Developer Fails In Attempt To Ignore Hawaiian Claims

WAILUKU - Developer Sterling Kim said his Hale Mua housing project may be in jeopardy if he is forced to wait for an appeals court to rule on land title questions before getting development approval from the state.

A 2nd Circuit judge ruled in March that Hale Mua
had clear title to its Waiehu property, but a group of Native Hawaiians claiming rights to the land appealed the decision.

The state Land Use
Commission told Kim in hearings this month that some commissioners still have "serious concerns" about the question of title, asking him to get written consent from all the Hawaiian claimants before proceeding...

Kim said he wouldn't seek the claimants' approval.


"We don't want to acknowledge they have any
rights (to the land) whatsoever," Kim said...

Commission rules require that if a developer is
not the fee simple owner of a property, the consent of the land's owner must be obtained.

The
commission had asked Kim either to provide legal arguments for why he should be treated as the owner, or to get the signatures of the claimants, Ching said....

STOPPING THE INSANITY ON VOICES OF TRUTH - ONE-ON-ONE WITH HAWAI`I'S FUTURE

Even though it’s a mater of record, many are not aware of just how much beneficiary money the Office of Hawaiian Affairs has spent lately on inappropriate and failed projects.


First, they put $7 million dollars into the failed attempt at getting the Akaka bill passed.

Next, they sunk another 4 million into their Kau Inoa registry program.

And now, they’re committing a shocking 10 million more to their so-called Native Hawaiian governing entity, which of course would be yet another US controlled Hawaiian puppet government.

That’s 21 million dollars of Hawaiian beneficiary money!

21 million dollars used to actually prolong the US occupation of Hawai`i, instead of help end it.


When does the insanity end?

From now until the OHA trustees election on November 7th, we’ll be focusing on alternatives.

One of those is long time Hawaiian patriot Bumpy Kanahele.

Bumpy, in his bid for one of the at-large trustee seats, would bring a no nonsense approach - something needed by the truckloads at OHA - as well as a return to fiscal sanity and focusing on serving the people rather than the occupier.

Inter-Tribal Testifies Before United Nations

Anchorage, Alaska - If Alaska Natives are right, then Alaska really is Seward's folly.

The Alaska Inter-Tribal Council made a stunning announcement: to take the United States before the United Nations.

It's a case that could overturn the 1867 treaty by which the United States bought Alaska from Russia.

A document submitted to the United Nations’ Human Rights Commission contended that “the United States is not sovereign in Alaska or Hawai`i.”

It says that in 1959, at the time of statehood, the United States “misled the United Nations” about how it acquired Alaska and Hawai`i.

Resolution 2005-10, which claims that Alaska and Hawai`i are not states, was formally argued before the Human Rights Commission in Geneva this July.

“These indigenous organizations are asserting that the territory of Alaska Natives nation and the kingdom of Hawai`i were deprived of their right to consent to being annexed into the United States,” said Judge Mary Ann Mills, a Kenaitze Athabascan.

DID YOU KNOW? -

Of the 40,000 non Kingdom subjects in Hawai`i at the time of the illegal overthrow, only 1,928 or so were american nationals as documented by the 1900 census.

They represented less than 3% of the entire population.

The rest of the non american aliens were not supportive of the illegal annexation of Hawai`i by the US.

This means that less than 3% of the population, all aliens, hijacked the Hawaiian Nation against the wishes of almost everybody else.

OFFICE OF HAWAIIAN AFFAIRS URGED TO SUE ARMY TO STOP DESTRUCTION OF SACRED SITES

Will OHA Act To Protect Hawaiians Or Continue Its Protection Of The State?


Groups concerned about the protection of Native Hawaiian sacred sites called on Office of Hawaiian Affairs and the State of Hawai`i to take legal action to halt the destruction and desecration of an ancient Hawaiian religious and cultural complex on O`ahu - location of the Schofield South Range and several Stryker Brigade expansion projects.


Since 2003, the U.S. Army has pursued the expansion of training areas on O`ahu and Hawai`i Island for the stationing of a Stryker Brigade.

At public hearings testimony was overwhelmingly opposed to the proposed expansion.

Along with concerns about military impacts to health, endangered species and Native Hawaiian land rights, one of the top issues raised was protection of Native Hawaiian cultural and sacred sites in proposed Stryker expansion areas.


DMZ-Hawai`i / Aloha `Aina has obtained information that the Army allegedly violated federal cultural preservation laws and agreements and as a result, has damaged sacred sites on O'ahu including the recently rediscovered Hale`au`au Heiau.

The Army's cultural monitors have called for a halt to ground disturbing activities in the Battle Area Complex.


Ikaika Hussey said "The community has spoken loud and clear in opposition to the Stryker expansion. So OHA should stand with the community and protect our heritage."

HERE'S HOW THE US GOVERNMENT, WITH THE HELP OF THE OFFICE OF HAWAIIAN AFFAIRS, IS PLANNING TO STEAL THE HAWAIIAN NATION - ONCE AND FOR ALL!

By their own laws, the US cannot simply walk in and take Hawaiian land titles and erase the word "Royal" and replace it with "United States" Patent.

They and the State of Hawai`i have never had "Clear Title" since Jan 17, 1893.

They all know this...have known for a long time.

The only way the United States will ever be able to get clear title to the Hawaiian Islands is if Hawaiians give it to them.

This is why title to the Hawaiian Islands never transferred to the United States by the Newlands resolution. The Newlands resolution relied on the treaty of Annexation from the republic of Hawai`i.

But the republic never owned title because the Kingdom of Hawai`i never gave it to them.

But Now They Have A Plan...

They are going to get Hawaiians to give title to them. How are they going to do that?

Here's how -

They are going to register a majority of Hawaiians on a "roll."

They are going to draft governing documents to "re-organize the Hawaiian government".

They are going to get Hawaiians to elect officers to that government.

They are going to make sure those governing documents give the officers of the government the authority to give away title in negotiations.

They are going to get the majority of Hawaiians on the roll to vote for the new governing documents to reorganize the Hawaiian government.

That government authorized and approved by the majority of Hawaiians is going to sit down at the negotiating table with the United States and trade land title for cash and benefits.

Many people believe that only the Kingdom of Hawai`i is authorized to give a way title to the Hawaiian Islands.... and they are correct, but only as long as the kingdom remains intact.

If the majority of its subjects revolt by forming a new government, the kingdom no longer exists. This is the effect of popular revolution.

The bill is only the bait. The hook is the formation of a new government and the negotiations between the U.S. and the new government. As long as Hawaiians don't bite the bait...the hook is harmless....The bill is not intended to settle any claims.... The bill dos not tell Hawaiians, but asks them to form a government that can and will extinguish Hawaiians claims.

Historic Referedum Held In Tokelau

A first ever national referendum was held this February in the Pacific island nation of Tokelau.

The Tokelau population of 1,500 was asked to decide whether to be self governing or remain in free association with New Zealand.

The vote took place between Feb. 11 and Feb. 15, beginning in Apia, Samoa before moving to the three islands in Tokelau.

Tokelau, a former British protectorate, became a territory of New Zealand in 1925.

The territory, located north of Samoa, includes the three Polynesia tolls of Atafu, Nukunonu and Falaofo.

A number of international organizations and governments, including New Zealand and the United Nations, observed the referendum.

The New Zealand parliament said it would repeal the Tokelau Act of 1948 and the two governments would sign a Treaty of Free Association with Tokelau no longer being a colony, if voters choose.

The US Did Just That With The Philippines And The Federated States Of Micronesia.

CURIOUS ABOUT HOW HAWAI`I BECAME A STATE ?

The United States acquired Hawai`i through force.

Queen Lili'uokalani, Hawai`i's last Queen, was deposed on Jan. 17, 1893, by a group of American businessmen supported by the United States Navy and Marine Corps and diplomatic representatives.

Sovereignty of Hawai`i was allegedly transferred to the U.S. on Aug. 12, 1898 during ceremonies at Iolani Palace in Honolulu, on the island of Oahu.

Hawai`i became a U.S. territory in 1900.

On Nov. 23, 1993, The United States apologized for illegally overthrowing the Kingdom of Hawai`i, and recognized the inherent sovereignty and right of self-determination of native islanders.

Needless to say, a lot of shady events took place between Jan. 17,1893 and Aug. 21, 1959.

Hawaiian sovereignty is still a hot issue in the islands to this day and likely will be for as long as the United States flag flies over Hawai`i.

HOW DOES HAWAI`I TREAT HAWAIIANS ?

Despite a strong state economy, the homeless rate in Hawai`i has nearly doubled over the past four years, and the majority of the new homeless are native Hawaiians and those with some Hawaiian ancestry.

From fabled Waikiki Beach, one of the places where the homeless congregate on O`ahu, to the neighboring islands that conjure the image of paradise to planeloads of tourists who arrive daily, there is increasing tension between the thousands of homeless people, their advocates, and state, city, and county governments.

Hawaiians represent only about 23 percent of the state's population, but the state survey suggested they make up 37 percent of the state's homeless population.

The Akaka bill sits on the ash heap of history.

Hawaiians and their supporters were responsible for it’s righteous defeat, more so than Republicans.

In his July Ka Wai Ola column, Mr. Mossman named the Koani Foundation as one of the organizations largely responsible for the bill’s demise.

We at Koani accept, with humility, that acknowledgement of our kuleana, our responsibility to the Hawaiian Nation.

In her August column, Trustee Akana attacked Clarence Ku Ching, Hawaiian patriot and former OHA Trustee, wrongfully aligning him with the radical right that worked to defeat the bill for very different reasons.

Ku Ching’s successful efforts to defeat the bill, and efforts by others in Washington, DC, were honorable and a true reflection of the will of the people back home.

OHA’s conspiracy to legitimize the illegal overthrow of the Hawaiian Kingdom - spending millions of beneficiary dollars to illegally lobby for passage of the Akaka bill - confirms, again, that the trustees are out of touch and out of control.

Worse, OHA Trustees’ recent attempts to smear and demonize those who disagree with them reveal a leadership filled with contempt, desperation and moral bankruptcy.

Had the Trustees genuinely intended to serve their constituents’ best interests, they would have gathered community input through public hearings, in Hawai`i, on the several versions of the bill – without fearing overwhelming public opposition.

We at Koani, along with countless other Hawaiian Nationals and supporters who remain loyal to our Queen and country, will continue the quest to end US occupation and restore our Independent Hawai`i.

Trustees Mossman and Akana have come out on the wrong side of history again by siding with the oppressor in the first place - and now, by waging desperate character assassination campaigns.

Let's pretend I visit your house.


You offer me food and rest. I decide to stay.

Then, I order you and your family around, use your things and rearrange the rooms.

I take down your photos and religious symbols, replace them with my own and make you speak my language.

One day, I dig up your garden and replace it with crops that I can sell.

You and your family must now buy all of your food from me.

Later, I invite my father and his buddies over.

They bring guns. We take your keys.

I forge a deed and declare my father to be the owner of your house.

I bring more people. Some work for me. Some pay me to stay in your house.

I seize your savings and spend it on my friends.

You and your family now sleep on the porch.

Finally you protest.

Being reasonable, I let you stay in a corner of the house and give you a small allowance, but only if you behave.

I tell you, "Sorry, I was wrong for taking the house."

But when you demand your house back, I tell you to be realistic."You are part of this family now, whether you like it or not," I say. "Besides, this is for your own good.

For all that I have done for you, why aren't you grateful?"
