature of Hawai'i is derived largely from the indigenous culture of the Native Hawaiians.

DI: Whom, you might want to add, the State has neglected in spite of having control of the land and the authority to ensure Hawaiians thrive.

LL: Native governments, like the one established by this Act, are well documented to best nurture and protect traditional native culture and values.

DI: I'm sorry. That is a crock of crap. Independent government best nurtures and protects traditional culture and values. Do you suppose American culture and values woud be best protected if the United States was subject to domestic dependence under, say, the Peoples republic of China? Get a grip!

LL: 4. Protects existing programs by clarifying that the relationship between the United States and the Native Hawaiian people has government-to-government origins rather than racial origins. Current and continuing legal challenges are unnecessarily putting programs to benefit Native Hawaiians at risk.

DI: Perhaps I shouldn't have been so harsh...I didn't realize that you hadn't read the bill . There is nothing in the bill that protects a single program or entitlement. Last year, in April, the bill was ammendedto include these words: "provided that the provisions of Public Law 103-454, 25 U.S.C. 479a, shall not apply." This law is the List of Federally recognized tribes entiled to the kinds of protections you are speaking of here.

ASSOCIATED PRESS REPORTS OPPOSITION WIDE-SPREAD TO FEDERAL RECOGNITION FOR HAWAIIANS

When Gov. Linda Lingle testified before a U.S. Senate committee last week, she said a bill to give native Hawaiians political status similar to that of American Indians is overwhelmingly supported by Hawai'i Democrats, Republicans and people of all ethnic backgrounds.

In the islands, however, there is an undercurrent of largely ignored opposition to the so-called Akaka bill, even among the people it aims to help: native Hawaiians. A range of opponents were interviewed by the Associated Press in advance of the Senate Indian Affairs Committee vote on the bill Wednesday.

Opposition in the islands ranges from those who favor totally independent government for all of Hawai'i's people to those who object to special privileges for any ethnic group in a state where no one race is a majority. About half of the estimated 400,000 native Hawaiians in the United States live in the islands.

The legislation has also raised concern in other states. Sen. John McCain, R-Ariz., chairman of the Indian Affairs Committee, has said it could deplete already scarce federal funds for American Indian programs...

"The only ones supporting it are those receiving federal benefits," said Kai'opua Fyfe, a director of the Kauai-based Koani Foundation, an advocacy group that aims to educate Hawaiians and others on "the real history of Hawai'i and the current situation."

The Senate committee heard oral testimony only from bill supporters. Fyfe, who was at the hearing, told the Associated Press that he and other opponents were refused permission to testify and were told to submit their testimony in writing.

"The bill is bad for Hawai'i and bad for the U.S.," said Fyfe, who focuses his opposition on "the dysfunction of the Department of the Interior in serving its wards."

The bill provides a process for native Hawaiians to establish a governing entity. It also would set up an Office of Native Hawaiian Relations in the Department of the Interior to address native Hawaiian issues.

"It is absurd to think of placing Hawaiians under the Department of the Interior," Fyfe said.

Opponents also object to the fact that no hearings on the current version of the bill were held in Hawai'i, saying it has been changed several times.

Fyfe said he hopes to encourage McCain, who has opposed the bill, to come to Hawai'i to show the Senate Indian Affairs Committee chairman there is
strong opposition in the islands.

Linda Lingle: The Native Hawaiian Government Reorganization Act allows Native Hawaiians to receive parity with the nation's other indigenous peoples. To withhold recognition of the Native Hawaiian people therefore amounts to discrimination since it would continue to treat the nation's three groups of indigenous people differently.

David Ingham: Oh God! This just keeps getting worse.... I'm almost embarrassed for you..... Please tell me someone wrote this for you and you didn't have time to review it before you read it.... Don't you know the United States specifically permits itself to discriminate not only between tribes, but within tribes and even between individual Indians? Don't you know that? The Committee does, and every Indian in the room knew. I can't believe you said this.

LL:The United States has historically recognized Native Hawaiians as a separate indigenous people by entering treaties with them as early as 1826 and enacting over 150 pieces of legislation relating them, including measures as recent as 2004.

DI: Congress has acknowledged the trust relationship exists between the United States and Native Hawaiians. Native Hawaiians are the only group of indigenous people within the claimed boundaries of the United States who are acknowledged as trustees without a corresponding forfiture of Land, rights and resources.

Why would you want to disrupt that by supporting this bill...You after their claims governor? You and your quislings? The treaties the United States entered into with the Kingdom of Hawai'i were entered into with an Independent co-equal government, not seperate indiginous people.

Do you know the difference between the two in U.S. law? You have alot to learn governor. Or are you taking lessons from Twigg-Smith on revisionism?

LL: Yet today there is no one governmental entity able to speak for or represent Native Hawaiians. The Act before you today would finally allow the process to begin that would bring equal treatment to the Native Hawaiian people.

DI: In case if you hadn't noticed Governor, the process is already underway. The bill isn't necessary for Hawaiians to form a government or to unify the governments that are already operating.

You don't have to believe me on this. Take it from the senior Senator from your State, Dan Inouye: "sovereignty is inherent in the people" and does not depend on recognition by the U.S. government. Native Hawaiians can go ahead and start reorganizing their government regardless of what happens with the legislation. "

I am writing to ask that you vote against reporting S147, the Native Hawaiian Government Reorganization Act of 2005, favorably to the full Senate when your committee meets this coming Wednesday March 9th to discuss the bill.

Hawaiians are overwhelmingly opposed to this legislation.

This bill will transfer the state of Hawaii’s federally delegated responsibility for the betterment of Native Hawaiians back to the federal government.

The state of Hawaii, as a condition of statehood, was ceded nearly two and a quarter million acres of land with which to meet its obligations to the federal government and Native Hawaiians.

Much of the land the federal government transferred to the state for the “betterment of the conditions of Native Hawaiians” remains vacant or is leased to non-Hawaiians.

Why would the federal government want to assume a responsibility it delegated to the state of Hawaii by adding nearly half a million Hawaiians to financially and legally troubled federal Indian policy when the state of Hawaii has nearly two and a quarter million acres of land at its disposal with which to meet its obligations?

In the face of ominous federal budget problems, particularly with respect to federal Indian policy, the proposal of the Hawaii congressional delegation is one that will benefit only narrow land interests in Hawaii at the expense of the federal government and Hawaiians.

Additionally, if passed into law, S147 will surely face years of litigation in the federal courts.

The state of Hawaii has the means to comply with the Statehood Act and it should be compelled to do so, not rewarded for its failure to do so.

Please vote against S147 at the Committee business meeting on Wednesday, March 9th 2005.

Linda Lingle: The United States is inhabited by three indigenous peoples-American Indians, Native Alaskans and Native Hawaiians.

David Ingham: Such blatant ignorance is mind boggling coming from a governor of a state of the union.

Lumping the Cherokee with the Dine or the Apache might be a convenient way for you to not have to think about the fact that these peoples were distinct from each other. Completely distinct from each other. Your mentality here is the same that prevailed in marching Indians for miles into combined reservations where five or more tribes were forced to live together. Peoples that didn't even share a common language, let alone laws, customs, or culture.

This is truly disgusting coming from the mind and mouth of the top elected official in Hawai'i. There were one hell of alot more than three indigenous peoples within the present borders of the United States. Hundreds ...maybe thousands.... we will never know for certain many of them were exterminated in the process.

LL: While these three indigenous groups differ in culture, history, and anthropological origin, all share three fundamental attributes: (1) they were here long before any European explorer ever set foot on the North American continent or the Hawaiian archipelago; (2) they lived according to their own governmental structures on their homelands long before the federal government of the United States was imposed upon them; and (3) the United States historically acknowledged their existence as distinct nations.

DI: This is crazy!!! In the last paragraph you are lumping them all together in to three groups, "three indigenous peoples", the American Indians, the Alaska Natives, and The Hawaiians.

But here in this paragraph you are saying saying the U.S. Acknowleged distinct nations. Are you saying saying there were only three nations the U.S. Acknowledged? Only three cultures? or maybe lots of nations but only three peoples?

It's clear to me that one of the two of us doesn't understand the history of the United States dealing with Indians. Where are you getting your information? What are you saying here? I can't believe you actually said this in a room where Indians were present. You should be thoroughly embarrassed by your ignorance.

LL: Congress has given two of these three populations full self-governance rights.

DI: This isnt true!!! Who told you this? Are you making it up? There are many thousands of indigenous people in the continental United States whose right to self determination is not acknowledged by the United States.

And there is not one indigenous people in the United States whose right to "full" self determination is acknowledged by the United States. I can't believe you said all this stuff with a straight face to a congressional committee. Were you trying to fool them? Or do you truely believe what you said? Or what? Don't you think that they know this is hog wash? Yikes!!!!

FREEHAWAII.INFO PRESENTS "A VISIT" WITH HAWAI'I GOVERNOR LINDA LINGLE

DAVID INGHAM, WORLD REKNOWN EXPERT ON FEDERAL RECOGNITION, REBUTS LINGLE'S TESTIMONY YESTERDAY FROM THE INDIAN AFFAIRS COMMITTEE HEARING IN WASHINGTON, DC

Linda Lingle: Let's look at the facts.

David Ingham: Yes! "Let's look"

LL: Native Hawaiians were governed by their own leaders and their own laws long before Europeans and Americans came to the Hawaiian Islands.

DI: And more importantly long after Europeans arrived

LL: The United States recognized and understood that the Kingdom of Hawai'i was a sovereign nation as evidenced by the exercise of Congress' constitutional authority to confirm treaties between the United States and the Kingdom of Hawai'i as far back as 1826.

DI: And as recently as 9 years before a handful of Americans took it upon themselves to unlawfully imprison the Queen and disrupt Hawaiian government. Let's not forget that part.

LL: When the United States annexed Hawai'i as a territory, it effectively subordinated the Native Hawaiian government to the federal government. Hence the United States' relationship to the people governed by the Native Hawaiian government was political, not racial, in nature.

DI: What in the world are you talking about? The Kingdom of Hawaii was never subordinated to anyone. Are you talking about the pre-1840 government? Are you denying the advancements Hawaiians made in creating a constitutional independent kingdom? Do you discount their sacrifice?

LL: To those who opine that SB147 will result in racial discrimination, I would posit that the only discrimination that can reasonably be associated with this bill is if it fails to become law. Let me explain this point.

DI: Please do, I'm very interested in how now, all of a sudden , after the State of Hawai'i has failed so miserably in meeting its obligation to Hawaiians, that the same kind of treatment from the federal government, administering the same responsibility, will make the kind of discrimination Hawaiians have suffered on State of Hawaii's watch somehow go away.

HAWAIIAN INDEPENDENCE IS ABOUT A COUNTRY

Regarding the joint commemoration of Martin Luther King Jr. Day and the Hawaiian kingdom "overthrow" anniversary -

What David Rosen fails or refuses to recognize (Letters, Feb. 15), first, is that the struggle for Hawai'i's independence is about a country and its nationality, not about race.

The Hawaiian kingdom was (is) an inclusive country with nationals of many races enjoying equal rights and protections, and that is what those of us who support independence seek to restore.

Second, later in his life, Dr. King took a strong stand against colonialism, imperialism and militarism. This, as much as his message on race, is what has relevance for Hawai'i historically and today.

Rosen also makes a statement about an article from the Los Angeles Times in which, Rosen says, "a Marine was quoted as articulating an apparently prevalent sentiment among Hawai'i-based military personnel and their dependents that 'we're just not wanted (in Hawai'i) ... I can't wait to leave.' "

The sentiment expressed, however, when read in context, is clearly due to the fact that they are military personnel, and is based on the behavior and impact of the military, and has nothing to do with race.

The article actually only demonstrates how widespread resistance is to the U.S. military presence in Hawai'i.

More and more people are recognizing the fact that Hawai'i is occupied, something that I have no doubt Dr. King would have opposed had he been aware of the truth of Hawai'i's history that has been exposed in recent years.
