TODAY IS KA LA HO`IHO`I EA - RESTORATION DAY - IN HAWAI`I

What Is Restoration Day?

Ka La Ho`iho`i Ea (Restoration Day) celebrates the 1843 British withdrawal from their 5-month military occupation of our homeland.

The observance of this event was revived at Thomas Square in Honolulu in 1985.

Thomas Square is named after the British military commander who withdrew the British military occupation from Hawai'i in 1843.

Since then, we yearly call upon the US to withdraw from its illegal occupation of our homeland.

It took the British only five months to realize their mistake.

Why are we still waiting over one hundred years later for the United States to realize theirs?


Hawai'i was a free nation - but never free for the taking!

HAWAIIAN INDEPENDENCE HOLIDAY TO BE OBSERVED

Restoration Day To Be Observed In Honolulu

Celebrate the 163rd anniversary of Ka La Ho‘iho‘i Ea with live music, keiki (children's) activities, cultural workshops

Kanaka Maoli (Native Hawaiians) and their supporters will gather at Thomas Square in Honolulu on July 30, 2006 from 10 am to 5 pm to celebrate the 163rd anniversary and 22nd annual revial of Ka La Ho‘iho‘i Ea, Kanaka Maoli Sovereignty Restoration Day.

The celebration recalls July 31, 1843, when British Admiral Richard Thomas ordered the Union Jack lowered and the Hawaiian Kingdom flag hoisted above Honolulu.

This action ended five months of Britain’s military invasion and occupation under Lord George Paulet.

In 1985, Kanaka Maoli nationals and supporters revived the annual celebration at Thomas Square. This year’s celebration will feature the new era of Maoli music and the resurgence of Hawaiian culture and art, with performances from Paula Fuga, Liko Martin, Jon Osorio, and Kupa‘aina.

Activities will be provided for the whole family, with informational tents to learn Hawaiian traditional arts, and a “bouncing castle” for the keiki.

All are welcome to come and learn about the Hawaiian movement for independence and self-determination, and celebrate this historic day.

CURIOUS ABOUT HOW HAWAI`I BECAME A STATE ?

The United States acquired Hawai`i through force.

Queen Lili'uokalani, Hawai`i's last Queen, was deposed on Jan. 17, 1893, by a group of American businessmen supported by the United States Navy and Marine Corps and diplomatic representatives.

Sovereignty of Hawai`i transferred to the U.S. on Aug. 12, 1898 during ceremonies at Iolani Palace in Honolulu, on the island of Oahu.

Hawai`i became a U.S. territory in 1900.

On Nov. 23, 1993, The United States apologized for illegally overthrowing the Kingdom of Hawai`i, and recognized the inherent sovereignty and right of self-determination of native islanders.

Needless to say, a lot of shady events took place between Jan. 17,1893 and Aug. 21, 1959.

Hawaiian sovereignty is still a hot issue in the islands to this day and likely will be for as long as the United States flag flies over Hawai`i.

WHO WINS IN A FREE AND INDEPENDENT HAWAI'I ? EVERYONE !

One of the biggest lies perpetuated today is that when Hawai`i achieves nationhood once again it will be at the expense of everyone else.

But no one will be kicked out; their businesses seized or their homes and property confiscated.

Instead, everyone, Hawaiians and all others, will be citizens of the sovereign and independent Nation of Hawai`i.

The Hawaiian Nation included people of many ethnic backgrounds that were loyal citizens before the illegal overthrow and it will be so again.

The truth is a sovereign Hawaiian nation will need the contributions and talents of all of its citizens to remain viable in the world.

Hawaiians would be no better than the very supremacists that overthrew and occupied them were they to divide people by race.

Hawaiians have always been inclusive, not exclusive.

How would this be accomplished politically given a civil war resulted the last time a state tried to leave the US?

Unlike the southern US states, the Kingdom of Hawai`i and its citizens never agreed to become part of the United States in the first place.

Therefore a move for Hawai`i to secede from the US would be both unnecessary and inappropriate.

Much like removing the top coat of paint to reveal the one underneath, the US Congress, after consultation between Hawaiians and the US at the level of state to state, could simply enact a US federal law that dissolves the entity known as the "state government" in Hawai`i.

What would be left in its place is what has existed all along anyway without interruption – the Nation of Hawai`i.

Only at that point, would it be appropriate for the citizens of Hawai`i to decide their future as it relates to a relationship with the United States.

Those possibilities would include

Full Independence - Joining once again the family of nations in the world.

Free Association Much like Palau and the Federated States of Micronesia.

Integration with the US Becoming a state again or a tribe of the US under federal recognition.

Did you know ? -

When Ronald Reagan was president, one of the most conservative US presidents in recent times, his administration actually granted the Marshall Islands independence in 1986, which then lead to a free association relationship with the US.

Precedent for Hawaiian independence exists right now within US law as outlined above.

There are no laws that exist today within the US to prevent the US federal government from dissolving a state government.

It is only fear and ignorance that holds the status quo in place.

DOES AMERICA HAVE A MONOPOLY ON LOVE OF COUNTRY ?

The United States of America has admitted in Public Law 1993, 103-150 that it violated its own Constitution, its treaties, international law and, by implication, all of the Christian teachings by perpetrating an outrageous armed theft of the Kingdom of Hawai`i and the forced American citizenship of Hawaiian national citizens.

America recognized in 1894, and again in 1993, that the Kingdom of Hawai`i has a right to exist.

The Hawaiian Nation has a right and obligation to enact and dictate land laws which prevent the selling of its lands to foreign speculators at prices which deny native nationals from living on their own home islands at an affordable price.

The Hawaiian nation has a right and obligation to protect and defend the quality of life, land, water, ocean and air.

The Hawaiian nation has a right and obligation to its citizens to provide the best in education, health care and housing.

Patriotism and love for our Nation of Hawai`i is what this all is about.

A lot of you have let us know of your deep concern regarding any so-called Native Hawaiian “governing entity” to be created in the future.

The Office of Hawaiian Affair’s “Plan B” to create just that kind of entity would surely divide rather than reconcile – it ends up defining people by race and perpetuating the very problems the rest of us seek to resolve once and for all.

OFFICE OF HAWAIIAN AFFAIRS TRUSTEES ARE DELUSIONAL

The Office of Hawaiian Affairs' daring plan publicized in The Honolulu Advertiser's July 17th edition to move "full speed ahead" with forming a race-based, Native-Hawaiians-only nation, shows the depths of the delusion into which the trustees have descended.

With Rice v. Cayetano and the recent debacle of the Akaka bill, what part of "racial discrimination" do the OHA trustees not understand?

So they want to get the "nation" up and running by 2008?

If a race-based governing entity isn't legal now, what makes them think that it will be legal two years from now?

Apparently OHA expects us to believe that it will happen if they get 118,000 Hawaiians to sign up under Kau Inoa.

Then the U.S. will miraculously say, "Congratulations! You hit the magic number! Now you qualify to have an unconstitutional race-based government!"

What part of "unconstitutional" do the OHA trustees not understand? And what happens if OHA's recruitment falls short of that number?

And why spend yet another "$7 to $10 million" to "build a nation" by following the exact format that was rejected by the U.S. Senate last month?

This would be another $7 million to $10 million lost to silly political machinations instead of real services to the beneficiaries.

And, by the way, how much did OHA spend in the six years of lobbying, slick advertising, posturing rallies and T-shirts to push for the fatally flawed Akaka bill? Where did that money come from?

The OHA trustees need to get on with truly serving all the people of Hawai`i.

If it is indeed OHA's purpose to redress the injustices stemming from the 1893 illegal overthrow of the Hawaiian Kingdom, then the OHA beneficiaries should be the Hawaiian Nationals (the remnants of a political entity), not Native Hawaiians (an ethnic sub-group of Hawaiian Nationals.)

This shift in the beneficiaries from Natives to Nationals, would provide OHA and other Hawaiian entitlement programs with the bulletproof "political entity" they have been flailing around to find.

HOW DOES HAWAI`I TREAT HAWAIIANS ?
HERE'S THE SAD TRUTH -

Despite a strong state economy, the homeless rate in Hawai`i has nearly doubled over the past four years, and the majority of the new homeless are native Hawaiians and those with some Hawaiian ancestry.

From fabled Waikiki Beach, one of the places where the homeless congregate on O`ahu, to the neighboring islands that conjure the image of paradise to planeloads of tourists who arrive daily, there is increasing tension between the thousands of homeless people, their advocates, and state, city, and county governments.

Hawaiians represent about 23 percent of the state's population, but the state survey suggested they make up 37 percent of the state's homeless population.

HOW HEALTHY ARE HAWAIIANS TODAY?

Hawaiians suffer the worst health profile in Hawai'i.

Between 1980 and 1990, while rates of death from heart disease, cancer, stroke and diabetes decreased for non-Hawaiians, they increased, sometimes dramatically, for Hawaiians.Below 1 year of age, the Hawaiian death rate is more than double the overall state average.

Between 1 and 4 years of age, it is triple the state figure, and so on into adulthood.

Just under 20 percent of the population, we suffer 75 percent of the deaths for persons less than 18 years of age.

Office Of Hawaiian Affairs Conspires Once Again To Steal Rights Of Hawaiian Nationals By Attempting To Set Up Counterfeit "Nation."

Here's An Abridged Version Of One Hawaiian's Reaction


"The Office of Hawaiian Affairs will fail as they did in Washington. 

We Hawai`i Nationals will be celebrating again. 

What they offer does not fit the definition of a Nation. 

It will not have the sovereign jurisdiction or other conditions that would make it a nation. 

They would have you relinguish your national rights and take something much less. 

By doing that, you will usurp the authority and jurisdiction that your ancestors enjoyed as a legitimate nation, to accept a lesser status and give the Kingdom away to the US. 

Then what about the non-Kanaka Maoli (non- Native Hawaiians) who were naturalized under the Hawaiian Kingdom and embraced our society and nation, who were ever-loyal to the Queen? 

Do we say they don't exist and deny them of their national rights? 

Are you familiar with the Kingdom's Constitution and laws? 

Are you going to let the US off the hook and give them the kingdom? Why?  Can't you govern yourself like kupuna (elders?) 

Are you not capable of governing yourselves? 

We have our government, no need to recreate one that fits their ideal of what they want; a puppet and phony. 

It's time for the US belligerent occupation to end; pack up, and get out and don't forget to pay your bill for the damages!"

We continue this week with showcasing individuals who not only are working tirelessly to create a brighter future for a Free Hawai`i, but have also taken it upon themselves to bring the “What’s next?” we’ve been focusing on the past few weeks directly into everyone’s lives.

Meleanna Meyer, one of three sisters who are virtual duplicate powerhouses of each other, seems to be everywhere at once telling anyone who will listen her vision of what’s possible both in Hawai`i and in people’s lives.

Spend ten minutes with her and you’ll feel as though anything’s possible.

As multi-talented as she is driven, she lets nothing stop her as she gets her message out through film, speaking, writing, and maybe most important of all, working with our kamali`i (teens.)

Kumu John Keola Lake and Mililani Trask have dedicated their entire lives towards the future.

Kumu, bringing treasures of the past to today and tomorrow and Mililani with her work on the international stage have both made innumerable contributions towards a brighter future for Hawai`i.

DEFIANT HAWAIIAN UNFURLS THE FLAG OF FREEDOM

The Stars and Stripes is nowhere to be seen.

Among the neat bungalows beneath the steep green mountains of Ko`olau only the flags of the Hawaiian state are on display.

They are all upside down.

"It is the international maritime signal of distress," said Bumpy Kanahele, who has devoted much of his life to a seemingly quixotic quest for independence from the United States. "It's saying, 'We're in trouble.' "

Mr Kanahele, wearing a T-shirt reading "Hawaiian by birth" on the front and "American by force" on the back, is the inspiration behind the beautifully situated village.

Mauka is a patch of 45 acres where Hawai`i's original inhabitants hold sway and Washington's writ has little force....

Here, among banana and coconut trees and blood red hibiscus, 100 people live a life in contemptuous rejection of the American dream.

"This is not America," Mr Kanahele said. "That is 3,000 miles away...."

Hawaiians Want Nothing To Do With The US Dept. Of Interior

A federal appeals court took the rare step of removing U.S. District Judge Royce C. Lamberth from a long-standing legal battle involving billions in Native American oil and gas royalties, saying the judge appears to be biased against the Interior Department....

The ruling removes a sitting trial judge for only the third time in the D.C. Circuit and provides the latest twist in a contentious decade-long class-action lawsuit filed by the Native American Rights Fund over the trust accounts, which were set up in 1887 to compensate Indians for use of their lands .

Since Blackfeet tribe leader Eloise Cobell filed the lawsuit in 1996, several independent investigations found that the Interior Department had never kept complete records, used unknown amounts of the funds to help balance the federal budget, and let the oil and gas industry use Indian lands at bargain rates....

Lamberth is a sharp-tongued Texan appointed to the bench by President Ronald Reagan. He has defenders from all points of the political spectrum and has repeatedly been ranked by lawyers as among the most skilled judges on the court.

...Lamberth writes that "the entire record in this case tells the dreary story of Interior's degenerate tenure as Trustee-Delegate for the Indian trust -- a story shot through with bureaucratic blunders, flubs, goofs and foul-ups, and peppered with scandals, deception, dirty tricks and outright villainy -- the end of which is nowhere in sight."

WHY DO MORE AND MORE PEOPLE WANT THE ILLEGAL U.S. OCCUPATION OF HAWAI'I TO END ?

Now The Conclusion -

Hawai`i imports two-thirds of its food from the mainland and locally-grown food is expensive due to high land prices.

Although a relative scarcity of farmable land exists in the islands, some economists have concluded that land prices are artificially inflated through manipulation by the Big Five, giant land-holding companies owned by descendents of the five most influential missionary families who settled in Hawai`i two centuries ago.

But critics argue that even the food imported from the mainland shouldn't cost as much as it does.

One supermarket manager admitted candidly that Matson Navigation shipping adds an average of only 18 per cent to the cost of imported food.

Yet prices range between 30 and 40 per cent higher than California where the Matson ships pick up the food for delivery to Hawai`i...

Meanwhile, the situation grows worse daily for the vast majority of people in paradise and it's unlikely to reverse direction anytime soon...

In the past, Hawai`i was known for its aloha spirit and laid-back lifestyle.

But by the early 1990s tourism, by then underpinning the state's economy, was under threat from cheaper competition. The Gulf War and early 1990s recession lost Hawai`i its status and a lot of its visitors.

The end of the Cold War saw cutbacks in military spending...

Now aloha is difficult to find as various ethnic groups vie with each other for the last crumbs of the once-large economic pie. And the pace of life has become frenetic in too many ways.

As one long-time resident commented: "Hawai`i is turning into one of those Caribbean tourist islands where you have fancy hotels and a tiny rich neighbourhood and the rest of the island is a shantytown of poverty and crime."

WHY DO MORE AND MORE PEOPLE WANT THE ILLEGAL U.S. OCCUPATION OF HAWAI'I TO END ?

Here's - Part Two

Today most of the Island of Hawai`i (Big Island) as well as Moloka`i, Lana`i and Kaua`i, are economic wastelands with little opportunity to make a decent living.

On Kaua`i workers often share apartments or small houses with several other workers because rents are too expensive for one or two individuals to afford.

And the torrential rain and floods in the last month have only made things infinitely worse.

On every island married couples with children often work two jobs each to make ends meet - if they are fortunate enough to find that many jobs, even at minimum wage.

Aside from housing, transportation and food expenses contribute heavily to Hawai`i's staggering cost of living.

The prices of gasoline, mandatory auto insurance, used cars and repair work are considerably higher than the mainland.

And only the city of Honolulu has reliable public transportation. On the other islands owning a car is a necessity to be able to work or look for jobs.

HERE'S WHY MORE AND MORE PEOPLE WANT THE ILLEGAL U.S. OCCUPATION OF HAWAI`I TO END

Native Hawaiians constitute roughly 20 per cent of the state population, but they represent 54 per cent of the prison population.

Not coincidentally, they also have the lowest per capita income, the highest poverty rate and the shortest lifespan of any ethnic group in Hawai`i.

Hawai`i public school students receive a very poor education by any standard of measurement. They consistently rank among the lowest of any state in test scores.

Education reform has been talked to death by every governor and legislature of the past 30 years, but nothing substantial has been done.

This has led to a "brain drain" in the islands. Most of the bright students who manage to learn something in spite of the handicapped school system leave Hawai`i for foreign colleges and careers.

In the 1980s, Hawai`i gained the enviable reputation of providing medical insurance to the highest percentage of residents of any state.

A decade after the state ended dental cover, toothless smiles are commonplace among the poor.

Tens of thousands of residents have no medical insurance at all.

Despite higher profits for many businesses, jobs are scarce and most of the available work pays minimum wage or close to it...

In some cases, the lives of the working poor are worse than the unemployed. Among other things, they don't qualify for state financial assistance or full food stamp benefits.

Even during the height of the hotel building boom in the 1980s, workers in the upscale South Kohala district of the Big Island were forced to sleep in their cars or public parks because they couldn't afford the high rents on hotel pay.

The writer of a June 29 letters cites the doctrine of acquisitive prescription to argue that "Hawaii's long acquiescence as a territory and state removes any legal defects in the United States' claim of sovereignty."

In a legal brief on the Continuity of the Hawaiian Kingdom available at
www.hawaiiankingdom.org Dr. Matthew Craven of the University of London examines this argument in some detail.

"If a claim as to acquisitive prescription is to be maintained in relation to the Hawaiian Islands, various indica have to be considered including, for example ... the extent of opposition to or acquiescence in, that occupation."

In "The Acquisition of Territory in International Law" (1963), a widely cited authority on the subject, R. Jennings, states that in cases of acquisitive prescription, "an acquiescence on the part of the State prescribed against is of the essence of the process."

Queen Lili'uokalani filed formal diplomatic protests on several separate occasions.

The Hawaiian people filed with the Senate a petition against annexation containing the names of a majority of the Hawaiian population at the time.

These protests resulted in the refusal of the Senate to ratify the treaty of annexation.

The U.S. 1993 Apology Resolution says the Hawaiian population "never directly relinquished their claims to the inherent sovereignty as a people or over their national lands to the United States."

Just because the occupation has been prolonged doesn't mean it isn't still an occupation.

At their conference in Honolulu last August, the Council For Native Hawaiian Advancement (CNHA) invited several representatives of federally recognized Native American tribes and Alaska Native Corporations to promote the economic benefits of federal recognition and oil drilling in the Artic National Wildlife Refuge.

When the Gwich'in, the native people who actually live on that land asked to participate in the discussions, the CNHA refused their request.

Not to be silenced, the Gwich'in did come to Honolulu and, with help from their many Hawai`i supporters, presented panel discussions and an Artic Film Festival at the State Capitol.

They also rented a conference room close to the CNHA convention to share the truth with all who would listen.

What they revealed was stunning.

A proud and self-sufficient people, the Gwich'in refuse to allow the violation of their natural environment.

They recount their life of poverty and deprivation under federal recognition and their constant battles with the US federal government and alien economic opportunists.

It has become clearly apparent that certain individuals within the CNHA have been secretly working with senators from both Alaska and Hawai`i to promote drilling in the ANWR, against the wishes of the Gwich'in, and also to force federal recognition here in Hawai`i - for personal gain.

Then, I order you and your family around, use your things and rearrange the rooms.

I take down your photos and religious symbols, replace them with my own and make you speak my language.

One day, I dig up your garden and replace it with crops that I can sell. You and your family must now buy all of your food from me.

Later, I invite my father and his buddies over. They bring guns. We take your keys.

I forge a deed and declare my father to be the owner of your house.

I bring more people. Some work for me. Some pay me to stay in your house.

I seize your savings and spend it on my friends. You and your family now sleep on the porch.

Finally you protest. Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave.

I tell you, "Sorry, I was wrong for taking the house."

But when you demand your house back, I tell you to be realistic. "You are part of this family now, whether you like it or not," I say. "Besides, this is for your own good.

For all that I have done for you, why aren't you grateful?"

WHAT CAN AMERICANS DO TO HELP HAWAI`I RECOVER ITS INDEPENDENCE ?

US Americans should start using critical thinking in resolving the Hawaiian issue.

If, in fact, the US is unlawfully occupying Hawai`i; logically it should deoccupy it.

One should become familiar with the laws of occupation to understand the issues.

One will also understand the folly of attempting to turn Hawaiians into American indians and tribes through federal recognition and what it seditiously represents.

The misrepresentation of the facts have been fostered on the US Americans and what has and is being done in their name.

Amid the myths and hoax lie documented facts with US admittance of misprison through covert and overt activities to destabilize the Hawaiian Kingdom, invasion, and takeover through a declaration among those involved, with the complicity of the USA and unbeknownst to the subjects of the Kingdom over a century ago.

This then took shape in a fake revolution to validate the nefarious actions spurred by the US government officials and their US American counterparts residing within the Hawaiian Kingdom.

AMERICANS CELEBRATE THEIR INDEPENDENCE TODAY - WHEN WILL HAWAI`I GET IT'S CHANCE?

The U.S. Justice Department knows that in 1898 the Congress of the United States made a grave constitutional mistake by attempting to annex Hawai`i by Joint Resolution 51.

They violated their own laws.

Hawaiian Nationals were not allowed to vote for or against annexation.


The U.S. Senate tried two times to pass a treaty of annexation of Hawai`i.

Twice it failed.

If they did allow the majority of the citizens of the Kingdom of Hawai`i in 1898 to vote whether to become part of the US, it would have been an overwhelming "no."

The only way the U.S. government can right the wrong it inflicted on Hawaiian Nationals is to let their descendants today decide if they want independent status or be part of the American system.

If Hawaiians and other loyal Kingdom citizens are not allowed to vote for the form of governance they prefer, then the whole American democratic process is good for nothing.

WHO REALLY OWNS THE LAND IN HAWAI`I ?

Land Titles Issued Today Are Very Much In Doubt -

"Clear Title," regarding legitimate legal ownership of land in Hawai`i is a topic quickly becoming an issue in the political and commercial areas.

With more lands being "quiet titled" in the courts by unscrupulous characters with the aid of foreign laws (USA and state of Hawai`i) illegally imposed against the rightful/legal owners of these lands and a judicial system aiding and abetting in these crimes; its no wonder developers want to build 1,100 new luxury homes in Makena and elsewhere.

Land titles in Hawai`i continue to carry the original "royal patent" from the mahele (land division) in the 1800's issued by the Hawaiian Kingdom.

If the U.S. Government or state of Hawai`i and their citizens rightfully have "clear title" to these lands, then why has the U.S. patent not replaced the royal patent as it was done in 49 other states.

Answer - Each royal patent has been "adjudicated," making them all a legal decree.When purchasing land, a "warranty deed" is issued, not a clear title per se. Shouldn't a clear title be guaranteed?

Unless, of course, there is no clear title to the land.
