Here's Part Three -
I have found that Hawaiians who oppose this bill have nothing in common with anyone involved with legal attacks on Hawaiian trusts or state agencies that serve Hawaiians.

Those groups and individuals compare Hawaiian empowerment with Apartheid - that analogy is offensive to all people of color, especially those who have suffered at the hands of white supremacists the world over.

The Akaka Bill, like the recent 9th circuit court's ruling, is an opportunity for Hawaiians to look honestly at the institutions of the American system and interpret its intention towards us and our homeland.

If we look at America through the eyes of our kupuna [elders,] what we see is the same country that helped overthrow the Kingdom.

We see the same country whose political, economic and legal system has displaced the Kanaka Maoli [Native Hawaiian]and used our homeland as a playground and a military outpost while developing what is now the largest arsenal in the world.

We see a country that admitted and apologized in 1993 for its role in the overthrow of the Hawaiian Kingdom, and yet refuses to return the stolen property they received for their efforts.

We see a system that does not respect our ways as Hawaiians and therefore cannot provide us any real justice, only a poor imitation of justice that first and foremost satisfies the US.

This bill places our assets in the Dept of Interior, an agency that is presently defrauding our indigenous friends on the continent of billions of dollars worth of their trust assets and is refusing to comply with orders from its own government's federal courts.

Imagine what they can do to us with all the practice they've had on the Indians. We can't even get the state of Hawai`i to inventory our lands, do we really think we're gonna get anywhere with the feds?

And this legislation was created by the feds. It emerged from the offices of Senator Inouye and Senator Akaka.

The Akaka Bill does not represent the hopes of Hawaiian people and is not a document created by the Hawaiian people.

But this one is. I have here a copy of one of the two Ku'e [protest] petitions signed in 1897 by almost every single living Kanaka Maoli in the Kingdom. I believe we need to stand for our queen and our kupuna and ku'e [resist.]

Here's Part Two -
During the past 4 years I've had the privilege of listening to, interviewing or filming Hawaiians from all over who oppose this legislation.

There are 3 things they all have in common:

1. Many Hawaiians see federal recognition as a threat to their legal options for true self-determination under international law-and see this bill as way of exchanging those rights for the American version, which means the plenary powers of congress-and that means no power for Hawaiians at all;

2. They see it as an attempt by the United States to pressure us into signing over title to the Crown and Government Lands of the Hawaiian Kingdom;

3. They believe it is an insult to the legacy of our ali'i, and that it undermines our spiritual and cultural kuleana [responsibilities] as Hawaiians.

Despite the assertion by others who insist that Hawaiians are no different than any average US citizen - Hawaiians who know their history often see themselves as Hawaiian citizens, not Americans.

They know the Organic Act of 1900 did not make them American citizens, it made citizens of the phony Republic of Hawai`i into Americans.

Kanaka Maoli [Native Hawaiians] were not citizens of the Republic. The Kanaka Maoli never acquiesced to either the fake Republic of Hawai`i or to the United States.

Hawaiians are called citizens of the US but that has been done without consent.

Mahalo to the organizers of this event for inviting me to be here.

Aloha Kakou: I apologize in advance for speaking quickly--- too little time and too much to say.

This legislation is primarily about money--- it's about using American laws to control the land and resources of Hawai`i and the political and cultural destiny of Kanaka Maoli [Native Hawaiians] who are the rightful heirs to the 1.8 million acres of Crown and Government lands.

We are told that it will protect 70 million federal dollars per year and millions of dollars in trust assets, but there's no guarantee for any of that in the bill--- and truth is that if we controlled our own land and collected rent and taxes on that land we wouldn't need any federal money and would be well on our way to self determination.

I agreed to participate on this panel because I believe there needs to be a perspective here that represents Hawaiian voices that are outside of the American agenda.

I am not a member of any sovereignty or kingdom group. And unlike the others on this panel, I am not a lawyer and I am not being paid to be here.

Before these gentlemen get off to the races about legal this and constitutional that, I want to remind all the Kanaka Maoli in this room that law was created to serve the needs of human beings, not the other way around.

I believe that from the beginning of American imposition of laws in Hawai'i to the present, our experience with the US has been dehumanizing.

The work I do as a journalist puts me in contact with maka'ainana [average, everyday people] who are not invested in the economic system of non-profits and state agencies that are pushing this bill.

KAMEHAMEHA RULING MISUSED TO SUPPORT AKAKA BILL

We are alarmed that both the media and others are misreporting the recent 9th Circuit Court of Appeals ruling in Doe vs. Kamehameha to scare people into supporting the Native Hawaiian Government Reorganization Act of 2005, commonly called the Akaka Bill.

Many news outlets, Office of Hawaiian Affairs trustees and paid proponents of the bill falsely describe the court's opinion as a decision that Kamehameha Schools' admission policy was "race-based and therefore unconstitutional...."

Proponents of the Akaka Bill are attempting to use their interpretation of the ruling as a way to redirect the activist opposition to the bill to focus on Kamehameha Schools....

Passage of the bill would not protect Kamehameha Schools from the racist attacks on Hawaiians, which are firmly grounded in U.S. law and principles of "racial equality" without justice.

SHADES OF THINGS TO COME FOR HAWAIIANS IF THE AKAKA BILL PASSES -

WASHINGTON (AP) -- The Justice Department took the unusual step of asking that a new judge be assigned to a 9-year-old lawsuit by American Indians seeking a century's worth of unpaid oil and gas royalties.

U.S. District Judge Royce Lamberth has been highly critical of the Interior Department for failing to identify how much money Indian tribes are owed.

Last year the judge held Interior Secretary Gale Norton in contempt of court....

The department criticized Lamberth for making a "gratuitous reference" to murder, dispossession, forced marches and other incidents of cultural genocide against the Indians.

Lamberth's ruling, the Justice Department complained, described the Interior Department to be a "dinosaur -- the morally and culturally oblivious hand-me-down of a disgracefully racist and imperialist government that should have been buried a century ago, the last pathetic outpost of the indifference and anglocentrism we thought we had left behind."

The government's problem is not the judge, said Dennis Gingold, lead attorney for the Indians suing the government.

Gingold said the government's problem is the district court calling it to account for "100 plus years of bad facts, its pattern of unethical behavior, and its persistent strategy of diversion, delay and obstruction."

In 1994, Congress found problems with the Interior Department's administration of 260,000 Indian trust accounts containing $400 million.

The Indians allege the department mismanaged oil, gas, grazing, timber and other royalties from their lands dating to 1887.

Elouise Cobell of the Blackfeet Indian tribe and others sued in 1996 to force the government to account for billions of dollars belonging to about 500,000 Indians....

Sen. John McCain, R-Arizona, has criticized the government for having "never really even made any serious attempt at keeping track of the revenues" it owed the Indians.

STRANGERS IN OUR OWN LAND

WAILUKU - With the Hawaiian flag flying upside down in a show of distress as the rains fell, the so-called "celebration" of 46 years of statehood for the islands on Friday was more of a somber gray than red, white and blue....

Cloaked in a red kihei, [Native Hawaiian cultural specialist Charles Kauluwehi] Maxwell recalled the day when he heard the news that the territory of Hawai`i was now a state.

"My father broke down in tears and said, 'We have lost Hawai`i forever as we know it, and it will never be the same,' " said Maxwell.

He then began to recite a list of some of the changes that have taken place since statehood opened the doors to tourism and a boom of transplants from the Mainland: less ocean and mountain access; million-dollar homes in gated communities where Hawaiians used to fish and camp; more traffic; big box stores replacing mom-and-pop businesses; and wealthy gentlemen farmers buying up former sugar cane lands.

"Today in 2005, my father's words ring loudly," said Maxwell. "We are strangers in our own land...."

DO YOU THINK THE LIVES OF HAWAIIANS WOULD IMPROVE UNDER THE "SPECIAL TRUST RELATIONSHIP" THAT FEDERAL RECOGNITION WOULD BRING ?

Just look at these comments from the Senate Indian Affairs Committee March 11, 2003 letter to the Budget Committee justifying their budget request for fiscal year 2004 -

"Native people in the U.S. continue to rank at or near the bottom of nearly every social, health, and economic indicator, as compared to all other citizens.

"Natives continue to suffer the highest rates of unemployment and poverty, live in substandard housing, have poor health, receive an inadequate education, and contend with disintegrating social systems, all of which erode both the quality and dignity of life in Native communities.

"Improving effectiveness in the Indian agencies is important but also recognizes that these agencies have witnessed a pattern of under-funding for decades and that, in part at least, increased resources are needed to alleviate the dire conditions in Native America and address the basic human needs Native people.

"The educational attainment for Native youth is deficient compared with other groups in the U.S. For example, Native youth receive fewer high school and college degrees. An aggravating factor in educational achievement is the continued inability of the Federal government to ensure adequate, safe and clean educational facilities conducive to learning.

There is also unmet demand for electricity in Native communities: a recent Department of Energy report estimated that 14.2% of all Native homes on reservations have no access to electricity compared to just 1.4% of all U.S. households.

"With unemployment averaging 43% and poverty rampant, Native communities are particularly sensitive to high energy prices.

Given the near-complete absence of a private sector in most Native communities, 31.2 % of Natives live in poverty.

"In the U.S. today, the unemployment rate is 5.8%, whereas the rate for Natives is near 50% --- twice that of the national unemployment rate in the Great Depression.

"The earning capacity of Natives also lags behind that of other Americans: for every $100 earned by the average American family, an Indian family earns $62. The per capita income for Indians averages $8,284.

"Most striking are the health statistics involving Native people: diabetes, tuberculosis, alcoholism, Fetal Alcohol Syndrome (FAS) and increasingly, AIDS, plague Native communities at rates far and above the incidence for other Americans.

"Many reservations lack basic infrastructure, with tribal governments being obliged to make large investments in water lines, sewage and sanitation facilities, and paved roads. responsibility and authority to provide safe and adequate water supply systems and sanitary sewage waste disposal systems in Indian homes."

HERE'S HOW THE US GOVERNMENT, WITH THE HELP OF THE OFFICE OF HAWAIIAN AFFAIRS, IS PLANNING TO STEAL THE HAWAIIAN NATION - ONCE AND FOR ALL!

By their own laws, the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent.

They and the State of Hawai`i have never had "Clear Title" since Jan 17, 1893. They all know this...have known for a long time.

The only way the United States will ever be able to get clear title to the Hawaiian Islands is if Hawaiians give it to them.

This is why title to the Hawaiian Islands never transferred to the United States by the Newlands resolution. The Newlands resolution relied on the treaty of Annexation from the republic of Hawai`i. But the republic never owned title because the Kingdom of Hawai`i never gave it to them.

But now they got a plan.....

They are going to get Hawaiians to give title to them. How are they going to do that?

Here's how -

They are going to register a majority of Hawaiians on a "roll."

They are going to draft governing documents to "re-organize the Hawaiian government".

They are going to get Hawaiians to elect officers to that government.

They are going to make sure those governing documents give the officers of the government the authority to give away title in negotiations.

They are going to get the majority of Hawaiians on the roll to vote for the new governing documents to reorganize the Hawaiian government.

That government authorized and approved by the majority of Hawaiians is going to sit down at the negotiating table with the United States and trade land title for cash and benefits.

Many people believe that only the Kingdom of Hawai`i is authorized to give a way title to the Hawaiian Islands.... and they are correct, but only as long as the kingdom remains intact.

If the majority of its subjects revolt by forming a new government, the kingdom no longer exists. This is the effect of popular revolution.

The bill is only the bait. The hook is the formation of a new government and the negotiations between the U.S. and the new government. As long as Hawaiians don't bite the bait...the hook is harmless....The bill is not intended to settle any claims.... The bill dos not tell Hawaiians, but asks them to form a government that can and will extinguish Hawaiians claims.

IS THE STATE OF HAWAI'`I FACT OR FICTION ? HERE'S WHAT A PROMINENT RETIRED ATTORNEY HAS TO SAY -

At a meeting in Kona, a retired O'ahu lawyer, gave his insights to questions regarding legitimacy of the State of Hawai`i and the quest for Hawaiian independence.

Two most interesting statements he made were -

1."The State of Hawai`i is a fiction.” He repeated this several times. A good analogy. For instance, books are nonfiction or fiction; one true, the other made up.

2."If you are a Hawaiian National and vote in the State of Hawai`i or federal elections, you destroy what you are trying to accomplish. You acquiesce to their jurisdiction and become a U.S. citizen. You cannot be both at the same time.”

History shows that Hawaiians successfully eluded all the plots, machinations and terrorism of the occupying nation for 111 years by objecting as one voice to annexation in the beginning with the amazing Monster Petition of 1897, and then simply by not voting in the occupying nation's elections.

The do-nothing strategy has held the status quo for Native Hawaiians despite the enormous odds against preservation of their inherent sovereignty for 111 years.

The last Office of Hawaiian Affairs referendum ploy in the 90's netted a whooping 9% vote and then they tried desperately to pad the numbers by counting the non responses as “yes“ which made OHA look ridiculous.

Viewed from this perspective, the recent newspaper articles deploring Hawai`i's "voter apathy”are very good news indeed. They report only 44% of eligible Hawaiians vote against a national average of 60% voter turnout.

These figures seem to agree with the estimated figures of a 20% Native Hawaiian population in Hawai'i.

"History shows clearly the Hawaiian Nation was not annexed - it was stolen!"

AND NOW THE CONCLUSION -

IS IT ANY WONDER MORE AND MORE PEOPLE WANT THE ILLEGAL U.S. OCCUPATION OF HAWAI`I TO END?

Aside from housing, transportation and food expenses contribute heavily to Hawai`i's staggering cost of living. The prices of gasoline, mandatory auto insurance, used cars and repair work are considerably higher than the mainland.

And only the city of Honolulu has reliable public transportation. On the other islands owning a car is a necessity to be able to work or look for jobs.

Hawai`i imports two-thirds of its food from the mainland and locally-grown food is expensive due to high land prices.

Although a relative scarcity of farmable land exists in the islands, some economists have concluded that land prices are artificially inflated through manipulation by the Big Five, giant land-holding companies owned by descendents of the five most influential missionary families who settled in Hawai`i two centuries ago.

But critics argue that even the food imported from the mainland shouldn't cost as much as it does. One supermarket manager admitted candidly that Matson Navigation shipping adds an average of only 18 per cent to the cost of imported food.

Yet prices range between 30 and 40 per cent higher than California where the Matson ships pick up the food for delivery to Hawai`i... Meanwhile, the situation grows worse daily for the vast majority of people in paradise and it's unlikely to reverse direction anytime soon...

In the past, Hawai`i was known for its aloha spirit and laid-back lifestyle. But by the early 1990s tourism, by then underpinning the state's economy, was under threat from cheaper competition.

The Gulf War and early 1990s recession lost Hawai`i its status and a lot of its visitors. The end of the Cold War saw cutbacks in military spending... Now aloha is difficult to find as various ethnic groups vie with each other for the last crumbs of the once-large economic pie.

And the pace of life has become frenetic in too many ways. As one long-time resident commented: "Hawai`i is turning into one of those Caribbean tourist islands where you have fancy hotels and a tiny rich neighbourhood and the rest of the island is a shantytown of poverty and crime."

IS IT ANY WONDER MORE AND MORE PEOPLE WANT THE ILLEGAL U.S. OCCUPATION OF HAWAI'I TO END?

Native Hawaiians constitute roughly 20 per cent of the state population, but they represent 54 per cent of the prison population.

Not coincidentally, they also have the lowest per capita income, the highest poverty rate and the shortest lifespan of any ethnic group in Hawai`i.

Hawai`i public school students receive a very poor education by any standard of measurement. They consistently rank among the lowest of any state in test scores.

Education reform has been talked to death by every governor and legislature of the past 30 years, but nothing substantial has been done.

This has led to a "brain drain" in the islands. Most of the bright students who manage to learn something in spite of the handicapped school system leave Hawai`i for foreign colleges and careers.

In the 1980s, Hawai`i gained the enviable reputation of providing medical insurance to the highest percentage of residents of any state. A decade after the state ended dental cover, toothless smiles are commonplace among the poor. Tens of thousands of residents have no medical insurance at all.

Despite higher profits for many businesses, jobs are scarce and most of the available work pays minimum wage or close to it... In some cases, the lives of the working poor are worse than the unemployed.

Among other things, they don't qualify for state financial assistance or full food stamp benefits. Even during the height of the hotel building boom in the 1980s, workers in the upscale South Kohala district of the Big Island were forced to sleep in their cars or public parks because they couldn't afford the high rents on hotel pay.

Today most of the Island of Hawai`i (Big Island) as well as the islands of Molokai, Lana'i and Kaua'i are economic wastelands with little opportunity to make a decent living.

On Kaua'i workers often share apartments or small houses with several other workers because rents are too expensive for one or two individuals to afford.

On every island married couples with children often work two jobs each to make ends meet - if they are fortunate enough to find that many jobs, even at minimum wage.

Let's pretend I visit your house. You offer me food and rest. I decide to stay.

Then, I order you and your family around, use your things and rearrange the rooms.

I take down your photos and religious symbols, replace them with my own and make you speak my language.

One day, I dig up your garden and replace it with crops that I can sell. You and your family must now buy all of your food from me.

Later, I invite my father and his buddies over. They bring guns. We take your keys.

I forge a deed and declare my father to be the owner of your house.

I bring more people. Some work for me. Some pay me to stay in your house.

I seize your savings and spend it on my friends.

You and your family now sleep on the porch.

Finally you protest. Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave.

I tell you, "Sorry, I was wrong for taking the house."

But when you demand your house back, I tell you to be realistic. "You are part of this family now, whether you like it or not," I say. "Besides, this is for your own good. For all that I have done for you, why aren't you grateful?"

Now Do You See Why Hawaiians Want Their Independence Back And Nothing Less?

HERE'S THE EFFECT OF OVER A CENTURY OF US OCCUPATION IN HAWAI'I ON NATIVE HAWAIIANS -

The Hawaiian people, have suffered since the first Western contact in 1778.

Western diseases, to which Hawaiians had no immunity, decimated their numbers.

At the time of western contact, some 800,000 people inhabited the Hawaiian Islands.

By 1805 that number had been halved.

By 1853 there were only 71,000 Hawaiian or part-Hawaiian people in the islands.

Within 100 years of western contact, the Hawaiian population had been reduced by nearly 90 percent.

According to the 2000 census, the numbers of people who claim some native Hawaiian ancestry have increased to over 400,000.

But only 239,000 live in Hawaii and they are the poorest, most locked-up population in the state.

Although they only make up about 20 percent of the state's population, in June 2001 they made up 39 percent of the state's prison population and 37 percent of the state's homeless population.

GET READY! HERE'S WHAT'S IN STORE FOR HAWAIIANS UNDER FEDERAL RECOGNITION!

U.S. SECRETARY OF INTERIOR GALE NORTON INVITED TO TESTIFY IN FEDERAL COURT TO PROVE SHE DIDN’T RETAILIATE BY WITHHOLDING INDIAN CHECKS

The judge in the landmark Cobell v. Norton Indian Trust case has issued an order inviting U.S. Secretary of the Interior Gale Norton to testify in court proceedings to prove she did not retaliate against American Indians by stopping the disbursement of Individual Indian Money (IIM) trust checks in October, 2004.

IIM beneficiaries, many of whom are among our nation’s poorest citizens and rely on Indian Trust payments for most or all of their income, were the victims of the government’s retaliatory actions.

In his February 7th order, Lamberth found such action deplorable.

"These Indians are the poorest minority group in the country," Lamberth wrote in his February 7th memorandum and order.

"The idea that Interior would either instruct or allow BIA to withhold trust payments, and then to stonewall the Indians who dared to ask why, is an obscenity that harkens back to the darkest days of United States-Indian relations."

HERE'S HOW THE US GOVERNMENT, WITH THE HELP OF THE OFFICE OF HAWAIIAN AFFAIRS, IS PLANNING TO STEAL THE HAWAIIAN NATION - ONCE AND FOR ALL!

By their own laws, the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent.

They and the State of Hawai'i have never had "Clear Title" since Jan 17, 1893. They all know this...have known for a long time.

The only way the United States will ever be able to get clear title to the Hawaiian Islands is if Hawaiians give it to them.

This is why title to the Hawaiian Islands never transferred to the United States by the Newlands resolution. The Newlands resolution relied on the treaty of Annexation from the republic of Hawai'i. But the republic never owned title because the Kingdom of Hawai'i never gave it to them.

But now they got a plan.....they are going to get Hawaiians to give title to them. How are they going to do that?

UN WORKING GROUP DECLARES OPPOSITION TO FEDERAL RECOGNITION

UN Working Group on Indigenous Populations (WGIP) Pacific Caucus has issued the following declaration against extension of U.S. federal Indian policy over Native Hawaiians (aka federal recognition).

The signed hard copy has signatures of all the Pacific peoples at the recent WGIP: New Caledonia, Aborigines, Maori, Malukas (under occupation by Indonesia), Hawai`i, as well as supporters from other nations.

Here's the text of the declaration -

Declaration of the Pacific Caucus Opposing Extension of United States Federal Indian Policy Over Kanaka Maoli [Native Hawaiians,] Hawai`i.

We, the undersigned, are the Pacific Caucus and other participants of the United Nations Working Group on Indigenous Populations. We are nations united in solidarity with the people of Hawai`i who continue to assert their fundamental human right of self-determination.

The United States has maintained an illegal occupation of Hawai`i since 1893 and has actively prevented the full expression of Kanaka Maoli self-determination.

Therefore, in recognition of the recommendations of the 1993 Peoples International Tribunal Hawai`i, and in support of the Hui Pu Declaration Rejecting and Condemning the Native Hawaiian Government Reorganization Act, we hereby declare that the United States Federal Indian Policy should not be unilaterally applied to Hawai`i through federal recognition.

All nations should be afforded the full exercise of self-determination as provided under international law and prevailing human rights standards.

TOO MANY QUESTIONS REMAIN ON THE AKAKA BILL

Before Congress votes on the Akaka bill, there are some important questions that the citizens of Hawai'i are entitled to have answered by our elected officials:

Shouldn't the citizens of Hawai'i be permitted to vote on whether they support an independent Native Hawaiian governance entity and are willing to fund it before the bill is enacted?

Shouldn't there also be a popular vote of all Hawai'i citizens before any governance entity is officially recognized by the state and any funds are diverted from state programs, such as education, to this new government?...

The justification for the bill is purportedly the need to redress the United States' role in the overthrow of the Hawaiian kingdom, which occurred over four generations and 112 years ago.

Why, then, are non-Native Hawaiians who are descendants of citizens of the kingdom of Hawai'i excluded from participating in the governance entity being proposed?

If large numbers of Native Hawaiians and non-Native Hawaiian citizens of Hawai'i oppose the bill or do not understand it, how is it going to bring reconciliation?

Isn't it just as likely to be a catalyst for continuing litigation, racial and social division, and reliance upon the hope of race-based governmental entitlements?
