SHADES OF THINGS TO COME FOR HAWAIIANS UNDER THE AKAKA BILL !

'Mixed-bloods' Have No Valid Claim To $32 Million Awarded To The Tribe, Federal Judge Rules

A federal judge on Friday dismissed a lawsuit filed by hundreds of mixed-blood Utes, ruling their challenge to the legal termination of their rights as tribal members came years too late....

The legal action centered on the Ute Partition Act of 1954, which divided the tribe into "mixed-bloods" and "full-bloods."

Under the legislation, 490 mixed-blood individuals lost recognition by the federal government as Indians and were removed from tribal roles.

In addition, they lost their rights to share in a $32 million judgment obtained by the Ute tribe over the federal government's taking of Colorado lands previously occupied by the White River and Uncompaghre Bands.

All but a few of the terminated members were Uintah Band descendents.

Full-bloods were defined as tribal members whose ancestry was at least one-half Ute and more than one-half Indian.

Mixed-bloods were defined as members who lacked sufficient Ute or Indian ancestry to qualify as full-bloods.

Rarely do we come across an individual as remarkable as Kanalu Young, a quadriplegic and Professor of Hawaiian history at the University of Hawai`i on O`ahu.

Even though he's currently bed ridden at home under doctor's orders, Kanalu accomplishes more in one day than most. Setting up his bedroom as his office, the world now comes to Kanalu - literally.

He meets on almost a daily basis with dignitaries and educators from all over the world as well as conducting his work for the university - all from his bed.


Of course we went calling on Kanalu, in his office/bedroom, and found an amazing individual indeed who lets absolutely nothing stop him.

OFFICE OF HAWAIIAN AFFAIRS GIVE HAWAIIANS THE SHAFT ONCE AGAIN !

Honolulu Star-Bulletin - January 27 - By Mary Vorsino

The Office of Hawaiian Affairs would get $15.1 million a year in ceded-lands revenues and $17.5 million in back payments under a tentative settlement announced yesterday, which some say falls well short of what the agency should be entitled to under a 1980 state law.

"It appears that the trustees have settled for crumbs at the table of the king," said state Sen. Clayton Hee, a former OHA trustee and chairman. "This amount represents an entitlement lower than what the legislation called for, particularly in times when the economy is robust. From a dollars perspective, this is not a good settlement from the Hawaiian point of view...."

Last night, OHA trustee Rowena Akana said the full board was not consulted before the deal was made public -- even though OHA sent out a news release with the Governor's Office on the settlement yesterday afternoon.

"The board of trustees was not privy to this deal," Akana said. "It is just egregious. It appears to be a done deal...."

Akana said the deal's $17.5 million payoff for back payments is far too small.

Akaka Bill Could Fail, Senator Warns -

U.S. Sen. Daniel Akaka said yesterday he would continue to ask for a Senate vote on a Native Hawaiian federal recognition bill this year, but if there is no vote soon and he is not re-elected, he believes the bill's chances of passage could be in doubt....

"I would think that the bill would not go," Akaka said in response to a question during an interview with The Advertiser's editorial board and reporters.... "

"Also commitments from Hawaiian organizations, as well. As you know, not all of them support the bill,...

Dexter Ka'iama, a member of Hui Pu, an umbrella group for organizations that oppose the Akaka bill, said a Case victory might hurt the bill's chances.

Akaka "is the one who actually proposed the bill and is the originator of the bill, even though from my perspective, Dan Inouye had quite a bit to do with this bill," he said....

Jon Osorio, director of the Kamakakuokalani Center for Hawaiian Studies at the University of Hawai'i-Manoa, also has opposed the Akaka bill but does not believe the Senate campaign will have much of an influence....

HOW HEALTHY ARE HAWAIIANS TODAY?

Hawaiians suffer the worst health profile in Hawai'i.

Between 1980 and 1990, while rates of death from heart disease, cancer, stroke and diabetes decreased for non-Hawaiians, they increased, sometimes dramatically, for Hawaiians.

Below 1 year of age, the Hawaiian death rate is more than double the overall average.

Between 1 and 4 years of age, it is triple the state figure, and so on into adulthood.

Just under 20 percent of the population, we suffer 75 percent of the deaths for persons less than 18 years of age.

WHAT DO HAWAIIANS WANT ?
HERE IS WHAT THEY SAY ABOUT THEMSELVES, THEIR COUNTRYMEN AND THE UNITED STATES -

"The most common sense thing is for a Free Hawai`i.

We were a progressive modern nation of our time and recognized as a friendly, neutral nation within the Family of Nations, the predecessor of the League of Nations and the United Nations.

We had a democratic form of government, a constitutional monarchy with a bicameral legislative assembly. The works and legacies of our monarchs are legendary and noteworthy.

Today under the American system, we are concerned about our lands, culture, people and lifestyle which has been under attack for over a hundred years.

This gets us angry and more Hawaiians are desiring a Free Hawai`i as a result.

The Kingdom of Hawai'i is not only Native Hawaiians but subjects of non-Hawaiian blood who were legitimate subjects of the Kingdom.

This racial argument is an American thing and not a Hawaiian thing.

So our concerns are well within our scope to protect all our subjects of the Kingdom.

We do expect reparations and restitution from the US for the injurious damages to our nation, land and people.

The US government is well aware of this and is trying to offer a piecemeal to settle this. Other options are still on the table and we are beginning to take a stand on which option is the right thing to do.

If the tables were turned around; which would you do? I'm sure it wouldn't be a hard decision.

Remember, Hawaiians never hated Americans; but only those that did harm to us and the US government for its complicity and deceit.

We were never afraid that another country would take us over; we had over twenty-four treaties with various countries but the US is the only country that broke their treaties with us."

That should tell you something.

AKAKA BILL MEETING JUST ANOTHER PUBLIC RELATIONS PLOY

Editor,

"Unity has Hawaiians hopeful on Akaka bill", Honolulu Advertiser, January 12, 2006 ignores the reality of the ever-expanding, overwhelming opposition to the Akaka bill.

The recent $595-a-head "leadership forum" was yet another public relations ploy to foment the illusion of "a sense of softening in the resistance" against federal recognition of Native Hawaiians.

Was there "a shift"? No, just the same groups eternally hopeful of perpetuating their heavy funding from US grants.

Who else could afford to participate for three days at the Hilton Hawaiian Village?

Was there a "strong feeling of unity"? Perhaps, but, once again, who was there?

The article said Native Americans and Alaskans; those already locked in the federal recognition dead end; and Maori, who accepted the guardianship of the British Crown when the sovereign constitutional monarchy of Hawai`i was already internationally recognized.

The most important questions are, who wasn't there, and why?

Closing Day Of Living Nation Events Marks Support For A Free Hawai`i

Honolulu, Hawai’i –Native Hawaiians, and supporters from throughout the islands and beyond, gather today at `Iolani Palace in unity for a Free Hawai`i.

“Hawai`i Loa Kulike Kakou”, all Hawai`i stand together, the theme of today’s events, demands an end to illegal US occupation, and acknowledgement of Free Hawai`i status.

This Tuesday, January 17, marks the 113th anniversary of US interference in the affairs of the peaceful, internationally recognized, sovereign Hawaiian Kingdom.

“Unity is the key to our cause,” declared Mel Kalahiki, Living Nation event organizer. “The health of our Nation is tied to the unity of our people.

Today’s continuous events begin with a “Run for Justice” at 6:30 AM. Keynote speakers, music and hula performances start at 10 AM. All events are free and the public is welcome.

“Our nation moves forward as we overcome injustices,” remarked Lynette Cruz, Living Nation event co-chair. “Our nation lives through you and me.”

Living Nation events began on Friday and have continued all weekend.

Highlights have included two evening torchlight processions honoring past Ali`i and a Celebration of Fallen Warriors.

Two dramatic events will occur this evening – a torchlight procession to honor Hawaiian Ali`i and a unique Fallen Warriors Ceremony later on `Iolani Palace grounds.

Tuesday, January 17, marks the 113th anniversary of US interference in the affairs of the peaceful, internationally recognized, sovereign Hawaiian Kingdom.

“We honor those who went before us, forewarning of the dangers of being engulfed and occupied,” states Mel Kalahiki, event organizer. “Tonight we walk forward in the footsteps of our ancestors. We welcome everyone to join us.”

The Torchlight procession will proceed from `Iolani Palace to Kamehameha’s Statue to honor the king, to the Judiciary Building to pay homage and recognition to items buried beneath the buildings corner, and finally to King Lunalilo’s tomb.

“We want the same thing our Ali`i and ancestors did – a Free Hawai`i,” asserts Kalahiki. “We will settle for nothing less because a Free Hawai`i benefits everyone, Native Hawaiians and all others.”

In recalling the illegal act of war, the Living Nation will launch activities at `Iolani Palace today, Friday, Jan.13th at 6:30p with opening ceremonies focusing on the Health and Wellness of the Hawaiian Nation.

“We call on everyone to join us in our rendezvous with destiny – an independent nation,” asserts Kalahiki. “Hawai`i has specialists in every field of endeavor, people who will ably fill the needs of the nation, people who know our history and understand a Free Hawai`i benefits everyone, Native Hawaiians and all others.”

Health & Wellness Of Hawaiian Nation Focus Of Event

Honolulu, Hawai’i – With the theme, “Hawai`i Loa Kulike Kakou, All Hawai`i Come Together,” Native Hawaiians and supporters from near and far will gather this weekend for the 113th observance of the illegal overthrow of the Hawaiian Nation in a massive demonstration of unity.

Voicing outrage at the continuing illegal US occupation of Hawai`i, participants will gather to celebrate and promote the continued life of the Hawaiian nation and its people. Everyone, whether of Hawaiian heritage or not, is invited to take part.

“As Hawaiians, we gather in support of our beloved Queen, Lili`uokalani. We maintain her legacy, the dignity and righteousness of our nation, our lands, and our people. We now move toward manifestation of our country. We will not be denied,” states Living Nation chair Mel Kalahiki.

The Living Nation campaign kicks off this Friday, January 13th and runs through Sunday, January 15th, at ‘Iolani Palace, historic seat of governance and residence of Hawaiian Monarchs.

Special activities include dramatic torchlight walks both Friday and Saturday evenings to honor Hawaiian ali`i, a unique Fallen Warriors ceremony late Saturday night, and an early morning Run For Justice on Sunday.

Wealthy sugar barons, assisted by US agents and military forces, illegally overthrew the internationally recognized Hawaiian Monarchy in 1893.


In 1993, President Clinton and Congress formally apologized for that illegal act of war, admitting that Hawaiian nationhood and sovereignty had, in fact, never been relinquished.

Another of our brand new segments, Imaikalani, both political activist and artist has fused both talents to create unique and beautiful works of art that deeply express his heritage as Kanaka Maoli.

And as if that isn't enough, he's also a published poet and playwright.

Imaikalani graciously shares with us an inside and personal look at some of his artwork and exactly what went into the crafting of each piece which even includes a stunning mural depicting an oli [chant] that was done entirely in felt markers!

If you have a budding artists in your `ohana, sit down with them and watch this one. Yet all of us, artists or not, will gain much insight and inspiration from this very gifted creator with his wonderful message for us all.

"Hawaiian Superman - A Visit With Dr. Kanalu Young, PhD."


Rarely do we come across an individual as remarkable as Kanalu Young, a quadriplegic and Professor of Hawaiian history at the University of Hawai`i on O`ahu.

If that isn't impressive enough, he's also Director of the Masters Program at Kamakakuokalani, the Center For Hawaiian Studies on campus.

Even though he's currently bed ridden at home under doctor's orders, Kanalu accomplishes more in one day than most. Setting up his bedroom as his office, the world now comes to Kanalu - literally.

He meets on almost a daily basis with dignitaries and educators from all over the world as well as conducting his work for the university - all from his bed.


Of course we went calling on Kanalu, in his office/bedroom, and found an amazing individual indeed who lets absolutely nothing stop him.

So if you're looking for a big dose of high inspiration and want to meet a world-class expert at showing us all how to become unstoppable as well as putting our own challenges in perspective, sit down with your entire `ohana and meet Hawai`i's Superman.

THE NEXT TIME SOMEONE ASKS, "WHY IS INDEPENDENCE BETTER FOR HAWAI'I THAN FEDERAL RECOGNITION," HERE'S WHAT TO TELL THEM -

Federal recognition (Akaka bill) is yesterday's solution.

It's thesis is again going hat in hand to the US federal government for help and turning Hawaiians inward and against each other in their own land.

For more than 100 years, this has not worked.

Instead, we can seize the opportunity to create a dynamic new nation through which we can maintain our culture and values, have more control over our future and be a leader among the pacific nations.

Let this be our legacy to our future generations.

HERE'S THE EFFECT OF OVER A CENTURY OF US OCCUPATION IN HAWAI`I ON NATIVE HAWAIIANS

The Hawaiian people, have suffered since the first Western contact in 1778.

Western diseases, to which Hawaiians had no immunity, decimated their numbers.

At the time of western contact, some 800,000 people inhabited the Hawaiian Islands.

By 1805 that number had been halved.

By 1853 there were only 71,000 Hawaiian or part-Hawaiian people in the islands.

Within 100 years of western contact, the Hawaiian population had been reduced by nearly 90 percent.

According to the 2000 census, the numbers of people who claim some native Hawaiian ancestry have increased to over 400,000.

But only 239,000 live in Hawai`i and they are the poorest, most locked-up population in the state.

Although they only make up about 20 percent of the state's population, in June 2001 they made up 39 percent of the state's prison population and 37 percent of the state's homeless population.

LET'S GET THE TRUTH OUT! DEMAND HEARINGS IN HAWAI`I ON THE AKAKA BILL

The first hearing on the Native Hawaiian Reorganization Act in Washington D.C. in 2006 will not be in the U.S. Senate as proponents had hoped.

Instead, the U.S. Commission on Civil Rights has scheduled a hearing on the proposed legislation for Jan. 20, 2006, at 9:30 a.m. at its headquarters in Washington D.C.

The commissioners, who research various civil rights issues and complaints and provide critical and analytical expertise in evaluations of those issues, have the power to hold hearings and issue subpoenas.

The commission lacks enforcement powers, and so refers the many complaints it receives to the appropriate federal, state, or local government agency or private organization for action.

Sources in Congress tell Hawaii Reporter this will likely be the only official government hearing on the bill, also known as the Akaka Bill, in D.C. -- at least until March or April of 2006.

Hawaii's Homeless Law Fuels Tension -
State To Debut At Third On List Of 'Meanest' -

HONOLULU -- Despite a strong state economy, the homeless rate in Hawai`i has nearly doubled over the past four years, and the majority of the new homeless are native Hawaiians and those with some Hawaiian ancestry.

From fabled Waikiki Beach, one of the places where the homeless congregate on O`ahu, to the neighboring islands that conjure the image of paradise to planeloads of tourists who arrive daily, there is increasing tension between the thousands of homeless people, their advocates, and state, city, and county governments.

Hawaiians represent only about 18 percent of the state's population, but the state survey suggested they make up 37 percent of the state's homeless population.

On top of that, she plans to film a documentary on the project as the buses travel.

And did we mention that she also has not one but two masters degrees as part of her action plan?
