US FEDERAL COURT SAYS NATIVE HAWAIIANS ARE NOT NATIVE AMERICANS

A federal appeals court has upheld a lower court's ruling that Native Hawaiians cannot apply for recognition as Native Americans.

The 9th U.S. Circuit Court of Appeals agreed with the U.S. Department of Interior that the court doesn't have jurisdiction because it's not a case of racial discrimination.

The court said Congress should "apply its wisdom" in deciding if Native Hawaiians should be eligible.

In 1978 the Interior Department established procedures for "acknowledging" American Indian tribes so they could receive certain benefits. The regulations applied only to the 48 contiguous states and Alaska.

Patrick Kahawaiola'a, Virgil Day, Samuel Kealoha Jr., Josiah Hoohuli and Ka Lahui Hawaii sued U.S. Secretary of the Interior Gale Norton, saying the geographic limitation excluding Hawaiians is unconstitutional racial discrimination.

U.S. District Judge Alan Kay dismissed the case and the plaintiffs appealed.

"Bluntly put," wrote U.S. Circuit Judge Sidney R. Thomas, in explaining the dispute, "the Department of Interior was hanging out a sign that said: 'No Hawaiians need apply."

In siding with the Interior Department, the Court of Appeals said Native Americans have historically been treated as members of "quasi-sovereign tribal entities" in formal relationships with the U.S. government. Therefore, the special preferences given to them were not racial but political.

The appeals court said the history of Native Hawaiians was different from that of Indian tribes because Hawaiians were once part of a kingdom "that was treated as a co-equal sovereign alongside the United States."

IS IT ANY WONDER THAN MORE AND MORE PEOPLE WANT THE ILLEGAL U.S. OCCUPATION OF HAWAI'I TO END?

Native Hawaiians constitute roughly 20 per cent of the state population, but they represent 54 per cent of the prison population. Not coincidentally, they also have the lowest per capita income, the highest poverty rate and the shortest lifespan of any ethnic group in Hawai'i.

Hawai'i public school students receive a very poor education by any standard of measurement. They consistently rank among the lowest of any state in test scores.

Education reform has been talked to death by every governor and legislature of the past 30 years, but nothing substantial has been done.

This has led to a "brain drain" in the islands. Most of the bright students who manage to learn something in spite of the handicapped school system leave Hawai'i for foreign colleges and careers.

In the 1980s, Hawai'i gained the enviable reputation of providing medical insurance to the highest percentage of residents of any state. A decade after the state ended dental cover, toothless smiles are commonplace among the poor. Tens of thousands of residents have no medical insurance at all.

Despite higher profits for many businesses, jobs are scarce and most of the available work pays minimum wage or close to it... In some cases, the lives of the working poor are worse than the unemployed.

Among other things, they don't qualify for state financial assistance or full food stamp benefits. Even during the height of the hotel building boom in the 1980s, workers in the upscale South Kohala district of the Big Island were forced to sleep in their cars or public parks because they couldn't afford the high rents on hotel pay.

Today most of the Island of Hawai'i (Big Island) as well as the islands of Molokai, Lana'i and Kaua'i are economic wastelands with little opportunity to make a decent living. On Kaua'i workers often share apartments or small houses with several other workers because rents are too expensive for one or two individuals to afford.

On every island married couples with children often work two jobs each to make ends meet - if they are fortunate enough to find that many jobs, even at minimum wage.

Aside from housing, transportation and food expenses contribute heavily to Hawai'i's staggering cost of living. The prices of gasoline, mandatory auto insurance, used cars and repair work are considerably higher than the mainland.

And only the city of Honolulu has reliable public transportation. On the other islands owning a car is a necessity to be able to work or look for jobs.

Hawai'i imports two-thirds of its food from the mainland and locally-grown food is expensive due to high land prices.

Although a relative scarcity of farmable land exists in the islands, some economists have concluded that land prices are artificially inflated through manipulation by the Big Five, giant land-holding companies owned by descendents of the five most influential missionary families who settled in Hawai'i two centuries ago.

But critics argue that even the food imported from the mainland shouldn't cost as much as it does. One supermarket manager admitted candidly that Matson Navigation shipping adds an average of only 18 per cent to the cost of imported food.

Yet prices range between 30 and 40 per cent higher than California where the Matson ships pick up the food for delivery to Hawai'i... Meanwhile, the situation grows worse daily for the vast majority of people in paradise and it's unlikely to reverse direction anytime soon...

In the past, Hawai'i was known for its aloha spirit and laid-back lifestyle. But by the early 1990s tourism, by then underpinning the state's economy, was under threat from cheaper competition.

The Gulf War and early 1990s recession lost Hawai'i its status and a lot of its visitors. The end of the Cold War saw cutbacks in military spending... Now aloha is difficult to find as various ethnic groups vie with each other for the last crumbs of the once-large economic pie.

And the pace of life has become frenetic in too many ways.As one long-time resident commented: "Hawai'i is turning into one of those Caribbean tourist islands where you have fancy hotels and a tiny rich neighbourhood and the rest of the island is a shantytown of poverty and crime."

After three decades of economic growth and prosperity, Hawai'i took a downturn 15 years ago and the Aloha state has never fully recovered.

In most respects things are getting worse every year. The effects have been devastating to those living on the margins of island society, particularly native Hawaiians. Other ethnic minorities have also been forced to bear the burden.

At the same time, however, many hotels and other big businesses in Hawai'i are reaping record-level profits today.

The statistics tell a story the Hawai'i Visitors Bureau would rather not see in print: In a state that has the most expensive cost of living in the US, one-in-10 residents lives under the federal poverty level. A conservative estimate is that 30,000 people are homeless, but the actual number is likely to be far higher.

Hawai'i has one of the worst hard drug problems of any state. The state and federal government spent hundreds of millions of dollars on three decades of helicopter raids on rural marijuana growers and doled out prison sentences equal to murder convictions in some cases.

Marijuana is now scarce and prohibitively expensive. The drug of choice is the much-cheaper crystal methamphetamine, a highly-addictive stimulant that causes violent behavior.

The meth epidemic and widespread poverty has resulted in a state prison system that is bursting at the seams, corrupt and inhumane.Unable to afford the cost of building new prisons, Hawai'i at first assigned three or four prisoners to cells built for two with the extra inmates sleeping on floors besides the toilet.

Later the state shipped several hundred inmates to mainland prisons where incarceration expenses were cheaper.

POLYNESIAN FARMERS EARN PRAISE IN SCIENTIFIC STUDY

Hawai'i's early Polynesian settlers have been lauded for their greatness as navigators, but they don't get enough credit for their farming skills, according to an international research team.

Writing in the June 11 edition of the journal Science, the researchers conclude that Polynesian settlers were able to identify swaths of mineral-rich soil and establish vast agricultural complexes where they raised sweet potatoes and other crops.

"They were fantastic farmers. They were able to develop and sustain intensive agricultural systems in tropical environments that are very difficult to farm," said Peter Vitousek, a professor of biological sciences at Stanford University and lead author.

Vitousek and his co-authors, including M.W. Graves of the University of Hawai'i-Manoa, focused on Kohala on the Big Island, where remnants of long-abandoned fields are still visible.

Soil tests provided evidence that early inhabitants discovered a "sweet spot" of high soil fertility under dense forests that received enough rain to harvest large quantities of sweet potatoes.

The scientists said that combination of rainfall and fertile soil did not exist on Kaua'i, O'ahu and Moloka'i, where taro was more common.

Anthropologists speculate that pressure to find new food sources may be one reason why Kamehameha I launched an invasion in 1795 that culminated in uniting the islands.

HOW WOULD YOU LIKE IT IF THIS HAPPENED TO YOU ?

Let's pretend I visit your house. You offer me food and rest. I decide to stay.

Then, I order you and your family around, use your things and rearrange the rooms. I take down your photos and religious symbols, replace them with my own and make you speak my language.

One day, I dig up your garden and replace it with crops that I can sell. You and your family must now buy all of your food from me.

Later, I invite my father and his buddies over. They bring guns. We take your keys. I forge a deed and declare my father to be the owner of your house.

I bring more people. Some work for me. Some pay me to stay in your house. I seize your savings and spend it on my friends.

You and your family now sleep on the porch.

Finally you protest. Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave.

I tell you, "Sorry, I was wrong for taking the house." But when you demand your house back, I tell you to be realistic. "You are part of this family now, whether you like it or not,"

I say. "Besides, this is for your own good. For all that I have done for you, why aren't you grateful?"

HOW DID HAWAIIANS BECOME OUTCASTS IN THEIR OWN LAND ?

HERE'S WHAT THE HISTORY BOOKS WON'T TELL YOU -

Western diseases, to which Hawaiians had no immunity, decimated their numbers.

At the time of western contact, some 300,000 people inhabited the Hawaiian Islands.

By 1805 that number had been halved. By 1853 there were only 71,000 Hawaiian or part-Hawaiian people in the islands.

Within 100 years of western contact, the Hawaiian population had been reduced by nearly 90 percent.

According to the 2000 census, the numbers of people who claim some native Hawaiian ancestry have increased to over 400,000. But only 239,000 live in Hawai'i and they are the poorest, most locked-up population in the state.

Although they only make up about 20 percent of the state's population, in June 2001 they made up 39 percent of the state's prison population, according to the state Department of Public Safety.

Sadly, they make up 37 percent of the state's homeless population, according to a 2003 survey by SMS Research and Marketing.

Hawaiian History Complex And Should Be Studied

I am a strong believer that everyone who lives in these islands should learn everything about Hawaiian history, not just a skim through a paragraph in an American history textbook.

King Kalakaua was not the best choice of a ruler (Letters, June 23). However, Kalakaua brought back a lot of cultural activities that were on the brink of being lost and he was the first world leader to travel around the world, visiting all the powerful countries as a representative of the Kingdom of Hawai'i.

Yet, he had a bayonet pointed at his head by his American-born Cabinet members and was forced to sign a constitution that gave them more power.

As for Queen Lili'uokalani, it is so evident that her whole heart was for her people. If that's not the only characteristic that a virtuous leader should have, then please tell me what is. It's sad to hear that an island resident feels that "the queen herself was weak, arrogant, and failed as a leader."

I am a University of Hawai'i Hawaiian Studies major and of all the researching that I have done, on both sides of the story, there was not one account of the queen showing arrogance.

No, America is arrogant.I do support an independent nation of Hawai'i.

As for Hawaii being better off under America, I must totally disagree.

Tahitians still speak Tahitian, Samoans still speak Samoan, Maori still speak Maori. My people have yet to fully learn their mother tongue.

Better for who, Hawai'i or America?

ECONOMY DRIVING AWAY HAWAIIANS AND THEIR ALOHA

Unless we immediately find a way to preserve and help the Hawaiians the tourism industry will soon find aloha harder to sell.

With the cost of homes soaring into the millions and thousands of Hawaiian families being forced to move to the Mainland, we are depleting our greatest natural resource for aloha.

Regardless of myopic rationalization by evolutionists that Hawaiians were just lucky they got here first, the place we live and the reason we love it is Hawaiian.As Hawaiians lose their young to hopelessness and despair and moving away, aloha is in trouble.

The Hawaiians who grow up angry all go to prison, and the poor wind up living on the beach until we roust them.

Those of you who found no problem in plopping $100,000 or more down on a home just to resell it - including brokers who buy their listings - are adding to the problem if you don't reach out and help others who can't.

Homeowners who recently sold their $200,000 to $300,000 homes for $650,000 and up then couldn't afford a new house payment because everyone played the same greed-guided game know.

Mayors and governors ought to appoint more Hawaiians to government posts. Greed, selfishness, nepotism and a lust for control are not your friends.

SIX SERIOUS QUESTIONS TO ASK OHA WHEN THEY COME TO YOUR CITY WITH THEIR KAU INOA PRESENTATION -

If the Akaka Bill becomes law, will the Department of the Interior mismanage Hawaiian assets and resources as badly as it's mismanaged the Native Americans?

Given that Native American tribes continue to sue the DOI for the loss and mismanagement of millions of acres and billions of dollars, is it wise, under federal recognition, to place Hawaiian assets in the same repository?

What about US Federal Judge Royce Lamberth, during the course of these lawsuits, repeatedly finding the DOI in contempt, incapable and unwilling to fulfill their fiscal responsibility?

Did Alaska Natives cut a good deal when they agreed to relinquish 90% of their lands in exchange for federal recognition?

Please provide examples of how federal recognition has improved the statistics of just one indigenous community to equal those same statistics in the dominant culture?

OHA has paid $450,000 to Patton Boggs, LLP, to lobby Capitol Hill for federal recognition. During the Carter administration, the firm lobbied for unrestricted weapons sales to Guatemala. Mr. Boggs personally represented a group of Guatemala landowners to help fund death squads that exterminated over two hundred thousand indigenous people, and human rights activists. Why has OHA hired this firm with the blood of indigenous people on its hands?

A VOICE OF HAWAIIAN INDEPENDENCE SPEAKS -

"The independence people haven't figured everything out, but the same can be said of those who advocate nation within a nation and so forth.

In response to comments one thing I can say is that I believe it is ok for Hawaiians to dream big - Americans at some point in their history dreamed big and look what happened, the settlers broke away from England and formed their own nation.

Why should Hawaiians have limited dreams? There is such thing as a the "American dream" why not the "Hawaiian dream".

My father, was an advocate of Hawaiian Independence. His beliefs were the same as Queen Lili'uokalani's. He believed that America would someday correct what they had done wrong. They took Hawaii; they should return Hawaii. For him it was that simple.

Can cite all you want about all the different pieces of legislation that have come forth since 1893 but when you think about it, all that matters is what was stolen. An entire country - how can America be so arrogant so as to think they could just get away with what amounts to 19th century piracy?

Let me also add that how can we afford to not support independence? If you look at all the different pieces of legislation that have come forth since 1893, all have done little or nothing to forward the progress of Native Hawaiians.

Moreover, it is my understanding that many of programs were never really made so that Hawaiians can succeed but made with the hope we would perish within the next generation or so - systematic government-supported methods of doing away with Hawaiians.

Just look at the statistics - prison, health, education - take your pick. No matter what kind of statistics, you will find that we are usually at the bottom of the socio-economic demographics and at the top of all the "social-ills" demographics: Highest percentage of homeless, high school dropouts, aids cases.

This is all happening within current American framework of society. Obviously I don't know history as well as [oghers,] but I do know what it is to be a Hawaiian struggling with and in today's American society. It's not that easy to be one Hawaiian attempting to be one practicing Hawaiian - know what I mean, right?

So when I think about independence I think about all the possibilities, not the hardships. I don't know about [others], but I going continue to keep my dreams alive and the dreams of my kupuna (elders.)

WASHINGTON - A measure to allow federal recognition of Native Hawaiians is dead for this year, but Hawai'i's senators yesterday secured a promise from Republican leaders to let the so-called Akaka bill come to the Senate floor for a vote next year...

The action is being received here with guarded optimism - both from supporters who say the bill will be in a better position to pass next year, and from opponents who hope they have bought a little more time to lobby against it...

Under Senate rules, the Akaka bill would need to be introduced again at the start of the new Congress that convenes in January and considered again by the Senate Indian Affairs Committee. The House also would have to approve the measure...

Opponents of the bill said the Senate action will allow them to regroup.

"The good thing for us is we have a little time to have an impact on what the new proposed federal recognition bill will look like," said Kai'opua Fyfe, a board member of Koani Foundation, a Kaua'i-based Native Hawaiian unity organization. Fyfe's group prefers an approach to independence that does not position Hawaiians as "wards" of the U.S. Department of Interior.

"The whole federal recognition process is sick. It's not an area we want to come into," he said. "It's something that's beyond repair..."

OFFICE OF HAWAIIAN AFFAIRS FALSELY CLAIMS THAT HAWAIIANS SUPPORT FEDERAL RECOGNITION -

The Office of Hawaiian Affairs (OHA) has launched a bogus Federal Recognition Poll on it's website to purport that Hawaiians support federal recognition, as well as a telephone poll conducted by OHA claiming response was overwhelmingly in support.

Yet only 300 people were questioned to arrive at these obviously erroneous conclusions!

300 Hawaiians out of over 400,000 (.075 of 1%) doesn't seem like a significant sampling size to claim that the majority support their lies. They must be getting pretty desperate.

Preserve Hawai'i!

Oppose the lie of the United States federal recognition of Native Hawaiians as Native Americans, and the United States claim that Hawai'i is a part of the United States.

Native Hawaiians are NOT Native Americans, and Hawai'i is NOT a part of the United States!

Remember, the 1850 “Treaty of Friendship, Commerce, and Navigation” is evidence of fact that the United States honored the Hawaiian Nation as a Legal Nation State.

According to International Law, the Treaty between two legal nation states is binding and supercedes United States Federal Law (including the Akaka Bill).The violation of the 1850 Treaty of Friendship, Commerce, and Navigation constitutes grounds for claims against the United States in an international law suit that can be addressed at the International Court of Justice.

OHA is a state of Hawai'i bureaucracy whose employees depend on government paychecks. If federal recognition fails, their paychecks could evaporate.

Is it any wonder they are putting forth the propaganda and lies that they are?

HERE'S HOW THE US GOVERNMENT, WITH THE HELP OF THE OFFICE OF HAWAIIAN AFFAIRS, IS PLANNING TO STEAL THE HAWAIIAN NATION - ONCE AND FOR ALL! -

By their own laws, the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent.

They and the State of Hawai'i have never had "Clear Title" since Jan 17, 1893. They all know this...have known for a long time.

The only way the United States will ever be able to get clear title to the Hawaiian Islands is if Hawaiians give it to them. This is why title to the Hawaiian Islands never transferred to the United States by the Newlands resolution. The Newlands resolution relied on the treaty of Annexation from the republic of Hawai'i.

But the republic never owned title because the Kingdom of Hawai'i never gave it to them. But now they gotta plan.....they are going to get Hawaiians to give title to them. How are they going to do that?

Here's how -

They are going to register a majority of Hawaiians on a "roll."

They are going to draft governing documents to "re-organize the Hawaiian government".

They are going to get Hawaiians to elect officers to that government.

They are going to make sure those governing documents give the officers of the government the authority to give away title in negotiations.

They are going to get the majority of Hawaiians on the roll to vote for the new governing documents to reorganize the Hawaiian government.That government authorized and approved by the majority of Hawaiians is going to sit down at the negotiating table with the United States and trade land title for cash and benefits.

Many people believe that only the Kingdom of Hawai'i is authorized to give a way title to the Hawaiian Islands.... and they are correct, but only as long as the kingdom remains intact. If the majority of its subjects revolt by forming a new government, the kingdom no longer exists.

This is the effect of popular revolution.The bill is only the bait. The hook is the formation of a new government and the negotiations between the U.S. and the new government.

As long as Hawaiians don't bite the bait...the hook is harmless....The bill is not intended to settle any claims.... The bill dos not tell Hawaiians, but asks them to form a government that can and will extinguish Hawaiians claims.

Federal appropriations in fiscal 2002 for all 250,000 people who call themselves Native Hawaiian included -

Education - $30.5 million / 250,000 Hawaiians = $122.00 per Hawaiian. How much education can you buy this year with $122.00? If teachers are making say 30,000/year you could hire 1016 teachers. That means there would only have to be 246 Hawaiians per classroom.

Affordable housing - $9.6 million/250,000 Hawaiians= $38.40 per Hawaiian. How much of your yearly rental costs does $38.40 cover?

Health care - $7 million /250,000 Hawaiians= $28.00 per Hawaiian. How much dental and medical insurance can you buy with $28.00? Maybe get only half your teeth cleaned this year and hope you don't get sick?

Strengthening community colleges (academics) - $3.25 million /250,000 Hawaiians= $13.00 per Hawaiian. How many units of academic instruction does $13.00 cover at a community college these days?

Vocational education - $2.9 million/250,000 Hawaiians = $11.60 per Hawaiian. What can you learn how to do for $11.60?

Community development - $2 million/250,000 Hawaiians= $8.00 per Hawaiian. How much Community infrastructure does $8.00 buy?

Strengthening community colleges (agriculture) - $1.5 million /250,000 Hawaiians= $6.00 per Hawaiian. What does $6.00 buy in the way of agricultural education at community college these days?

Housing loan guarantees - $1 million /250,000 Hawaiians = $4.00 per Hawaiian. How much of your annual mortgage does $4.00 cover?

Culture and arts - $740,000/250,000 Hawaiians= $2.96 per Hawaiian For $2.96, about all the culture you can afford is a plastic kukui nut lei.

Looks like about $233.96 per Hawaiian total ...less administrative costs of course.
