HERE'S PART TWO FROM THE NEW YORK TIMES EDITORIAL ON WHY FEDERAL RECOGNITION IS DEADLY FOR NATIVE POEPLES -

Those who examine the trust - including members of Congress - come away stunned by how badly and how fraudulently it has been handled. Records have been lost and purposely destroyed. Even a conservative guess of the amount owed to Indians from the trust runs as high as the tens of billions of dollars. Ineffectual plans to reform the trust have been drawn up by the Interior Department. But instead of working to provide a historical accounting of the trust, as required, Interior officials point to concern in Congress that the cost of an accounting is likely to reach $3 billion, with no guarantee that it will actually find anything. In other words, the department wants to conclude in advance that very little is likely to be owed to anyone.

The plaintiffs have won in court every step of the way. Interior officials have repeatedly been placed under sanctions for misconduct and malfeasance. So far Interior has worked as hard to discredit the judge in the case, Royce Lamberth, as it has to actually fix the problem. The department essentially argues that the judiciary has no business telling the executive branch how to do its business. But the department has had more than a century to get this right.

These are not abstract issues. This is a case about real money owed to real people. The central question is simply: Who has profited from economic activity on the individual Indian trust lands? Certainly not the Indians who owned them. The only real reason to block a historical accounting of this trust - and real reform - is to block the real answer to that question.

Native Americans came in great numbers to Washington last week, partly to celebrate, partly to correct a historic injustice. The occasion was the opening of the National Museum of the American Indian on the National Mall - a vivid reminder of the profound cultural and symbolic legacy of America's indigenous peoples. In the background, however, was a continuing lawsuit, whose purpose is to restore to the Indians assets and revenues that are rightfully theirs.

Specifically, the suit seeks a proper accounting of a huge trust established more than a century ago when Congress broke up reservation lands into individual allotments. The trust was intended to manage the revenues owed to individual Indians from oil leases, timber leases and other activities. Yet a century of disarray and dishonesty by the federal government, particularly the Interior Department, whose job it is to administer the trust, has shortchanged generations of Indians and threatens to shortchange some half million more - the present beneficiaries of the trust.

Many of the beneficiaries hold minutely fractionated interests in land that has been passed down from generation to generation. But no one really grasps the true dimensions of the trust because the value of those leases and royalties is unclear, and because there has never been a real accounting of the money paid into or out of it. What has become clear is that Indians were often paid far less for leases on their property than whites were for comparable property.

IS IT REALLY TRUE THAT WHAT YOU DON'T KNOW WON'T HURT YOU?

WHAT DOESN'T THE OFFICE OF HAWAIIAN AFFAIRS WANT YOU TO KNOW ABOUT FEDERAL RECOGNITION FOR HAWAIIANS?

Here's A Letter From The September Issue Of The Office Of Hawaiian Affairs Newspaper -

I am a young Hawaiian student who recently visited the Office of Hawaiian Affairs (OHA) website concerning federal recognition.

I have many questions and worries concerning the proposed federal "recognition" of Native Hawaiians.

One of my most pressing questions is, "What would the Hawaiian people lose with the passing of this legislation?"

I was happy and surprised to find "What do Hawaiians stand to lose?" on the site.

I was, however, very frustrated by the answer OHA provides to this question. The answer has nothing to do with the proposed question but instead praises the bill exclusively,

Would we lose nothing through this bill?

I don't know if this website is meant to give Hawaiians a clear, true view of what this bill would imply or is it a politically motivated voice-box for the speedy acceptance of a largely misunderstood and complicated issue?

AN HAWAIIAN PATRIOT SPEAKS OUT ON U.S. SENATE BILL S.344, PROPOSED FEDERAL RECOGNITION FOR NATIVE HAWAIIANS


I met with Noe Kalipi of US Senator Daniel Akaka's office a few months ago in DC.

I pointed out to Noe that there are supporters of S344 (Akaka Bill) such as Office of Hawaiian Affairs, CNHA, and others who are pointing out that we need the Akaka Bill to protect the Native Hawaiian trusts and programs.

I asked Noe to point out the specific language in S344 that would protect the Native Hawaiian trusts and entitlements. Noe could not because it is obvious, there is none.

Strange that S344 supporters would make this sort of claim because this is not what the Akaka Bill is designed to do. It is simply an effort to address what the US sees as a blunder that they made back in 1993.

The US inadvertantly provided us with an admission of their guilt in conspiring to unlawfully displace the lawful governing body of Hawai'i, who did not willfully or through conquest turn over our inherent sovereignty or our national lands to anyone...

...The primary purpose of the Akaka Bill is to extinguish our claims to our inherent sovereignty as a people, and to extinguish our claims over our national lands, claims which remain intact and to which no law allows the US to extinguish on their own...

...The Akaka Bill simply exposes the typical corrupt nature of the US government at work. If they can't get what they want by convincing the lawful owner to "willfully" relinquish their claims, the US will cheat you in any other creative way they can dream up.

S344 is an example of how the US uses deception to convince the owners to relinquish their claims. Across the globe people have experienced andunderstand that the US will resort to killing to get what they want...

...The typical American I believe is a good person, but they have allowed the corruption of corporations and special interests to overtake their government.

If Americans take back their government and re-install their Constitution as the basis for their government, I believe the world would be a much better place for all.

HERE'S WHAT'S IN STORE FOR HAWAII'S CHILDREN IF U.S. FEDERAL RECOGNITION IS IMPOSED UPON NATIVE HAWAIIANS

Conditions for children called a "crime" - From Native Times.com

A recent survey from American Indian housing directors shows that Native children are less likely to get enough sleep and finish their homework and are more likely to suffer from communicable illnesses and live in overcrowded and substandard housing conditions.

The survey by the National American Indian Housing Council asserts that overcrowding not only interferes with homework but also prematurely exposes children to sex and other age-inappropriate behaviors.

The NAIHC blames a dearth of federal funding.“ It’s a crime that the government spends more money for health care for prisoners than it does for Native Americans,” said NAIHC Executive Dierctor Gary Gordon, citing figures that show current federal spending at $3,803 a year per inmate as compared to $1,914 for each individual tribal member.

The survey showed increased cases of communicable diseases such as colds, flu, and skin outbreaks, with 77 percent of respondents making a direct correlation between those conditions and overcrowded housing. The group used the U.S. Census Bureau's definition of overcrowding - more than one person per room.

The questionnaire handed out to tribal housing directors also showed that black mold was causing such severe problems that some children are wearing respirators to bed at night.

“We fear for the next generation,” said NAIHC Chairman Chester Carl. “The children do not have a bed to call their own on many reservations.”

Bureau of Indian Affairs head Dave Anderson said the survey rings true."The observations by this group are very accurate," Anderson told The Associated Press. "As Indian people, we have been almost like a Third World developing nation. It's unfortunate that America's first people probably experience the bottom rung of every social dysfunction there is.

”Very few places in our nation have children hurting as much as on our Indian reservations,” Carl said. “It is up to the federal government to uphold the trust responsibility-an obligation it has made to tribes through treaties and laws-and make good on promises ratified centuries ago. We, as Native people, will also continue to work together to make a better life for our children."

IF THE U.S. TREATS NATIVE AMERICANS LIKE THIS - CAN NATIVE HAWAIIANS BE FAR BEHIND ?

Here's What Noted Native American Activist Elouise Cobell Says In The Albuquerque Tribune

Imagine a bank that took your money on a regular basis, never gave you a statement, had no idea how much was supposed to be in your account and argued it has no responsibility to return your money to you or provide you any information about your money.

Now imagine that same financial institution destroying the documents, lying in sworn statements and in court, and routinely defying court orders.

It doesn't take a lawyer to understand federal and state regulators would be padlocking the door to that bank and walking the bank's managers off to jail.

Well, there is such an institution, and it behaves exactly this way. But it's not a bank. It's the U.S. government. The only difference here is the managers are never held to account for their theft and fraud.

Since 1887, the government has been taking proceeds from land owned by individual American Indians, including oil and gas, forestry, minerals and other leasing in which resources are extracted from Indian land.

That money is supposed to be held in trust and paid to the American Indian beneficiaries on a timely basis.

But the money is gone, and the government refuses to account for it - despite court orders that say they must.

These are not mere allegations. These are facts. We've proven them in court in the individual Indian trust case.

Although the government has lost four separate times at trial, it still refuses to do the right thing. Instead, officials have been slapped with repeated contempt citations and other court sanctions, including shutting down the Department of Interior's Web site because it left the trust account open to tampering.

After more than eight years of litigation, not a single individual Indian beneficiary has ever received an accounting. Not one!

Tragically, more and more of my fellow beneficiaries die without ever seeing justice done. After a century of mismanagement that continues today - mismanagement that has annually robbed hundreds of millions of dollars from these individuals and their families.

SHOULDN'T HAWAIIANS BE GLAD THEY'RE A PART OF THE U.S. ?

HERE'S HOW NATIVE HAWAIIANS FEEL ABOUT THE OVERTHROW OF THEIR COUNTRY -

Let's pretend I visit your house. You offer me food and rest. I decide to stay.

Then, I order you and your family around, use your things and rearrange the rooms. I take down your photos and religious symbols, replace them with my own and make you speak my language.

One day, I dig up your garden and replace it with crops that I can sell. You and your family must now buy all of your food from me.

Later, I invite my father and his buddies over. They bring guns. We take your keys. I forge a deed and declare my father to be the owner of your house.

I bring more people. Some work for me. Some pay me to stay in your house. I seize your savings and spend it on my friends.

You and your family now sleep on the porch.Finally you protest. Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave.

I tell you, "Sorry, I was wrong for taking the house." But when you demand your house back, I tell you to be realistic."You are part of this family now, whether you like it or not," I say. "Besides, this is for your own good. For all that I have done for you, why aren't you grateful?"

Free Hawai'i means returning the Hawaiian Islands back to an independent, sovereign nation status, like it was before it was illegally overthrown by US marines and rich sugar barons in 1893.

In 1993, President Clinton formally apologized for that act and publicly acknowledged the illegality of the overthrow.

98% of all Hawaiians living at the time opposed the illegal overthrow!

Today, less than 20% of all land in Hawai'i is in Hawaiian hands. Over 60% is in non-Hawaiian hands.

A few individuals, who are non-Hawaiian, lease an amount of land in Hawai'i that is greater than all land leased to all Native Hawaiians!

Currently, only 72 landowners control 95% of all land in Hawai'i.

Native Hawaiians make up the largest percentage of homeless in Hawai'i today.

Native Hawaiians have the worst social, educational and economic indicators of any ethnic group in the US. Native Hawaiians currently have the worst health profile of any ethnic group in the US.

Descendants of the Hawaiian Nation want their country and land back so they can grow their own foods, become healthy once again, and control their own destiny.

A VOICE OF HAWAIIAN INDEPENDENCE SPEAKS -

"The independence people haven't figured everything out, but the same can be said of those who advocate nation within a nation and so forth.

In response to comments one thing I can say is that I believe it is ok for Hawaiians to dream big - Americans at some point in their history dreamed big and look what happened, the settlers broke away from England and formed their own nation. Why should Hawaiians have limited dreams? If there is such thing as the "American dream" why not the "Hawaiian dream."

My father, was an advocate of Hawaiian Independence. His beliefs were the same as Queen Lili'uokalani's. He believed that America would someday correct what they had done wrong. They took Hawaii; they should return Hawaii. For him it was that simple.

Can cite all you want about all the different pieces of legislation that have come forth since 1893 but when you think about it, all that matters is what was stolen. An entire country - how can America be so arrogant so as to think they could just get away with what amounts to 19th century piracy?

Let me also add that how can we afford to not support independence? If you look at all the different pieces of legislation that have come forth since 1893, all have done little or nothing to forward the progress of Native Hawaiians. Moreover, it is my understanding that many of programs were never really made so that Hawaiians can succeed but made with the hope we would perish within the next generation or so - systematic government-supported methods of doing away with Hawaiians.

Just look at the statistics - prison, health, education - take your pick. No matter what kind of statistics, you will find that we are usually at the bottom of the socio-economic demographics and at the top of all the "social-ills" demographics: Highest percentage of homeless, high school dropouts, aids cases. This is all happening within current American framework of society.

Obviously I don't know history as well as [others,] but I do know what it is to be a Hawaiian struggling with and in today's American society. It's not that easy to be one Hawaiian attempting to be one practicing Hawaiian - know what I mean, right? So when I think about independence I think about all the possibilities, not the hardships. I don't know about [others], but I going continue to keep my dreams alive and the dreams of my kupuna."

WHAT DO HAWAIIANS WANT ?

HERE IS WHAT THEY SAY ABOUT THEMSELVES, THEIR COUNTRYMEN AND THE UNITED STATES -

"The most common sense thing is for total independence. We were a progressive modern nation of our time and recognized as a friendly, neutral nation within the Family of Nations, the predecessor of the League of Nations and the United Nations.

We had a democratic form of government, a constitutional monarchy with a bicameral legislative assembly. The works and legacies of our monarchs are legendary and noteworthy.

Today under the American system, we are concerned about our lands, culture, people and lifestyle which has been under attack for over a hundred years. This gets us angry and more Hawaiians are desiring total independence as a result.

The Kingdom of Hawaii is not only Native Hawaiians but subjects of non-Hawaiian blood who were legitimate subjects of the Kingdom. This racial argument is an American thing and not a Hawaiian thing. So our concerns are well within our scope to protect all our subjects of the Kingdom.

We do expect reparations and restitution from the US for the injurious damages to our nation, land and people. The US government is well aware of this and is trying to offer a piecemeal to settle this. Other options are still on the table and we are beginning to take a stand on which option is the right thing to do.

If the tables were turned around; which would you do? I'm sure it wouldn't be a hard decision. Remember, the Hawaiians never hated Americans; but only those that did harm to us and the US government for its complicity and deceit.

We were never afraid that another country would take us over; we had over twenty-four treaties with various countries but the US is the only country that broke their treaties with us. "

That should tell you something.

WHO REALLY OWNS THE LAND TODAY IN HAWAI'I ?

Land Titles Issued Today Are Very Much In Doubt -

"Clear Title," regarding legitimate legal ownership of land in Hawai'i is a topic quickly becoming an issue in the political and commercial areas.

With more lands being "quiet titled" in the courts by unscrupulous characters with the aid of foreign laws (USA and state of Hawai'i) illegally imposed against the rightful/legal owners of these lands and a judicial system aiding and abetting in these crimes; its no wonder developers want to build 1,100 new luxury homes in Makena and elsewhere.

Land titles in Hawai'i continue to carry the original "royal patent" from the mahele. If the U.S. Government or state of Hawai'i and their citizens rightfully have "clear title" to these lands, then why has the U.S. patent not replaced the royal patent as it was done in 49 other states.

Answer: Each royal patent has been "adjudicated," making them all a legal decree.When purchasing land, a "warranty deed" is issued, not a clear title per se.

Shouldn't a clear title be guaranteed? Unless, of course, there is no clear title to the land.

WHO WINS IN A FREE AND INDEPENDENT HAWAI'I ? - EVERYONE !

One of the biggest lies perpetuated today is that when Hawai'i achieves nationhood once again it will be at the expense of everyone else.

But no one will be kicked out; their businesses seized or their homes and property confiscated. Instead, everyone, Hawaiians and all others, will be citizens of the sovereign and independent Nation of Hawai’i.

The Hawaiian Nation included people of many ethnic backgrounds that were loyal citizens before the illegal overthrow and it will be so again. The truth is a sovereign Hawaiian nation will need the contributions and talents of all of its citizens to remain viable in the world.

Hawaiians would be no better than the very supremacists that overthrew and occupied them were they to divide people by race. Hawaiians have always been inclusive, not exclusive.

How would this be accomplished politically given a civil war resulted the last time a state tried to leave the US?

Unlike the southern US states, the Kingdom of Hawai’i and its citizens never agreed to become part of the United States in the first place. Therefore a move for Hawai’i to secede from the US would be both unnecessary and inappropriate.

Much like removing the top coat of paint to reveal the one underneath, the US Congress, after consultation between Hawaiians and the US at the level of state to state, could simply enact a US federal law that dissolves the entity known as the “state government” in Hawai’i.

What would be left in its place is what has existed all along anyway without interruption – the Nation of Hawai’i. Only at that point, would it be appropriate for the citizens of Hawai’i to decide their future as it relates to a relationship with the United States.

Those possibilities would include –

Full Independence - Joining once again the family of nations in the world.

Free Association Much like Palau and the Federated States of Micronesia.

Integration with the US Becoming a state again or a tribe of the US under federal recognition.

Did you know that when Ronald Reagan was president, one of the most conservative US presidents in recent times, his administration actually granted the Marshall Islands independence in 1986, which then lead to a free association relationship with the US? Precedent for Hawaiian independence exists right now within US law as outlined above.

There are no laws that exist today within the US to prevent the US federal government from dissolving a state government. It is only fear and ignorance that holds the status quo in place.

HAWAIIANS REASSERT UNITY

They turned out yesterday to protest development of sacred Mauna Kea, the continued desecration of Hawaiian remains, forcing landowners such as Kamehameha Schools to sell leasehold lands and a dozen other issues that wound the souls of Native Hawaiians.

Some carried ancient fighting spears as others sipped from plastic water bottles. Some wore traditional malo, while others donned modern-day T-shirts.They rode on scooters, pushed baby strollers, blew conch shells, and some even showed their disdain by carrying the Hawaiian flag upside-down.

But all along the course of the mile-and-a-quarter march, sometimes disparate Hawaiian groups were united in one thing: chanting for justice in Hawaiian and English.

It was the second year that Honolulu police closed Kalakaua Avenue through the heart of Waikiki so Native Hawaiian organizers could stage a "March for Justice" that some see as a massive protest, and others consider a major opportunity for Hawaiians to unite.

Hawaiian Man Fights To Reclaim Family's Land

WAIKANE - Raymond Kamaka has never given up hope that he would one day get back the lush acreage in Waikane Valley where his grandparents were born, where the family once raised taro from the mountains to the ocean, where he played as a boy six decades ago.

But a court date looms this month, and he fears that it could end for good the family connection to the land that Kamaka traces to the 1850s. The land, 187 acres that was leased to the military for less than $2 an acre, was used for live-fire training from 1942 to 1976 and condemned in 1989 after the Marine Corps and Navy determined that they could not clear the property of unexploded ordnance as stipulated in the lease.

After drawn-out and often contentious negotiations, the family settled with the federal government in 1994 for $2.3 million. His siblings and cousins signed an agreement with conditions that once the property was cleaned the family could buy it back for that amount plus interest.

But Kamaka, 65, refused to sign the agreement or accept payment. He is duty bound to his kupuna (elders,) who instructed him to never sell the 'aina (land,) he said, and insisted that the government honor its commitment and clean up the land.

Senator Inouye Says Fight Not Over Yet On Akaka Bill -

The push for federal recognition for Native Hawaiians is coming to a head this fall as proponents fight to have that status approved by Congress by the end of the current session.

U.S. Sen. Daniel Inouye, a leading champion of the Native Hawaiian Reorganization Act - the so-called Akaka bill - said he's planning to attach the legislation to one of the 12 appropriations bills still moving through Congress.

Congress might have little more than a month of lawmaking left, with pressure mounting to adjourn early before the general election, and the federal recognition bill is still languishing without a hearing on the Senate floor. It has been seen as a means to give Hawaiians a protected, political status that would derail lawsuits that challenge as unconstitutional programs or benefits targeting them.

The use of an appropriations package as a vehicle for the Akaka bill seems to be the only means left for its passage this session, because of the hold placed on it by the Senate's Republican leadership, Inouye said....

Complicating all of this: The Akaka bill does not enjoy universal support, even among Native Hawaiians, some of whom believe it gives too much control over Hawaiian affairs to the U.S. Department of the Interior, the federal agency that oversees Native American tribes and Native Alaskan corporate entities.

From Mauna Kea To Capitol Hill -
This Week On "Voices Of Truth"

Our show segments this week on Voices of Truth - One-on-One With Hawai'i's Future cover many fascinating topics.

Coming this Wednesday, Sept. 8th for viewers on Maui and Molokai's on Akaku, Visions - Channel 53 at 6:30 PM is "Why Independence?" - a lively discussion of what's really at stake regarding Hawaiian Independence. The answers may surprise you.

Then on Ho'ike - Channel 52 on Kaua'i, it's "Perpetuating Makahiki - A Time Of Peace - An Interview With Kapono Souza." Those of you who have not yet seen this amazing young Kanaka Maoli role model speak about his mission and passion for the movement will be able to this coming Thursday, Sept. 9th at 8:30 PM.

Hawaii's Homeless Law Fuels Tension - State To Debut At Third On List Of 'Meanest'

HONOLULU -- Despite a strong state economy, the homeless rate in Hawaii has nearly doubled over the past four years, and the majority of the new homeless are native Hawaiians and those with some Hawaiian ancestry.

From fabled Waikiki Beach, one of the places where the homeless congregate on Oahu, to the neighboring islands that conjure the image of paradise to planeloads of tourists who arrive daily, there is increasing tension between the thousands of homeless people, their advocates, and state, city, and county governments.

Hawaiians represent only about 18 percent of the state's population, but the state survey suggested they make up 37 percent of the state's homeless population.
