A QUICK TRUE OR FALSE QUIZ REGARDING THE BENEFITS OF NATIVE HAWAIIAN FEDERAL RECOGNITION -

1. Senate Bill 147, The Native Hawaiian Government Reorganization Act of 2005 contains language that guarantees Hawaiians a land base.

2. SB 147ensures that the Hawaiian Homes program will not be terminated.

3. Hawaiians will vote on whether or not to accept federal recognition. The choice is theirs to make.

4. The commerce clause and treaty clauses of the U.S. constitution do not prohibit federally recognized indigenous people achieving independent nationhood.

5. Federal law provides for the protection of indigenous peoples entitlements and they cannot be taken from them without their consent.

6. The United states has never terminated a government to government relationship with federally recognized people without their consent.

7. Blood quantum restrictions will not result in the exclusion of future generations of Hawaiians from Hawaiian citizenship.

8. Indigenous peoples lives have improved more under federal policy than the lives of people in independent nations in the same time frame.

9. Federal recognition will provide that every Hawaiian will receive land and housing for life.

10. SB 147, the Akaka bill, would protect Kamehameha Schools.

WHO WINS IN A FREE AND INDEPENDENT HAWAI'I ? EVERYONE !

One of the biggest lies perpetuated today is that when Hawai`i achieves nationhood once again it will be at the expense of everyone else.

But no one will be kicked out; their businesses seized or their homes and property confiscated.

Instead, everyone, Hawaiians and all others, will be citizens of the sovereign and independent Nation of Hawai`i.

The Hawaiian Nation included people of many ethnic backgrounds that were loyal citizens before the illegal overthrow and it will be so again.

The truth is a sovereign Hawaiian nation will need the contributions and talents of all of its citizens to remain viable in the world.

Hawaiians would be no better than the very supremacists that overthrew and occupied them were they to divide people by race.

Hawaiians have always been inclusive, not exclusive.

How would this be accomplished politically given a civil war resulted the last time a state tried to leave the US?

Unlike the southern US states, the Kingdom of Hawai`i and its citizens never agreed to become part of the United States in the first place.

Therefore a move for Hawai`i to secede from the US would be both unnecessary and inappropriate.

Much like removing the top coat of paint to reveal the one underneath, the US Congress, after consultation between Hawaiians and the US at the level of state to state, could simply enact a US federal law that dissolves the entity known as the "state government" in Hawai`i.

What would be left in its place is what has existed all along anyway without interruption – the Nation of Hawai`i.

Only at that point, would it be appropriate for the citizens of Hawai`i to decide their future as it relates to a relationship with the United States.

Those possibilities would include

Full Independence - Joining once again the family of nations in the world.

Free Association Much like Palau and the Federated States of Micronesia.

Integration with the US Becoming a state again or a tribe of the US under federal recognition.

Did you know ? -

When Ronald Reagan was president, one of the most conservative US presidents in recent times, his administration actually granted the Marshall Islands independence in 1986, which then lead to a free association relationship with the US.

Precedent for Hawaiian independence exists right now within US law as outlined above.

There are no laws that exist today within the US to prevent the US federal government from dissolving a state government.

It is only fear and ignorance that holds the status quo in place.

PLOY BY INOUYE & AKAKA TO FAIL ?
Scare Tactic On Akaka Bill Never Worked
U.S. Court Appears On Verge Of Reversing Itself

Last year, when three judges of the US Ninth Circuit Court of Appeals ruled that Kamehameha Schools must admit students of all races, Hawai`i Senator Daniel Inouye claimed if the so-called "Akaka bill" had been law already, it would have protected against a non-Hawaiian being admitted.

Of course, that is blatantly false.

Nothing in the Akaka bill would prevent such an occurance.

But the senator had hopes the temporary ruling by those three judges last year would scare those who didn't know better into supporting the Akaka bill.

His statement actually backfired, causing anger within the Hawaiian community.

Now that the strategy failed, is the ninth circuit court, with all 15 justices rehearing the case, preparing to reverse itself ?

And most importantly, was there an agreement behind the scenes from the beginning to orchestrate just such an outcome ?

The U.S. 9th Circuit Court of Appeals will rehear the case involving a non-Hawaiian student seeking to enroll at Kamehameha Schools.

The ruling today is a blow to the hopes of the unnamed non-Hawaiian student seeking to gain entrance to the school whose policy is aimed at admitting only students with Hawaiian blood.

The decision essentially sets aside for now a 2-1 decision by a three-member panel of the court that ruled in favor of the non-Hawaiian student on Aug. 2....

DESECRATION & RESTORATION OF SACRED HAWAIIAN BURIAL MOUND CAPTURED IN PHOTOS

Moving Photos Show Importance of Respect For Hawaiian Culture & Need For Independence

Honolulu - An ahu, or sacred mound made from rocks stacked without mortar, was desecrated by vandals on the grounds of `Iolani Palace yesterday in Honolulu.

The ahu contains, among other items, rocks brought from many places far and wide in honor of those who have passed on.

Fortunately, it was quickly discovered by a caretaker of the ahu and burial grounds nearby.

Phone calls were made, people arrived, including those who just happened to be passing by, riding a city bus, and the mound was rebuilt.

Pule, or prayers in Hawaiian were offered, hula performed, and lastly a ti leaf lei was placed on the rebuilt ahu.

HERE'S HOW THE US GOVERNMENT, WITH THE HELP OF THE OFFICE OF HAWAIIAN AFFAIRS, IS PLANNING TO STEAL THE HAWAIIAN NATION - ONCE AND FOR ALL!

By their own laws, the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent.

They and the State of Hawai`i have never had "Clear Title" since Jan 17, 1893.

They all know this...have known for a long time.

The only way the United States will ever be able to get clear title to the Hawaiian Islands is if Hawaiians give it to them.

This is why title to the Hawaiian Islands never transferred to the United States by the Newlands resolution. The Newlands resolution relied on the treaty of Annexation from the republic of Hawai`i.

But the republic never owned title because the Kingdom of Hawai`i never gave it to them.

But Now They Have A Plan...

They are going to get Hawaiians to give title to them. How are they going to do that?

Here's how -

They are going to register a majority of Hawaiians on a "roll."

They are going to draft governing documents to "re-organize the Hawaiian government".

They are going to get Hawaiians to elect officers to that government.

They are going to make sure those governing documents give the officers of the government the authority to give away title in negotiations.

They are going to get the majority of Hawaiians on the roll to vote for the new governing documents to reorganize the Hawaiian government.

That government authorized and approved by the majority of Hawaiians is going to sit down at the negotiating table with the United States and trade land title for cash and benefits.

Many people believe that only the Kingdom of Hawai`i is authorized to give a way title to the Hawaiian Islands.... and they are correct, but only as long as the kingdom remains intact.

If the majority of its subjects revolt by forming a new government, the kingdom no longer exists. This is the effect of popular revolution.

The bill is only the bait. The hook is the formation of a new government and the negotiations between the U.S. and the new government. As long as Hawaiians don't bite the bait...the hook is harmless....The bill is not intended to settle any claims.... The bill dos not tell Hawaiians, but asks them to form a government that can and will extinguish Hawaiians claims.

AKAKA BILL DEVIOUS ATTEMPT TO AVOID TRUTH & JUSTICE

In 1993, the United States of America admitted in U.S. Public Law 103-150 that it had deprived the Native Hawaiian people of their right to self-determination and that the native people have never given up their right of "inherent sovereignty."

Understanding this, it is clear that the Akaka bill is not a fair or just solution.

International laws, treaties and conventions have been broken.

U.S. constitutional law and Hawaiian kingdom law have been broken.

Restitution and reparations are due.

The Akaka bill does not address these crimes at all.

There have been seven or eight versions of the bill, yet only one hearing on one island in Hawai'i before the Hawaiian people.

How can the Hawaiian people determine for themselves what they are really going to get or lose?

Why hasn't the process included open and in-depth discussion in the Hawaiian communities so that Hawaiians may have input?

This bill is purportedly about the building of a nation.

One hearing isn't fair or logical.

As it stands, the Akaka bill is simply a devious attempt to avoid the truth and justice.

98% of all Hawaiians living at the time opposed the illegal overthrow!

A few individuals, who are non-Hawaiian, lease an amount of land in Hawai`i that is greater than all land leased to all Native Hawaiians!

Currently, only 72 landowners control 95% of all land in Hawai`i.

Native Hawaiians make up the largest percentage of homeless in Hawai`i today.

Native Hawaiians have the worst social, educational and economic indicators compared to any ethnic group in the US.

Native Hawaiians currently have the worst health profile compared to any ethnic group in the US.

Descendants of the Hawaiian Nation want their country and land back so they can grow their own foods, become healthy once again, and control their own destiny.

THINK THE U.S. GOVERNMENT CARES WHAT'S SACRED TO NATIVE PEOPLES? THINK AGAIN!

Here's What's In Store For Hawai`i If The Akaka Bill Becomes Law -

Indian Country Today - by Tanya Lee

FLAGSTAFF, Ariz. - In a stunning Jan. 11 opinion, U.S. District Court Judge Paul Rosenblatt rejected every argument American Indians presented to prevent further desecration of the San Francisco Peaks in northern Arizona.


The Peaks, sacred to 13 tribes, are federal lands managed by the U.S. Forest Service.

Despite decades of protests, a ski resort has operated there since 1938.

''This is another slap in the face,'' said Rex Tilousi, tribal council member and former chairman of the Havasupai Tribe, who testified during the trial on religious freedom issues raised by the lawsuit.

The suit, brought against the Forest Service by six tribes and three environmental groups, was filed in June 2005 after the Forest Service approved Arizona Snowbowl owners' 2002 application to make changes at the ski resort.

The most controversial is a plan to use recycled wastewater to make snow.

The case is one of the first legal challenges to RFRA and as such has set an important precedent.

Yavapai-Apache Nation Tribal Chairman Jamie Fullmer and Apache Historian Vincent Randall said in a Jan. 12 statement: ''Recent history has shown the federal courts are not supportive of Native American sensibilities and traditions when it comes to issues concerning the landscape and spiritual health of our People.''

Phoenix attorney Howard Shanker, who represented the Navajo, Yavapai-Apache and White Mountain Apache tribes and the environmental groups, said in a statement Jan. 12: ''[T]he federal government felt, and the court affirmed, that the economic viability of the Arizona Snowbowl Resorts Limited Partnership was more of a priority than the beliefs of hundreds of thousands of Native Americans.''

During that time, I was the attorney for the Hawaiian Homes Commission, an agency that managed and supervised the use of lands allocated to native Hawaiians for residential and agricultural uses....

This Akaka bill proposes to create a government whose citizens would be restricted to persons whose ancestry includes any amount, however small, of blood quantum of natives who lived in the Hawaiian Islands before the discovery of the Islands by English explorer Captain James Cook in 1778.

This is beyond any serious debate an attempt to create a race-based nation and government....

Throughout the history of the Hawaiian Kingdom, there was never any constitutional or Legislative restriction of Hawaiian citizenship to persons of Hawaiian descent....

If it is the purpose of the Congress to make amends for the annexation of Hawai`i, then the appropriate action would be to kill this bill and enact a reparations bill with programs and benefits for descendants of all the people who were living in Hawai`i at the time of annexation....

Remember - Kingdom Rights Are Always Greater Than Aboriginal Rights - Don't Be Fooled!

GET READY! - HERE'S WHAT'S IN STORE FOR HAWAIIANS UNDER FEDERAL RECOGNITION!

U.S. SECRETARY OF INTERIOR GALE NORTON INVITED TO TESTIFY IN FEDERAL COURT TO PROVE SHE DIDN’T RETAILIATE BY WITHHOLDING INDIAN CHECKS

The judge in the landmark Cobell v. Norton Indian Trust case has issued an order inviting U.S. Secretary of the Interior Gale Norton to testify in court proceedings to prove she did not retaliate against American Indians by stopping the disbursement of Individual Indian Money (IIM) trust checks in October, 2004.

IIM beneficiaries, many of whom are among our nation’s poorest citizens and rely on Indian Trust payments for most or all of their income, were the victims of the government’s retaliatory actions.

In his February 7th order, Lamberth found such action deplorable.

"These Indians are the poorest minority group in the country," Lamberth wrote in his February 7th memorandum and order.

"The idea that Interior would either instruct or allow BIA to withhold trust payments, and then to stonewall the Indians who dared to ask why, is an obscenity that harkens back to the darkest days of United States-Indian relations."

THINK THE LIVES OF HAWAIIANS WOULD IMPROVE UNDER THE "SPECIAL TRUST RELATIONSHIP" FEDERAL RECOGNITION WOULD BRING ?

Just look at these comments from the Senate Indian Affairs Committee March 11, 2003 letter to the Budget Committee justifying their budget request for fiscal year 2004 -

"Native people in the U.S. continue to rank at or near the bottom of nearly every social, health, and economic indicator, as compared to all other citizens.

"Natives continue to suffer the highest rates of unemployment and poverty, live in substandard housing, have poor health, receive an inadequate education, and contend with disintegrating social systems, all of which erode both the quality and dignity of life in Native communities.

"The educational attainment for Native youth is deficient compared with other groups in the U.S.

"There is also unmet demand for electricity in Native communities: a recent Department of Energy report estimated that 14.2% of all Native homes on reservations have no access to electricity compared to just 1.4% of all U.S. households.

"With unemployment averaging 43% and poverty rampant, Native communities are particularly sensitive to high energy prices.

"Given the near-complete absence of a private sector in most Native communities, 31.2 % of Natives live in poverty.

"In the U.S. today, the unemployment rate is 5.8%, whereas the rate for Natives is near 50% --- twice that of the national unemployment rate in the Great Depression."

WHO IN THEIR RIGHT MIND WOULD WANT FEDERAL RECOGNITION IF THIS IS THE RESULT?

IF IT CAN HAPPEN HERE, IT CAN HAPPEN IN HAWAI`I !

TOKELAU READIES FOR HISTORIC REFERENDUM

Melbourne, Australia (Radio Australia, Feb. 6) –

A voter education workshop is being organiZed next week in Tokelau to prepare voters for the first ever national referendum next month.

The Tokelau population of 1,500 will decide whether to be self governing or remain in free association with New Zealand.

The vote will take place between Feb. 11 and Feb. 15, beginning in Apia, Samoa before moving to the three islands in Tokelau.

Tokelau, a former British protectorate, became a territory of New Zealand in 1925.

The territory, located north of Samoa, includes the three Polynesia tolls of Atafu, Nukunonu and Falaofo.

A number of international organizations and governments, including New Zealand and the United Nations, will observe the referendum.

If the result is in favor of self-determination, the New Zealand parliament will repeal the Tokelau Act of 1948 and the two governments will sign a Treaty of Free Association with Tokelau no longer being a colony.

TOO MANY QUESTIONS REMAIN ON THE AKAKA BILL

Before Congress votes to turn Native Hawaiians into Native American tribes, here's a few important questions that the citizens of Hawai'i are entitled to have answered by elected officials:

1. Shouldn't the citizens of Hawai'i be permitted to vote on whether they support an independent Native Hawaiian governance entity and are willing to fund it before the bill is enacted?

2. Shouldn't there also be a popular vote of all Hawai'i citizens before any governance entity is officially recognized by the state and any funds are diverted from state programs, such as education, to this new government?

The justification for the bill is purportedly the need to redress the United States' role in the overthrow of the Hawaiian kingdom, which occurred over four generations and 112 years ago.

3. Why, then, are non-Native Hawaiians who are descendants of citizens of the kingdom of Hawai'i excluded from participating in the governance entity being proposed?

4. If large numbers of Native Hawaiians and non-Native Hawaiian citizens of Hawai'i oppose the bill or do not understand it, how is it going to bring reconciliation?

5. Isn't it just as likely to be a catalyst for continuing litigation, racial and social division, and reliance upon the hope of race-based governmental entitlements?

SHOULDN'T HAWAIIANS BE GLAD THEY'RE A PART OF THE U.S. ?

HERE'S HOW NATIVE HAWAIIANS FEEL ABOUT THE OVERTHROW OF THEIR COUNTRY -
Let's pretend I visit your house.

You offer me food and rest. I decide to stay.

Then, I order you and your family around, use your things and rearrange the rooms.

I take down your photos and religious symbols, replace them with my own and make you speak my language.

One day, I dig up your garden and replace it with crops that I can sell.

You and your family must now buy all of your food from me.

Later, I invite my father and his buddies over.

They bring guns. We take your keys.

I forge a deed and declare my father to be the owner of your house.

I bring more people. Some work for me. Some pay me to stay in your house.

I seize your savings and spend it on my friends.

You and your family now sleep on the porch.

Finally you protest.

Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave.

I tell you, "Sorry, I was wrong for taking the house."

But when you demand your house back, I tell you to be realistic."You are part of this family now, whether you like it or not," I say. "Besides, this is for your own good.

For all that I have done for you, why aren't you grateful?"
