WHERE DID FREEDOM FOR HAWAI'I GO ?

I write this letter in the earnest hope that it will thoroughly disappoint Ms. Janice Johnson, who in a letter to the Advertiser (Constant degrading of the U.S. is tiresome, Jan. 24), belittles native Hawaiians by comparing them to "teenagers," accuses them of dwelling in the past and giddily expresses her hopes of reading more of what she calls "uplifting words" in the Letters and Commentary section.

In our culturally diverse community, Ms. Johnson need not look very far to find Holocaust survivors and Mainland Nisei internees, who refused to give in to similar flag-waving attempts to deflect legitimate grievances against grave injustices committed in the past.

I wonder if Ms. Johnson would have the temerity to confront such individuals and tell them to their faces that they "are looking for a free ride" or that they "expect everything and have no pride"?

Over a hundred years ago, U.S. troops overthrew the government of a sovereign nation that posed no threat to us, because we coveted its natural resources and strategic location. While the global geo-political focus has shifted elsewhere long ago, the United States appears to have made no progress in its attitude toward other countries.

And even though President Bush and people like Ms. Johnson scream "FREEDOM! FREEDOM! FREEDOM!" to exculpate the foreign policy
misadventures of the U.S., past and present, the "degrading of the United States" in the eyes of the world today comes about because of our ignoble deeds in places like Abu Ghraib and Guantánamo, and not from those who speak out against such outrages, present or past.

Injustices cannot be camouflaged with red, white and blue.

May this letter lift the hearts of every Hawaiian who reads it.

A QUICK TRUE OR FALSE QUIZ REGARDING THE BENEFITS OF NATIVE HAWAIIAN FEDERAL RECOGNITION -

1. Senate Bill 147, The Native Hawaiian Government Reorganization Act of 2005 contains language that guarantees Hawaiians a land base.

2. SB 147ensures that the Hawaiian Homes program will not be terminated.

3. Hawaiians will vote on whether or not to accept federal recognition. The choice is theirs to make.

4. The commerce clause and treaty clauses of the U.S. constitution do not prohibit federally recognized indigenous people achieving independent nationhood.

5. Federal law provides for the protection of indigenous peoples entitlements and they cannot be taken from them without their consent.

6. Federal law prohibits the states from interfering in federally recognized indigenous peoples affairs in any way.

7. State law and rights do not apply on federally recognized indigenous land bases.

8. Federal law allows for recognized indigenous people to make treaties and commercial agreements with foreign nations.

9. Federal law allows recognized indigenous people to make treaties with the United States.

10. Federal law does not allow the United States to terminate recognition of an indigenous people at any time.

11. The United states has never terminated a government to government relationship with federally recognized people without their consent.

12. Nationality, defined by blood quantum rather than legal definition, is common in other nations around the world.

13. Blood quantum restrictions are not the primary reason for the steep decline in the number of federally recognized indigenous people.

14. Blood quantum restrictions will not result in the exclusion of future generations of Hawaiians from Hawaiian citizenship.

15. Under federal indigenous policy, the legitimacy of existing Hawaiian claims against the United States for treaty violations, unlawful confiscation of land, usurpation of their peaceful neural government, theft their resources, restraint of their rights, damage to their culture,and all other existing claims in international and domestic law will be decided in an court of law, not in negotiations between the United States and a federally funded Hawaiian governing entity.

16. The size of the land base Hawaiians are being promised by American and Hawaiian proponents of federal recognition will be determined prior to Hawaiian's acceptance of federal recognition and their agreement to subject themselves to the framework of federal law forever.

17. Hawaiians will not have to compete with other interests at the federal table for funds and programs already woefully inadequate for those now receiving those funds.

18. Indigenous peoples lives have improved more under federal policy than the lives of people in independent nations in the same time frame.

19. Federal recognition will provide that every Hawaiian will receive land and housing for life.

HAWAI'I'S CHILDREN REDISCOVER THEMSELVES IN THEIR CULTURE

Island children are discovering themselves and their roots in the taro lo'i (patches) of Kapahu Farm in Kipahulu.


"Many of the kids have never been in mud, were not raised in taro," says Tweetie Lind, a longtime resident of the rural Maui community. "A lot of them have problems; there are special-ed kids, high-risk kids, those who have to take Ritalin to keep them controlled in school. They're dealing with pressure from their parents and teachers. They need help."

Lind and her husband, John, are showing that working with taro can do that. During a morning tour with school groups that can last up to four hours, they "talk story" about taro: its importance in old Hawai'i, the legends surrounding it, varieties that are grown at Kapahu Farm, how the patches are irrigated with water from nearby Oheo Stream, and more....

"Their faces brighten; they squeal and laugh," says Lind. "Their expressions say it all: 'Wow!' It's rejuvenating; it's healing. And the next time they come, you can see big improvements; they're feeling much better about themselves."

ADDING INSULT TO INJURY -
"HAVE THEY NOT TAKEN EVERYTHING AND NOW BEGRUDGE STILL MORE?"

2005 is a very special year. The official date of the Martin Luther Holiday fell on the same day (January 17) as the date that the Hawaiian community commemorates the Overthrow of the Hawaiian Kingdom.

Therefore, we, The Dr. Martin Luther King, Jr. Coalition-Hawaii, invited several Hawaiian organizations to join us in observing this unique juncture by participating in the parade for equal rights, dignity and justice.

Hence it distressed me to read letters in the Advertiser from Thurston Twigg-Smith as well as David Rosen an attorney representing the plaintiffs in Arakaki vs. Lingle, a lawsuit challenging the constitutionality of the Office of Hawaiian Affairs and Department of Hawaiian Home Lands programs. Both letters to the editor were full of misrepresentations and obfuscations. In fact, they were downright abusive....

Why after 122 years is it necessary for these men to continue to defame Queen Liliuokalani? Have they not taken everything and now begrudge still more? Rosen is being consistent in his opposition to the Native Hawaiians' claim for self-determination, reclaiming their heritage, their land, their history and respect due to the host culture....

I am assuming that Mr. Rosen and Twigg-Smith have not noticed that the Dr. Martin Luther King Jr. Coalition-Hawaii’s parade has all nationalities participating in the observance of the Dr. Martin Luther King Holiday and has so for the past seventeen years....

Since my mother was Hawaiian-Chinese and my father African-American, as long as I have breath in my body, the Hawaiians will be invited to participate.

OVER 100 YEARS LATER, THE LIES AND DECEPTIONS CONTINUE - THE DECENDANTS OF THOSE WHO OVERTHREW THE SOVEREIGN HAWAIIAN GOVERNMENT ATTEMPT TO RE-WRITE HISTORY

Readers should find Thurston Twigg-Smith's Sunday letter interesting and humorous.

While criticizing [Queen]Lili'uokalani as not "working for the rights of her people," he used her proposed 1893 constitution as evidence that she attempted to increase unprecedented political rights for herself.

If a person were to compare the queen's proposed constitution with that of the 1864 constitution, he would find that the two are almost identical.

The queen was not proposing anything new. She was attempting to restore the constitution of 1864, while ridding the kingdom of the constitution forced upon the previous head-of-state while the Legislature was out of session.

Twigg-Smith claims the queen wanted to take the right to vote for nobles away from the people. What he does not mention is that Lorrin Thurston, through the 1887 Bayonet Constitution, reduced the voting power of all citizens (of all races) of the kingdom, by allowing mere residents of American and European birth the right to vote.

It is boggling as to why the Bayonet Constitution did not extend this right to residents of Chinese or Japanese birth.

Resident aliens are not afforded the right to vote in America today, and they were not afforded the right to vote in the Hawaiian kingdom, at least not until the Bayonet Constitution, which was written by Lorrin Thurston.

NATIVE HAWAIIAN BENEFITS ARE ALREADY IN PLACE - SO WHY ARE THEY TRYING TO SHOVE THE AKAKA BILL DOWN OUR THROATS ?

In the Jan. 7 article "McCain could block vote on Native Hawaiian bill," you noted that the U.S. senator stated that when Hawai'i attained statehood, "there was an implicit agreement at that time that Native Hawaiians would not receive the same status as Native Americans."

I also oppose the bill, but for different reasons than McCain, who has it wrong.

As a condition of admission to the union, Hawaiian entitlements were to be protected by the state of Hawai'i. The State Admission Act details five purposes for the income from the leases of the so-called ceded lands (which were stolen from the kingdom of Hawai'i), including "the betterment of the conditions of Native Hawaiians."

Also, the Hawai'i Constitution states that these lands shall be held by the state in trust for Native Hawaiians and the general public, which means that the designation of Native Hawaiians as beneficiaries of the trust shows that they are entitled to benefits over and above any other state citizens.

These trust benefits are the least of our entitlements because our unadjudicated sovereignty claims expose the lack of federal title to any of those lands in the first place.

'Tis the season for treason. In remembrance of the illegal overthrow of the Hawaiian Kingdom, I believe resistance to oppression is the highest form of culture and, in the case of the Hawaiians, this equals resistance against the ongoing theft of our most valuable cultural treasure, our aina (land.)

Crushed by America's impending neglect is the hope for meaningful change. Clearly, the neglect of Hawaiian rights has become the overriding factor in our removal from our ancestral lands.

America considers Hawaiians "wards of the state." By virtue of this so-called status, the state and federal governments assume the privilege of drafting legislation pertaining to our people without our consent, and in doing so continue to deny existing Hawai'i self-determination and land rights.

The state of Hawai'i, along with Hawaii's federal delegation is seeking to finish what began with the illegal overthrow of the Hawaiian Kingdom by passing the Akaka Bill.

Since forced under U.S. domination, Hawaiians have never relinquished their rights to sovereignty and to their land. While politicians plot the legalization of America's illegal occupation of Hawaiian national territory, so-called state and county authorities can incarcerate Hawaiians for trespassing on their own land.

Clarify our land rights, not re-create them, because the land is our social link broken by American imperialism. This is Hawai'i, our home.

You cannot promote freedom and at the same time look down your nose at it.

HERE'S THE PLAIN TRUTH - HAWAIIANS DON'T WANT FEDERAL RECOGNITION OR THE AKAKA BILL!

You continue to publish articles extolling the benefits of the Akaka bill (articles by Beadie Kanahele Dawson and Bill Meheula, Sunday).

There seem to be two main arguments for the Akaka bill:

* It would eliminate challenges to federal funding for programs benefiting Hawaiians.

When will Hawaiians learn that we cannot rely on the federal government for funds, particularly when the government is facing a massive spending deficit and is in the control of a party that has never shown much interest in the problems of minorities?

Because of the power of Sen. Daniel Inouye, Hawai'i has presence in Washington that is far beyond its due. With all due respect to our other senator and congressmen, when Hawai'i no longer has Sen. Inouye to represent us, our little state 5,000 miles from the seat of power will be thought of only as an American military base far out in the Pacific Ocean.

We should not then be surprised if federal handouts for Hawaiian programs suddenly dry up or are seriously curtailed.

* It would somehow revive a Hawaiian nation.

It would instead be a make-believe nation that would isolate and wall off Hawaiians from the rest of Hawai'i's people and the life of our land.

Only by achieving an independent Hawai'i can we have a true Hawaiian nation. In a few generations, people with Hawaiian blood will be the largest ethnic group in Hawai'i. With a sovereign Hawaiian nation, we can realize our true destiny. We can control our own values and not have them dictated by waves of rich new immigrants and investors, whether from the Mainland or other foreign places.

We should not discount the reality of creating an independent Hawai'i. In our world, new nations are continually being created from parts of existing nations.

The Akaka bill is an old-person's solution. Its thesis is again going hat in hand to the federal government for help and turning Hawaiians inward in their own land. For more than a hundred years, this has not worked.

Instead, we can seize the opportunity to create a dynamic new nation through which we can maintain our culture and values, have more control over our future and be a leader among the Pacific nations.

Let that be our legacy to our future generations.

HERE'S HOW THE US GOVERNMENT, WITH THE HELP OF THE OFFICE OF HAWAIIAN AFFAIRS, IS PLANNING TO STEAL THE HAWAIIAN NATION - ONCE AND FOR ALL!

By their own laws, the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent. They and the State of Hawai'i have never had "Clear Title" since Jan 17, 1893.

They all know this...have known for a long time.

The only way the United States will ever be able to get clear title to the Hawaiian Islands is if Hawaiians give it to them. This is why title to the Hawaiian Islands never transferred to the United States by the Newlands resolution.

The Newlands resolution relied on the treaty of Annexation from the republic of Hawai'i. But the republic never owned title because the Kingdom of Hawai'i never gave it to them.

But now they got a plan.....they are going to get Hawaiians to give title to them.

How are they going to do that?

Here's how -

They are going to register a majority of Hawaiians on a "roll."

They are going to draft governing documents to "re-organize the Hawaiian government".

They are going to get Hawaiians to elect officers to that government.

They are going to make sure those governing documents give the officers of the government the authority to give away title in negotiations.

They are going to get the majority of Hawaiians on the roll to vote for the new governing documents to reorganize the Hawaiian government.

That government authorized and approved by the majority of Hawaiians is going to sit down at the negotiating table with the United States and trade land title for cash and benefits.

Many people believe that only the Kingdom of Hawai'i is authorized to give a way title to the Hawaiian Islands.... and they are correct, but only as long as the kingdom remains intact.

If the majority of its subjects revolt by forming a new government, the kingdom no longer exists.

This is the effect of popular revolution.The bill is only the bait. The hook is the formation of a new government and the negotiations between the U.S. and the new government.

As long as Hawaiians don't bite the bait...the hook is harmless....The bill is not intended to settle any claims.... The bill dos not tell Hawaiians, but asks them to form a government that can and will extinguish Hawaiians claims.

James Kuroiwa Jr. is an American who has no roots during the time of the U.S. invasion of the kingdom or prior to it ("Akaka bill opposition will lead to dialogue," Letters, Jan. 13). He is preaching to the choir who are directly involved and many who never acknowledged the United States as possessing our country.


Most of the islanders living here today have no knowledge or involvement of that part of our history. They only know the one-sided American revisionists' version of the events, which white-washes the U.S.' involvement in destabilizing the kingdom's government and its takeover.

We know the truth, and Kuroiwa has yet to learn it. The plebiscite of 1897 has been ignored and the Statehood Organic Act has been deemed irregular and thus illegal and unlawfully executed.

The United States contends that the people of Hawaii voted for statehood, but only Americans were allowed to vote. Many Hawaiian subjects were barred from participating. Now that's the truth.

HERE'S WHAT'S IN STORE FOR HAWAII'S CHILDREN IF U.S. FEDERAL RECOGNITION IS IMPOSED UPON NATIVE HAWAIIANS

A recent survey from American Indian housing directors shows that Native children are less likely to get enough sleep and finish their homework and are more likely to suffer from communicable illnesses and live in overcrowded and substandard housing conditions.

The NAIHC blames a dearth of federal funding.“ It’s a crime that the government spends more money for health care for prisoners than it does for Native Americans,” said NAIHC Executive Dierctor Gary Gordon, citing figures that show current federal spending at $3,803 a year per inmate as compared to $1,914 for each individual tribal member.

The survey showed increased cases of communicable diseases such as colds, flu, and skin outbreaks, with 77 percent of respondents making a direct correlation between those conditions and overcrowded housing. The group used the U.S. Census Bureau's definition of overcrowding - more than one person per room.

The questionnaire handed out to tribal housing directors also showed that black mold was causing such severe problems that some children are wearing respirators to bed at night.“We fear for the next generation,” said NAIHC Chairman Chester Carl. “The children do not have a bed to call their own on many reservations.”

Bureau of Indian Affairs head Dave Anderson said the survey rings true."The observations by this group are very accurate," Anderson told The Associated Press. "As Indian people, we have been almost like a Third World developing nation. It's unfortunate that America's first people probably experience the bottom rung of every social dysfunction there is.”

"Very few places in our nation have children hurting as much as on our Indian reservations,” Carl said. “It is up to the federal government to uphold the trust responsibility-an obligation it has made to tribes through treaties and laws-and make good on promises ratified centuries ago. We, as Native people, will also continue to work together to make a better life for our children."

Mahalo to all who called me these past days on behalf of freedom.


I pray also that on Jan. 17 at 11 a.m. in front of Queen Ka'ahumanu Center there will be a massive turnout of Hawaiians and Hawaiians at heart holding signs and blowing conch shells letting the world know that we love our nation.

The United States helped restore Iraq after destroying it. It apologized to us but did not keep its word. U.S. officials totally disrespect their own laws and that's a shame.

I love who I am, a kanaka maoli, [Native Hawaiian] and I will continue pursuing our right to exist.

Because for foreign business interests it's a matter of profit and loss. For Native Hawaiians it's a matter of life and death.

Because while Native Hawaiian families are struggling to survive, their water is being shipped to the other side of the island so that housing and resorts can be built by rich foreigners.

Because it is our national inheritance - never given away by either native treaty or by native vote.

KAHULUI - The Akaka Bill is a trick to swindle Native Hawaiians out of any recourse to international support, University of Illinois professor Francis Boyle told a crowd of about 50 Mauians Wednesday night.

"The Kanaka Maoli (Native Hawaiians) must build and restore the Kingdom of Hawaii from the ground up," Boyle said.

"They're trying to reduce and eliminate all your claims under international law."

LAW EXPERT FRANCIS BOYLE URGES NATIVES TO TAKE BACK HAWAI'I

International law expert Francis Boyle walked hastily into Kona Outdoor Circle Wednesday morning. He was late by almost 30 minutes, but it didn't matter.

About 60 people waited patiently in their seats to hear his three-hour speech, "The Restoration of Hawaii's Independence."

Most favored the perspective of Nation of Hawaii and Hui Aloha Aina -- Na Wahine O Puna sponsors -- "He just makes sense."

Boyle said the United States conceded it unlawfully occupied the Kingdom of Hawaii and has done so for more than 111 years. That fact alone, he added, "gives the Kanaka Maoli (Native Hawaiians) the entitlement to restore their independent status as a sovereign nation state..."

INTERNATIONAL LAW EXPERT SAYS AMERICA HAS A DUTY TO SET HAWAI'I FREE

A professor of international law contends that the so-called Akaka Bill would strip Hawaiians of their right to self-determination.

He also says independence would be best achieved through international law.

Speaking Wednesday afternoon at the University of Hawaii at Hilo, Francis A. Boyle, who teaches at the University of Illinois, offered an ominous vision of the legislation that, as the bill states, would "provide a process for the recognition by the United States of the Native Hawaiian governing entity."

"The United States federal government is setting up a process whereby it's telling you, the kanaka maoli, (Native Hawaiian) how you are going to give up your sovereignty, give up your land and give up your self-determination."

He offered instead an alternative to the Akaka Bill: arguing the case in an international court of law. Boyle said the United States made numerous treaties with the Hawaiian Kingdom in the 19th century, none of which has since been rescinded.

Further, the Akaka bill and the Apology bill both recognize the Hawaiians have "never relinquished their claims" to sovereignty.

"The United States promised 'perpetual peace and amity' to the Hawaiian Kingdom," Boyle said, referring to an 1849 treaty.

"That promise is still there. Even though the United States has not honored it, it is obligated to honor it." The Hawaiian Kingdom exists in international law and treaties, if not in practice, he said.

vision of the legislation that, as the bill states, would "provide a process for the recognition by the United States of the Native Hawaiian governing entity."

"Under the Akaka legislation, kanaka maoli (Native Hawaiians) are going to get an entity, not a government, not a state, just an entity, whatever that is," Boyle said.

Sovereignty, he said, would not be determined by the Hawaiians as declared in the "Apology Bill" - Congress' 1993 resolution apologizing for the overthrow of the Hawaiian Kingdom.

Instead, Boyle said the Akaka Bill would establish an "interim governing council" - a far cry from an actual government. It would have no authority to enact laws or control land, and would be subject to federal jurisdiction.

"The United States federal government is setting up a process whereby it's telling you, the kanaka maoli, how you are going to give up your sovereignty, give up your land and give up your self-determination."

He offered instead an alternative to the Akaka Bill - arguing the case in an international court of law. Boyle said the United States made numerous treaties with the Hawaiian Kingdom in the 19th century, none of which has since been rescinded.

THINGS TO AVOID DOING WHILE ON VACATION

  • Do not disturb offerings at heiau, including leis, rock piles. Do not make an offering of rocks wrapped in ti leaves--it is not a traditional practice and heiau can be damaged when small rocks are removed from ancient walls. The small rocks help anchor the larger rocks.

  • Don't apply sunscreen at the beach and then immediately jump in the water. If you look closely at the water at popular beaches, you'll often see an "oil slick" of sunscreen on the surface. This is not good for marine life! Try to limit your time in the sun, wear sunprotective swimwear and/or cover up sooner, in order to cut down on your use of sunscreen in the water.

  • Avoid so-called "eco-tourism" activities that actually disrupt dolphin resting places (like those in Kealakekua Bay) or which have adverse impact on other wildlife or plants. Check with a local environmental group before signing up to "swim with the dolphins" or other such activities.
