HERE'S THE EFFECT ON NATIVE HAWAIIANS OF OVER A CENTURY OF US OCCUPATION IN HAWAI`I

The Hawaiian people, have suffered since the first Western contact in 1778.

Western diseases, to which Hawaiians had no immunity, decimated their numbers.

At the time of western contact, some 800,000 people inhabited the Hawaiian Islands.

By 1805 that number had been halved.

By 1853 there were only 71,000 Hawaiian or part-Hawaiian people in the islands.

Within 100 years of western contact, the Hawaiian population had been reduced by nearly 90 percent.

According to the 2000 census, the numbers of people who claim some native Hawaiian ancestry have increased to over 400,000.

But only 239,000 live in Hawai`i and they are the poorest, most locked-up population in the state.

Although they only make up about 20 percent of the state's population, in June 2001 they made up 39 percent of the state's prison population and 37 percent of the state's homeless population.

This governing entity OHA speaks of is ludicrous and will not fit into the U.S.A. nefarious box.

What is it that they can't comprehend?

Take the acknowledged facts:

The Hawaiian Kingdom is a duly recognized independant nation-state; friendly, neutral, democratic country.

The U.S. committed covert and overt actions to destabilize and invade the Hawaiian Kingdom, thus breaking and violating the treaties with the Hawaiian Kingdom.

The Ku'e Petitions, the people's plebiscite was dismissed as irrelevant and ignored.

The U.S.A. belligerent occupation of the Hawaiian Kingdom is subject to the Laws of Occupation and must de-occupy it, thus, make reparations and restitution for damages in violation of their criminal acts.

There is no secession from the U.S.A. since statehood is illegal and unlawful processes to place.

The U.S.A. admits to its dishonor and shame and the criminal acts they have done in the name of their people.

OHA is an U.S. American State Agency designated to receive the stated funds from the Native Hawaiian stolen lands, confiscated by the U.S. and those taken in its name.

OHA cannot represent the Hawaii Nationals and in conflict of interest.

WHAT DO HAWAIIANS WANT ?

HERE IS WHAT THEY SAY ABOUT THEMSELVES, THEIR COUNTRYMEN AND THE UNITED STATES -

"The most common sense thing is for total independence.

We were a progressive modern nation of our time and recognized as a friendly, neutral nation within the Family of Nations, the predecessor of the League of Nations and the United Nations.

We had a democratic form of government, a constitutional monarchy with a bicameral legislative assembly.

The works and legacies of our monarchs are legendary and noteworthy.

Today under the American system, we are concerned about our lands, culture, people and lifestyle which has been under attack for over a hundred years.

This gets us angry and more Hawaiians are desiring total independence as a result.

The Kingdom of Hawai`i is not only Native Hawaiians but subjects of non-Hawaiian blood who were legitimate subjects of the Kingdom.

This racial argument is an American thing and not a Hawaiian thing.

So our concerns are well within our scope to protect all our subjects of the Kingdom.

We do expect reparations and restitution from the US for the injurious damages to our nation, land and people.

The US government is well aware of this and is trying to offer a piecemeal to settle this.

Other options are still on the table and we are beginning to take a stand on which option is the right thing to do.

If the tables were turned around, which would you do?

I'm sure it wouldn't be a hard decision.

Remember, Hawaiians never hated Americans; but only those that did harm to us and the US government for its complicity and deceit.

We were never afraid that another country would take us over; we had over twenty-four treaties with various countries but the US is the only country that broke their treaties with us."

“A Violation Of Trust – Part One”

At their conference in Honolulu last August, the Council For Native Hawaiian Advancement (CNHA) invited several representatives of federally recognized Native American tribes and Alaska Native Corporations to promote the economic benefits of federal recognition and oil drilling in the Artic National Wildlife Refuge.


When the Gwich'in, the native people who actually live on that land asked to participate in the discussions, the CNHA refused their request.

Not to be silenced, the Gwich'in did come to Honolulu and, with help from their many Hawai`i supporters, presented panel discussions and an Artic Film Festival at the State Capitol.

They also rented a conference room close to the CNHA convention to share the truth with all who would listen.

What they revealed was stunning.

A proud and self-sufficient people, the Gwich'in refuse to allow the violation of their natural environment.

They recount their life of poverty and deprivation under federal recognition and their constant battles with the US federal government and alien economic opportunists.

It has become clearly apparent that certain individuals within the CNHA have been secretly working with senators from both Alaska and Hawai`i to promote drilling in the ANWR, against the wishes of the Gwich'in, and also to force federal recognition here in Hawai`i - for personal gain.

AKAKA BILL DOOMED FROM THE START

The Akaka bill for native Hawaiian recognition was doomed nearly from the start when its proponents lost sight of the objective.

U.S. Sen. Daniel Akaka introduced the measure in 2000 after the U.S. Supreme Court ruled that Hawaiian-only elections for the state Office of Hawaiian Affairs unconstitutionally granted special voting privileges based on race....

The fact is that his bill will never pass as long as George W. Bush is president and Republican conservatives control Congress; pursuing it for the next two years, at least, is a waste of valuable time.

What voters need now from Akaka, Case and other leaders are fresh ideas for dealing with vital issues left unresolved by the failure of the Akaka bill.

Gov. Linda Lingle, who was unable to win Bush administration support for the Akaka bill after three years of lobbying, says it's time to pursue other options for protecting Hawaiian assets — possibly without federal involvement....

Now, the priority should be to find creative ways to preserve programs such as OHA, Hawaiian Homes and Kamehameha Schools primarily for Hawaiians while taking race out of the equation....

As for Hawaiian nationhood, it's up to Hawaiians to decide what they want and try to make it happen....

FUNDING FOR HAWAIIAN PROGRAMS TO BE PROTECTED

The roof leaks in one of the three bedrooms of Symphonie Kaai's family home in Nanakuli, rendering that section of the house useless.

Kaai, a 29-year-old community health worker, is primary breadwinner in a family of seven that cannot afford badly needed repairs.

But last year, Kaai attended home improvement classes offered by the Nanakuli Housing Corp., which is dedicated to helping Native Hawaiians gain and maintain home ownership....

"If it wasn't for the Nanakuli Housing Corp., I wouldn't know how to take the first steps," said Kaai, a single mother of a 7-year-old....

Kapi'olani Barber, executive director of Nanakuli Housing, countered that the statistics are clear that Hawaiians still need the extra help.

"It's very sad — the majority of people in prison are Native Hawaiians, the most impoverished, demographically, are Native Hawaiians. And as the host culture, it just shouldn't be that way."

Senator Dan Inouye last week announced he will introduce legislation designed specifically to shield the Hawaiian programs without addressing the explosive issue of federal recognition....

'Ehu Cardwell of the pro-independence Koani Foundation, opposes the Native Hawaiian Recognition Act — dubbed the Akaka bill for its sponsor, U.S. Sen. Daniel Akaka.

His group, which contends the bill does not go far enough in addressing wrongs that began with annexation, nevertheless believes Hawaiian programs funded by the federal and state governments are important.

"As an occupying power, that's the least the U.S. can do for Native Hawaiians," he said....

The U.S. Supreme Court has rejected a taxpayer lawsuit challenging the use of state general funds for the Office of Hawaiian Affairs.

In its ruling, the high court indicated on Monday that the payment of taxes alone isn't enough to provide a group of Hawai'i residents with the legal standing needed to challenge the OHA funding....

The lawsuit is the last pending challenge to the constitutionality of government funding for OHA....

It clearly took the defeat of the Akaka bill cloture vote to finally get our senior statesman to think "out of the box."

For the past several years, the Koani Foundation has offered to collaborate with Sen. Akaka on potential remedies, other than the Akaka bill, to no avail.

Perhaps we're witnessing a dawning of political creativity.

EXPOSING THE AKAKA BILL RUSE
The Sky Is Not Falling

One of the reasons the failed Native Hawaiian Recognition Act also known as the "Akaka Bill" was such a mess is because it was written as a frantic, knee-jerk reaction to the court challenges to Native Hawaiian entitlement programs.

Anything done in a panic not only gets sloppy, it can get downright ridiculous.

Then, to get the Native Hawaiians behind the federal legislation, Sen. Daniel Akaka, D-Hawai`i, for whom the bill is named, used another liberal ploy: Fear and Panic.

When reason is scarce, use the Chicken Little strategy, “The sky is falling, the sky is falling!” Call for huge rallies and stampede the herd.

These are acts of desperation not sensible political strategy.

Of course, the ruse did not work for Chicken Little, and it didn’t work for Akaka.

Knowing the majority of Hawaiians (native and non-native) would see right through this lame legislation, would not panic, would apply sensible principles in evaluating the bill, Sen. Akaka kept any congressional hearings far away from home.

In order to dupe Congress, hearings in Washington were carefully manipulated, allowing testimonies by invitation only, to give the impression that all Hawai`i was solidly united in support of this bill.

Fortunately there were a few Senators who actually attempted to understand the bill and became alarmed by its recklessly illegal composition.

Add to that a few citizens from Hawai`i, on their own dime, made it to Washington and exposed the Akaka bill for what it was: racial discrimination dressed up as an Indian.

With the defeat of the Akaka bill, we find that the sky is not falling.

None of the entitlement programs are in any real danger of being shut down.

The Supreme Court just vacated the Ninth Circuit Court of Appeals ruling of Arakaki v. Lingle.

The Akaka bill was intended to be history-making. Now it’s just history.

AKAKA BILL - R.I.P.
Hawai`i Embarrassed by Akaka Bill Fiasco, Time to Move On

Hawai`i Reporter - June 13, 2006

It is truly unfortunate that Hawai`i embarrassed itself in front of a nationwide audience as its Senators attempted to pass the controversial Native Hawaiian Recognition Act S.147 also known as the Akaka Bill.

This bill was defined as "racist" and "divisive" by no less than the United States Commission on Civil Rights, the United States Justice Department and the President of the United States.

Ignoring these organizations and the President were Hawai`i's Democrat Senators Daniel Inouye and Daniel Akaka, who vainly tried to mislead their colleagues into believing that creating a nation of one race based on ancestry was not racist....

It is time to put the Akaka Bill to rest and work on restoring the trust and unity among all races that Hawai`i's leadership has purposely devalued.

It's time to stop the politicians looking for swing votes, the OHA employees trying to hold on to their jobs, attorneys on the dole from OHA making a fortune on the spinning of the U.S. Constitution, the overpaid OHA lobbyists eagerly accepting money that should have gone to native Hawaiian benefits and above all else it's time to stop the victimization of a great race of people....

One has to ask how many more millions of OHA and state dollars will be spent pursuing a nationalist agenda when the money should be going to benefit native Hawaiians.

Federal recognition (Akaka bill) is now on the ash heap of history - a failed solution.

It's thesis was going hat in hand to the US federal government for help and turning Hawaiians inward and against each other in their own land.

For more than 100 years, this had not worked.

Moreover, the very people trying to push federal recognition down the throats of Hawaiians were the very ones who never asked Hawaiians what they wanted!

Instead, we can seize the opportunity to create a dynamic new nation through which we can maintain our culture and values, have more control over our future and be a leader again among the pacific nations.

Free Hawai`i means returning the Hawaiian Islands back to an independent nation status, as it was before it was illegally overthrown by US marines and rich sugar barons in 1893.

In 1993, President Clinton formally apologized for that act and publicly acknowledged the illegality of the overthrow.

NINE REASONS THE AKAKA BILL FAILED

Hawai`i Reporter Lists Fatal Mistakes -

Political observers noted several fatal mistakes Hawaii’s top elected officials made in their campaign to get the Akaka Bill through.
  • They disregarded the public’s lack of support for the measure and concerned themselves only with recruiting endorsements from Hawaii’s top political leaders.
  • They authored legislation that would divide rather than unite, the state’s non-Hawaiian and native Hawaiian communities.
  • They seriously misjudged the influence that Gov. Linda Lingle has in swaying Republican Senators and President George W. Bush in favor of the Akaka Bill.
  • Gov. Lingle, Senators say, confided that the Akaka Bill would help Republicans politically in Hawaii -- including her own campaign for governor or U.S. Senate in the future. They, for the most part, did not believe her because the legislation was introduced by a Democrat and does not sit well with the Republican or conservative agendas.
  • They underestimated their opponents and personally attacked them rather than addressed their statements with convincing arguments and facts.
  • They overestimated the power of government over the power of the people.
  • They underestimated the negative reaction mainlanders would have once sunshine was put on the true implications of the bill through more than 50 nationally published opeds and stories.
  • Rather than grassroots support, they believed the money they spent lobbying for the bill, buying support from conservatives, advertising dollars spent by the millions to buy off media, and public relations campaigns they ran to promote the bill, would manipulate Hawai`i residents into believing that the Akaka Bill is the best legislation for Hawai`i.
  • They believed secrecy in the negotiations of the final language of the bill was more effective than open negotiations. It wasn’t, as the closed-door negotiations only raised suspicions of opponents.

AKAKA BILL DEFEATED IN US SENATE

Hawaiian Independence Backers Claim Huge Victory

Honolulu Star-Bulletin - Thursday, June 8, 2006

In a close 56-41 vote, the U.S. Senate failed to pass a procedural petition this morning that would have brought the Akaka Bill to the floor for debate and a vote....

The cloture petition needed the support of 60 of the 100 senators to allow the bill to go to the floor. To become law, the Akaka Bill needs to pass both the Senate and House in the same two-year session....

Opponents of the bill were obviously pleased with the vote....

“I think it’s a definite victory for all of the individuals, both Hawaiian and non-Hawaiian, who contacted their senators and asked they vote against the cloture petition,” said Ikaika Hussey of Hui Pu, a coalition of native Hawaiians opposed to the Akaka bill.

BULLETIN! WHITE HOUSE ANNOUNCES OPPOSITION TO AKAKA BILL!

On the eve of a crucial vote, the U.S. Department of Justice late today issued a letter to Senate leaders stating that the Bush Administration "strongly opposes" passage of the Native Hawaiian Government Reorganization Act, better known as the Akaka bill.

Assistant Attorney General William E. Moschella cited a report issued last month by the U.S. Civil Rights Commission recommending that senators reject the bill, which initiates a process that would lay the groundwork toward establishing of a federally recognized Native Hawaiian entity....

Moschella's two-paragraph letter was addressed to Senate Majority Leader Bill Frist.

A copy was sent to Senate Minority Leader Harry Reid, who leads the Democratic caucus.

A cloture vote set for tomorrow will determine whether the Akaka bill will finally get a Senate vote after a number of failed attempts over the last six years....

Moschella wrote: "This bill would reverse that great American tradition and divide people by their race."

Some opponents counter that it flies against the concept of equal treatment for all in order to discriminate in favor of Hawaiians.

Other opponents maintain that the bill does not go far enough in addressing wrongs tied to the overthrow....

A group of nine people affiliated with the anti-Akaka bill organization Hui Pu made its way on to the second-floor balcony of Iolani Palace, the former seat of government for the hawaiian monarchy this morning.

The group, backed by about two dozen supporters on the ground, said it wants to "occupy" the palace in protest of the Native Hawaiian Reorganization Act, which is now the subject of a cloture debate on the Senate floor in Washington, D.C.

Andre Perez, a Hui Pu member, said "[Hawai`i Governor] Linda Lingle does not speak for Hawaiians. The Office of Hawaiian Affairs does not speak for Hawaiians. [Senator] Dan Inouye does not speak for Hawaiians. Senator Akaka does not speak for Hawaiians. We speak for ourselves."

HITTING THE BULLS-EYE!

Kingdom Rights Versus Aboriginal Rights

Is there someone out there who can help me understand why the Office of Hawaiian Affairs is continuously pushing for Native Hawaiian federal recognition?

Wouldn’t it be easier for them to stop fighting the U.S. Constitution and to start pushing for the recognition of the descendants of Hawaiian Nationals?

Trustee Mossman wrote that “immigrants settle in the land of our ancestors.”

Hawai`i is more than the “land of our ancestors.”

The blood of our ancestors was spilt and a nation was built.

The citizens of the Hawaiian kingdom were predominantly Kanaka Maoli (Native Hawaiian) anyway.

Everyone already knows that the United States conceded that the overthrow was illegal.

Wouldn’t this give us legal standing to fight for what is lawfully ours instead of begging for “entitlements?”

By doing this, wouldn’t we create a less divisive means of attaining true political recognition?

Does anyone have answers to these questions?

HAS ANYONE BOTHERED TO ASK HAWAIIANS IF THEY WANT THE AKAKA BILL?

...One of the many problems with the bill is that no one has asked the Native Hawaiians themselves about this “Hawaiian issue.”

I spoke with Kilikina Kekumano and Leon Siu - both Native Hawaiian activists opposed to the Akaka bill.

They are opposed largely because the legislation seeks to deal with a Hawaiian issue without ever consulting the people of Hawai`i about it.

Kekumano, who was adopted as a young girl by a mainland American family and now flies between her family’s land in Virginia and Hawai`i while working on this issue, says the Akaka bill will create racial division in Hawaii where there has been none.

“I guess I got mad reading the newspapers…telling everyone that this is what the Hawaiians want,” she said.

It is not what they want, she contends. And, polls seem to back her up.

A poll conducted by the Honolulu Star-Bulletin in March of 2005 showed that 74 percent of Hawaiians were against the Akaka bill and federal recognition.

A conservative think-tank in Hawai`i, the Grassroot Institute of Hawai`i, commissioned a survey in 2005, which showed that 67 percent of Hawaii residents were against the Akaka bill, and 48 percent of Native Hawaiians surveyed agree.

The Institute’s most recent survey shows that 70 percent of Hawaiian residents want to vote on the Akaka bill before it’s considered on a national level, and 67 percent of residents continue to oppose the Akaka bill.

That’s all Siu wants—a say.

He pointed out that no hearings have been held in Hawai`i on the current or any previous version of the Akaka bill, despite the immense impact it may have on the state.

“We’re not opposed to the government helping us do something,” he said, “but together as a community, we should figure out what’s best....”

"What most people fail to realize is, we already have Federal Recognition through our treaties with the U.S.

The problem is for the U.S. to stand behind that and honor it.

What in the word, "perpetuity" don't they understand, used in their treaty with the Hawaiian Kingdom?

How do they define friendly and neutral?

Is it all semantics and the play on words?

To absolve their dishonor and shame, the U.S. must deoccupy Hawai`i and make restitution and reparations for the intentional incalculable damages it dealt to the Hawaiian Kingdom, its people, and the US Americans it duped, manipulated, lied to, and felonious actions committed in our name.

The U.S. continues to commit high treason against itself and the Hawaiian Kingdom."

HAWAIIANS ARE NOT RACISTS!

Akaka Bill Would Define Residents By Race To Extinguish Kingdom Rights Of All Hawai`i Nationals

Hawaiian Sen. Daniel Akaka's seven-year project, the "Native Hawaiian Governmental Reorganization Act" often called simply the Akaka bill, has been labeled many things from manifest destiny in reverse to unhinged multiculturalism but what it really is is an attempt to legalize and codify what the Supreme Court ruled unconstitutional in 2000: a race-based government....

In his push to get the legislation back on the Senate's agenda, Mr. Akaka asserted that, "those who characterize this bill as race-based fail to understand the federal policies towards indigenous peoples."

[We understand very well, Mr. Akaka, US federal policies towards indigenous peoples. They include
  • Being Left With About 2% Of Your Land - The US Governmnet Takes The Rest.
  • Having The Worst Health, Social and Economic Profiles Of Any Demographic In The US.
  • Living In Poverty For The Rest Of Your Life. Also Goes For Your Children And Your Children's Children.
  • Having Absolutely No Legal Recourse Ever Again To Right These Brutal Wrongs.]
Postponed indefinitely by Hurricane Katrina, the Akaka bill is scheduled to come to the floor when the Senate returns next week.

Mr. Akaka has referred to the bill as "my efforts to bring parity to Native Hawaiians."

But no matter how thickly veiled the legislation may be in the multicultural rhetoric of making up for past wrongs, the bill smacks of a divisive move toward racial separation, not inclusion....

Mr. Akaka's legislation should not have proceeded this far, and deserves to be firmly defeated.

AKAKA BILL INSANITY

Akaka & Inouye Will Stop At Nothing To Steal Hawaiian's Land

Hawai`i Reporter - May 30, 2006

Never doubt the political clout of two U.S. Senators, Daniel Akaka and Inouye.

The Hawai`i Senators successfully submitted a new bill, Senate Bill 3064, the Native Hawaiian Government Reorganization Act of 2006 into a First Reading in the U.S. Senate on May 25, 2006, and the next day, took it to a Second Reading, with the intent on organizing a Cloture vote by early June.

These two senators were greatly assisted by some promised obligation of Republican Senator Bill Frist.

S. 3064 authorizes a new Native Hawaiian government entity, using the term 71 times but merely defining the entity as some ambiguous, future government "organized by the Native Hawaiian people."

The new bill has only one sponsor, Senator Akaka, but previous sponsors of the predecessor bill, S.147, remain committed: Akaka, Cantwell, Coleman, Dorgan, Graham, Inouye, Murkowski, Gordon Smith, and Stevens.

The nine senators above entirely fail the sanity and ethics test so we will need to watch precisely how the remaining 91 Senators vote on this precedent-setting bill to dismantle America into separate race-based enclaves annually funded by taxpayers but tax-exempt and free of most federal, and all state and local governing authority.

Can you just hear the spin?

"Oh this bill's better. This bill improves S.147. You can vote for this bill...."

The Commerce Clause, nor any other language within the U.S. Constitution allows such a travesty as the Akaka Bill....
