FREEHAWAII.INFO PRESENTS -

"POSITIONS ON THE ISSUES"

SEVEN CRITICAL AREAS OF LIFE THAT MOST OF US TAKE FOR GRANTED BUT NATIVE HAWAIIANS ARE DEPRIVED OF IN THEIR OWN HOMELAND

Today's Focus -

ECONOMIC DEVELOPMENT AND EMPLOYMENT –

Economic self-sufficiency is a goal of sovereignty. Since the precious environmental and cultural resources of Hawai’i are exploited for profit by entities external to the islands, an economic strategy for Hawai’i must serve the needs of the people first.

We call for -

  • Development of cultural crops, food and medicine as an economic development priority.
  • Land use should prioritize the following industries: kalo, (taro,) fishponds, ‘awa, (ceremonial drink,) mamaki, (a tree bark for tapa making,) etc.
  • First source hiring for Native Hawaiians and residents.
  • Development of Native Hawaiian consumer and producer cooperatives on each island.
  • Development of Native Hawaiian commercial fishing rights.
  • Development of an emergency assistance program for Hawaiian families in need.
  • One percent of tourism tax receipts to support the development of Native Hawaiian arts.

TODAY IS KA LA KU'OKO'A - HAWAIIAN INDEPENDENCE DAY

In the Kingdom of Hawai'i, November 28 was an official holiday called Ka La Kuokoa, or Independence Day. This was the day in 1843 when England and France formally recognized Hawaii's independence.

His Hawaiian Majesty King Kamehameha III deemed it prudent and necessary to dispatch a Hawaiian delegation to the United States and then to Europe with the power to negotiate treaties and to ultimately secure the recognition of Hawaiian Independence by the major powers of the world.

The Hawaiian delegation, while in the United States of America, secured the assurance of U.S. President Tyler on December 19, 1842 of its recognition of Hawaiian independence, and then proceeded to meet Sir George Simpson in Europe and secure formal recognition by Great Britain and France.

As a result of this recognition, the Hawaiian Kingdom entered into treaties with the major nations of the world and had established over ninety legations and consulates in multiple seaports and cities.

November 28 was thereafter established as an official national holiday to celebrate the recognition of Hawai'i's independence.

But in 1893, an illegal intervention into Hawai'i's affairs by the U.S. resulted in a "fake revolution" against the legitimate Hawaiian government, and a puppet oligarchy set itself up with its main purpose being Hawai'i's annexation to the United States.

Hawaiians protested and celebrated Ka La Ku'oko'a anyway, telling the story of the national heroes who had travelled to Europe to secure Hawaii's recognition.

Recently there has been a renewed effort to revive the celebration of Nov. 28 as Ka La Ku'oko'a - Hawaiian Independence Day, to remember that Hawai'i was a fully recognized member of the world family of nations, and that's its independence is still intact under prolonged illegal occupation.

"POSITIONS ON THE ISSUES"

SEVEN CRITICAL AREAS OF LIFE THAT MOST OF US TAKE FOR GRANTED BUT NATIVE HAWAIIANS ARE DEPRIVED OF IN THEIR OWN HOMELAND

Today's Focus -

‘AINA, WAI AND KAI (LAND, FRESHWATER AND OCEAN WATER) –

The health and survival of Hawaiians depends on the health of our ‘aina.
Hawaiian cultural values promote lokahi (accord) with the environment, which is essential for long-term sustainability. It is our sacred responsibility to malama ‘aina (care for the land.)

We call for -
  • Changes in land use laws, and planning processes to require that land development must also pass a Hawaiian review system.·
  • Implementation of a culturally based resource management system.·
  • Development of ahupua’a-based (land division from the uplands to the sea) land use planning.·
  • Creation of a new traditional Hawaiian zoning category for communities with large Hawaiian communities which would require development to be consistent with Hawaiian cultural principles and practices.·
  • Department of Hawaiian Home Lands and Department of Land and Natural Resources to open up more raw lands for homesteading.·
  • Approve any pending leases with community organizations currently on the land.·
  • Expedite the process for acquiring lands.·
  • Support the creation of “liberated zones” by maka’ainana (commoners) land occupation efforts.·
  • Return the stolen waters to their original source. Change Hawai’i’s water code to protect ahupua’a integrity and Hawaiian cultural uses before other uses are allowed.·
  • Free and clean water for everyone.·
  • A moratorium on ceded lands sale and development of raw lands.

IS FEDERAL RECOGNITION AND THE AKAKA BILL A SCAM ON HAWAIIANS ?

The Honolulu Advertiser - Letters to the Editor
Friday, November 19, 2004

I am saddened and disappointed by the phony parade of politicians, historians and lawyers, followed by our colonized Hawaiians, all tooting their "American values" in support of the Akaka bill and the
determination that this is a window of opportunity for `Native Hawaiians to achieve self-determination and self-governance.

There are many people in the general public who do not have the slightest clue of the scandal behind this scheme. But the truth behind the Akaka bill is that it is simply a cover-up and confirmation of the flimsy and heinous intent to undermine the Native Hawaiians in their quest for self-determination that began in the early 1970s.

Creating the state agency Office of Hawaiian Affairs in 1978 was the Trojan donkey of carrying out this vile scheme. But after more than 25 years, along comes Rice v. Cayetano, and the scam is out of the bag. Thus the scramble by our longtime politicians and colonized Hawaiians to get out of their self-created kaumaha [burden.]

For the last 25 years, Ka Lahui Hawai'i, a Native Hawaiian initiative, has been talking the talk and walking the walk only to be chastised, ignored and denied. We are the only indigenous people in all of the 50 states of America to be treated this way.

SHOULD HAWAIIAN NATION LAWS BE OBSERVED?

Letters to the Editor -Honolulu Star-Bulletin
Friday, November 12, 2004

This is in response to an attorney for a non-Hawaiian student arguing that Kamehameha Schools' Hawaiian heritage policy is a racial exclusion that violates federal law (Star-Bulletin, Nov. 5).

This attorney might have been watching Fox News, which reported that the Hawaiian Islands were given to the United States. What was missing was the explanation that it was given in the same way that a wallet is given during a mugging.

The United States overthrew the Kingdom of Hawai'i and has made subsequent verbal apologies but little else and has not been held accountable.

If you are a fair-minded person that believes in justice is not only for the rich and powerful, then you will agree that federal law prevails except where an aggressor nation overthrows a peaceful nation that was not a threat and when the aggressor nation admits this act was wrong, then the laws of the peaceful nation supercede or trump the laws of the aggressor nation.

So whenever Hawaiian issues surface the choice is simple. Allow Kamehameha Schools to continue the policies that were put in motion before Hawai'i was overthrown or give the islands back to the Hawaiians.

IS THIS YOUR FIRST VISIT TO FREEHAWAII.INFO ?

Free Hawai'i means returning the Hawaiian Islands back to an independent, sovereign nation status, like it was before it was illegally overthrown by US marines and rich sugar barons in 1893.

In 1993, President Clinton formally apologized for that act and publicly acknowledged the illegality of the overthrow.

DID YOU KNOW ? -

98% of all Hawaiians living at the time opposed the illegal overthrow!

Today, less than 20% of all land in Hawai'i is in Hawaiian hands.

Over 60% is in non-Hawaiian hands.

A few individuals, who are non-Hawaiian, lease an amount of land in Hawai'i that is greater than all land leased to all Native Hawaiians!

Currently, only 72 landowners control 95% of all land in Hawai'i.

Native Hawaiians make up the largest percentage of homeless in Hawai'i today.

Native Hawaiians have the worst social, educational and economic indicators of any ethnic group in the US.

Native Hawaiians currently have the worst health profile of any ethnic group in the US.

Descendants of the Hawaiian Nation want their country and land back so they can grow their own foods, become healthy once again, and control their own destiny.

"Don't condemn our lands, condemn the wrongs that have been done to us!"

WHAT ARE THE FOUR ELEMENTS OF SOVEREIGNTY AND SELF-DETERMINATION ?

1. A land base - the Hawaiian islands.

2. A distinct population - all peoples possessing the inherent right to the Hawaiian kingdom.

3. A Government - the government that was unlawfully overthrown.

4. Sovereignty itself and the right to exercise it. A place in the Family of Nations.

HAWAIIAN KINGDOM HAS MANY ADVANTAGES

Honolulu Star-Bulletin - Letters to the Editor
Wednesday, November 17, 2004

With the majority of people having concentrated on the presidential race, I think they forgot about local politics. I strongly feel we are on the brink of being "paradise lost." Things like housing costs have shot through the roof and the future for the youth seems really grim.

I strongly feel the Hawaiian Kingdom should be instituted soon so we can save what paradise we have left. Such a government also would not entail exorbitant taxes and high property costs. We could become self-sufficient as far as food goes with a big emphasis on agriculture.

And we definitely need to bring the Hawaiian culture to the forefront, which would boost tourism immensely. Take for example the Merrie Monarch Festival, which gives the Big Island a huge economic boost. Imagine hula being an everyday thing and tourists flocking to the Hawaiian islands.

Let's rise up in unity and have a better way of life for everybody and not just the rich.

HOW DOES HAWAI'I TREAT HAWAIIANS ?

HONOLULU -- Despite a strong state economy, the homeless rate in Hawaii has nearly doubled over the past four years, and the majority of the new homeless are native Hawaiians and those with some Hawaiian ancestry.

From fabled Waikiki Beach, one of the places where the homeless congregate on Oahu, to the neighboring islands that conjure the image of paradise to planeloads of tourists who arrive daily, there is increasing tension between the thousands of homeless people, their advocates, and state, city, and county governments.

Hawaiians represent only about 18 percent of the state's population, but the state survey suggested they make up 37 percent of the state's homeless population.

WHO REALLY OWNS THE LAND TODAY IN HAWAI'I ?

Land Titles Issued Today Are Very Much In Doubt -

"Clear Title," regarding legitimate legal ownership of land in Hawai'i is a topic quickly becoming an issue in the political and commercial areas.

With more lands being "quiet titled" in the courts by unscrupulous characters with the aid of foreign laws (USA and state of Hawai'i) illegally imposed against the rightful/legal owners of these lands and a judicial system aiding and abetting in these crimes; its no wonder developers want to build 1,100 new luxury homes in Makena and elsewhere.

Land titles in Hawai'i continue to carry the original "royal patent" from the mahele. (Land divisions in the mid-1800's)

If the U.S. Government or state of Hawai'i and their citizens rightfully have "clear title" to these lands, then why has the U.S. patent not replaced the royal patent as it was done in 49 other states?

Answer: Each royal patent has been "adjudicated," making them all a legal decree. When purchasing land, a "warranty deed" is issued, not a clear title per se.

Shouldn't a clear title be guaranteed?

Unless, of course, there is no clear title to the land.

DID YOU KNOW...?

The Honolulu Advertiser - Letters to the Editor
Thursday, November 11, 2004

One of the key points most often overlooked is the fact that Bernice Pauahi's people were Hawaiians and not Americans.

With the issue of the unlawful belligerent occupation by the United States of Hawai'i, this is still a major point of contention, and the United States is
governed by the laws of occupation.

The people's plebiscite was held in 1897, called the Ku'e Protest Petitions, and they rebuked the U.S. invasion and were against annexation.

The United States could not take the Islands through treaty and decided to do it through its own internal resolution against the people's wishes.

The United States continued to violate international law by passing the illegitimate Statehood Organic Act, voted on by Americans and not by Hawai'i subjects.

There was no international body to oversee the elections, and the choice avoided independence for our lawful nation.

These are facts most U.S. citizens are not aware of. We want the
United States to get out of our country.

HOW DID HAWAI'I BECOME A STATE ?

HERE'S WHAT A NEWSPAPER IN RACINE WISCONSIN HAD TO SAY...

The Journal Times, Racine, WI - November 11, 2004

...The United States acquired Hawaii through force.

Queen Lili'uokalani, Hawaii's last Queen, was deposed on Jan. 17, 1893, by a group of American businessmen supported by the United States Navy and Marine Corps and diplomatic representatives.

Sovereignty of Hawaii transferred to the U.S. on Aug. 12, 1898 during ceremonies at Iolani Palace in Honolulu, on the island of Oahu.

Hawaii became a U.S. territory in 1900.

On Nov. 23, 1993, The United States apologized for illegally overthrowing the Kingdom of Hawaii, and recognized the inherent sovereignty and right of self-determination of native islanders.

Needless to say, a lot of shady events took place between Jan. 17,1893 and Aug. 21, 1959.

Hawaiian sovereignty is still a hot issue in the islands to this day and likely will be for as long as the United States flag flies over Hawaii.

IS THE STATE OF HAWAI'I FACT OR FICTION ?

HERE'S WHAT A PROMINENT RETIRED ATTORNEY HAS TO SAY -

At a meeting in Kona, a retired O'ahu lawyer, gave his insights to questions regarding legitimacy of the State of Hawai'i and the quest for Hawaiian independence.

Two most interesting statements he made were:

1."The State of Hawai'i is a fiction.”He repeated this several times. A good analogy. For instance, books are nonfiction or fiction; one true, the other made up.

2."If you are a Hawaiian National and vote in the State of Hawai'i or federal elections, you destroy what you are trying to accomplish. You acquiesce to their jurisdiction and become a U.S. citizen. You cannot be both at the same time.”

History shows that Hawaiians successfully eluded all the plots, machinations and terrorism of the occupying nation for 111 years by objecting as one voice to annexation in the beginning with the amazing Monster Petition of 1897, and then simply by not voting in the occupying nation's elections.

The do-nothing strategy has held the status quo for Native Hawaiians despite the enormous odds against preservation of their inherent sovereignty for 111 years.

The last Office of Hawaiian Affairs referendum ploy in the 90's netted a whooping 9% vote and then they tried desperately to pad the numbers by counting the non responses as “yes“ which made OHA look ridiculous.

Viewed from this perspective, the recent newspaper articles deploring Hawaii's "voter apathy”are very good news indeed. They report only 44% of eligible Hawaiians vote against a national average of 60% voter turnout.

These figures seem to agree with the estimated figures of a 20% Native Hawaiian population in Hawai'i.

"History shows clearly that the Hawaiian Nation was not annexed - it was stolen!"

WELCOME IF YOU'RE VISITING FREEHAWAII.INFO FOR THE FIRST TIME!

Did you know -

98% of all Hawaiians living at the time opposed the illegal overthrow!

Today, less than 20% of all land in Hawai'i is in Hawaiian hands.

Over 60% is in non-Hawaiian hands.

A few individuals, who are non-Hawaiian, lease an amount of land in Hawai'i that is greater than all land leased to all Native Hawaiians!

Currently, only 72 landowners control 95% of all land in Hawai'i.

Native Hawaiians make up the largest percentage of homeless in Hawai'i today.

Native Hawaiians have the worst social, educational and economic indicators of any ethnic group in the US.Native Hawaiians currently have the worst health profile of any ethnic group in the US.

Descendants of the Hawaiian Nation want their country and land back so they can grow their own foods, become healthy once again, and control their own destiny.

FREEHAWAII.INFO PRESENTS THE FINAL SEGMENT OF A SPECIAL SERIES IN THREE PARTS -
THE UNITED STATES OCCUPATION OF THE HAWAIIAN KINGDOM

Here's Part Three Of What Actually Happened That's Still In Place To This Day

An independent neutral nation, the Hawaiian Kingdom, was invaded and overthrown by a foreign state, the United States of America.

The United States then committed fraud against the Hawaiian People. They said they annexed the Hawaiian Islands with the Newlands Resolution. That was impossible because only treaties of annexation between the de jure governments of two states can agree to an annexation.

It was a fraud upon the Hawaiian People because neither the people nor the sovereign Hawaiian government agreed to any so-called annexation. Neither under international law nor under United States law do thieves obtain lawful title to their ill-gotten gains.

Nevertheless, the US took control of the Hawaiian Islands and declared Hawaiian nationals were now US citizens.

Hawaiian nationals never consented to their nation of Hawai’i being ceded to the United States, to the loss of their Hawaiian nationality, nor to becoming US citizens.

The US government subsequently imposed US laws upon all Hawaiians. Thus, Hawaiians right to self-determination was, and is to this very day, being violated by the United States by their unlawful occupation of the Hawaiian Kingdom.

FREEHAWAII.INFO PRESENTS THE SECOND PART OF A SPECIAL SERIES IN THREE PARTS -

THE UNITED STATES OCCUPATION OF THE HAWAIIAN KINGDOM

Here's Part Two Of What Actually Happened That's Still In Place To This Day

Until January 16, 1893, the United States recognized the Nation of Hawai'i as a sovereign and independent nation equal to other recognized nations in the world.

Hawai'i had many treaties with many nations, including the United States. Under international law, treaties in existence between the Nation of Hawai'i and the United States of America were binding on each other on January 16, 1893.

On January 16, 1893, in violation of the treaty of Friendship. Commerce, Navigation and Extradition of 1850, between the Nation of Hawai'i and the United States of America, the United States committed acts of aggression by landing troops on Hawaiian soil.

On January 17, 1893, the Committee of Safety, protected by the armed forces of the United States, read their proclamation and took over the de jure government of the Hawaiian Islands.

The United States established occupational governments in Hawai'i. First, they were called the "Committee of Safety," and later the "Provisional Government," and finally the "Republic of Hawai'i."

They were made up of the very same traitors. They were despotic governments, not governments of the people. They remained in power only by the presence and threat of the United States military. They were not de facto governments, only occupational governments.

The United States still has an occupational government over the Hawaiian Kingdom. It is called the "State of Hawai'i."

All treaties between the Nation of Hawai'i and the United States of America including the treaty of Friendship, Commerce, Navigation and Extradition of 1850 have never been lawfully terminated.

The Organic Act of April 30, 1900, ch.339, 31 Stat 141, presumptively extending US citizenship to Hawaiian citizens and descendants of them, as well as asserting jurisdiction of the United States over the Hawaiian Kingdom, is based on the fraudulent joint resolution of annexation known as the Newlands Resolution which had, and still has, no force of law outside the boundaries of the United States, nor even inside, since it contravenes even United States law according to the US constitution.

FREEHAWAII.INFO PRESENTS A SPECIAL SERIES IN THREE PARTS -

THE UNITED STATES OCCUPATION OF THE HAWAIIAN KINGDOM

Here's What Actually Happened That Is Still In Place To This Day -

The United States of America has unlawfully occupied the Hawaiian Kingdom, a neutral nation, for over 111 years.

In January 1893, John L. Stevens, the United Sates ambassador to Hawai'i, Captain Wilkes of the USS Boston, and other government leaders conspired with 13 civilian businessmen to seize control of the Hawaiian Islands.

On the morning of January 16, 1893, the 13 businessmen tried to back out. They would be committing treasonous acts and under Hawaiian law they would be facing the death penalty. John Stevens promised them the protection of the United Sates and said it was too late to back out; they had to go through with it.

He then proceeded to have 164 marines, armed with rifles and canon, disembark from the USS Boston. They camped and set up their canon to direct fire against Queen Lili'uokalani's Palace. The next day, January 17, 1893, the 13 businessmen, known as the Committee of Safety, read their proclamation from the steps of the government building.
